PUBLIC HEARING LOCAL LAW # 1 FOR 1984 A Public Hearing was held at the Town Hall, Town of Cortlandville at 7:30 P.M. concerning proposed Local Law # 1 for 1984, providing for the appointment instead of election of the Superintendent of Highways of the Town of Cortlandville. • Members present: Supervisor Stanley Nadolski Councilman Warren Manning Councilman Ray Thorpe Councilman Melvin Pierce Town Clerk Pauline Parker Absent: Councilman Edwin O'Donnell Others present were Attorney Phillip Rumsey; Deputy Town Clerk June Bradshaw; Assessor David Briggs; Justice, Donald Eaton; Highway Sup't., Carl Bush, Jr.; Confidential Sec'y., Edna Puzo; Legislator Del Palm; Newsreporters Michael Mittelstadt from Cortland Standard and Karen Huxtable from WKRT. Also present were town residents Ken Andrews and Ivan Mayo. The Public Hearing was opened by Supervisor Nadolski at 7:30 P.M.. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE LOCAL LAW NO. 1 FOR 198A Notice is here by given, that a public hearing will be, held before the Supervisor, and the Town Board of the Town of Cortlandville, Cort- land County, New York at, the Town Hall, 15 Terrace Road, Town of Cortland- ville, New York on August 1, 1984 at 7:30 o'clock p.m. concerning proposed Local Law No. 1 for the year 1984, providing for the appoint- ment instead of election of the Superintendent of Highways of the Town of Cortlandville. Each member stated his opinion briefly, and it was the consensus of the Town Board that they were in favor of the highway sup't. position to be an appointed one and not an elected one. Town residents Ken Andrews and Ivan Mayo made comments in favor of the change. Supervisor Nadolski apprised the Town Board that other towns have taken these steps and were very happy about their decisions. Legislator Del Pam asked about the time element involved. Attorney Rumsey explained that it was seven (7) days exclusive of Sunday.of introducing the law and subject to a mandatory referendum, which has to be held at least 60 days away. At that time, general elections • will be close, so it can be put on the ballot then. Being no further discussion, Councilman Thorpe made a motion, seconded by Councilman Manning to close the public hearing. All voting,aye, motion was carried. The regular meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, N.Y. with Supervisor Stanley Nadolski presiding. Councilman Thorpe made a motion, seconded by -Council- man Manning to receive and file the minutes of July 5, 1984 and July 12, 1984 and July 16, 1984, as written. All voting aye, the motion was carried. RESOLUTION # 147 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Pierce Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers # 286-320 $ 32,791.11 Highway # 114-132 45,083.40 Water Fund # 108-121 3,435.34 Sewer Fund # 47-53 825.56 Supervisor privilege of the Nadolski allowed those floor. in attendance the No comments were heard. Town of Cortlandville.,All voting aye, the motion was carried. IZ Wednesday, August 1, 1984 Page 2 Letters were received from Senator D'Amato and D'Amato & Senator Moynihan regarding their support for the EDA Moynihan application that the Town has submitted. Councilman letters Thorpe made a motion, seconded by Councilman Pierce to receive and file the letters. All voting aye, the motion was carried. A letter was received from John G.A. O'Neil, member of Assembly, thanking the Town for their support O'Neil of the Farmland Overburden Aid Act, which did not get letter approved this year. Councilman Manning made a motion, seconded by Council- man Thorpe to receive and file the letter. All voting aye, the motion was carried. Councilman Pierce made a motion, seconded by Councilman Thorpe to receive and file a letter received from Senator Anderson Majority Leader, Warren Anderson regarding the allocation letter of hydropower. All voting aye, the motion was carried. Supervisor Nadolski received a letter that was written to Mayor Quinlan, from a resident complaining of accumul- ation of junk at the north end of Conable Ave.,located in junk the Town of Cortlandville. In turn Supervisor Nadolski Conable Ave. turned the complaint over to Zoning Officer, Don Fowler, who has investigated the situation and also talked to Mrs. Chorley,,Jr.;,,,who lives there, and she stated the area would be cleaned up soon. i,' Councilman Pierce made a motion, seconded by Council- man Manning to receive and file the letter. All voting aye, the motion was carried. Councilman Pierce made a motion, seconded by Council- man Thorpe to receive and file a letter from Richard A. Teichman Teichman, Jr. commending the Town Board for their under - letter standing of the issue of junk cars and other zoning violations. All voting aye, the motion was carried. 1 • Councilman Manning made a motion, seconded by Council- man Pierce to receive and file the Cortland County Economic Cort Co Development Committee quarterly report. All voting aye, Econ report the motion was carried. • Councilman Pierce made a motion, seconded by Councilman Thorpe to receive and file a letter from Edwazd V. Regan, Regan State Comptroller, regarding investment practices and urged letter the town to refrain from purchasing securities subject to repurchase agreements. All voting aye, the motion was carried. Councilman Thorpe made a motion, seconded by Councilman Cable Comm. Manning to receive and file a cable commission report from report Jack Buttino. Dept. of Labor that an explosives license has been issued to Mr. Walter Andrews, 2590 Virgil Road, Cortland, N.Y.. All voting aye, the motion was carried. A letter was received from Richard L. Bassler, DOT Engineer, regarding the drainage problem along the west side of Route 281 north of the Cortlandville Fire Station and the park. He stated that in the future the state may be able to install a subsurface drainage system to solve the drainage problem. Councilman Manning made