PUBLIC HEARING PROPOSED USE OF FEDERAL REVENUE SHARING FUNDS A Public Hearing was held�at the Town of Cortlandville Town Hall, 15 Terrace Road, Cortland, New York, at 7:45 P.M. concerning the proposed use of Federal Revenue Sharing Funds to be received in 1986. Parker Others present were Attorney, Phillip Rumsey; High- way Sup't.,_Carl Bush; Assessor, David Briggs; News - reporter, Michele Catz and several town residents. _The Public Hearing was opened by Supervisor Nadolski at 7:45 P.M. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDV'ILLE NOTICE OF PUBLIC HEARING FEDERALREVENUE SHARING LAW Please take notice, that a Public Hearing will be held before the Supervisor of the Town of Cortlandville dur- ing a regular meeting of the Town Board of the Town of Cortlandville at the Town Hall, 15 Terrace Road, Town of Cortlandville, New York on November 6, 1985 at 7:45 p.m. to consider the proposed use of Federal Revenue Sharing funds to be received by.the Town of, Cortlandville during the' next fiscal year comment-' ing January 1, 1986. The amount of Federal Revenue Sharing funds the Town of Cortlandville anticipates receiving during said fiscal year is approximately $43,000.00. The proposed use of said Federal Revenue Sharing• funds is for highway repair and recreation. Residents of the Town of Cortlandville have the right to present at said Public Hearing their written and oral comments on the pro- posed use of Federal Revenue Sharing funds. The amount of unobligated entitlement funds in the Federal Revenue Sharing Trust fund of the Town of Cortlandville is$NONE. Recreation Chairman, Ken Andrews, stated that they will be installing basketball courts next year with the funds received for Recreation. PUBLIC HEARING 1986 PRELIMINARY BUDGET A Public Hearing was held at the Town of Cortlandville Town Hall, at 15 Terrace Road, Cortland, New York, at 8:OOp.m. concerning the preliminary budget for 1986. Members present: Supervisor Stanley Nadolski Councilman Edwin O'Donnell Councilman Warren Manning Councilman Melvin Pierce Councilman Ray Thorpe Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; High- way Sup't., Carl Bush; Assessor, David Briggs; Justice, Mardis Kelsen; Newsreporter, Michele Catz and several town residents. The Public Hearing was opened by Supervisor Nadolski at 8:00 p.m. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE NOTICE OF PUBLIC HEARINGON. Dated: Octdbe r 31,1985 PAULINE H. PARKER, Clerk Town of Cortlandville 15 Terrace Road Cortland, New York, 13045 258-1t Supervisor Nadolski offered the floor to those in attendence. Justice elect, Mardis Kelsen, asked for an explaination why the justice's salary for 1986 was not included in the legal notice. It was explained to her that the legal notice reads Town Board salaries, and due to a change in law, a town justice is no longer a member of a town board. The justice's salary, as an elected offical, does appear on the last page of the budget as required by law. Town Clerk, Pauline Parker, asked the Board to pass a resolution granting her a salary increase for 1987- She presented the Board with a copy of her 1986 request which asked for a salary increase for the two years of her term - 1986 and 1987. She also presented a sample resolution adopted by the County of the proce- dure done by them for their full time elected officals. This needs to be done at the time of election. No comments were made. 12 C � Wednesday, November 6, 1985 Page 2 Peg Petri, Rt. #11 McGraw, compared the salaries and responsibilities of Pauline Parker as Town Clerk to those of county employees. They receive 5-5-21% annutal._salary increases. She thought that Mrs. Parkers request deserved consideration. Ken Andrews, Lamont Circle, asked why the budget spread sheet for the Fire Department was not included in the. Preliminary 1986 Budget. Supervisor Nadolski responded that the Town Board has no influence on the Fire Department, its budget or the inclusion of said budget spread sheet. Mr. Andrews stated that the Fire Department Budget should be included in the budget packet for informational purposes, as they are accountable to the tax payers. Ken Andrews, Lamont Circle, also inquired if the tax levy as quoted in the Cortland Standard was based on the new assessments with the veterans exemption included. Assessor, David Briggs responded that it does include all applicable exemptions including the veterans exempti.Dns. He reminded everyone that the Town of Cortlandville opted out in regards to the veterans exemptions. REGULAR MEETING The regular meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Nadolski presiding. Members present: Supervisor Stanley Nadolski Councilman Edwin O'Donnell Councilman Warren Manning Councilman Melvin Pierce Councilman Ray Thorpe Town Clerk Pau line Parker Others present were Attorney, Phillip Rumsey; High- way Sup't., Carl Bush; Assessor, David Briggs; News - reporter, Michele Catz and Town residents Ken Andrews, Patricia Casey and SeymourParker and other town residents for the hearings. Supervisor Nadolski called the meeting