HomeMy WebLinkAbout08-20-1986Wednesday, August 20, 1986 , Page 1 REGULAR MEETING The Regular Meeting of the Town of Cortlandville Town Board, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members Members present: Supervisor Councilman Melvin Pierce Warren Mannin Councilman Edwin O'Donnell Deputy Town Clerk Beth O'Gorman ® absent: Councilman Raymond Thorpe Councilman Ronal Rocco Town Clerk Pauline Parker Others present were Attorney, Phillip R. Rumsey; Engineer, Hayne Smith; Highway Superintendent= Carl ,Bush; Newsreporter, Kevin Conlin, and town resident, Dick Crozier. The meeting was called to order by Supervisor Pierce at 5:15 p.m. He requested that those in attendence rise and pledge allegiance to the flag. RESOLUTION #165 AWARD BIDS -WATER & SEWER IMPROVEMENT PROJECT N.Y.S. ROUTE 281 and 222. Award bids Water & Sewer Improvement Motion b Councilman O'Donnell Rt. 222/281 Secondedyby Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS, a'Public Hearing was held on September 23, 1985, in regards to the Sewer Improvement project, and WHEREAS, a Public Hearing was held on Wednesday, April 2, 'Project, 1986, in regards to the Water Improvement and WHEREAS, on Wednesday, July 16, 1986, authorization was granted to advertise by legal notice, letting of the bids for the Water and Sewer Improvement Project, and WHEREAS, sealed bids were received and read aloud by the Town Clerk, at a Special Meeting on Friday, August 20, 1986, and given to the Supervisor and the Engineer for review, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville, does hereby award the bid for the Water and Sewer Improvement Project N.Y.S. Route 281 and 222, to inc., Eastern Pipe S ly Co. of Auburn, New York, in the amount of �pW,990.80, subject to the Town Engineer determining when construction may begin. RESOLUTION #166 AWARD BID - PORTLAND CEMENT - LUKER RD. Award Bid Motion by Councilman O'Donnell Portland Cement Seconded bV Councilman Manning VOTES: ALL AYE ADOPTED Luker Rd. ® WHEREAS, on August 6, 1986, the Engineer was ranted authorization to advertise by legal notice letting of the for Portland bids Cement, Luker Road Project, and WHEREAS, sealed bids were received and read aloud byy the To Clerk -.t a Special Meeting on Friday, August 20, ` 19, and given to the Supervisor Engineer for and review, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville, does herebyy award the bid for Portland Cement, Luker Road Project, to Indep ndent Cement of $17,100.00. Buffalo, New York, in he amount of Rec. & File Notice Applic- ation McGraw well Wednesday, August 20, 1986 Page 2 Supervisor Pierce offered those in attendence the privilege of the floor. A motion was made by Councilman O'Donnell, seconded by Councilman Manning, to receive and file the Notice of Complete Application. All voting aye, the motion was carried. The notice related to installation of a new well for the Village of McGraw. Rec. & File A motion was made by Gouncilman.:0'Donnell, seconded Letter by Councilman Manning, to receive and file the letter St. Marys from St. Marys' Church Associate Pastor, Reverend Frank Church Outing Young. All voting aye, the motion was carried. The letter advised that'.,the church pparishoners throughlyy enjoyed use of -the Cortlandville Recreation Park on theer annual outing Wednesday, August 13, 1986. Rec. & File letter A motion was made by Councilman Manning, seconded by Waste hauler Councilman O'Donnell, to receive and file the letter from land spread the New York State Department of Environmental Conservation sites to William Enslow and S.on of Freeville, New York. All voting aye, the motion was carried. The letter was in response to his request for a modification to the Part 364 Waste Haulers�Permit which would -result in two additional landspreading sites. A permit was granted for the Glen Downey property but denied for the Dennis Rew property because of its proximity to Cortlands municipal water supply. Rec. & File letter A - mot,ion was made by Councilman O'Donnell, seconded James Roberts by Councilman Manning, to receive and file a copy, of the. Aquifer letter to the CortlandCounty Health Department from protection James E. Robert, Superintendent Cortland Water Board. All votin ayye, the motion was carried. The eeter expressed concern for new businesses locating in. the proximity of the City of Cortland wells with hazardous chemical potential to the aquifer.. Aquifer RESOLUTION #167 DIRECT LETTER -TOWN OF CORTLANDVILLE Protection PLANNING BOARD letter to Planning Bd. Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, on July 29, 1986, the Town of Cortlandville Planning Board approved a conditional permit for T.D.R. Oil Inc. for a ten minute oil change operation located between the Kellog Auto Supply Store and Cityof Cortland Water Works propery on New York State Route 281, and WHERAS, numerous residents and officials of -the town and surronding municipalities have expressed their concern that spills, leaks, or careless maintenance in such close proximity to Water Board property could be potentially hazardous to fresh water supplies, and WHEREAS, this Town Board has many concerns regarding this type of operation being allowed to operate at this location in the town as it is located over the aquifer which supplies water for both the City of Cortland and the Town, therefore BE IT RESOLVED, that the Town Board hereby authorizes the Supervisor to communicate to the Planning Board the Town Boards concerns relatin to T.D.R. Oil Inc., and similar business operations in he proximity of the aquifer with hazardous potential to the fresh water supply, and schedule a joint meeting to discuss these questions and concerns,. and 1 • 1 1 Z Wednesday, August 20, 1986 A� Page 3 RESOLUTION #168 BOND RESOLUTION OF THE TOWN OF CORTLANDVILLE, NEW YORK, ADOPTED AUGUST 20, i �)86 AUTHORIZING THE ISSUANCE OF $170,000.00 SERIAL BONDS TO FINANCE THE CONSTRUCTION AND