HomeMy WebLinkAbout07-16-1986Wednesday, July 16, 1986 Page 1 REGULAR MEETING The Regular Meeting of the Town of Cortlandville Town Board, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding at 5:OOp.m. Members present: Supervisor Melvin Pierce Councilman Warren Manning Councilman Raymond Thorpe Councilman Edwin O'Donnell Town Clerk Pauline Parker absent: Councilman Ronal Rocco Others present were Highway Superintendent, Carl Bush; Code Enforcement Officer, Bruce Weber; and town resident, Dick Crozier. The meeting was called to order "-y Supervisor Pierce at 5:00 p.m. He requested that those in attend.ence rise and pledge allegience,to the flag. Supervisor Pierce offered the privilege of the floor to those in attendence. Dick Crozier Dick Crozier,. 242 Tompkins Street, advised the..Board Zoning that he has added an "apperidap" to his home. While this complies with the zoning requirements for that particular area, he has been in dispute with Code Enforcement Officer, Bruce Weber, on some technical aspects: Mr Crozier stated that he has consulted an attorney, on his behalf, and requested an opportunity to discuss with Town Attorney Phillip Rumsey, the jurisdiction of the Town Zoning and ;ode Enforcement afficer. Supervisor Pierce advised Mr. Crozier that Attorney Rumsey will be present at the August 6, 1986, Board . meeting at which time arrangements could be made for such a discussion. Penquin Trlr. RESOLUTION #150 DIRECT TOWN CLERK TO ISSUE ORDER OF Park Compliance NON-COMPLIANCE - IF APPLICABLE - W` Section 6B PENQUIN TRAILER PARK Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, Code Enforcement Officer, Bruce Webery has informed Mr. Robert Bean, owner of Penquin Trailer Park, - that the park is in violation of Section 6B (P,�,rk Plan), of the Town of Cortlandville House Trailer Ordinance,and compliance must occur by July 22, 1986, and WHEREAS, Code Enforcement Officer, Bruce Weber, informed the Town Board of said violation and requested the necessary procedures, in accordance with the ordinance, 'be accomplished, therefore BE IT RESOLVED, that the Town Board of the Town of Cortlandville hereby directs the Town Glerk to issue an order of non-compliance, in the event that Penquin Trailer Park is not in compliance with Section 6B of the Town of Cortlandville House Trailer Ordinance by July 22, 1986, said order requiring compliance within five days after date of service of such order. 1 40 1 ;rl 1 9 Wednesday, July 16, 1986 Page 2 A motion was made by Councilman O'Donnell, seconded by Cortland Councilman Thorpe, to recieve and file the Cortland Free Free Library Library Activities Report for 1985. All voting aye, the Activity motion was carried. Report 1985 Town Clerk, Pauline Parker, apprised the Town Board Oi�dinance that many of the older town ordinances refer to the Town (Zoning) Clerk faking action and assisting in zoning affairs. She Verbage requested a review and update of the verbage used, as Update many of the tasks described fall under the Code Enforce- ment Officers job description. At the time some of the ordinances were written, these duties were designated to the Town Clerk,as the present position of Code Enforcement Officer did not exist. Dick Crozier, Tompkins Street, asked which elected offical would be the defendent in a zoning related litigation if the change in ordinance responsibility verbage was made as requested above. Supervisor Pierce responded that the Town Board would be the defendent in such -litigation. RESOLUTION #151 AUTHORIZE HIRING KATHY LEONARD-S.Y.E.T.P. Motion by Councilman O'Donnell S.Y.E.T.P. Seconded by Councilman Thorpe Summer assistant VOTES: ALL AYE ADOPTED WHEREAS, irLtke.past the Town. of Cortlandville, in conjunction with the Summer Youth Employment and Training Program, has employed a temporary, part.t.ime, clerical worker to assist in the Town Clerk's office and the Assessors Office, at no cost to the town, and WHEREAS; this service is once again available though the Summer Youth Employment and Training Program, therefore BE IT RESOLVED, that the Town Clerk, Pauline Parker, is hereby authorized to secure the employment of Kathy Leonard in the position of temporary, part time clerical assistant for the summer. RESOLUTION #152 AUTHORIZATION TO ADVERTISE FOR BIDS- Advertise bids WATER AND SEWER IMPROVEMENT PROJECT, W & S Project N.Y.S. ROUTE 281 and 222 Rt. 222 & 281 Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, a Public Hearing was held on September 23,.1985, in regards to the Sewer Improvement, project,and bonding approved, and WHREAS, a Pubic Hearing was held