The regular meeting of the Town of Cortlandville, Town Board was held at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding. Members present: Supervisor Councilman Stanley Nadolski Warren Manning Councilman Edwin O'Donnell Councilman Ray Thorpe Councilman Melvin Pierce Town Clerk Pauline Parker n LJ Others present were Attorney Phillip Rumsey; Deputy Town Clerk, June Bradshaw; Assessor, David Briggs; High- way Sup't., Carl Bush, Jr.; Justice, Donald Eaton and Newsreporter Brian Newman. Also present were town residents Lorna A. Sertoli and her neighbors; Ken Andrews and Richard Tupper. Supervisor Nadolski opened the meeting at 7:35 P.M. following the public hearing relating to Local Law ,a# 1 of 1985 providing for the administration and enforcement of the Uniform Fire Prevention and Building Code. Councilman Manning made a motion, seconded by Council- man Pierce to approve the minutes of January 2, 1985 and approve January 21, 1985, as written. The motion was carried with minutes all voting aye;with the exception of Councilman Thorpe. He abstained as he was not in attendance at the meetings. Councilman Pierce made a motion, seconded by Council- man O'Donnell, to receive and file the Cortlandville Planning planning Board minutes of January 29, 1985. All voting aye, the Bd.Minutes motion was carried. Councilman Manning made a motion, seconded by Council- ZBA man O'Donnell, to receive and file the Cortlandville ZBA minutes minutes of December 11, 1984. All voting aye, the motion was carried. Lorna Sertoli Mrs. Lorna Sertoli, 66 Delaware Ave., Cortland, New York, Deleware Ave. requested assistance from the Town Board, if possible, to put a stop to cars being parked in the street near her residence. Many times she cannot get in or out; of either driveway at her residence. Both customers and employees of Gary's Automative are illegally parking their cars there. A letter of January 31, 1985, widtten by Mrs. Sertoli, was read, which fully explained the problem. Gary's Automative has recently purchased a small strip of land next to Mrs. Sertoli with the intent to park cars there. Is this permissable? This would need t_o be referred to the Cortlandville ZBA for their determination. A discussion followed regarding parking on a public highway, the zoning requirements of the area and our high- way department plowing the snow. Councilman Manning made a motion, seconded by Council- man Thorpe, to receive and file the letter from Mrs. Sertoli. All voting aye, the motion was carried. All voting aye, the motion was carried. Supervisor Nadolski apprised the Town Board that the Town Clerk has just received the dog enumeration list. The number of ddgs, estimated 1,000, is about the same as the number of dogs licensed last year. Reports of various departments are on the table for review, or are availabe upon request in the clerks office. Councilman Thorpe made a motion, seconded by Council- flooding man Pierce, to receive and file correspondence relating Blodgett to the flooding problem at the creek in Blodgett Mills. There are no state funds available to correct the problem, but they have advised the property owners of the proper way to correct it. Councilman O'Donnell made a motion, seconded by Council- abandonmen man Pierce, to receive and file the letters received from denied the County Highway Sup't. regarding the abandonment of HoxieGorge Hoxie Gorge Road and Kinney Hill Road. All voting aye; the KinneyHill motion was carried. Public Hearings were held by the County on September 26, 1984. Those in attendance gave reasons for not wanting the town to abandon the roads. RESOLUTION # 43 APPOINT DELEGATE TO ASSOCIATION OF TOWNS ANNUAL MEETING Motion by Councilman O'Donnell Seconded by Councilman Thorpe VOTES_-W ALL AYE ADOPTED Assn. of Towns BE IT RESOLVED that court clerk, Mardis F. Kelsen, is delegate hereby appointed as delegate to represent the Town of Cortlandville at the Association of Towns 1985 Annual Meeting, to be held in New York City February 17th 20th, 1985. RESOLUUION # 50 ADOPT LOCAL LAW NO. 1 OF THE YEAR 1985 Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED adopt Local WHEREAS LOCAL LAW NO. 1 of the year 1985, providing for Law #1 of 1985 the administration and enforcement of the uniform fire prevention and building code, was introduced at the January 21, 1985 meeting of the Town Board, and WHEREAS, said Local Law has been, in its final form, upon the desks of the members of this board at least seven days, exclusive of Sunday, prior to this date, and WHEREAS, a public hearing thereon, has been held before this Town Board, after publication of notice thereof, as required by law, now therefore BE IT RESOLVED that Local Law No. 1 of the year of 1985 is hereby adopted and enacted by the Town Board of the Town of Cortlandville as follows: Wednesday, February 6, 1985 Page 9 SECTION I. Definitions. (a) The words and terms used in this local law shall have the same meaning as those contained in Executive Law, Article 18 as added by Chapter 707 of the Laws of 1981, unless the context may otherwise require. (b) "Enforcement official" shall mean the Town of Cortlandville Code Enforcement Officer and/or any other ® designated person or firm authorized and empowered to administer and enforce the Uniform Code in the Town. SECTION 2. Permits. (a) No person, firm, corporation, association or partnership shall commence the construction, enlargement, alteration, improvement, removal or demolition of any building or structure or any portion thereof without first having obtained a permit from the enforcement officer or other designated person or firm of the Town. No such permit shall be required for necessary repairs which are not of a structural nature and do not involve abatement of a violation of the Uniform Code. (b) The form of the permit and application therefor shall be prescribed by a resolution of the town board. The application shall be signed by the owner or authorized agent of the building or work and shall contain at least the following: (1) the name and adress of the owner; (2) identification or description of the land on which the work is to be done; (3) a description of use or occupancy of the land and existing or proposed building; (4) a brief description of the proposed work; (5) estimated value of the proposed work; and (6) a statement that the work shall be performed in compliance with the Uniform Code and applic- able state and local laws, ordinances and regulations. (c) A duplicate set of