HIGHLAND ROAD WATER IMPROVEMENT PROJECT A Public Hearing was held at the Town Hall, 15 Terrace Road, Cortland, New York, at 5:00 p.m. concerning the High- land Road Water Improvement Project. i1 Members present: Supervisor, Melvin Pierce Councilman Raymond Thorpe Councilman Ronal Rocco Town Clerk, Pauline Parker absent: Councilman Warren Manning Councilman Edwin O'Donnell Others present were Attorney, Philip Rumsey; News - reporter, Kevin Conlon; and town residents: James Swinehart, Robert Moore, Steve and Jamie Dangler, Douglas Hatch and Mr. Norton. Supervisor Pierce opened the Public Hearing. Regular Meeting The Regular Meeting of the Town Board of the Town of Cortlandvil-le, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor, Melvin Pierce Councilman, Raymond Thorpe Councilman, Ronal Rocco Town Clerk, Pauline Parker absent: Councilman, Warren Manning Councilman, Edwin O'Donnel Others present were, Attorney, Philip Rumsey; Newsreporter, Kevin Conlon; and town residents: Mr. James Swinehartd Robert Moore, Steve and Jamie Dangler-, Douglas Hatch and Mr. Norton. The meeting was called to order by Supervisor Pierce immediately following the Public Hearing on the Highland Road Water Improvement Project. RESOLUTION # 84 - AUTHORIZE PAYMENT OF VOUCHERS - APRIL Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #167 - 189 a 11,992.61 Highway 87 - 107 6,696.46 Water Fund 39 - 47 937.02 Sewer Fund 21 - 23 19,072.62 A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to receive and file a copy of the letter to the Chairman of the Cortlandville Planning Board from the Cortland County Superintendent of Highways. All voted aye, the motion was carried. The letter stated that the Cortland County Legislature has refused to authorize the County Highway Department's application for a gravel pit on the Gunzenhauser property west of Smith -Corona. The permit application was withdrawn. A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to receive and file the letter from Cortland Mayor, Francis J. Quinlan to Supervisor Melvin Pierce. All voted aye, the motion was carried. Thomas, a Water Department employee for the Town of Cortlandville. The course was a Water Operator Certification Course. RESOLUTION # 85 - APPROVE RONALD J. SHAW - WATER AND SEWER CONNECTIONS Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED Ronald Shaw WHEREAS, an application was submitted by Ronald J. Shaw plumber for plumber recognition and was reviewed by the Board, approval therefore BE IT RESOLVED, that the application submitted for Ronald J. Shaw, of R.D.3 Wetmore Rd., Tully, N.Y. is hereby approved for both water and sewer connections, and be it further RESOLVED,that his name shall be added to the approved plumber list of the Town of Cortlandville. RESOLUTION # 86 - ACCEPT RESIGNATION OF BETH O'GORMAN, DEPUTY TOWN CLERK - TOWN OF CORTLANDVILLE Motion was made by Councilman Thorpe resignation Seconded by Councilman Rocco Beth 0' Gorman VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the resignation of Beth O'Gorman from the office of Cortlandville Deputy Town Clerk is hereby accepted with regret, and shall be effective April 15, 1987. RESOLUTION #87 - AUTHORIZATION TO TRANSFER MONIES - PURCHASE OF TYPEWRITER Motion was made by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED transfer of WHEREAS, the secretary of the Zoning Board of Appeals monies and the Planning Board, Millie Brookins, is in dire ZBA&Ping Bd. need of a new typewriter, therefore BE IT RESOLVED, that the Budget Officer is hereby authorized and directed to transfer $200.00 from Zoning Board of Appeals contractual (B8030.4) and $50.00 from Planning Board contractual (38020.4) to Planning Board Equipment (B8020.2) for purchase of a typewriter. RESOLUTION # 88 - APPROVE " HIGHLAND ROAD AREA WATER IMPROVEMENT" - WATER PROJECT Approve Motion was made by Councilman Thorpe Highland Road Seconded by Councilman Rocco Water Project VOTES: ALL AYE ADOPTED 1 [7 LJ Wednesday, April 15, 1987 Page 3 WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for the residential area from Fairview Drive northerly along Highland Road to adjacent residential areas of the Town of Cortlandville, as required by Section 209-q (2) and 209-c of the Town Law, and WHEREAS, an Order was duly adopted by the Town Board on April 1, 1987 reciting the filing of said general plans, the improvements proposed, and the estimated expense thereof and specifying April 15, 1987 at 5:00 o'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the said Board would meet to consider the documents filed as aforesaid and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, such Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the Board on the 15th day of April, 1987 commencing at 5:00 p.m. at the Town Hall in the said town and discussion upon the matter having been had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Raymond Thorpe, Councilman, seconded by, Ronal Councilman, and unanimously passed, it is RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of Cortlandville are in compliance with Section 209-C of the Town Law of the State of New York and are otherwise sufficient, and that to establish the aforesaid water improvement is in the public interest, and it is further RESOLVED AND DETERMINED, that the establishment of a water improvement as proposed in said plans be authorized pursuant to Section 209-q (6) (c) of the Town Law; that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made avaliable or provided for; and that such improvement shall be designated and known as the "Highland Road Area Water Improvement", and it is further RESOLVED, that the proposed improvement, including costs or rights of way, construction costs, legal fees, 1 engineering and consultant fees, and all other expenses approximate to be a maximum of $250,000.00 shall be financed as follows: 100% of the cost thereof will be financed from a grant from the State of New York, and it is further RESOLVED, that the Town Clerk of this Town shall within ten (10) days after the adoption of this Resolution file a certified copy thereof in the Office of the Cortland County Clerk as provided for by the Town Law, Section 209-q (6) (c), and it is further RESOLVED, that this Resolution is effective immediately. All voting aye, the motion was carried. The following information was received from the Supervisor's office. A motion was made by Councilman Rocco, seconded by Councilman Thorpe, to adjourn the Executive Session and reconvene to the Regular Meeting. All voting aye, the motion was carried. RESOLUTION # 89 - AUTHORIZE ADJUSTING STARTING SALARIES OF PERSONNEL POLICY Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the starting salary schedule of the personnel policy shall be adjusted. A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to adjourn the regular meeting. All voting aye, the motion was carried. The meeting was adjourned at 6:22 P.M.
