Members present: Supervisor Melvin Pierce Councilman Edwin O`Donnell Councilman Ronal Rocco . Deputy Town Clerk Beth O'Gorman absent: Councilman Warren Manning Councilman Raymond Thorpe Town Clerk Pauline Parker Others present were Highway Superintendent, Carl Bush; Zoning and Code Enforcement Officer, Bruce Weber; Cortland- ville Recreation Director, Ken Andrews; Newsreporter, Kevin Conlon, and town resident, Dick Crozier. The meeting was called to order by Supervisor Pierce a. 5:00 p.m. He requested that all those in attendence rise and pledge allegience to the flag. RESOLUTION .,#125 AUTHORIZE PAYMENT OF VOUCHERS Payment of Vouchers Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, that thQ voucher submitted have been audited and shall be Daid as follows: General Fund Vouchers #198-224 22,461.84 Highway 83--99 7,361.67 Water 55- 59 2,317.36 Sewer 22- 26 593.41 RESOLUTION j#126 AUTHORIZE HIGHWAY SUPERINTENDENT Auth. Hwy. Supt. TO ATTEND HIGHWAY SCHOOL AT Attend Hwy. CORNELL UNIVERSITY School at Cornell Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, that Carl Bush is hereby authorized to attend the 1986 Highway School at Cornell University in June, and RESOLVED, that the expenses incurred by same be reimbursed sr.b j e ct to audit by the Town Board A motion was made by Councilman O'Donnell, seconded Hoxie Gorge by Councilman Rocco, to receive and file the letter sent Development to Mayo Snyder, Director of the Cortland County Planning Department, from George McDermott, Chairman, Hoxie Gorge Committee on behalf of the State U-niversity of New York College and Cortland, All voting aye, the motion was carried. Wednesday, May 21, 1986 Page 2 The letter restated the position of S.U.N.Y. Cortland on the Hoxie Gore nature preserve and field study site. Any development in this area could a.dTfersely affect numerous academic programs.at the college, as well as detract from the aesthetics and quietude of the area. Hillside Drive A motion was made by Councilman O'Donnell, seconded Meadow Lane by Councilman Rocco, to receive and file the letter and Letter & petition from Attorney John Fitzgerald. All voting aye, Petition the motion was carried. The letter and petition related to the Hillside Drive and Meadows Lane areas. Paving of both streets • was requested and other zoning related complaints were submitted. A discussion was held, whereby it was the consensus of the Board that Supervisor Pierce respond to Mr. Fitzgerald advising him of the Highway Departments road repair schedules, and provide current information on the other complaints mentioned. Laura Smith A motion was made by Councilman O'Donnell, seconded Sewer hookup by Councilman Rocco, to receive and file the letter from request Mrs. Laura Smith requesting sewer service to her lot on Halstead Road. All voting aye, the motion was carried: A'discussion was held whereby it was the consensus of the Board that Supervisor Pierce direct a letter to Mrs. Smith advising her that sewer service is not planned for this area in the near future. Halstead Road was paved in 1985, and the resulting construction costs would be very high. Amend Res. #123RESOLUTION #127 AUTHORIZATION TO AMEND RESOLUTION #123 Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS an error was made in Resolution No. 12.3, adopted May 7, 1986, in the writing of the minutes, therefore BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to correct Resolution #123 to read Authorize the Supervisor to Purchase Lawn Mower- Water Department", to be paid from F8310.2. Supervisor Pierce advised the Board that he has recieved the proposals for the new well -site property west of the Luker Road. Supervisor Pierce offered the floor.to those in attendence. Transient Retail Zoning and Code Enforcement Officer,Bruce Weber, Business provided the Board with information relating to proposed Ordinance amendments to the transient retail business ordinance. He would like to incorporate this into the Cortlandville Zoning Law. He requested tYa t the Board review this information; prepare comments and questions, and take action at, the next regular meeting, June 4, 1986. Councilman 0.'Donnell requested a clarification of how the transient business permit applies to the sale Wednesday, May 21, 1986 Page 3 of fresh fruit and vegetables. Mr. Weber responded Fresh Produce Sale that sales of produce off the peroperty, where grown, relating to Zoning would fall under, -the new transient business amendment.. Town resident, Ken Andrews, asked what zoning restrict. ions were applicable to Christinas_' Produce located on Tompkins Street. Traffic hazards caused by a lack of parking and sanitation were among his main concerns. Mr. Weber responded that the business was established under the old zoning law. The current zoning law can- not now be enforced causing a hardship for the business, ® as it is"grandfathered in".as a result of pre?-ious operation and the fact that the trailer was not removed from the site while closed for the winter season. The area is zoned for business purposes. RESOLUTION #128 AUTHORIZE HIGHWAY SUPERINTENDENT TO CONSIDER QUALIFICATION OVER RESIDENCY IN HIRING Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED Auth. Hwy. Supt. Consider Qualificat- ions over residency in Tzi ring emps . BE IT RESOLVED, that authorization is hereby granted to Highway Superintendent, Carl Bush, to use his own discretion in hiring employees. Based on their qualifications, town residents will have first preference, and giving residents outside the town second consideration. Supervisor Pierce advised the Board that Town Historian, Alice Blatchley, has had a change of residence and no longer has the storage space for historical papers and memorabilia relating to the Town of Cortlandville. Supervisor Pierce stated that he is open to ideas and suggestions on how to alleviate this situation. Supervisor Pierce advised the Board that plans for the Town Hall expansion and improvements are on schedule. Next month they will go out to bid. Contracts will be awarded for various aspects of construction, including masonary, electrical, and plumbing. Ken Andrews, Cortlandville Recreation Director, advised the Board of the financial operation of the Cortlandville Park. He stated that town residents are not charged for use of the Cortlandville Park as the park is funded by the public. Residents of the town can also utilize City of Cortland facilities at no expense. To reimburse the city for this privelege $3,200.00 is paid to the city, off" which $1,600.00 ® is reimbursed by the New York State Division of Youth. Town baseball fields are also made available to city residents, at no charge, at the towns convenience. The city does their own grounds maintenance for scheduled games. On occasion, city staff has assisted town staff with planned activities. As a result of this interaction, facilities and services are not duplicated at residents expense and the needs of youth are addressed. Ken Andrews Fiscal Operation of Park :e � %-" Wednesday, May 21, 1986 Page 4 It was the consensus of -the Town Board that this type of operation of the'park is in the best interest of'residents and youth. Any comments from privatly owned recreation facilities are welcomed -in the future, however the Board.stands'behind this decision. There being no further business, a motion was made by Councilman 0 Donnell, seconded by Councilman Rocco, to adjourn the meeting. All voting ayo, the motion was carried.
