SPECIAL MEETING A Special Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 1.5 Terrace Road, Cortland, New York, with Supervisor Melvin Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman. E'dW n--O'!DonH1ell Town Clerk Pauline H. Parker Others present were Deputy'Town Clerk, Beth O'Gorman; Chief Court Clerk, Eileen Malay; Assessor, David Briggs, and Newsreporter, Kevin Conlin. The meeting was called to order by Supervisor Pierce at 5:00 o'clock p.m. RESOLUTION #203 AUTHORIZE SUPERVISOR PIERCE TO SIGN Aid to STATE CONTRACT FOR AID TO LOCALITIES Localities PROJECT - HIGHLAND ROAD WATER PROJECT Highland Rc Motion by.Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Town of Cortlandville herein called the "munidipality," after thorough consideration of the various aspects of the problem and study of available data, has hereby determined that certain work, as described in the State Contract, herein called the "Project," is desirable, in the public interest, and is required in order to study and/or implement the local project or program; and WHEREAS, under Chapter 53, Section 1, relating to the Local Assistance Budget, as amended by Chapter 886 of Laws of 1986, the Legislature has authorized financial assistance to localities for services and expenses related to local projects, programs and studies by means of written agree- ment; and WHEREAS, the Municipality has examined and duly considered Chapter 53, Section 1, relating to the Local Assistance Budget, as amended by Chapter 886 of the Laws of 1986, and deems it to be in the public interest and benefit under this law to enter into a contract therewith; NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Cortlandville 1. That Supervisor, Melvin H. Pierce, is directed and authorized as the official representative to act in connection with any contracts between the Municipality and the State, and to provide such additional information as may be required; 2. That one (1) certified copy of this Resolution be prepared and sent to the New York State Depart- ment of Environmental Conservation, Albany, New York together with the State Contract; 3. That this Resolution take effect immediatly. Thursday, October 30, 1986 Pg. 2 Adopt RESOLUTION #204 ADOPT THE TENTATIVE BUDGET AS THE Tentative Budget PRELIMINARY BUDGET FOR THE TOWN for 1987 OF CORTLANDVILLE FOR 1987 Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, the tentative budgets of the; Town, including the Water Fund; Sewer Fund, and Fire District for 2.987, were presented by the Town Clerk, to the Town Board at a regular meeting held October 1, 1986, and WHEREAS, the Town Board has reviewed said tentative budgets and has made such -changes, alterations and revisions as it considers advisable and are consistent with the law; THEREFORE, BE IT RESOLVED, that the tentative budget for the Town of Gortlandville, as modified, be and the same hereby is, approved and adopted as the preliminary budget of the Town of Cortlandville. for the fiscal year beginning January 1, 1987, and BE IT FURTHER RESOLVED, that the tentative budget for the Water Fund, as modified, be, and the same hereby is, approved and adopted as a preliminary budget of the Water Fund for the fiscal year.commencing January 1, 1987, and BE IT. -FURTHER RESOLVED, that the tentative budget for the Sewer Fund., as modified, be, and the same hereby 'is, approved and adopted as the preliminary budget of the Sewer Fund for the fiscal year commencing January 1, 1987, and BE IT FURTHERiRESOLVED, that the ,tentative budget for the Cortlandville Fire District, as modified, be, and the same hereby is, approved and.adopted as a preliminary budget of the Cortlandville Fire District for the fiscal year commencing January 1, 1987. RESOLUTION #205 RESCIND RESOLUTION NO. 200 #200 Adopted ADOPTED OCTOBER 15, 1986 Oct. 15, 1986 Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Town�Board Resolution #200 adopted by this Town Board on October 15, 1986, regarding the purchase of a replacement ten -wheel dump truck for the highway department, is hereby rescinded. Purchase new RESOLUTION #206 AUTHORIZE HIGHWAY SUPERINTENDENT, ten -wheel CARL BUSH, TO PURCHASE A NEW TEN - dump truck WHEEL DUMP TRUCK Motion by Gouncilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED 1 0 J 1 :7 L Thursday, October 30, 1986 WHEREAS, a recent accident Beverly damaged one of the Town's ten -wheel dump trucks, and WHEREAS, the age and condition of said truck do not merit the approximatly $15,000.00 cost of repair, and WHEREAS, said truck is the only spare vehicle for snow- plowing and sanding, and WHEREAS, a replacement truck is needed as soon as possible due to the necessary pre -winter road work,,which is -currently behind schedule, and WHEREAS, the time required for bidding procedures is likly to result in a loss of any available replacement truck for which there is a high demand in the market and research by the Highway Superintendent indicates that bidding for a truck built to needed specifications would provide us a vehicle as late as February, 1987,.and WHEREAS, an appropriate replacement is currently available for a short period of time, nowI-tn:er6forei be: it RESOLVED, that pursuant to General Municipal Law Section 103 (4), the Cortlandvi.11e Town Board declares that the accidental loss of one of the Town's ten -wheel trucks represents a present emergency arising out of an unfore- seen occurence affecting the health, safty, and property of inhabitants of the Town, requiring action which can not await competitive bidding, and be it further RESOLVED, that the Highway Superintendent is hereby authorized to purchase and appropriate replacement ten - wheel dump truck at a cost not to exceed $57,000.00. Chief Court Clerk, Eileen Malay, commented that she would like to take this opportunity, to state for the record, that she feels the salaries proposed in the 1987 Preliminary Budget for employment positions currently filled by women at the town are inequitable compared to those proposed for men based on duration of employment and experience. Supervisor Pierce stated that the appropriate time for comment on the Preliminary Budget would be the Public Hearing scheduled for November 5, 1986. He verified that adoption of the Preliminary Budget, establishes that no increases can be made to an appropriation in that budget. There being no further comment from those in attend- ance, a motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to adjourn the special meeting.
