PUBLIC HEARING LOCAL LAW NO. 3 FOR 1985 A Public Hearing was held at the Town Hall, Town of Cortlandville, at 7:30 p.m. concerning proposed Local Law No. 3 for 1985,providing for the appointment instead of election of the Superintendent of Highways of the Town of Cortlandville. Members present: Supervisor Stanley Nadolski Councilman Edwin O'Donnell Councilman Warren Manning Councilman Melvin Pierce Councilman Ray Thorpe Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; Deputy Town Cler,,;,Barbara Falso; Confidential Sec'y., Edna Puzo; Highway Sup't., Carl Bush; Justice, Mary Fowler; Legislator, Fred Compagni; Newsreporter, Garry VanGorder; and Town residents, Ken Andrews, Robert Moore and Ronal Rocco. The Public Hearing was opened by Supervisor Nadolski at 7:30 p.m.. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE LOCAL LAW NO.3 for 1985 Notice is hereby given that a public hearing will be held before the Supervisor hnd the Town Board of the Town of Cortlandville, Cort- land County, New York at the Town Hall, 15 Terrace Road, Town of Cortland- ville, New York on August 7, 1985 at 7:30 o'clock p.m. concerning proposed Local Law No. 3 for the year 1985, providing for the appoint- ment instead of election of the Superintendent of High- ways of the Town of Cort- landville. The Town Board has decided to submit this to the! electors of the Town again. They plan to better inform the residents thru news media etc. this year. This action is subject to mandatory referundum. The new law, if passed, would allow the Town Board to select a fully -qualified person to run the highway dep't. rather than to leave it to the political process. The Highway Dep't. accounts for more than 50% of the towns entire budget and the Town Board has no other control of the highway dep't. Robert Moore asked if this job would be classified as civil service. Supervisor Nadolski responded. that it could be or the job description could be written- as such that it would not come under civil service. Concern was expressed regarding the duplication of I • 1 r: Wednesday, August 7, 1985 Public Hearing services between the County and Towns. It could save the taxpayers money if working arrangements could be made. There is a large investment of monies for equipment alone. There being no further comments or questions, Councilman Manning made a motion, seconded by Councilman Pierce, to adjourn the public hearing. The Regular meeting was called to order by Supervisor Nadolski at 7:45 p.m. Councilman Thorpe made a motion, seconded by Council- man O'Donnell to receive and file the Planning Board minutes of July 30, 1985. All voting aye, the motion was carried. RESOLUTION # 142 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED audit of BE IT RESOLVED that the vouchers submitted have been vouchers audited by the Town Board and shall be paid as follows: General Fund Vouchers #307 - 345 $38,292.76 Highway Fund #160 - 184 11,441.78 Water Fund # 99 - 106 137,522•98 Sewer Fund # 39 - 45 37,608.36 Supervisor Nadolski allowed those in attendance the privilege of the floor. Legislator, Fred Compagni, requested the Town Board tour county to arrange a tour of the county jail and forward their jail opinion of such to the County Legislature. They want our input as to which alternative route would be best - to renovate or new construction of the county jail„ He also requested that they review the facts and figures, which have been presented, and judge for themselves. The Town Board set a date for Wednesday, August 14, 1985 at 8:30 a.m. to tour the county jail. Supervisor Nadolski the Town Board that Sherry Cable TV Tillema., manager df Sammons Cable TV, had requested to be placed on the agenda but could not attend. Our representative, Jack Buttino, has been very active on this commission and has faithfully reported their activities to us. • I I) �D Wednesday, August 7, 1985 page 2 RESOLUTION # 143 ADOPT LOCAL LAW NO. 3 OF 1985 - PROVIDING FOR THE APPOINTMENT OF INSTEAD OF ELECTION OF THE aUP�T OF HIGHWAYS OF THE TOWN OF V VILLE Motion by Councilman -Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT ENACTED by the Town Board of the Town of Cortland- ville as follows: ® SECTION 1. The elective office of Superintendent of Highways of the Town of Cortlandville is hereby abolished and a Superintendent of Highways for the Town of Cortland- ville shall hereafter be appointed by the Cortlandville Town Board. SECTION 2. This local law shall supersede in its application to the Town of Cortlandville paragraph (b) of subdivision one of Section Twenty of the Town Law with respect to the mode of selection of the Superintendent of Highways in the Town of Cortlandville. Ado pt Local Law No. 3 SECTION 3. This local law shall take effect immediately upon filing with the Secretary of State and after approval by a majority of the electors voting thereon in accordance with the requirements of Section Twenty-three of the Municipal Home Rule Law. Supervisor Nadolski reviewed the May and June monthly reports of Justice Mary Fowler with the Town Board. Compliments were made to Justice Fowler. A discussion was held relating to the results of the dog enumeration recently completed and the effects of it. Councilman Manning reported that he has received complaints -concerning a new resident located on Rte #281 that has a dog kennel. This has created a neighborhood nuisance. Supervisor Nadolski advised that this complaint has been referred to the zoning officer. Councilman Manning made a motion, seconded by Councilman O'Donnell, to receive and file the June and July Cable TV Commission reports. All voting aye, the motion was carried. The reports of various department heads are on the table for review and may be seen upon request. at the Clerk's office, Councilman Manning made a motion, seconded by Councilman O'Donnell, to receive and file the report regarding the first Defensive Driving Course class. All voting aye, the motion was carried. Instructor, Howard king, reported that there were 13 applicants. All voting aye, Supervisor Nadolski stated that our cost of insurance coverage for this year is expected to increase by 30%. Attorney Rumsey stated that the State Legislature is considering action