PUBLIC HEARING LOCAL LAW NO. 1 FOR THE YEAR 1987 NEAL STEARNS - ZONING CHANGE REQUEST A Public Hearing was held at the Town Hall, 15 Terrace Road, Cortland, New York, at 5:00 o'clock p.m., concerning the zoning change request of Neal Stearns. Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Town Clerk Pauline Parker Others present were Deputy Town Clerk, Beth O'Gorman; Highway Superintendent, Carl Bush; Zoning and Code Enforcement Officer, Bruce Weber; Assessor, David Briggs; Town Historian, Alice Blatchley; News Reporter, Kevin Conlin; Mrs. Ralph Maricle, Mr, and Mrs. Potter, and Ron Hall. Supervisor Pierce opened the Public Hearing at 5:00 o'clock p.m. The Town Clerk read aloud the legal notice as follows: LEGAL NOTICE Town of Cortlandville Local Law No. 1 for the Year 1987 Notice is hereby given that a Public Hearing will be held before the Super- visor and Town Board of the Town of Cortlandville, Cort- land County, New York, at the Town Hall, 15 Terrace Road, Town of Cortland- ville, New York on January 21, 1987 at 5:00 o'clock p.m. concerning proposed Local Law No. 1 for the Year 1987, providing for a zone change of the parcel of land known as Cortlandville Tax Map Parcel No. 77-00-03-08.00 (Neal R. Stearns). from 'Residential R-1" to "Business" zone designa- tion, and providing for said change to be made on the Zoning Map of the Town of Cortlandville, which map was duly adopted by Local Law No. 1 for 1he'Year 1986. At the time and place of said hearing, all parties in interest and citizens shall have an opportunity to be heard. Dated: January 9, 1987 Pauline H. All voting aye, the motion was carried. The Public Hearing adjourned at 5:05 o'clock p.m. 11 Wednesday, January 21, 1987 5:00 P.M. REGULAR MEETING The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Town Clerk Pauline Parker Others present were Deputy Town Clerk, Beth O'Gorman; Highway Superintendent, Carl Bush; Zoning and Code Enforcement Officer, Bruce Weber; Assessor, David Briggs; Town Historian, Alice Blatchley; News Reporter, Kevin Conlin; Mrs. Ralph Maricle, Mr. & Mrs. Potter, and Ron Hall. The meeting was called to order by Supervisor Pierce immediately following the Public Hearing on Local Law No. 1 for 1987, regarding Neal Stearns request for a zoning change. He requested that all those in attendance rise and pledge allegiance to the flag. Payment of RESOLUTION #31 AUTHORIZE PAYMENT OF VOUCHERS - JAN Bills - Jan. Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #1 - 30 $18,541.86 Highway Fund 1 - 16 17,854.23 Water Fund 1 - 6 2,290.37 Sewer Fund 1 - 5 8,923.51 Supervisor Pierce offered those in attendance the privilege of the floor. .A. Blatchley Alice Blatchley, Town Historian, provided copies of Historian her annual report for 1986 to the members present. As one of the years accomplishments, she presented a historical booklet titled "Cortlandville Churches" The booklet included photos and historical accounts of local church developments. "C-ville RESOLUTION #31 SET SELLING PRICE AND BENEFACTOR - Churches" CORTLANDVILLE CHURCHES BOOKLET History Book Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED 15 Wednesday, January 21, 1987 Page 2 WHEREAS, Town Historian, Alice Blatchley, has compiled an illustrated historical booklet on churches in the Town of Cortlandville as a project for 1986, and WHEREAS, the expertise, research time, and costs of printing have been taken into consideration in providing these booklets to the public, and WHEREAS, publishing costs for the booklet were included in the historians budget for 1986, therefore BE IT RESOLVED, that the Cortlandville Historical Society, is hereby authorized to sell the "Cortlandville Churches" booklet and charge the price of one dollar and twenty-five cents ($1.25) per booklet, and all proceeds shall benefit the Cortlandville Historical Society for activities as they deem appropriate. A motion was made by Councilman O'Donnell, seconded Rec. & File by Councilman Thorpe, to receive and file the historians Hist. Annual annual report for 1966. All voting aye, the motion was Report carried. Councilman Thorpe stated that on January 20, 1987, Justice Books he audited the 1986 books of the Justice department, Audit - Thorpe reviewing the years financial records and dockets. He 1 reported