PUBLIC HEARING A Public Hearing was held at the Cortlandville Town Hall, 15 Terrace Road, Cortland, New York, at 5:00 o'clock p.m. providing for the establishment of a water improvement district to be designated and known as the "Pheasant Run Water Improvement." Members -present:, Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Edwin O'Donnell Town -Clerk Pauline H. Parker Others present were Deputy Town Glerk, Beth O'Gorman; Newsreporter, Mike Middlestadt; Justice, Mardis Kelsen; and numerous residents of the Pheasant Run area including Dianne Sorrells, Ralph and Donna Riese, Bill Spencer, and Chris Wright. The Public Hearing was called to order by Supervisor Pierce at 5:00 o'clock p.m. The Town Glerk read aloud the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE ORDER PURSUANT TO TOWN LAW Section 209-q (3) Whereas, there was filed in the Office of the Town Clerk of the Town of Cort- landville, Cortland County, New York, general plans relating to the estab- lishment of a water improvement project for the Pheasant Run area of the Town of CortandviIle, as required by Section 209-q and 209-c of the Town' Law, and are available for public inspection, and Whereas, the proposed in provement consists of the extension of water lines into the Pheasant Run area by construction of approx- imately 1200 lineal feet plus service pipe, in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cort- landville, and Whereas, the maximum amount proposed to be ex- pended for said improve- ment is $100,000.00, and Whereas, the proposed method of financing the said improvement is from surplus funds or bonds issued by the Town of Cort- landville at a maximum term of 20 years at prevail- ing interest, or combination of surplus funds and bonds, it is hereby Ordered, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, Terrace Road, Cort- land, New York on the 3rd day of October, 1986 at 5:00 ,o'clock p.m. of that day to hear all persons interested in the proposed water im- provement, and forsuch other action of said Town Board with relation to the said water improvement as may be required by law or be deemed proper. Parker, Town Clerk Town of Cortlandville 15 Terrace Road Cortland, New York 13045 ADOPTED: September 22, 1986 9 A 3— ('t 223-11 .Supervisor Pierce advised those present that the legal notice incorrectly stated that surplus funds will be utilized in financing the improvement project. Bonds issued by the Town of Cortlandville for a maximum term of fifteen years will finance the improvement project. Councilman Manning explained that per Resolution #186 adopted September 17, 1986, a public emergency was declared in the Pheasant Run area, and Super- visor Pierce was authorized to exercise the powers of his office to extend Town water service to the Pheasant Run area. The presence of organic__ chemicals in local ground water required immediate action for the health, safty, and property protection of area inhabitants. Construction of the improvement project could not await competative bidding. The Councilmen commended Super- visor Pierce on his immediate attention to this end result. Supervisor Pierce offered those in attendence the privilege of the floor for comments and questions. 1 0 1 0 I 1 C. 1 1 Friday,' October 3, 1986 Page 2 Public Hearing Several residents voiced the concern that their well has not been tested for contamination and the frustration that communication was not better among health officials, residents, town officials, and the media. Some residents inquired as to when water service would be available and the requirements for a hookup. Supervisor Pierce responded that construction is scheduled to begin next week, as the service pipe passes their residence, they will have the opportunity to hook- up free of charge. Residents may elect to continue using their well water for yard maintenance. Should they decide to delay hook-up beyond the improvement project time guideline, the resident will be required to pay the hook- up fee. Residents exercising these last options were encouraged to make knowledgeable decisions -based on the expertise of local and state health officials. Users and benefitors of the improvement project will pay a benefit tax via tax collection, and users will receive a quartly billing based on consumption. In response to concerns for the safty of town water supplies, Supervisor Pierce responded that recent tests have indicated no hazardous impact on the town wells. The Town is currently researching increased zoning protection for properties near the aquifer and seeking additional well sites for alternate supply sourses and to meet the increasing demand for fresh ground water. There being no further comments or questions from those in attendence, a motion was made by Councilman 0:°Donnell, seconded by Councilman Thorpe, to adjourn the public hearing. All voting aye, the motion was carried. Approve Pheasant Run Project & Funding Friday, October 3, 1986 SPECIAL MEETING A Special Meeting,of the Town Cortlandville, was held at the Town Cortland, New York, with Supervisor Page 1 Board of the Town of Hall, 15 Terrace Road, Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Edwin O'Donnell Town Clerk Pauline H. This Special Meeting was called to order by Super- visor Pierce immediatly following the,Public Hearing providing for the establishment ofa water improvement project to be designated and known as the "Pheasant Run Water Improvement." RESOLUTION #199 APPROVE PHEASANT RUN WATER IMPROVEMENT PROJECT AND FUNDING Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for the Pheasant Run area of the Town of Cortlandville, as required by Section 209-q (2) and 209-c of the Town Law, and WHEREAS, an Order was duly adopted by the Town Board on September 22, 1986 reciting the filing of said general plans, and improvements proposed, and the estimated expense thereof and specifying October 3, 1986 at 5:00 o'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the said Board would meet to consider the documents filed as afore- said and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, such Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the Board on this 3rd day of October, 1986 commencing at 5:00 p.m. at the Town Hall in the said Town and discussion upon the matter having been had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Raymond Thorpe, Councilman, seconded by Edwin O'Donnell, Councilman, and unanimously passed, it is 1 0 0 1 G 1� 1 11 Friday, October 3, 1986 Page 2 RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of Cortlandville are in compliance with Section 209-c of the Town Law of the State of New York and are otherwise sufficient, and that to establish the aforesaid water improvement is in the public interest, and it is further RESOLVED AND DETERMINED, that the establishment of a water improvement as proposed in said plans be authorized pursuant to Section 209-q (6) (c) of the Town Law; that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made available or provided for; and that such improvement shall be designated and known as the "Pheasant Run Water Improvement", and it is further RESOLVED, that the proposed improvement', including costs of rights of way, construction costs, legal fees, engineering and consultant fees, and all other expenses approximated to be a maximum of $80,000.00 shall be financed as follows: 100% of the cost thereof will be financed with bonds issued by the Town of Cortlandville for a term of a maximum of 15 years and at the interest rate prevailing at the time of sale, said bonds to be retired by payments received from the users and benefitors of the water improvement through water rates, charges and fees in the first instance, and'only if necessary by Town charges, and it is further RESOLVED, that the Town Clerk of this Town shall within ten (10) days after the adoption of this Resolution file a certified copy thereof in.the Office of the Cortland County Clerk as provided for by the Town Law, Section 209-q (6) (c), and it is further RESOLVED, that this Resolution is adopted subject to permissive referendum. There being no further business, a motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to adjourn the special meeting. All voting aye, the motion was carried.
