HomeMy WebLinkAbout1954-10-05 182 October 5 , 1954 . The regular monthly meeting of the Dryden Town Board was held Tuesday Evening , October 5 , 1954 at 7 : 30 P . M . at the Town Office Building . . Present were Supervisor Downey , Justices Whitford , Shaw , Spaulding and Baker and Superintendent of Highway Beach . The minutes of the last meeting , also the special meeting of September 16th , were read , tcorrected and approved . A communication from Attorney Charles Newman was read , f'eporting on the Carl James Trailer case . He stated that the only question to be litigat ed in these proceedings shall be the legal $.y of the ass - .; essment9 of trailers to the owners of the lands upon which the trailer parks are situated . . Communications were also read from J. . A . Lacy , street lighting representative for the hamlet of Varna , regarding an improved street lighting system for Varna ; and from Howard E . Conklin ; Secretary of the Board of Fire ' Commissioners , Brooktondale Fire District , asking for a reopening of discussion as to the amount of the consideration provided for in the Town of Dryden contract for fire protection , . Th e Town Board set the evening of October 12th at 7 : 30 p . rp . to meet with the Brooktondale Fire Commissioners at the Bethel Grove Hall . The September report of George Guest , Multiple Dwelling Inspector , was read and placed on file . Moved by Justice Spaulding , seconded by Justice Shaw , that the general bills , totaling 4199 . 24 , and the Youth Project bills of 413 . 70 , be paid as audited . Roll call vote taken . All voted Yes . Moved by Justice Whitford , seconded by Justice Baker , that the Highway bills , totaling 42462 . 77 , be paid as audited . Roll call vote , all voting Yes . h Moved by Justice Whitford , seconded by Justice Spaulding , that the Town of Dryden continue to buy gas from Tripp and Fellows at the State price , providing they repair the meter on the gas pump . Mr. RULTSON—read once and referred to the • Committee on drays and Means AN ACT To amend the finance law and the general municipal law, in relation to special census and state assistance based thereon The People of the State of New York, represented in Senate and . Assembly, do enact as follows : 1 . Section 1 . Section fifty-four of the finance law is hereby amended 2 by adding thereto a new subdivision , to be subdivision five-a, to read 3 as follows : • 4 5.a. Where a county on behalf of the cities, towns, and villages 5 therein Or any city, town or village on its own behalf shall have con- 6 traded with, the United States bureau, of the census for a special 7 population census, and as ci result, that bureau shall have certified 8 the population of any such political subdivision as of April first, o f 9 any year subsequent to the latest decennial federal census and such 10 certification shall have been filed with the state comptroller by 11 October first of any year, the population so certified shall be used 12 thereafter for computation of state assistance payable in subsequent EXPLANATION - Matter in italics is new ; matter in brackets [ ] is old law to be omitted. • 2 1 fiscal years to such political subdivision pursuant to this section 2 until the. next decennial census shall have been completed, published 3 and used for purposes of this section . 4 § 2 . The general municipal law is hereby amended by inserting 5 therein a new section, to be section twenty, to read as follows : 6 § 20. Special population census . Any county on behalf of all 7 cities, towns, and villages therein or any city, town, or village on its 8 own behalf is hereby authorized, and empowered to contract with, 9 the United States bureau of the census to supervise a special popu- 10 lation ce'ii-sus for purposes of coi iputation of state assistance pay- 11 able pursuant to section fifty-four of the state finance law and the 19 cost of such a census shall be an expense of the county, city, town, • 13 or village respectively . . 14 § 3 , This .act shall take effect immediately . Carried by Roll call vote , all Justices Yes . Justice Shaw offered the following resolution and asked its adoption : RESOLVED,, that this Town Board does hereby prepare . . " and approve as the Preliminary Budget of this Town for the fiscal year beginning on the first day of January 1955 , the itemized statements of the estimated revenues and expenditures hereto attached and made a part of this resolution , and be it FURTHER RESOLVED , that such Preliminary Budget shall be filed in the Office of the Town Clerk where it shall be available for inspection by any interested person at all resonable hours , and be it FURTHER RESOLVED , that this Board shall meet between the hours of 700 and 8 :0q P. . M , on the, Trd day of November 1954 for the purpose of holding a public hearing upon such preliminary budget , and be It TFURTHER RESOLVED , that the Town Clerk give notice of such public hearing in the manner provided in Sec . 113 of the Town Law , and that such notice be published . Present were Supervisor Downey , Justices Spaulding and Shaw . After a discussion with the Brooktondale fire commissioners , .a motion was made by Justice Shaw , seconded by y . Justice Spaulding , that the Town Board call a public hearing for the purpose of consider- ing an increase of the contract prices for fire protection with 1/ the said company for the remainder of their, contractor for a five year period , as the Town Attorney = Lh9tbparirigytu be held November 3rd , 1954 from 8 : 00P . M . to 000 P . M . Motion Carried . A ' Motion was made by Justice Spaulding , seconded by Justice Shaw , that the Town Board call a public hearing for the purpose of considering a new lighting contract with the New York State Electric and Gas Corporation for street lighting in the hamlet of Varna as requested by them .