to order at 7:30 P.M. Supervisor Nadolski announced that the public hearing scheduled for 7:30 p.m. concerning a sewer capital reserve fund would not be held, but would be rescheduled. Councilman Manning made Councilman Pierce, to approve a motion, seconded by the minutes of October 2, approve 1985 and October 21, 1985, as written. All voting aye, minutes the motion was carried. Councilman Thorpe made a motion, seconded by Ping. Bd. Councilman Pierce, to receive and file the Cortlandville minutes Planning Board minutes of October 29, 1985. All voting aye, the motion was carried. Supervisor Nadolski allowed those in attendence the privilege of the floor. No comments were made. Councilman Pierce made a motion, seconded by Councilman Manning,to receive and file Justice Fowlers report for September 1985. All voting aye, the motion was carried. Councilman Pierce made a motion, seconded by Councilman Manning, to receive and file the Annual Recreation Report submitted by Ken Andrews, Recreation Director. All voting aye, the motion was carried. Ken Andrews reported increased activity at the park this year. All voting aye, the motion was carried. Supervisor Nadolski reported that the commission is still considering the request from B.O.C.E.S. -to install another line. Reports of various departments are on the table for review, and are available upon request in the Clerk's office. Councilman Pierce made a motion,,seconded by status Councilman O'Donnell,to receive and file the status Freon gas report from John H. Larkin, Clerk of the Cortland incident County Self Insurance Program. All voting aye, the motion was carried. The report advised to date the cost of the September 9, 1985,freon gas exposure incident. Councilman Pierce made a motion, seconded by Councilman O'Donnell,to receive and file a memorandum from Assemblyman Rappleyea. RESOLUTION #187 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED payment BE IT RESOLVED that the vouchers submitted have,baen of vouchers audited and shall be paid as follows: General Fund Vouchers #457 - 495 $34,265.56 Highway 222 - 241 54,671.31 Water Fund 124 - 130 2,605.84 Sewer Fund 65 - 72 50,270.69 Councilman Manning made a motion, seconded by Sewer Councilman Thorpe, to receive and file information Improvement received from the Cortland County Planning Department Project regarding our sewer improvement project at the inter- Rte #281 section of Route 281 and Groton Avenue. All voting aye the motion was carried. 1 • 1 is 1 L F I Wednesday, November 6, 1985 Included was the resolution County Planning Board approving sewer expansion at Route 281 and Page 3 adopted by the Cortland our application for a Groton Avenue. A call was received from the main office of Mr. Donut in Minneapolis, requesting water and sewer service at their Cortland location for the future. This concern stems from the state road improvement project, which will take road frontage on Route 281 from their business. A discussion followed, whereby it was the concensus of the Town Board that our town engineer should contact the businesses in that area and make a feasibility study of both water and sewer service of that area. Councilman Pierce made a motion, seconded by Councilman Thorpe, to recess the regular meeting to hold a Public Hearing on Federal Revenue Sharing Funds. All voting aye, the motion was carried. Refer to page 126. Councilman Manning made a motion, seconded by Councilman Pierce,to reconvene the regular meeting. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Thorpe, to receive and file the letter from William Clem_gn,s, Chairman of the Cortlandville Planning Board, concerning a noise ordinance. All voting aye, the motion was carried. A discussion followed, whereby it was the concensus of the Town Board that past experiences have proven that a noise ordinance would be very difficult to enforce. Examples were cited whereby contacting law enforcement agencies has been sufficient. No action was taken. Councilman Pierce made a motion, seconded by Councilman Thorpe, to recess the regular meeting to hold a Public Hearing concerning the 1986 Preliminary Budget. All voting aye, the motion was carried. Refer to page 127. Councilman Thorpe made a motion, seconded by Councilman Pierce, to reconvene the regular meeting. All voting aye, the motion was carried. RESOLUTION ##188 APPOINT KENNETH ANDREWS TO CORTLAND COUNTY YOUTH BOARD - THREE YEAR TERM Motion by. RESOLUTION #189 AUTHORIZE PAYMENT'FOR HOLIDAY ON ICE PROGRAM Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Holiday On WHEREAS during the past several years the town has Ice program contributed to the "Holiday on Ice" program to allow town residents to participate in this program, there- fore BE IT RESOLVED that the Supervisor is hereby authorized and directed to forward $200.00 to the Cortland Youth Bureau for sponsorship of the "Holiday on Ice" program. Councilman Manning made a motion, seconded by N.Y. Telephone Councilman O'Donnell, to receive and file the petition assessment of the Special Franchise Assessment for 1985 from New