a motion, seconded by Councilman Pierce to receive and file the letter. All voting aye,\ the motion was carried. A letter from the Southern Tier East Regional Planning Development Board was received stating that the ARC Funds requested would be "rolled over" into fiscal 1984-85 and placed bn the Regions project priority list. Councilman Manning made a motion, seconded by Councilman Thorpe to receive and file the letter. RESOLUTION # 148 APPROVE NEED OF PROPOSED ROUTE 13 CORRIDOR proposed Rte. 13 Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS several proposals have been made and reviewed in the past, to request the State to upgrade or build a new Route # 13 in Cortland County, and WHEREAS the state has not accomplished such and does not look favorable in the forseeable future, therefore BE IT RESOLVED that'the Town Board of the Town of Cortland- ville goes on record in favor of upgrading or building a new Route # 13 corridor, and RESOLVED that this Town Board does approve Resolution # 84-32, received from the Cortland Planning Board relating to the proposed Route # 13 corridor, and RESOLVED that Supervisor Nadolski shall forward to the NYS-DOT Regional Office in Syracuse, the response of this board. A discussion was held to review the water and sewer billing date and how to count for 30 days to add the 10% penalty. water & Attorney Rumsey stated that the next day after the sewer billing date should be counted as day one. pen. date }. 4 Wednesday, August 1, 1984 Page 4 driving course RESOLUTION # 149 AUTHORIZE TOWN EMPLOYEES'TO TAKE THE DRIVING COURSE Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that Town employees, who drive Town vehicles, are hereby authorized and directed to take the National Safety Counci.l's Defensive Driving Course, to be held on Wednesday, August 29, 1984 from 8:00 am to 3:00 pm, at the Town Hall, and BE IT FURTHER RESOLVED that the cost will be $ 15.00 per student, payable by the Town, with a 10 % reduction to the Town insurance. If the driver wishes a card to apply to his own insurance, the cost is $ 10.00 per card, paid by the individual, and RESOLVED that the class shall be open to the public for a fee of $ 25.00 per person. set public RESOLUTION # 150 hearing — city Sewer Ordin. RESOLUTION # 151 AUTHORIZE SUPERVISOR TO CONTACT INACTIVE contact MEMBERS OF ZBA inactive ZBA members Motion by Councilman Thorpe Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS it has been brought to the attention of the Town Board that two (2) members of the ZBA have not attended the regular meetings of the ZBA board, therefore BE IT RESOLVED that Supervisor Nadolski is hereby authorized and directed to contarat-L David Plew and Jacquelyn Rosen to ask if they are still interested in serving on that board, and if not, he is authorized to ask for their resignation. RESOLUTION # 153 AUTHORIZE SUPERVISOR TO CONTACT CITY contact OF CORTLAND-SEWER USERS ON ABDALLAH city sewer AVENUE users ® Motion by Councilman Manning Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS many years ago some residents of Abdallah Ave. requested permission to hook into the City of Cortland Sewer line, and permission was granted, and ,r�,/,,i WHEREAS the Cityof Cortland bee �� ��.. billies those customers direct, therefore BE IT RESOLVED that the Supervisor is hereby authorized and directed to contact the City of Cortland and request them to bill those customers using the city sewer services to the Town of Cortlandville, as we should be responsible for our own consituents, and we will in turn bill our residents in the same manner that we handle those water customers using the city water. RESOLUTION # 154 AUTHORIZE ACCEPTANCE OF PAYMENT SCHEDULE IN LIEU OF TAXES - CORTLAND Ccrt. RESOLUTION # 155 ADOPTING LOCAL LAW # 1 FOR 1984 Motion by Councilman Pierce Seconded by Councilman Manning ROLL CALL VOTE: Supervisor Nadolski Aye Councilman Manning Aye Councilman Pierce Aye Councilman Thorpe Aye Councilman O'Donnell Absent ADOPTED WHEREAS, Local Law No. 1 for the year 1984, providing for the appointment instead of election of the Superintendent of Highways of the Town of Cortlandville, was introduced at the June 18, 1984 meeting of the Town Boat and WHEREAS, said Local Law has been in its final form upon the desks of the members at least seven days exclusive of Sunday prior to,this date, and WHEREAS, a public hearing thereon has been held before this Town Board, after publication of notice thereof as required by law, now, therefore, be it 1 n U RESOLVED, that Local Law No. 1 for the year 1984 is hereby passed and enacted in the following form: SECTION 1. The elective office of Superintendent of Highways • of the Town of Cortlandville is hereby abolished and a Superintendent of Highways for the Town of Cortlandville shall hereafter be appointed by the Cortlandville Town Board. SECTION 2. This local law shall supersede in its application to the Town of Cortlandville paragraph (b) of subdivision one of Section Twenty of the Town Law with respect to the mode of selection of the Superintendent of Highways in the Town of Cortlandville. This local law shall take effect immediately upon filing with the Secretary of State and after approval by a majority of the electors voting thereon in accordance with the requirements of Section Twenty-three of the Municipal Home Rule Law. All voting aye, the motion was carried. executive session RESOLUTION # 156 AUTHORIZATION TO HIRE BERNARD THOMA _ hire Bernie Motion by Councilman Thorpe Thoma Seconded by Councilman Pierce, VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Board does hereby authorize the hiring of Bernard Thoma to make application for a grant to purchase land for an Industrial Park, and RESOLVED that the salary is not to exceed $ 800.00, to be paid from General Fund A dontingency Fund. Councilman Thorpe made a motion, seconded by Council- adjourn man Pierce to adjourn the meeting.