EXTENSION OF A -SANITARY SEWER IMPROVEMENT TO BE KNOWN AS SEWER IMPROVEMENT PROJECT FOR THE N.Y.S. RT. 222/ N.Y,-S. 281 AREA OF THE TOWN OF CORTLANDVILLE Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Bond Res. Sewer Improvement N.Y.S. Rt. 281/ N.Y.S. Rt. 222 THE TOWN BOARD OF THE TOWN OF CORTLANDVILLE, IN THE COUNTY OF CORTLAND, NEW YORK, HEREBY RESOLVES AS FOLLOWS: SECTION 1. The specific object or purpose for which obligations are issued pursuant to this resolution is to finance the cost of rights of way, land, legal fees, engineering fees, construction costs and all other such expenses relating to the construction and extension of a sewer improvement area in the Town of Cortlandville know as Sewer Improvement Project for the N.Y.S Rt. 222/N°Y.S. 281 Area of the Town of Cortlandville as the same is shown in the map9, plans and engineering reports heretofore filed with the Cortlandville Town Clerk. SECTION 2. The maximum cost of such sewer extension is d�1'70,000.00 to be financed by the issuance of serial bons and bond anticipation notes for a term of 1 years at the interest rate prevailing at the time of sae. SECTION 3. The period of probable usefulness of said sewer improvem nt is forty (40� years, as set forth in Section 11.00 of the Local Finance Law. SECTION 4. Said serial bonds will have a maturity in excess of five years. SECTION 5. The faith and credit of the Town of ofrsaiddbonds and InTe estsotherepOnywhen duethe principal SECTION 6. The Supervisor of the Town is hereby authorized and directed to sell such bonds at priv to sale in accordance with the provisions of Section 3.00 of the Local Finance Law. SECTION 7. Subject to the provisions of this resolution and of the Local Finance Law, and pursuant to the provisions of Section 30.00 relative to the authorization of the issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to 60.00-of the law, the powers and duties of -the Town Board relative to prescribing the terms, form and contents as to the sale and issuance of said bonds -and any notes issued in anticipation of said bonds, or the renewals thereof, are hereby delegated to the Supervisor, the chief fiscal officer of the Town. SECTION 8. The validity of the bonds autho_nized by this resolution and of any notes issued in anticipation of said bonds, may be contested only if: (a) Such obligations are authorized for an Mect or purpose for which the Town is "authorized to expend money, or Wednesday, August 20, 1986 Page 4 (b) The provisions 'of the Law which should be complied with at the date of the publication of such resolution are not substantially complied with and an action, suit or proceeding contesting such validity, is ommenced within twenty days after the date of such publication, or (c) Such obligations are.authorized in violation of the provisions of the constitution. THE TOWN BOARD OF THE: TOWN :OF CORTLANDVILLE, IN THE COUNTY OF CORTLAND, NEW YORK, HEREBY RESOLVES AS FOLLOWS: SECTION 1. Corrected Sept. 3, 1986 see page 260 RESOLUTION # 170 SET DATE . 0R PUBI I HEARING Set Date P.H . 19869 WELL R JEGT Well project 1986 Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHERE'AS,. there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, maps, plans, and an engineering report relating to the establishment of a 1986 Well Project for the Town of Cortlandville, as required by Section 202-q and 202-c of the Town Law, and are available for public inspection, and WHEREAS, the proposed improvement consists of the locating, drilling, constructing of a new well, pump house and all accessories, in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortland- ville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $250,000.00, and WHEREAS, the proposed method of financing the said improvement is from surplus funds, IT IS HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, 15Terrace Road, Cortland, New York, on the 3rd dayy of September, 1986, at 7:30 o'clock p.m. of that day to hear all persons interested in the proposed well improvement, and for such other action of said Town Board with relation to the said well improvement as may be required by law or be deemed proper. ® RESOLUTION ,#l71 SET DATE FOR PUBLIC HEARING WATER Set date P.H. Rt. N.Y.S. Rt. 281 area of the Town of Cortlandville and proposing the maximum amount of said project to be $149,000.00, which maximum amount was also stated, after public hearing by Z CJ 1 Set Date P.H. RESOLUTION #172 SET DATE FOR PUBLIC HEARING -SEWER IMPROVEMENT FUNDING INCREASE Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS, an Order pursuant to Town Law Section 209-q (3) was adopted on September 4, 1985 proposing the Sewer Improvement Project for the N.Y.S. Rt. 222/N.Y.S. Rt. 281 area of the Town of Cortlandville and proposing the maximum amount of said project to be $149,000.00, which maximum amount was also stated, after public hearing by resolution adopted September 23, 1985, and WHEREAS, prior to completion of said project, -the lowest responsible bidders in August of 1986 necessitate an increase to $170,000.00 in the maximum amount, now, therefore, _ E IT RE 0 VED, that pursuant to Town Law Section 209-g 3) and5�, a public hearing will be held before the Town oard of the Town of Cortlandville at the -Town Hall, 15 Terrace Road Cortland, New York on the 3rd day of September 1�86 at 7:45 o'clock p.m. on the proposal to increase �he maximum amount to $170,000.00 for the Sewer Improvement Project for the N.Y.S Rt. 222/ N.Y.S. Engineers' Supervisor, Pierce advised the Board that Town Assistant Engineer, Hayne Smith, will be needing an assistant to help oversee the various construction projects scheduled for the town. He is recommending Roy Rounseville to oversee the N.Y.S. Rt. 281/222 Water and Sewer Improvement Project. It was the consensus of the Town Board that Hayne Smith continue to negotiate the hourly salary and terms of employment with Mr. Rounseville.