York Telephone. All voting aye, the motion was carried. RESOLUTION #190 AUTHORIZE ISSUANCE OF A TRAILER PERMIT TO LEWIS AND LIDA GENSON Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED trailer WHEREAS an application for a house trailer permit has permit been received and has been acknowledged by the L. Genson Assessor, therefore BE IT RESOLVED that the Town Clerk is hereby authorized and directed to issue a house trailer permit to Lewis and Lida Genson, upon payment of the proper fee. Said trailer to be located on West Blodgett Mills Road, R.D. #1, Cortland, New York, in the town of Cortlandville. RESOLUTION #191 ACCEPTANCE OF WILLIAM B. CLEMENS RESIGNATION-CORTLANDVILLE PLANNING BOARD Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED resignation WHEREAS the term of William B. Clemens many years of dedicated service. RESOLUTION #193 REQUEST COUNTY LEGISLATURE TO APPLY SURPLUS SALES AND USE TAX TO REDUCE COUNTY TAX LEVY , IN AREAS OUTSIDE VILLAGES FOR 1986. Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, pursuant to Resolution No. 118 adopted at a Special Meeting of this Board held on August 29, 1978, the Town of Cortlandville elected to have its proportionate share of the Cortland County Sales and Use Tax which is due the area of the Town outside of Villages to pay in cash directly to the Town to be used for any legal Town, outside village purposes and WHEREAS, pursuant to the Towns election referred to herein, the amount of Sales Tax to be received by the Town of Cortlandville will exceed the amount necessary to fund the portion of the Budget attributable to areas outside Villages, and WHEREAS, there will therefore be surplus of Sales Tax availible and which this Board desires to be credited against the County Tax in the area of t1le Town outside of Villages, and WHEREAS, the surplus referred to herein will be in the amount of $587,000.00. A discussion was held by the Town Board relating to the salary increase request of the Town Clerk. salary Councilman O'Donnell stated that he felt that the increase clerks salary increase for 1987 should be taken care of elected next year, when the budget for 1987 is being prepared. officials He also suggested that when next years workshop sessions occur, the Board and the Budget Officer should include elected officals and/or department heads. Comments made by other board members expressed concern of the budget process. The action taken will apply to all elected officals not just the clerk position, thus using the example of the adopted county resolution. Attorney Rumsey referred to the Section in Town Law which applies to elected officials of town government. This same ruling does not apply to county elected officials. He will research this matter further and will furnish an opinion to the board before the November 18, 1985 Special Meeting. RESOLUTION #195 ADOPTING THE TENTATIVE BUDGETS AS THE PRELIMINARY BUDGETS FOR 1986 Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED adopt 1986 WHEREAS, the tentative budgets of the Town, including Preliminary $43,000.00 of the estimated Federal Revenue Sharing Funds, Budget and Water Fund, Sewer Fund and Fire District for the year 1986, were presented by the -Town Clerk, to the Town Board at a reguler meeting held, October 2, 1985, and WHEREAS, the Town Board has reviewed said tentative budgets and has made such.changes, alterations and revisions as it considers advisable and are consistent with the law; THEREFORE BE IT RESOLVED that the tentative budget for the Town of Cortlandville,. as modified, be, and the same hereby is, approved and adopted as the preliminary budget of the Town of Cortlandville for the fiscal year beginning January 1, 1986, and BE IT FURTHER RESOLVED, that the tentative budget for the Water Fund, as modified, be, and the same hereby is, approved and adopted as a preliminary budget of the Water Fund for the fiscal year commencing January 1, 1986, and 1 • 1 1 Page 7 1 0 Wednesday, November 6, 1985 BE IT FURTHER RESOLVED, that the tentative budget for the Sewer Fund, as modified, be, and the same hereby is, approved and adopted as a Sewer Fund for the fiscal 1986, and preliminary budget of the year commencing January 1, BE IT FURTHER RESOLVED, that the tentative budget for the Cortlandville Fire District, as received, be, and the same hereby is, approved and adopted as a preliminary budget of the Cortlandville Fire District for the fiscal year commencing Januaay 1, 1986. Councilman Thorpe expressed his concern on the problem of underground gasoline storage tanks polluting area ground water supplies in the future. Assessor, David Briggs, responded that the New York State Fire Prevention and Building Code states that if any station is vacant for more than two years, the tanks must be removed or filled. Enforcement of this code falls under the jurisdiction of the County Health Department. No further comments were made. There being no further business, Councilman Manning made a motion, seconded by Councilman O'Donnell, to adjourn the meeting. All voting aye, the motion was carried.
