A Public Hearing was held at the Town Hall, 15 Terrace Road, Cortland, New York, at 7:45 o'clock p.m., concerning Local Law No. 5 for the year 1987 , to amend Local Law No. 1 of 1986, Town of Cortlandville Zoning Law. Supervisor Pierce opened the Public Hearing at 7:30 o'clock p.m. The Town Clerk read aloud the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE LOCAL LAW NO. 5 FOR YEAR 1987 Notice is hereby given that a Public Hearing will be held pursuant to the Municipal Home Rule Law and Town Law Section 264 before the Supervisor and the Town Board of the Town of Cortlandville, Cortland County, New York at the Town Hall, 15 Terrace Road; Town of Cort- landville, New York on May 6, 1987 at 7:35 o'clock p.m. concerning proposed Local Law No. S for the year 1987, providing for the amend- ment of.Local Law No. 1 for 1986 (Cortlandville Zoning Law) which amendment would create an "Aquifer District" and require Special Permits from the Town Board for certain development and for use or storage of certain amounts of toxic or hazardous chemicals within the district such as is delineated on an Aquifer District Map. Graham from Mayor Francis Economic J. Quinlan. All voting aye, the motion was carried. Development The letter was regarding the City of Cortland's Zone preapplication for Economic Development Zone designation. The reports of the various departments are on the table for review and are available in the Town Clerk's office on request. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to receive and file a Certificate of Returns of Births and Deaths from NYS Health Department for 1986. All voting aye, the motion was carried. RESOLUTION # 92 - AUTHORIZE MCGRAW CENTRAL SCHOOL TO USE VOTING MACHINE - MAY 27, 1967 Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS , a request was received from McGraw Central School District asking permission to use Cortlandville's voting machine for the school budget vote scheduled on May 27, 1987, and WHEREAS, a precedent has been set that they may use the voting machine for such purposes, therefore BE IT RESOLVED, that the McGraw Central School District is hereby authorized to use the voting machine in McGraw for the school budget vote, scheduled for May 27, 1987 RESOLUTION # 93 - APPROVE RONALD CLEVELAND - WATER AND SEWER CONNECTIONS Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by Ronald Cleveland for plumber recognition and was reviewed by the Board, therefore BE IT RESOLVED, that the application submitted for .Ronald Cleveland, of 42 Evergreen St., Cortland, N.Y. is hereby approved for both water and sewer connections, and be it further RESOLVED, that his name shall be added to the approved plumber list of the Town of Cortlandville. McGraw School use voting machine approve Ronald Clevela plumber approval (3-8 approve bids for sewer meter Table Aquifer Law Local Laws State Wednesday, May 6, 1987 Page 4 RESOLUTION # 94 - AUTHORIZATION TO ADVERTIZE FOR BIDS - NEW SCM SEWAGE METERING FACILITY Motion by Councilman Manning Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, the sewer flow meter located near SCM does not work properly, and WHEREAS, the fees collected will offset the cost of replacing the meter, therefore BE IT RESOLVED, that the Town Engineer is hereby authorized to advertise by legal notice, letting of the bids for a new sewage metering facility for the Sewer Department. RESOLUTION # 95 - TABLE LOCAL LAW NO. 5 - ESTABLISHING AN AQUIFER DISTRICT Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that action on Local Law No. 5 - Establishing an aquifer District is hereby tabled. RESOLUTION # 96 - ACKNOWLEDGE RECEIPTS FROM STATE LOCAL LAWS NO. 1 AND NO. 2 OF 1987 Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, notice was received from New York Department of State on April 9, 1987 regarding Local Law No. 1 and Local Law No. 2 of 1987, therefore BE IT RESOLVED, that Local Law No. 1 of 1987, Zoning Change on Lorings Crossings (Neal Stearns) and Local Law No. 2 of 1987, Zoning Change on Lorings Crossings (Roger Beck - John Potter) is hereby in effect in accordance with Section 27 of the Municipal Home Rule Law. Motion was made by Councilman O'Donnell, seconded renew by Councilman Rocco, to receive and file a letter Natolis received by the Cortlandville Town Clerk from the liquor license Village Clerk of Homer from Joseph Natoli. The letter is to advise that Joseph Natoli, d/b/a Natoli Route 11 Market, intends to apply to the New York State Liquor Authority for renewal of his off - premise beer and wine cooler license. 