Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Ronal Rocco Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; Deputy Town Clerk, Beth O'Gorman; Highway Superintendent, Carl Bush; Zoning and Code Enforcement Officer, Bruce Weber; Cortland County Health Department Director, James V. Feuss; Cortland County Legislator, Delmar C. Palm; Newsreporters, Kevin Conlin representing the Cortland Standard Newspaper, and Mark Webster of WTKO; Town Residents, Carmen Pace, Pat Casey, Seymour Parker, Dick Crozier, Fred Compagni, Robert Moore, Coleen Warren, and Chris Temple. The Public Hearing was called to order b;y Supervisor Pierce at 7:30 o'clock p.m. The Town Clerk read aloud the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE NOTICE OF PUBLIC H E A R I N G O N PRELIMINARY BUDGET FOR YEAR 1987 Notice is hereby, given that the. preliminary budget of the Town. of Cort- landville, Cortland County, . New York, for the fiscal year beginning January 1, 1987 has been completed and filed in the office of the Town .Clerk of the Town located at 15 Terrace Road in said Town, where it is -available for inspection by any interested person dur- ing office hours; and Notice is hereby given that the Town Board of the Town of Cortlandville, will meet and review said preliminary budget and hold a Public Hearing thereon at the Town Hall, 15 Terrace. Road in the Town of Cortlandville, New York on the Sth day of November, 1986 at 7:30 o'clock p.m., and that at such Hearing. any person may be heard in favor of or against said preliminary budget as filed; or for or against any item or items therein contained; and Notice is hereby further given pursuant to Section 108 of the Town Law that the following are proposed yearly -salaries for each member of the Town Board of the Town of Cort- landville, the elected Town Clerk and the elected Town Superintendent of Highways. Parker, Town Clerk Town of Cortlandville 15 Terrace Road Cortland,'New York 13045 Dated: October30, 1986 256-1t Supervisor Pierce advised those present that additional copies of the preliminary budget and the fire depart- ment budget were available on the end of the table. He then offered those in attendence the privilege of the floor and requested that they identify them- selves when speaking. Dick Crozier, Tompkins Street, inquired if additional funds were budgeted for legal expenditures for 1987. Supervisor Pierce responded that the usual attorney fee was included, however, there were no other increases. A contingency fund maybe 'utilized if this appropriation is insufficient. Dick Crozier, Tompkins Street, read aloud the salaries of elected officials in surronding towns within Cortland County as printed in Cortland Standard newspaper legal notices, and comparison was made to those paid by the Town of Cortlandville. Supervisor Pierce stated that the commitment and time required in service to the town justify these salaries. 1 41 1 • C� 11 n C Wednesday, November 5, 1986 Pg. 2 P.H. Councilman Rocco commented that a clear example of this, has been the time and expertise dedicated to the residential Bound water contamination in the Pheasant Run area. Numerous improvements throughout the town have been accomplished during the past year as a result of Supervisor Pierces dedication and commitment to the town. Carmen Pace, Pheasant Run, stated that in areas where town sewer service is available, he would like to see mandatory residents required to hook-up and not exercise the option sewer to continue using private septic systems. He voiced this hook-up concern in regard to the contamination of public ground water supplies near residential areas. Mr. Pace knew of one example of the above situation on Terrace Road, and inquired if there were others in the Town. Supervisor Pierce advised Mr. Pace that residents have the option of service refusal, however they must pay a benefit tax. Communication with this property owner has not resulted in any response, further attempts will be made to assure hook-up. No other examples of this problem were stated. There being no further comments or questions from those in attendance, a motion was made by Councilman Thorpe, seconded by Councilman Manning, to adjourn the Public Hearing. REGULAR MEETING The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cort-land, New'._York, with Supervisor Pierce presiding. A motion was made by Councilman Thorpe, seconded by Minutes Councilman Manning, to approve as written the Oct._1y1986 Cortlandville Town Board minutes of October 1, 1986, and Oct. 3, 1986 October 3, 19e6. All voting aye, the motion was carried. Rec. & File A motion was made by Councilman Manning, seconded Planning Bd. by Councilman Rocco, to receive and file the Minutes Cortlandville Planning Board minutes of October 17, Oct. :17, 1986 1986. All voting aye, the motion was carried. Supervisor Pierce offered those in attendance the privilege of the floor. No comments or questions were made. M. Woodward Supervisor Pierce offered the privilege of the Atlantic floor to Michelle Woodward of Atlantic Inland. Miss Inland Woodward did not appear for her scheduled presentation to the board at this time. Rec. & File A.motion was made by Councilman Rocco, seconded by Recreation