on.Wednes6ay, April 2, 19in regards to the Water Improvement bonding and project approved on Wednesday, April 2, 1�86, therefore BE IT RESOLVED, that the Engineer, Hayne Smith, is hereby authorized to advertise, by legal notice, letting QE the bids for the Sewer and Water Improvement Project, N.Y.S. Route 281 and 222, and RESOLVED, thi It . dpeni'ng :cif the bids::shall occur on August 159 1986, at 3:00 p.m., in the.Cortlandville Town Clerk's office, and Wednesday, July 16, 1986 Page 3 RESOLVED, that awarding of the bids shall occur on Wednesday,°August 20,..1986, at 5:00 p.m., at the Regular Meeting of the Cortlandville Town Board. Hire David RESOLUTION #153 AUTHORIZATION TO HIRE DAVII) THOMAS- Thomas Water & WATER AND SEWER OPERATOR TRAINEE Sewer Assistant Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED WHEREAS, on Wednesday, March 19, 1986, the Supervisor was granted authorization to seek an assistant for the water and sewer department, per Resolution.#88„ and WHEREAS, the Supervior'.has notified the Civil Service Commission of the positon and has selected a.qualified applicant, therefore BE IT RESOLVED, that authorization is hereby granted to hire David Thomas of 3908 Highland Road, for a posiion in the Water and Sewer Deaartment, at an annual salary to be determined later. Hire Fred LittleRESOLUTION #154 AUTHORIZATION TO HIRE FRED LITTLE - Hwy. Laborer HIGHWAY DEPARTMENT LABORER Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, on Wednesday, July 2, 1986, per Resolution-#149, authorization was granted to reinstate a tenth highway position, and WHEREAS, interviews where held by Highway Superintendent, Carl Bush, with those who had submitted applications, therefore BE IT RESOLVED, that Highway Superintendent, Carl Bush, is hereby authorized to hire Fred Little, for the full time position of Highway Department Laborer, effective July 28, 1986, at an hourly salary of $4.80. Personnel Policy A brief discussion was held by the Town Board in relation to the Town of Cortlandville personnel policy. It was the consensus of the Board that an update of the personnel policy is required to include job titles, descriptions, qualifications, and base salaries. Supervisor Pierce advised the Board that the current personnel policy is currently under review by the department heads. Luker Rd. Supervisor Pierce advised the Board that the second test water well test well drilling at the Luker Road site yielded water Drilling satisfactory in quanity for a residential well but not a municipal water well. A second test site has been selected, drilling to begin within a week. Expansion of Supervisor Pierce advised the Board that the Town Hall update Performance bonds and signed contracts of those contractors involved in the Town Hall expansion have been submitted to the Supervisors.offices.A meeting will be held among the contractors, architect, and Supervisor Pierce, prior to the construction start on July 28, 1986. Completion of the project will require approximatly 120 c.alender days. Public response to the Town Hall expansion has been favorable. r Wednesday, July 16, 1986 Page 4 RESOLUTION #155 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #299-317 45619.34 Highway 135-153 23:838.90 Water 81-85 1012.18 Sewer 34-38 5:658.71 A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to recess the regular meeting and convene to an executive session, on a personnel problem. All voting aye, the motion was carried. The following information was received from the Supervisors office. Payment of Vouchers A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to adjourn the executive session and reconvene the regular meeting. All voting aye, the motion was carried. RESOLUTION AUTHORIZE SALARY INCREASE - BRUCE WEBER - CODE ENFORCEMENT OFFICER Motion by Councilman Manning . Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Salary Increase Bruce Weber Zoning & Code Officer WHEREAS, a salary increase request was submitted during the executive, session of this Town Board meeting by Code Enforcement Officer, Bruce Weber, and WHEREAS, the Town Board has reviewed this request, taking into consideration the duties of the position, therefore BE IT RESOLVED, that a salary increase shall be granted to Bruce Weber from $15,000.00 to $20,000.00 annually, upon the completion of the probationary six month period in the position of Code Enforcement Officer, in compliance with the personnel policy of the Town of Cortlandville. A motion was made by Councilman Manning, seconded by Councilman Thorpe, to adjourn the regular meeting. All voting aye, the motion was carried.
