REGULAR MEETING The Regular Meeting of the Town Board of the Town of Cortlandvi.11e,'was held at the Town Hall., 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Deputy Town Clerk Beth 01G;orman Others present were Newsreporter, Kevin Conlin; Zoning and Code Enforcement Officer, Bruce Weber; High- way Superintendent, Carl -Bush; Michael P. Trick, Manager of Grossman: Lumber, and town resident, Dick Crozier. The meeting was called to order by Supervisor Pierce at 5:00 o'clock p.m. He offered the.pr.ivilege of the floor to Michael P. Trick. Michael Trick Michael P. Trick, Manager of Grossman's Lumber, at road repair 203 Homer Avenue, Cortland, advised the Town Board that the Grossmans Lumber back access road to their property, or Old Route 11, is in access road need of repair. This road is utilized by numerous area businesses and their clientele. Mr -Trick presented -the Town Board with photographs of the -area illustrating the public hazard caused by numerous potholes and resulting drainage problems. A one day petition of area business patrons was submitted requesting road maintenance. Mr. Trick contacted Highway Superintendent, Carl Bush; by phone on October 14, 1986, regarding this problem. A copy of the follow-up letter sent by Mr. Trick to Mr. Bush was provided for the board members. At the time contacted, Mr. Bush was unable to comment on when road maintenance. in the area would be poss-iable. Supervisor Pierce advised Mr. Trick that he will discuss what can be done to improve drainage and patch the road prior to inclement weather with the Highway Superintendent. Letter from A motion was made by Councilman Manning, seconded by c-man Boehlert Councilman Thorpe, to receive and file the letter to Fed. Revenue Supervisor Pierce from Congressman Sherwood Boehlert . All Sharing voting aye, the motion was carried. The letter advised that no Federal Revenue Sharing Funds will be available in 1987. Easment w/ A motion was made by Councilman O'Donnell, seconded Charles by Councilman Thorpe, to receeve and file the temporary ease - Bowman ment for laying water mains, laterals, and manholes between the Town of Cortlandville and Charles K. Bowman This temporary easement is required for the Pheasant Run Water Improvement Project. Zoning and CB3 A discussion was held among those present regarding the Computer request of Zoning and Code Enforcement Officer, Bruce Weber, Request for a transfer of funds in the amount of $3,500.00 from Personal Service acct. B8010.1 to Equipment acct. B8010.2, for the purchase of a personal computer and appliciable software packages. Fi • 1 • d Wednesday, October 15, 1986 Pg. 2 It was the concensus of the Town Board that this request be reviewed at a later date when more information is available on the usage of access time and storage capacity of the present hardware system. The effeciency of the current system in operation must be reviewed prior to additional hardware purchases. RESOLUTION #200 AUTHORIZE HIGHWAY SUPERINTENDENT TO Replace PURCHASE REPLACEMENT TEN WHEEL Ten -wheel DUMP TRUCK Pr�:t i nc� _nl '7, ,r-12 � D um truck 0,+ p: a94 Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED. WHEREAS, a recent accident Beverly damaged one of the Town's ten -wheel dump trucks, and WHEREAS, the age and condition of said truck do not merit the approximatly $15,000.00 cost of repair, and WHEREAS, said truck is the only spare vehicle for snow- plowing and sanding, and WHEREAS, a replacement truck is needed as soon as possible due to the necessary pre -winter road work which is currently behind schedule, and WHEREAS, the time required for bidding procedures is likly to result in a loss of any available replacement truck,for which there is a high demand in the market, now therefore BE IT RESOLVED, that pursuant to General Municipal Law Section 103 (4), the Cortlandville Town Board declares that the accidental loss of one of the Town's ten -wheel trucks represents a present emergency arising out of an unforeseen occurance affecting the health., safety., and property of inhabitants of the Town, requiring action which can not wait competative bidding, and be i.t.further RESOLVED, that the Highway Superintendent is hereby auth- orized to purchase an appropriate replacement ten -wheel dump truck at a cost not to exceed $35,000.00. It was the, concensus of the Town Board, that Super- visor Pierce advise Highway Superintendent, Carl Bush, of their concern for the value received in regard to cost when purchasing a used truck under urgent circumstances. RESOLUTION #201 DENY REQUEST TO MAKE EXCEPTION OF N.Y.S UNIFORM BUILDING CODE - REGARDING P.V.C. PLASTIC PIPE ® Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, a request was received from local plumber, and subcontractor for the Tompkins Street condominium project of David Yamen and Barden Construction, Norman Grant, that the Town exercise their option to approve materials for construction, other than those currently specified under the New York State Uniform Building Code in relation to the use of P.V.C. plastic pipe, and Norman Grant P.V.C. Plastic Pipe exception denied Payment of Vouchers Wednesday, October 15, 1986 Page 3 WHEREAS, the Zoning and Code Enforcement Officer, Bruce Weber, advised the Board that conversations with state officials and local plumbers indicated that cast 'iron or copper pipe is more duriable, lasts longer, and is part- icular.ly, suited.to inaccessiable areas, and WHEREAS, ground soil conditions. must be taken into consideration in the use of plastic pipe, and -trenching in sand or gravel is strongly recommended, and WHEREAS „the advantages of P.V.C., plastic pipe use are dependent on the building circumstances, therefore BE IT RESOLVED, that the New York State Uniform Building Code shall remain the standard for use of P.V.C. plastic pipe, and RESOLVED, that the request to use P.V.C. plastic pipe i's hereby denied. RESOLUTION #202 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL.AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #484 - 505 $44,692.19 Highway Fund 223 - 242 53,539.01 Water Fund 118 - 124 424.29 Sewer Fund 67 - 71 740.19 There being no further business, a motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to adjourn the meeting.
