PUBLIC HEARING
LOCAL LAW # 2 FOR 1984
SEWER ORDINANCE
7:30 P.M.
A Public Hearing was held at the Town Hall, Town of
Cortlandville at 7:30 P.M. concerning proposed Local Law
# 2 for 1984, providing for a Wastewater Discharge Law and
further providing for the repeal of the Town of Cortland-
ville Sewer District Ordinance enacted July 13, 1960 and
all the amendments, thereto, as of the effective date of
the new law.

Others present were Attorney, Phillip Rumsey; Justice,
Donald Eaton; Assessor, David Briggs; Deputy Town Clerk,
June Bradshaw; Zoning Officer, Don Fowler; Confidential
Sec'y., Edna Puzo and Brian Newman from the Cortland
Standard.
Also present was Kenneth Andrews.
The Public Hearing was opened by Supervisor Nadolski
at 7:30 P.M.

Supervisor Nadolski asked all board members if they
had received and reviewed the material relating to this
local law. All responded, yes.
Supervisor Nadolski apprised the Town Board that the
EPA requires that all towns that utitize the Sewer Treat-
ment Plant should adopt the Wastewater Discharge Law which
has been adopted by the City of Cortland.
This local law would also include our present sewer
ordinance.
The supervisor stated that the Town Board may pass a
resolution to set or change fees, rules or regulations
in the future. The Attorney advised that a public hearing
should be held before any changes are made. Present
sewer rates will remain the same.
A discussion was held regarding how many copies would
be needed now to be available for the public, or if a fee
would be charged. The decision will be made during the
regular meeting.
There being no further questions or comments from
-those in attendance. Councilman Manning made a motion,
seconded by Councilman Pierce to close the public hearing.
All voting aye, the motion was carried.
The hearing was closed at 7:40 P.M..

The regular meeting of the Town of Cortlandville Town
Board was held at the Town Hall, 15 Terrace Road,'Cortland,
New York with Supervisor Stanley Nadolski presiding.

to'make the Cortlandville Citizens Park a reality and a

Supervisor Nadolski allowed those in attendance the

g Mr. Kenneth Andrews was given the privilege of the
floor floor. He understood that William Porter was going to add
K. Andrews more buildings to his Plaza on Groton Ave. If this was
true could something be done about the road behind the
Groton Ave. Shopping Plaza. Supervisor Nadolski explained
that the road was privately owned and the -town couldn't do
anything about it.
It was suggested that if enough customers complained
to the store owners about the condition of the road,
maybe something would be done.
A discussion was held regarding the conditions etc.
at the Groton Ave. Plaza. Tax payments are not paid in
a timely manner, nor are the water bills.
Supervisor Nadolski reported that he recently discussed
with the Mayor of the City of Cortland the matter of billing
of water and sewer customers located in the Town but are
now using City of Cortland services. If the city billed
us in one sum, and we -billed -and collected from the customers,
we now have provisions to collect, via taxes, for bills
that are not paid. The city cannot'do this.
The matter will be reviewed further.

WHEREAS the Town.Board of the Town of Cortlandville, does
approve the request, therefore
BE IT RESOLVED that Ken Andrews is hereby authorized
to request permission from the state DOT to allow him
to maintain t'fle triangle at the intersection of Route
# 281 and Route # 13 for the future.
Supervisor Nadolski apprised the Town Board that he
was contacted by the DPW from the City of Cortland. Their
sewer cleaner needs repairs and is expected to be down
for awhile. They requested permission to borrow ours
in the case of an emergency. He told them yes bLt one of
our men would go with the machine,if needed.
A discussion followed whereby the Town Board requested
the supervisor to contact Mayor Quinlan to make arrange-
ments to adopt a mutual aid program between us.
Councilman Manning made a motion, seconded by Council-
man Thorpe to receive and file the August cable commission
report from Jack Buttino. All voting aye, the motion was
carried.
Reports of various departments are on the table or
are available, upon request, in the Clerk's office.
Supervisor Nadolski apprised the Town Board as of
January 1, 1985 Governor Cuomo signed into legislation
that the installation of wood stoves and coal -burning
stoves will require a permit and inspection.
Discussion was held regarding who will issue the
permits -and do inspections. Zoning Officer, Don Fowler,
stated that Atlantic Inland will -be issuing the permits
and making the inspections.
Councilman Pierce made a motion, seconded by Council-
man O'Donnell to table the discussion for further invest-
igation. All voting aye, the motion was carried.
Councilman Manning made a motion, seconded by
Councilman O'Donnell to receive and file the notice of
petition from New York Telephone Company. All voting
aye, the motion was carried.