Councilman Thorpe, to receive and file the Recreation Department Department annual report as prepared by Director, Ken report Andrews. All voting aye, the motion was carried. Councilman Rocco commented that this culminates another outstanding year for the recreation department thanks to the efforts of Ken Andrews and staff. Wednesday, November 5, 1986 Page 2 A motion was made by Councilman Rocco, seconded by Rec. & File Councilman Thorpe, to receive and file the purchase Gunzenhauser option with Benny and Joe Gunzenhauser in regard to the Purchase property for the new well. All voting aye, the motion Option was carried. A motion was made by Councilman Thorpe, seconded by Rec. & File Councilman Rocco, to receive and file the temporary Easement w/ easement with Charles K. and Elizabeth Bowman, of 44 Bowmans of Lamont Circle, in regard to the Pheasant Run Water Lamont Circle Project. All voting aye, the motion was carried. Supervisor Pierce explained that Mrs. Bowman is deceased, however because her name appeared on the deed, it must also appear on the easement. A motion was made by Councilman Rocco, seconded by Councilman Thorpe, to receive and file the Water Supply Permit issued by the New York State Department of Environmental Conservation, Region 7, Division of Regulatory Affairs. All voting aye, the motion was carried. -This permit was required for extension of the Cortlandville Water District to approximately twenty homes in the Pheasant Run area. A motion was made by Councilman Manning, seconded by Councilman Thorpe, to receive and file the letter to Supervisor Pierce, from Judith A. Hayes, Developmental Disabilites Specialist with Seguin Community Services. All voting aye, the motion was carried,. The letter advised Supervisor Pierce that the list of alternate sites submitted for consideration for a developmentally disabled adults group home have been reviewed. Of the sites suggested, none were feasible alternatives to the proposed Cosmos Hill Road location. A discussion was held among.those present in regard to the proposed residence location at 4343 Cosmos Hill Road. It was the consensus of the Board that once a site has been selected and approved by the various state agencies the decision is firm, despite concerns raised by local officials, area residents, and alternate site suggestions. No -additional sites for consideration were recommended at this time, however the Board will continue,to monitor the actions taken by Seguin Community -Services in regard to this -site. . • A motion was made by Councilman Thorpe, seconded by Councilman Rocco, to receive and file the letter to Supervisor Pierce from the,New York State Affordable Housing Corporation. All voting aye, the motion was carried.. The4,letter advised that the Town of Cortlandvilles' joint application with David J. Yaman and Thomas A. Barden for financial assistance with the Allen Drive Development Project, was not approved in this funding cycle. Councilman Rocco commented that should this opportunity arise again, he would like to see more community involvement and full advantage taken of the resources available in preparation of the application. Affordable Housing - Allen Dr. Development Wednesday, November 5, 1986 Page 3 Rec. & File A motion was made by Councilman Manning, seconded Insurance Noticeby Councilman Rocco, to receive and file the notice of Hayes Ambulance insurance coverage cancellation for Richard F. Purdy, Hayes Ambulance Service, due to non-payment of premium. All voting aye, the motion was carried. It was the consensus of the Town Board, that Supervisor Pierce contact Mr. Purdy advising him.that the Board has received this notice and is concerned in regard to the ambulance service contract with the Town of Cortlandville. Rec. & File A motion was made by Councilman Thorpe, seconded by Crum & Forster Councilman Manning, to receive and file the letter to Letter - Stupke Town Clerk, Pauline Parker, from Crum & Forster Managers Litigation Corporation. All voting aye, the motion was carried. The letter was in reference to the public officials and employees liability insurance coverage in regard to the claim of Paul Stupke. Rec. & File A motion was made by Councilman Thorpe, seconded by List of unpaid Councilman Rocco, to receive and file the list of unpaid Water & Sewer water and sewer charges. All voting aye, the motion was carried. Street Supervisor Pierce advised those present that Mr. Lighting Durante, of Niagara Mohawk, is currently preparing a Commission study on street lighting in the town based on Update information available in their company files. When this study is complete, the Board will be contacted and individuals chosen for a committee. Councilman Rocco added that numerous individuals have contacted him that are interested in serving. He will provide these names to the Supervisor. Health Dept. Supervisor Pierce offered the privilege of the J. Feuss floor to James V. Feuss, Director of the Cortland County Order water Health Department. extension to Rt. 281_ College Field area Mr Feuss explained that ground water samples taken from residential wells in the Route 281, College Field Area, have indicated increasing concentrations of TCE. A conservative