plans, drawings and specificat- ions (except for demolition or removal of a building) shall accompany such application, together with a statement by a registered architect or licensed professional engineer of this state that such plans and specifications comply with the applicable provisions of the Uniform Code and local requirements, unless any such requirements are waived by the Town Board for good cause shown. SECTION 3. Fees. Fees for permits shall be established by resolution of the Town Board. SECTION 4. Building Inspections. Wednesday, February 6, 1985 Page 10 (a) The progress of work .for which a permit has been issued shall be inspected at such times and intervals as may be necessary and appropriate to determine whether the work is being performed in compliance with the Uniform Code and applicable regulations. Such inspection shall be carried out prior to enclosing or covering of the particular portion or phase of building construction, including but not limited to excavation, foundation, superstructure, elect- rical, plumbing, heating and air conditioning. ,(b) The inspection shall be made by the enforcement official or other designated person or firm. (c) It shall be the duty and responsibility of the owner or authorized agent to inform the enforcement official or other designated person or firm that the work is ready for each phase of inspection. SECTION 5. Certificate of Occupancy. (a) A building or structure for which a permit has been issued shall not be used or occupied in whole or in part until a certificate of occupancy shall have been issued by the enforcement official or other designated person or firm. Such certificate of occupancy shall be :issued when after final inspection it is determined that the construction and other work has been completed in compliance with the Uniform Code and other applicable laws, rules and regulations. (b) A temporary certificate of occupancy may be issued pending final completion of the work provided -the use or occupancy of the building shall not present a danger to any person or property. (c) A certificate of occupancy may be issued for any building or individual dwelling unit at any other time after inspection thereof by request, determination of compliance and payment of the prescribed fees. SECTION 6. Fire Prevention and Safety Inspection. (a) All dwelling units in a building consisting of more than two such units, shall be inspected for the purpose of determining compliance with safety requirements of the Uniform Code in accordance with the requirements of the Uniform Code and applicable regulations and at such frequency as may be established by resolution of the Town Board. Inspection of the common areas of such building such as halls, foyers, staircases, etc. shall be so inspected at such frequency as established by the code, regulations and resolution. Fees for such inspection may be established by Town Board resolution. F_� • Wednesday, February 6, 1985 Page 11 (b) An inspection of building or dwelling unit shall be performed at any other time upon (1) request of owner or authorized agent, (2) receipt of a written statement specify- ing ground upon which the subscriber believes a violation of the Uniform Code exists or (3) other reasonable and reliable information that such violation exists. SECTION 7. Annual Reports. The enforcement official shall annually submit a report to the town board on or before such date and containing such information as the town board shall prescribe by resolution, including but.not limited to the number and category of inspections conducted during the towns preceding fiscal year, the number of violations and abatement thereof, the number and type of permits issued, and recommendations for improving the administration and enforcement of the Uniform Code. SECTION 8. Variance and Review. A request for a variance from the Uniform Code and an appeal to review determination of or failure to render a determination by the enforcement official shall be processed with the appropriate board of review as provided in 19NYCRR 440. SECTION 9. Remedies and Penalties. In addition to the remedies prescribed by Executive Law, Sec. 382, any person, corporation, association, firm or partnership that fails -to remedy the condition found to exist in violation of the Uniform Code and this local law shall be subject to a fine of not more than $ 500.00 or imprisonment for a period not exceeding 15 days or to both such fine and imprisonment. Each violation that continues to exist beyond the date fixed in the order of the enforce- ment official to remedy the violation each day shall be deemed a separate offense. SECTION 10. A permit for installation of a solid fuel burning heating appliance, chimney and flue in any dwelling unit shall be obtained as provided in Section 2 of this local law. If the enforcement official, after inspection, determines that the installation is in compliance with the Uniform Code, he shall issue a certificate of compliance on a form to be prescribed by resolution of the town board. A violation of this section and of subdivision 5 of Section 378 of the Executive Law shall be punishable as provided in such subdivision 5.. SECTION 11. This local law shall take effect in accordance with the provisions of the Municipal Home Rule Law. Wednesday, February 6, 1985 Page 12 Supervisor Nadolski apprised the Town Board that the repairs at Chairman of the fire department has requested a donation fire station from the Town Board to fix up or repair a room located at the fire station. It is now a storage room. Supervisor Nadolski reported that he has contacted audit and control and was advised that we may not give the building to the fireman, as that belongs to the taxpayers of the Town. A discussion followed whereby it was the consensus of the Town Board that the fireman would be allowed to fix up the room at their own expense but we are not allowed to contribute to the cost. Supervisor Nadolski introduced Mr. Tom Casey, a Mr. Tom Casey representative of Sammons Communications. Sammons The franchise between Sammons Communication and the Communications Town will expire in November 1985. They are in the process of negotating with the City of Cortland's Cable Commission at the present time. Mr. Jack Buttino, our representative from the Town of Cortlandville, has also met and worked with the cable commission and himself. Mr. Casey explained the cable system that Sammons has to offer to the Town. A question and answer period followed.