Councilman O'Donnell made a motion, seconded by

Office of State Comptroller. All voting aye, the motion
was carried.
Councilman Manning made a motion, seconded by Council-
man Pierce to receive and file the Certificate of Insurance
file cert. from New York Atlantic Inland in the amount of $ 5 million.

A short discussion was held regarding a letter received
from Attorney Francis A. D.iscenza relating to unmowed
grass and weeds on Bowling Green owned.by Niederhofer.There
weeds is nothing in the Zoning ordinance to cover such a matter.
Bowling Green The owner has been contacted with no action taken. Council-
man Manning made a motion, seconded by Councilman O'Donnell
to receive and file Mr. Discenza's letter. All voting aye,
the motion was carried. •
Supervisor Nadolski stated he would answer Mr. Discenza's
letter.

A memo was read from Justice Donald Eaton advising of
new working hours for his office. The new hours are 9:00 A.M.
Justice to 5:00 P.M., subject to change at the convenience of the
new hours Department head because each girl works at court.

A letter was received from State of New York Depart- new laws
ment of Motor Vehicles Office of the Commissioner listing
new amendments to the Vehicle and Traffic Law regarding Parking lots

Councilman O'Donnell made a motion, seconded by
Councilman Manning to receive and file the letter. All
voting aye, the motion was carried.
Supervisor Nadolski apprised the Town Board that on
September 26, 1984, at 7:30 P.M: and 8:00 P.M., two (2) 2 Public
public hearings will be held in the meeting room at Town Hearings
Hall, 15 Terrace Road, Cortland, New York regarding the abandonment
qualified abandonment of Kinney Hill Road and Hoxie Gorge of roads
Road located in the Town of Cortlandville. Supervisor
Nadolski would appreciate the Councilmen attending.
Supervisor Nadolski apprised the Town Board that the
Cortland County Self -Insurance program will be increased Increase
from $ 10,000 to $ 20,000. He has met i rith John Larkin Self -Ins .
regarding this matter. Mr. Larkin explained the increase
is because almost every community has had a serious accident
or death in the volunteer fire departments, which the
program covers. Mr. Nadolski has contacted the New York
Self -Insurance program and they have all the information
regarding each employee and they will get back to him
in two weeks.

Supervisor Nadolski apprised the Town Board that
Assesor Assessor, David Briggs attended the American Institute
attend course of Real Estate Appraiser's :Course 1-B .at Dartmouth .College,
at no cost to the Town.
Karen Seibert has made a request for two sign._ to
be erected on Route # 281 at the intersection of Route
SPCA signs # 281 and McLean Road to show people where the SPCA
shelter is. After much discussion, Supervisor Nadolski will
contact Mrs. Seibert and discuss the matter further.
No action was taken.

A discussion was held regarding the lease agreement
between the Town and the Cortlandville Fire Commissioners lease agree
for the Municipal Bldg. Attorney Rumsey requested that the C'Ville Fir
matter be tabled -for further investigation. Councilman
O'Donnell made a motion, seconded by Councilman Thorpe
to table the matter for further study. All voting aye,
the motion was carried.

A discussion was held regarding the N.Y.S. Retirement
Retirement Incentive Program. Supervisor Nadolski was approached
program by one of the highway employees regarding this. The Town
Board has to pass a Local Law or Resolution following
the law of the state. Councilman Manning explained the
program. The state has to designate who is.eligible.
Councilman O'Donnell made a motion, seconded by Council-
man Thorpe to table the discussion for further study. All
voting aye, the motion was carried.
Councilman Pierce made a motion, seconded by Council-
man Manning to recess the regular meeting and convene to
recess executive session in the matter of litigation. All voting
aye, the motion was carried.

adjourn Councilman Thorpe to adjourn the executive session and
executive reconvene the regular meeting. All voting aye, the motion