to assist municipalities of this dilema. Councilman O'Donnell made a motion, seconded by Cortland Councilman Thorpe, to receive and file the letter written FreeLibrary by Councilman Manning to Mr. Warren Eddy, Library Director of the Cortland Free Library. All voting aye, -the motion was carried. Town resident, Ronal Rocco, encouraged the Town to respond to the financial needs of the library. Youth of today are receiving encouragement in schools toward better reading habits, and they are responding. More and more town residents are taking advantage of the services offered by the 'Cortland Free Library. Any mone-y spent there is for the best interest of the towns future. RESOLUTION # 144 RECEIVE DENIAL OF GRANT - A:PPLICATION FOR SINGLE PURPOSE SMALL CITIES BLOCK GRANT PROGRAM Motion by Councilman Manning Seconded by Councilman Thorpe Denial VOTES: ALL AYE ADOPTED HudGrant WHEREAS the town submitted an application for a grant Economic to assist businesses with Economic Development :Loans, Loans therefore BE IT RESOLVED that the Town Board does hereby .acknowledge receiving the denial of the application for Single Purpose Fiscal Year 1985 Small Cities Community Development Block Grant Program, Project Number B-85—DH-36-0097 Councilman Pierce made a motion, seconded by election Councilman O'Donnell, to receive and file the letter receeved inspectors from George Palmer of the NYS Board of Elections. All fees or voting aye, the motion was carried. salaries The letter advised that the State Comptroller has received an opinion from the U.S. Internal Revenue Service that payments to election inspectors are in the nature of fees and not salaries, therefore not subject to withholding taxes, or W-2 forms unless payment is more that $600 in a calendar year. Councilman Manning made a motion, seconded by safety Councilman O'Donnell; to receive and file correspondence devices received from County Safety Officer, John Larkin. Cortland Their bank held a clambake for their employees at our Savings Park and was enjoyed by all. Also accompanying the letter Bank - was a donation to the park. Both were given to recreation park for chairman, Ken Andrews. clambake Pleasure was expressed by the Town Board. Town resident, Ron Rocco expressed gratitude to John Pilato for doing a fine job as our recreation ® director for this year. Supervisor Nadolski congratulated town resident, Service Ken Andrews for having been chosen the Syracuse area Award winner of the Community Service Recognition Award sponsored KenAndrews by the{Postal Service. He is now a candidate for the Eastern Regional Award, which will be presented in Washington. Councilman O'Donnell made a motion, seconded by Dep't. of Councilman Thorpe, to receive and file the information State received from NYS Dept. of State. All voting aye, the Local Law motion was carried. No. 2 The State Dept. has received our Local Law No. 2 for year 1985 providing for written notification of defects and obstructions on town highways and sidewalks in the Town of Cortlandville. Councilman O'Donnell made a motion, seconded by 1985-86 Councilman Thorpe, to receive and file the list of newly election appointed election inspectors for the Town. They will inspectors serve from July 15, 1985 to July 14, 1986. All voting aye, the motion was carried. RESOLUTION # 145 RESCIND RESOLUTION #93 ADOPTED MAY 1985 - UNDERGROUND FACILITIES Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that Town Board Resolution #93, adopted rescind by this Town Board regarding the Underground Facilities underground Protective Organization Program is hereby rescinded facilities resolution Councilman O'Donnell made a motion, seconded by Councilman Pierce, to receive and file the information 1986 regarding the Cortland County Self Insurance 1986 budget. Insurance RESOLUTION #146 AUTHORIZE McGRAW CENTRAL SCHOOL TO USE VOTING MACHINE Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the McGraw Central School District McGraw is hereby authorized to use the towns voting machine voting for their special election to be held on August 20,1985. machine 98 vehicle inspection agent Wednesday, August 7, 1985 Page 5 RESOLUTION # 147 AUTHORIZE TOWN HIGHWAY DEPT. TO PROCEED AS VEHICLE IWECTION AGENT Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED - WHEREAS the highway Dep't. has many vehicles which need annual inspections and this process has become very costly, and WHEREAS the extra equipment needed to accomplish this would offset the cost of inspections, therefore, BE IT RESOLVED that the Highway Sup't. is hereby authorized to proceed as necessary as a vehicle inspection agent. A discussion was held concerning the speed limits speed limits established by the State for short streets and/or town Tn roads & roads that go nowhere, such as Lamont Circle. Town streets residents are continually contacting the Supervisor and Highway Sup't. wanting the,speed limits lowered. We have sent many requests through the legal process, but usually they are not honored. The Supervisor and Councilman will attempt to discuss this matter with Assemblyman Rappleyea the next time he is in town. RESOLUTION# 148 AUTHORIZE PAY INCREASE TO HIGHWAY EMPLOYEE - DENNIS BILODEAU Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED pay increase BE IT RESOLVED that Dennis Bilodeau, an employee of the D. Bilodeau highway Dep't. is hereby granted a salary increase, effective immediately. RESOLUTION # 149 AMEND TOWN PERSONNEL POLICY Motion by Councilman Thorpe Seconded by Councilman Manning amend town VOTES: ALL AYE ADOPTED personnel BE IT RESOLVED that the Town Personnel Policy is hereby policy amended as follows: ADD: the provisionary period may be shortened for exceptional cases, upon recommendation of the Department Head, and approval by the Towh Board. Councilman O'Donnell made a motion, seconded by Councilman Manning, to recess the -regular meeting and convene to an executive session to discuss a matter of litigation. RESOLUTION # 150 AUTHORIZE ENGINEER TO DESIGN A SALT STORAGE BUILDING Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Engineer is hereby authorized to design plans for a salt storage building and submit the proposal, including costs, to the Town Board.