evaluation, based on state and federal standards for contamination of this type, indicateSthat any concentration of TCE represents a public health risk or nuisance. Under such circumstances, the County Health Board has the authority, under Article 1304 of the Public Health Law, to order the Town of Cortlandville to extend public water supply lines to this area, if service is reasonably available. The Town intends to extend service to this area, however, an order by the County Health Board, might assist the Town in legal proceedings for recovery of funds as a result of this unforeseen public emergency. It was the consensus of the Board, that although an order is not necessary in this case, involvement by the Health Department is necessary and welcome in -the exchange of information and service to the public. • 1 zo Wednesday, November 5, 1996 Page 4 RESOLUTION #207 AUTHORIZE SUPERVISOR PIERCE TO Authorize Extension - EXTEND TOWN WATER SERVICE TO THE of Water to 281 ROUTE 281 COLLEGE FIELD AREA College Field Area Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS, water samples from private wells in the residential cluster of the N.Y.S. Route 281 College field area of the Town of Cortlandville (Tax Map Numbers 96.05-01-03.000 through 96.05-01-08.000 inclusive) have revealed the presence of various organic chemicals including trichloethene, 1,1,1 - trichloroethane, and trans-1, 2-dichloroethene, and WHEREAS, the Cortland County Health Department subscribes to general guidelines that indicate the presence of said organic chemicals are at levels approaching a health threat, and WHEREAS, groundwater monitoring wells reveal that contamination by said chemicals in the Pheasant Run area of the Town is moving northeasterly in a defined pattern or plume toward said .Route 281 College field are, now therefore be it, RESOLVED, .that pursuant to General Municipal Law Section 103 (4), the Cortlandville Town Board declares that the presence of the above indicated organic chemicals in the residential cluster of the Route 281 College field area of the Town represents a�public emergency arising out of an unforeseen occurrence affecting the health, safety and property of inhabitants of the Town, requiring immediate action which can not await competitive bidding, and be it further . RESOLVED, that the Supervisor is hereby authorized to take whatever,steps he deems appropriate to extend Town water service to the residential cluster of the N.Y.S. Route 28l College field --area of the Town (Tax Map Numbers 96.05-01-03.000 through 96.05-01-08.000 inclusive). Supervisor Pierce advised those present that he meet with the residents of the College Field area on the evening of Monday, -November 3, 1986,.to.update them on the current situation. The residents were in agreement with the efforts of Supervisor Pierce to provide town water service in their area. Supervisor Pierce advised that due to the .urgency of extending water service to the N.Y.S. Route 281 College field area, the project will not be bid competitively, however two area contractors have submitted prices for the job. The Town Clerk opened and read aloud the quotations submitted. RESOLUTION #208 AWARD CONTRACT FOR 281 WATERMAIN Award contract EXTENSION - COLLEGE FIELD AREA 281 College Field Area Watermain Ext. Motion by Councilman Thorpe Seconded by Councilman Manning VOTES-. ALL AYE ADOPTED WHEREAS, water samples from private wells in the residential cluster of the N.Y.S. Route 281 College Field area of the Town have revealed the presence of various organic chemicals, and WHEREAS, the presence of said organic chemicals; has been declared a public emergency arising out of an unforeseen occurrence affecting the health, safety, and property of inhabitants of the Town, requiring immediate action which can not await competitive bidding, and WHEREAS, per Resolution #207 adopted by this Town Board on Wednesday, November 5, 1986, Supervisor Pierce was authorized to take whatever necessary steps he deemed appropriate to extend Town water service to the area, and WHEREAS, quotations were submitted for the project of extending watermains to the Route 281 College field area, and WHEREAS, these quotations were opened, read aloud, and evaluated based on material availability, project start time and cost, therefore BE IT RESOLVED, that the contract for extension of town water service to residents in the Route 291 college field cluster is hereby awarded to F.G. Compagni Construction Company Inc., of 182 Port Watson Street, Cortland, New York, in the amount of $55,500.00. Jamie Dangler Jamie Dangler, Pheasant Run, inquired if -the Town Contingency Board has considered establishing a contingency fund in Fund the event that the contamination plume should affect Cortlandville wells or other municipal wells in the area. Supervisor Pierce responded that such a fund may be established in the future, if necessary, as a result of on going discussions with the Health Department and other City of Cortland and county officials. Increased well Supervisor Pierce added that he has initiated testing weekly testing of the Cortlandville wells by Upstate Laboratories, an private firm, in addition to those conducted by the County Health Department