PUBLIC HEARING LOCAL LAW # 3 FOR 1984 A Public Hearing was held at the Town Hall, Town of Cortlandville at 4:30 P.M. concerning proposed Local Law # 3 for 1984, providing the Town of Cortlandville's election to provide all its eligible employees with a retirement incentive program authorized by Chapter 665, Laws of 1984. Members present: Deputy Supervisor Melvin Pierce Councilman Warren Manning Councilman Edwin O'Donnell Town Clerk Pauline Parker Absent: Supervisor Stanley Nadolski Councilman Ray Thorpe Others present were -Attorney Phillip Rumsey; Assessor, David Briggs; Zoning Officer,. Don Fowler; Highway Sup't., Carl A. Bush, Jr.; Deputy Town Clerk, June Bradshaw and newsreporter Brian Newman. The Public Hearing was opened by Deputy Supervisor Melvin Pierce at 4:30 P.M. — The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE LOCAL LAW NO.3 FOR YEAR 1984 Notice is hereby given that a public hearing will be held before the Supervisor and the Town Board of the Town of Cortlandville, Cort- land County, New York at the Town Hall, 15 terrace Road; Town of Cort- landville, New York on November 19, 1984 at 4:30 o'clock p.m. concerning proposed Local Law No. 3 for the Year 1984, providing the Town of Cortlandville's election to provide all its eligible employees with, a retirement incentive pro- gram authorized by Chapter 665, Laws of 1984. PARKER, Clerk Town of Cortlandville 15 Terrace Road Cortland, New York 13045 267-1T Deputy Supervisor, Melvin Pierce reported that a list has been received from NYS Retirement advising of those whom maybe -,eligible. The cost to the town would be offset by hiring new employees at a less wage. Attorney Rumsey reported that he has contacted the state and was advised that this program would not apply to elected officials. They could retire if they chose to, but could not take advantage of the incentive program. L' • I� • 1 Monday, November 19, 1984 Page 2 Attorney Rumsey stated that the town must designate a set period for which the employees must retire during that time to take advantage of. the incentive program. It may be from 50 to 90 days. The councilmen asked if all eligible employees had been contacted. Some had not. It was the consensus of the board that a meeting should be held to discuss the program with all eligible employees and attempt to obtain more information. Councilman.Manning stated that Don McKune worked on the program at the local college. He felt that he would answer any questions employees might have. There being no further discussion, Councilman O'Donnell made a motion, seconded by Councilman Manning, to close the public hearing. All voting aye, the motion was carried. SPECIAL MEETING A Special Meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, New York with Deputy Supervisor Melvin Pierce presiding. RESOLUTION # 216 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: audit BE IT RESOLVED that ALL AYE ADOPTED the vouchers submitted have been audited bills and shall be paid as follows: General Fund Vouchers # 466 - 519 $ 12, .�43.95 Highway #188 - 197 19,3 0. 0 Water Fund of# 163 - 164 1,501.54 Sewer Fund it# 78 - 82 6,932.12 RESOLUTION # 217 AUTHORIZE DEPUTY SUPERVISOR TO SIGN 1984 SPCA CONTRACT Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED sign 1984 BE IT RESOLVED that the Deputy Supervisor is hereby author- DCO Contract ized and directed to sign the 1984 contract for Dog Control SPCA Officer and sheltering with the SPCA. • Councilman O'Donnell made a motion, seconded by Councilman Manning to receive and file the 1984 Dog Control Contract. All voting aye, the motion was carried. pj ,7 Monday, November 19, 1984 Page 2 RESOLUTION # 218 AUTHORIZE NOTIFICATION TO COUNTY - UNPAID WATER AND SEWER CHARGES Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Board does hereby authorize submitting the list of unpaid water and sewer charges to the County and the charges shall be relevied on.the 1985 tax rolls. RESOLUTION # 219 ADOPTION OF THE TOWN OF CORTLAND- VILLE BUDGETS FOR 1985 Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED send unpaid water & sewer to County WHEREAS on the 7th day. of November 1984, the Town Board of the Town of Cortlandville, held a public hearing on the preliminary budgets, approved by the Town Board, and filed with the Town Clerk, for the fiscal year commencing January 1, 1985;.and having heard -all persons in favor of or against the preliminary budget as complied, or for or against any item _or .items �oontaine_d, therefore BE IT RESOLVED, that the preliminary budgets approved and filed, and the same hereby is adopted and established as the annual budget of this town for fiscal year beginning January 1, 1985, and such annual budget, as so adopted be entered in the minutes of the Town Board, and RESOLVED that the Town Clerk of this town shall prepare and certify, as provided by law, duplicate copies of the annual budgets hereby adopted, together with the assessment rolls for the benefit of improvement for the Water Fund and the Sewer Fund, adopted pursuant to Section 202 a of the Town Law, and within five days thereof, deliver two copies to the Supervisor of the Town, and the Supervisor shall present the copies of the annual budgets to the Legislature of Cortland County within ten days, after his receipt thereof from the Clerk. RESOLUTION # 220 TABLED DECISION ON EARLY RETIREMENT INCENTIVE PROGRAM Motion by Councilman O'Donnell Seconded by Councilman Manning adopt 1985 Budget • VOTES: ALL AYE ADOPTED WHEREAS a request has been received from employees of the Early Town to adopt an early retirement incentive program which Retirement was previously adopted by the State, and IncentiveProgram WHEREAS a list has been received from the state listing those whom may be eligible,and WHEREAS a pullic hearing was held on November 19, 1984, in accordance with the law, and Monday, November 19, 1984 1 Page 3 WHEREAS the consensus of the Town Board is that this Local Law shall be adopted by the Town, upon receiving further information from the state, therefore BE IT RESOLVED that Local Law # 3 for 1984 shall be tabled until further information is received. RESOLUTION # 221 APPROVE HIRING A HIGHWAY MECHANIC HELPER Motion by Councilman Manning Seconded by Councilman O'Donnell hire new VOTES: ALL AYE ADOPTED employee highway WHEREAS a vacancy has occurred in the Highway Department, Dept. therefore BE IT RESOLVED that the Highway Sup't. is hereby author- ized to hire Rondell Hurlbert as a mechanic's helper with a salary of $ 6.00 an hour,. starting November 26, 1984. Councilman O'Donnell made a motion, seconded by Councilman Manning to adjourn the special meeting. All voting aye, the motion was carried. The meeting adjourned at 4:50 P.M..