that all was in order. Councilman Manning stated that on January 21, 1987, T. Clerk Books he audited the books of the Town Clerk for 1986. He Audit - Manning reported that all was in order. A motion was made by Councilman Thorpe, seconded by Dog/Deer Councilman Manning, to receive and file the Legal Notice Quarantine from the Cortland County Legislature. All voting aye, the motion was carried. The legal notice relates to the dog quarantine now in effect to prevent the depredation of deer. A motion was made by Councilman Thorpe, seconded by Suit - Kote Councilman Manning, to receive and file the letter from. No 1/ discount Rod Birdsall, President of Suit-Kote Corporation. All voting aye, the motion was carried. The letter advised that a 1% discount for early payment will no longer be available to the town in payment of invoices. RESOLUTION #32 AUTHORIZE SUPERVISOR TO DRAFT LETTER Endorse Housing OF ENDORSEMENT - 1987 HOUSING Preservation PRESERVATION GRANT PROGRAM Grant Program Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Residential Resources Corp., has advised that they are processing a grant application to the Farmers Home Administration in Syracuse, to benefit rural Cortland County residents, and have requested a letter of support from the Town for the project, therefore I G Wednesday, January 21, 1987 Page 3 BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to draft a letter of endorsement to Pierre L. LaBourdette, State Director of the Farmer's Home Administration, in support of the 1987 Housing Preservation Grant Program to benefit rural Cortland County residents, and RESOLVED, that the letter from James Bennett, Executive Director, Cortland County Residential Resources Corporation, requesting Town Board support, is hereby received and filed. Rec. & File A motion was made by Councilman Thorpe, seconded by Fire Contral Councilman O'Donnell, to receive and file the agreement Agreement with Cortland County Fire Control to monitor the town fire alarm system. All voting aye, the motion was carried. This service is available to the town free of charge. Approve RESOLUTION #33 APPROVE OTTENSCHOT CONSTRUCTION CO. Ottenschot Const. FOR WATER AND SEWER CONNECTIONS W & S .Hook-ups Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by Richard J. Ottenschot, on behalf of Ottenschot Construction Co., for plumber recognition and was found to be in proper order, therefore BE IT RESOLVED, that the application submitted for Ottenschot Construction Co., of 12 Prospect Street, Homer, New York, is hereby approved for both water and sewer connections, and be it further RESOLVED, that their name shall be added to the approved plumber list of the Town of Cortlandville. Custom Trash- A motion was made by Councilman O'Donnell, seconded Fee increase by Councilman Manning, to receive and file the letter from Gregory K. Leach, owner of Custom Trash Service. All voting aye, the motion was carried. The letter advised that effective January 1, 1987, the fee for commercial trash service will increase by $5.00 to $15.00. Advertise for RESOLUTION #34 AUTHORIZATION TO ADVERTISE FOR BIDS - Bids - Hwy. NEW BUCKET LOADER -HIGHWAY DEPARTMENT Bucket Loader Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Highway Superintendent, Carl Bush, is hereby authorized to advertise by legal notice, letting of the bids for a new bucket loader, to be opened on February 11, 1987, at 3:30 o'clock p.m., and award the bid on February 18, 1987 at 5:00 o'clock p.m. 1 11 Wednesday, January 21, 1987 Page 4 RESOLUTION #35 AUTHORIZATION TO ACCEPT BIDS TO SELL THE HWY.DEPT. 1968 TROJAN 3000 LOADER Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Highway Superintendent, Carl Bush, is hereby authorized to advertise by legal notice acceptance of bids to sell a 1968 Trojan 3000 loader, bids to be opened on February 18, 1987 at 12:00 o'clock p.m., and award the bid on February 19, 1987, at 5:00 o'clock p.m. Sell Hwy. '68 Trojan 3000 Loader A motion was made by Councilman Thorpe, seconded by Rec. & File Councilman Rocco, to receive and file the Town Clerks T. Clerks Annual Report for 1986. All voting aye, the motion was Annual Report carried. There being no further business, a motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to adjourn the regular meeting.