twice a month. f� C 1 9 .7 • I 1 Wednesday, November 5, 1986 Page 6 A verbal test result is available in less time from this firm than a documented county report can be obtained. Recent tests have indicated no contamination. A discussion was held among those present as to the Frequency of frequency of water testing and the types of pollutants Water testing for which tests are conducted. Lab errors can occur when concentrations of a pollutant are very low. Mr Feuss commented -that testing for TCE has occurred approximately every two years in the past, based on state affordability. Testing for all 129 priority pollutants as determined by the federal government and 13-others added by the state, have occurred periodically. In -the past; when this large scale test has been conducted on,Cortlandville wells no hazardous contents have been detected. He added that the frequency and range of testing -by the Health Department in the future has been a, -major -consideration in the -current county budget process. Any"input by the Town to the County Legislature on this issue would be useful under the circumstances. Cortland County,Legislator; Delmar Palm, advised those present that -a resolution is currently before the County Legislature which would request the cooperation of area business and industry in reporting the use, storage, and disposal -of chemicals with hazardous potential used in their operation. It was the consensus of the Board that such disclosure should be mandatory not voluntary and enforced -for maximum usefulness in future planning. Supervisor Pierce advised those present that Thomas Caso, the district representative of the Bureau of National Affairs, Inc., has contacted him in regard to the current contamination problems offering the -services of this agency to the Town. Mr. Pierce directed Mr. Caso to the county, as the resources of the county are available to all, the surrounding municipalities. A subscription to the "Toxics Law Reporter", a weekly legal notification -on toxic tort and hazardous waste lawsuits, -and related insurance litigation, has been recommended as a reference source. 11 Mr Feuss stated that he has previewed the reporter and found it very informative. A motion was made by Councilman Manning, seconded by Councilman Thorpe, to receive and -file the information packet provided to Supervisor Pierce by Thomas Caso, District Representative of the Bureau of National Affairs, Inc. All voting aye, the motion was carried. The packet contained information on subscribing to the "Toxics Law Reporter." Cortland County Legislator, Fred Compagni, inquired if business and industry drywells in the Route 281 area were being monitored for contamination, such as degreasers, and the impact of such contamination evaluated in relation to fresh ground water supplies. Mr Feuss responded that monitoring wells are strategically located throughout the area, and none of them have indicated contamination asa result of their proximity to drywells. Cost is a major consideration in direct -monitoring of drywells, when the area -test wells do not indicate a problem. Hazardous Waste Use disclosure T. Caso Rep. Pace forced compliance hazardous waste use disclosure Wednesday, November 5, 1986 Page 7 Concerns of this type have initiated the resolution that Mr. Palm described earlier which would require information sharing on chemicals with hazardous potential used by area business and industry. Carmen Pace, Pheasant Run, questioned the accuracy of shared information, and stated that forced compliance w/ with current legislation on the use, storage, and disposal of hazardous wastes might be more effective than increased monitoring at the county level. This information is currently provided to the New York State Labor Department, Department of Environmental Conservation, and Health Board. The resolution pending in the County Legislature would request that a copy of this same report and any additional information that would be useful at the county planning level be provided to the County Legislature. Mr. Feuss added that adoption of more stringent disclosure legislation than that required by the state, would be extremely difficult at the county level. J. Dangler Jamie Dangler, Pheasant Run, inquired if the Town Litigation to had any plans at this time to pursue litigation to recoup funds recoup the funds of expanded water improvements due to used in water the contamination problem. extensions due Supervisor Pierce responded that any litigation on to contaminatioibehalf of the Town of Cortlandvi l le, will be undertaken by the Cortland County Health Department, the New York State Department of Environmental Conservation and the Attorney Generals office. The Town also has the option of pursuing litigation independent of these other agencies. Town claims Attorney Rumsey added, that Supervisor Pierce has under state z contacted the Director of the Division of Hazardous and federal Wastes, Mr. Rosenchuck, advising him that the Town has ;super funds expended funds in the Pheasant Run area as part of a clean up effort. If no wrong doer is identified or can be held responsible for the contamination and resulting cleanup improvements, this notification assures