1 1 69 Wednesday, May 6, 1987 Page 5 RESOLUTION # 97 - AUTHORIZE HIRING ROSEMARY DEMEREE DEPUTY TOWN CLERK Motion was made by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Clerk is hereby authorized to hire Rosemary Diane Demeree, 1643 Lighthouse Hill Rd., Homer, New York, as Deputy Town Clerk, effective May 11, 1987 at an annual salary of $10,200.00, to be paid from A1410.1. RESOLUTION # 98 - AUTHORIZE HIRING'CAROLE STEHM - DEPUTY TOWN CLERK - PART TIME Motion was made by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, Carole Stem has worked in the Town Clerks office part-time since January 1981, predominantly during tax time, and WHEREAS, the work load in the Town Clerk's office has increased significantly, therefore BE IT RESOLVED, that the Town Clerk is authorized to hire Carole Stehm, 799 Gwen Lane, Cortland,.New York, as Deputy Town Clerk, part-time at a salary of $4.22 per hour, to be paid from A1410.1, not to exceed 20 hours per week. RESOLUTION # 99 - UPDATE SPECIFICATIONS FOR TOWN ROADS AND STREET CONSTRUCTION MOTION BY COUNCILMAN THORPE SECONDED BY COUNCILMAN O'DONNELL VOTES: ALL AYE ADOPTED WHEREAS, the Specifications'for Town Roads and Street Construction in the Town of Cortlandville has not been updated since the adoption of it in 1968, and WHEREAS, new specifications have been written and reviewed, therefore, BE IT RESOLVED, that the Specifications for Town Roads and Street Construction is hereby updated and revised. 1 Hiring Diane Demeree Deputy TnClerk Carole S tehm part-time approve update Totrn Road Specifications Wednesday May 6, 1987 Page 6 Mrs. Jamie Dangler asked what the Town Board will Aquifer do now in regards to the Aquifer District Law. District Law Supervisor Pierce stated that the Town Board will review all input received tonight as a result of the Public Hearing and go from there. He wants to appoint a committee of five or six people to work on this. The Town Board asked Mrs. Dangler to be a member of a committee and submit to Mr. Pierce a few names from the Clean Water Committee to participate. She agreed to this. It was the consensus of the Town Board that the committee shall remain in small numbers to accomplish the task. Compliments were heard from those in attendance for the proper and orderly fashion in which the Public Hearing was conducted. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the regular meeting and recess to executive session to discuss pending litigation. All voting aye, the motion was carried. The following was received from the Supervisor's office: Councilman Thorpe made a motion seconded by Councilman Rocco, to adjourn the executive session and reconvene the regular meeting. All voting aye, the motion was carried. No action was taken. Councilman Manning made a motion, seconded by Councilman O'Donnell, to adjourn the meeting. All voting aye, the motion was carried. REGULAR MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, N.Y., with Supervisor Pierce presiding. Members present: Supervisor, Melvin Pierce Councilman, Raymond Thorpe Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, Warren Manning Town Clerk, Pauline Parker Others present were Newsreporter, Kevin Conlon; Highway SLlp't, Carl BLIsh; and area residents, John Murdock and Jamie Dangler. The meeting was called to order by Supervisor Pierce at 5:00 P.M. He requested that all those in attendance rise and pledge allegiance to the flag. Supervisor Pierce offered those in attendance the priviledge of the floor. Eileen Malay, Chief Court Clerk, requested an Executive Session with the Town Board to discuss their refusal of her six month probationery pay increase. A discussion was held of which the Town Board advised Ms. Malay that an Executive Session was not necessary because her Department Head, Justice Kelsen had been advised that a residency requirement must be met when she was hired. This did not happen. The Town Board consensus was that employees should not submit this type of request to them. It is the responsibility of the Department Head to see that all rules and regulations are followed. It is also their responsibility to advise their employees of decisions made, and take care of it. Councilman Manning made a motion, seconded by Councilman Rocco, that the request be tabled. All voting aye, the motion was carried. Mr. John Murdock, Fuller Road, Cortland, N.Y., advised the Town Board that the Cortlandville Planning Board recently approved his request for a subdivision off Lyncourt Dr. He will be building a new road in this area and wanted to know the requirements for the Town accepting the road upon completion. Supervisor Pierce advised him that it would be necessary for him to build the road according to the Specifications for Town Roads. Upon completion and approval by the Town Highway Superintendent, the road would then be dedicated to the Town. He can obtain the necessary requirements from the Highway Sup't. ROSATO OF VERNON DRIVE Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, in the past the Cortlandville Firemen have filled swimming pools upon request but are no longer doing this, and WHEREAS, Joseph T. Rosato plans to fill his pool with a hose; and he is now hooked into Cortland City water and sewer, therefore BE IT RESOLVED, that Joseph T. Rosato shall be responsible for paying the water fee for filling his swimming pool but will be forgiven the sewer charge for 20,000 gallons of water. Councilman Rocco reported that as a result of the committee meetings held recently concerning the highway lighting update, he will be submitting a proposal at the next Town Board meeting. RESOLUTION # lal - AUTHORIZE PAYMENT OF VOUCHERS - MAY Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #233 - 275 $14,597.96 Highway Fund #127 - 137 9,065.32 Water Fund # 62 - 71 23,052.15 Sewer Fund # 28 - 35 7,243.07 There being no further business, Councilman Thorpe made a motion, seconded by councilman O'Donnell, to adjourn the meeting.
