REGULAR MEETING The Regular Meeting of the Town Board of the Town of Cortlandville, was held -at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'DonnelI Town Clerk, Pauline Parker absent: Councilman Warren Manning Councilman Ronal Rocco Others present were Deputy Town Clerk, Beth O'Gorman; Highway Superintendent, Carl Bush; Assessor, David Briggs; Cortland County Legislator, Delmar Palm; New Reporters, Kevin Conlin of the Cortland Standard, and Lachlan Carmichael of the Syracuse Post Standard; town residents Robert Moore and Steven and Jamie Dangler. The meeting was called to order by Supervisor Pierce at 5:00 o'clock p.m. He requested that all those in attendance rise and pledge allegiance to the fIag. A motion was made by Councilman Thorpe, seconded by Rec. & File Councilmen O'DonneIl, to receive and file the P. Bd. Min. CortlandviIle Planning Board minutes of February 24, Feb.24, 1987 -' 1987. All voting aye, the motion was carried. Supervisor Pierce offered the privilege of the floor to those in attendance. No comments or questions were made. A motion was made by Councilman O'Donnell, seconded Rec. &FiIe by Councilman Thorpe, to receive and file the letter Invitation from Anita W. 3ebbett. All voting aye, the motion was H ^ CaIaIe carried. retirement The letter extended an invitation to attend a reception and dinner in honor of Harry A. CalaIe who is retiring after twenty years of service as the Mayor of the Village of Homer. The reception will be held Saturday, March 2B, 1987 at the Corey Union Building on the S.U.N.Y. Cortland campus. Supervisor Pierce advised those present that the Update on Town has received a check for state assistance with the Highland Rd. Highland Road Water Project. This check in the amount water project of $237,500.00 will, be eutremely helpful in the funding of this project. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to receive and file the letter from Assemblyman Clarence Rappleyea. All voting aye, the motion was carried. The letter was in reference to the speed reduction request submitted to the New York State Department of Transportation for Lime Hollow and Sears Road. EncIosed was a copy of S-1260, a proposed bill which would allow the Town Board to determine the speed limits on town roads. Rec. & File C. Teiehman by Councilman Thorpe, to receive and file a copy of the Groton Ave„ letter from Richard A. Teichman, Jr., Executive Vice North Plaza President of the Cortland County Economic Development Committee. All voting aye, the motion was carried. The letter was written in reference to development plans for the shopping plaza on the north side of Groton Avenue. Supervisor Pierce advised those present that investors, interested in this site, met with him and Zoning and Code Enforcement Officer, Bruce Weber, to discuss future use of the building. The area. is currently zoned commercial. Rec. & File letter A motion was made by Councilman O'Donnell., seconded C. Rappleyea by Councilman Thorpe, to receive and file the letter Gen. Purpose Aid from Assemblyman Clarence D. Rappleyea, to Supervisor Pierce. All voting aye, the motion was carried. The letter provided follow-up information on state General Purpose Local Aid and the effects of a proposal to revise the formula used for distribution of funds to cities, towns, village, and counties. Under this proposal, the share of total General Purpose Aid to towns would increase from 17% to 21%. Abandonment of RESOLUTION #70 AUTHORIZE ABANDONMENT OF TOWN LINE Town Line Road. ROAD - CORTLAND COUNTY LANDFILL AREA Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a request was received from the Cortland County Department of Solid Waste Committee that the town consider abandonment of the Town Line Road from the existing landfill entrance south to the Heath Road to better control the access to the proposed "Long -Term Landfill", therefore BE IT RESOLVED, that the highway in said Town of Cortlandville, known and described as Town Line Road has not been traveled or used as a highway for six or more years prior to the date of this certificate and said highway is hereby declared abandoned pursuant to Section 205 of the Highway Law as a highway and a public right of way described and follows: BEGINNING at a point 0.37 miles from the point of beginning of named road which is at its intersection with Heath Road in the Town of Solon and going a distance of 0.31 miles, which all the portion of named road that is in the Town of Cortlandville. Committee & CORTLANDV I LLE RECREATION COMMITTEE Youth Bureau AND THE CORTL_AND COUNTY YOUTH BUREAU Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, on February 4, 1487, the Cortlandville Town Board, accepted with sincere regret, the resignation of Kenneth J. Andrews from the Cortlandville Recreation Committee and the Cortland County Youth Bureau, and 1 I!, WednesdaV, March 18, 1987 Page 3 WHEREAS, Supervisor Pierce, in conversations with Mr. Andrews, has discussed the recommendation of John Pilato for this vacancy, and WHEREAS, John PiIato has many years experience as a high school athletics coach and has assisted Mr. Andrews with management of the park programs and recreation ~~=�' activities at the CortlandvilIe Recreation Park for several seasons, therefore BE IT RESOLVED, that John PiIato is hereby appointed as a representative of the Town of CortIandviIle, to the Cortland County Youth Bureau, to fill the unexpired term of Ken Andrews, term of office to expire December 31, l9B8, and RESOLVED, that John Pilato is hereby appointed as the chairman of the Cortlandville Recreation Committee to fill the unexpired term of Ken Andrews, term of office to expire December 31, 1987. RESOLUTION #72 AUTHORIZATION TO HIRE ROGER KARN BireR^ Karu M.E.Q. - HIGHWAY DEPARTMENT Hwy. M.E.O. Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Highway Superintendent, Carl Bush, is hereby authorized and directed to hire Roger Karn, of 3019 Clute Road, Cortland, as Motor Equipment Operator, at a starting Salary of $6.40 per hour' RESOLUTION #73 APPOINT LOUIS CLOSSON TO THE Appoint Louis BOARD OF ASSESSMENT REVIEW FOR Closson to THE TOWN OF CORTLANDVILLE Bd. Assessment Review Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, due to a recent change of residence, Dexter Paddock, is no longer eligible to serve on the Assessment Review Board, and WHEREAS, Assessor David Briggs has given substantial consideration to the appointment of an individual to fill this vacancy, and has recommended Louis Closson, of 3099 West River Road, in the Blodgett Mills area of the Town of CortlandviIle, a qualified individual based on his background as an assessor in Chenango County, therefore BE IT RESOLVED, that Louis Closson is hereby appointed to the Town of Cortlandville Assessment Review Board to fill the unexpired term of Dexter Paddock, term of office to expire September 30, 1988. RESOLUTION #74 DESIGNATE THE NEW YORK STATE Lead Agency DEPARTMENT OF ENVIRONMENTAL County Gravel CONSERVATION AS LEAD AGENCY - Mining Proposal CORTLAND COUNTY HIGHWAY DEPARTMENT GRAVEL MINING PROPOSAL Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Highway Department is proposing a gravel mining operation located in the Town of Cortlandville on the Gunzenhauser property located west of Smith Corona property, and WHEREAS, the County Highway Department will have to obtain permission for said mine from the Town of Cortlandville and the State Department of Environmental Conservation , and WHEREAS, the proposed mining operation is a Type I Action pursuant to S.E.Q.R, and WHEREAS, is required that pursuant to S.E.Q.R., a "Lead Agency" be designated from the involved governmental agencies including the County Highway Department, the Town of Cortlandville, and the D.E.C, and WHEREAS, pursuant to a meeting between the involved agencies, D.E.C. has agreed to be Lead Agency, NOW THEREFORE BE IT RESOLVED, that the Town of Cortlandville accepts the designation of New York State Department of Environmental Conservation as Lead Agency. APPLICATION AND RECLAMATION REPORT - COUNTY HIGHWAY GRAVEL MINING PROPOSAL Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Highway Department is proposing a gravel mining operation to be located in the Town of Cortlandville on the Gunzenhauser property, west of Smith Corona land holdings, and WHEREAS, per Resolution #74, adopted March 18, 1987, the New York State Department of Environmental Conservation was designated the lead governmental agency pursuant to the State Environmental Quality Review Act, and WHEREAS, the County Highway Department will have to obtain permission for said mine from the Town of Cortlandville and the State Department of Environmental Conservation, and WHEREAS, a Mining Permit Application and Reclamation Report, must be submitted to the New York State Department of Environmental Conservation, Bureau of Mineral Resources, with information reactive to reclamation activity on the affected land, therefore Wednesday, March 16, 1967 Page 5 BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to sign the Mining Permit Application and Reclamation Report regarding the Cortland County Highway Department mining proposal. Supervisor Pierce advised those present that his signature on this permit does not constitute approval or disapproval of the land -use objective or reclamation plan but merely indicates a knowledge of such objective and of the contents of the plan. A public hearing will scheduled and the results of environmental impact studies made public when more information is available. RESOLUTION 476 APPROVE EDWARD 3. HUNT 3R. - WATER Approve for SEWER CONNECTIOINS_ W & S Connects Edward Hunt Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by Edward J. Hunt Jr. for plumber recognition and was found to be in proper order, therefore BE IT RESOLVED, that the application submitted for Edward 3. Hunt Jr., of 724 Hoy Road' Cortland, New York, is hereby approved for both water and sewer connections, and be it further RESOLVED, that his name shall be added to the approved plumber list of the Town of Cortlandville. Supervisor Pierce provided preliminary maps of an Bo. Cortland industrial park proposed by local businessman Homer Industrial Pk. Gutchess and real estate agent James Yaman for the SouthH. Guthcheaa Cortland area. Sixty acres of land across from Smith Corona would be subdivided into nine industrial use size lots. The area is currently zoned industrial, however all developers would apply through Zoning and Code Enforcement Officer, Bruce Weber, for site plan approval. This process would also screen industry proposals for potential contamination of the aquifer. A discussion was held among those present regarding the screening process and the availability of sewer service to protect the aquifer. There being no further business, a motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to adjourn the meeting' All voting aye, the motion was carried.