that the town has reserved its rights under the state and federal super funds for financial assistance with these expenditures. County Health Councilman Manning asked Legislator Palm if it was Dept. Budget - the intent of the Legislature to appropriate additional water testing funds for the Health Department to meet the needs of the increased water contamination problem. Legislator Palm said that the tentative budget of the health department was received and increases are anticipated due to the water contamination. S.C.M. Corp. RESOLUTION #209 S . C . M CORPORATION DONATION FOR Donation GROUNDWATER CONTAMINATION CLEANUP Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS, by letter of October 20, 19e6, Smith Corona, Inc. has delivered a check No. 00129868 on the account of SCM Corporation payable to the Town of Cortlandville in the amount of $25,000.00, and 1 1 • 1 Wednesday, November 5, 1986 Page 8 WHEREAS, said letter states that said check is a donation to the Town for use in responding to the recently detected groundwater contamination, and is delivered as a concerned and responsible corporate citizen and in no way reflects a belief that Smith Corona has caused or contributed to said contamination, and • WHEREAS, the Town of Cortlandville receives said donation without any intention of releasing any party responsible in whole or in part from responsibility for contamination and resulting damages,.and without any intention of waiving any of its legal rights and recourse, now therefore be it RESOLVED, that the Town of Cortlandville accepts the donation from Smith Corona, Inc. in the amount of $25,000.00 for the purposes and conditions set forth above. RESOLUTION #210 ACCEPT NOTICE OF LIQUOR LICENSE RENEWAL - TERRACE RESTAURANT Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED, that notice has been received from the Terrace Restaurant, 879 Tompkins Street, advising that they are renewing their -liquor -license in accordance with the Acholic Beverage Control Law. Telephonf the Special Franchise Assessment for the 1986 Tar. Roll, Assessment as filed by New York Telephone with the New York State Petition Board of Equalization and Assessment, dated October 14, 19e6. All voting aye, the motion was carried. RESOLUTION #211 CANCEL TOWN SUBSCRIPTION TO THE NEW YORK STATE REGISTER Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED • WHEREAS, in the past the Town Board requested subscription to the New York Register, a weekly publication advising of public hearing dates and regulation changes throughout the state, and WHEREAS, time has indicated that the information pertaining to the town included in the Register is usually obtained from other sources, and WHEREAS, requests to utilize the towns issue of the Register have been very infrequent, therefore BE IT RESOLVED, that based on this information, it is the consensus of the Town Board -that the Towns subscription to the Register not be renewed upon expiration. Register m.9 Wednesday, November 5, 1986 Page 9 Justice Office RESOLUTION #212 AUTHORIZE TOWN JUSTICE OFF"ICE TO close for construction CLOSE - NOVEMBER 12 - 14 1986 Nov. 12-14 1986 Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, progress on the Town Hall expansion requires conduit and insulation work in the ceiling of the meeting room and justice offices, and WHEREAS, this work would interfere in the work routine and could represent a potential health hazard as a result of removing the old fiberglass insulation, therefore BE IT RESOLVED, that authorization is hereby granted for the justice office to close due to necessary construction work on the 12th - 14th of November, 1986. CORTLANDV I LLE EMPLOYEES Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, a request was received from employees that the Town provide New York State Disability Insurance for employees of the Town, and WHEREAS, a proposal for coverage was submitted by the Denniston Agency of McGraw for consideration, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized and directed to obtain New York State Disability Insurance coverage -For town employees as a fringe benefit at the towns expense. Supervisor Pierce apprised the Town Board that he has held discussions with property owners that are considering a subdivision and asked about hooking into town water. He advised them that this would be done by their contractor at their expense. It was the consensus of the Town Board that plans be submitted for review before further action is taken. Subdivisions and requests for water hook-up Supervisor Pierce advised those present that he is New town well still looking for a new municipal well site. A site in sites the Lyncourt and Sears Road area has been suggested. County Legislator, Fred Compagni, asked that the F. Compagni Board consider the advantages of contracting for town Contact for road road resurfacing and construction, and focusing town construction and efforts on maintenance and ditching. resurfacing Councilman Manning responded that the town has considered this alternative in the past and will again, based on current information. Comments were also voiced in regard to numerous areas where reduced speed zones would be useful in increasing public safety.
