The regular meeting of the Town of Cortlandville Town Board was held at the.Town Hall-, 15 Terrace Road, Cortland', NY with Deputy Supervisor', Melvin Pierce presiding. Members present: P ® Absent: Deputy Sup.'v.,, Melvin Pierce Councilman Edwin 0.' Donnell Councilman Warren Manning Town Clerk Pauline Parker Supervisor, Stanley Nadolski Councilman, Ray Thorpe Others present were Attorney, Philip Rumsey; Assessor, David Briggs; Deputy Town Clerk, June Bradshaw; Confidential Sec.'y.,, Edna Puzo; Zoning Officer, Don Fowler; Highway Sup,'t.,, Carl Bush; Legislator, Delmar Palm; and newsreporter Brain Newman of the Cortland Standard. The meeting was called to order by Deputy Supervisor, Melvin Pierce at 7:45 P.M. Councilman O'Donnell made a motion, seconded by Councilman Manning to accept the minutes of June 6, 1984, June 18&, 1984 and approve June 22, 1984 as written. All voting aye, the motion was carried. minutes A discussion was held concerning the minutes of May 21, 1984. The Supervisor and the Town Clerk will review them further. No action was taken. Councilman O'Donnell made a motion, seconded by Councilman Manning to receive and file the Cortlandville Planning Board Planning minutes of June 26, 1984-, as received. All voting aye:; the motion Bd mins. was carried. Deputy Sup'v. Pierce allowed those in attendance the privilege of the floor. Zoning Officer, Don Fowler, explained that he is involved change of with enforcing twelve different codes, of which six are state title mandated. He requested that.hi.s title be changed to "Code Zoning Enfocement Officer" as that is how the state codes refer to*'his Officer position. The Town Board requested him to make a formal request in writing/for review, and will be discussed at the next meeting. No action was taken. RESOLUTION # 133 AUTHORIZE JUSTICE TO ATTEND ST. ® LAWRENCE SEMINAR Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that Justice, Donald Eaton, is hereby authorized Justice to attend the Annual Justice Seminar from July 22, 1984 - July seminar 27, 1984 at St. Lawrence University at Canton, N.Y., and RESOLVED that any expense incurred by same, be reimbursed, subject to audit by the Town Board. Thursday; July 5, 1984 page 2 Justice Justice Eatons monthly report was read. Councilman report O'Donnell made a motion, seconded by Councilman Manning to receive,,and file the report. All voting aye, the motion was carried. Reports of other departments are on the table or are available, upon request, in the Clerk's office. A letter was read from Justice, Donald Eaton, advising update that he has received the updated New York Statutes. They will statutes be available to anyone that wishes,to utilize them. Also provided was a list of what is available which will be distributed to all department. heads. Councilman O'Donnel made a motion, seconded by Councilman County Manning to receive and file a letter from Cortland County dispute District Attorney, Thomas Gilhooley, in regards to a meeting center which was held to discuss establishing a community dispute resolution center. All voting aye, the motion was carried. Justice Eaton reported that several counties in the state have established this program. Matching funds are available to the counties from a grant. Cortland County is going to appoint an ad -hoc committee to pursue the matter. Future meetings will be held. A letter was read from Carl Hinkle, President of Atlantic - fire Inland Inc. requesting a meeting as he is ready to proceed inspectionwith fire prevention inspections. Councilman O'Donnell made a motion, seconded by Councilman Manning, to receive and file the letter. All votin aye, the motion was carried. Councilman Pierce requested all committeemen to be in attendance at the meeting. The date is yet to be determined. Councilman Manning asked if all was in order with the City of Cortland concerning the payment of those monies received from Pall the Pall Trinity grant, which was to be paid to the Cortland Trinity County Economic Development for our share of the cost of their grant program. Deputy Supervisor, Melvin Pierce, advised that our share was paid this year by Mayor Hart when he was in office. It is uncertain what will happen in the future. Councilman O'Donnell made a motion, seconded by Councilman Manning, to receive and file the letter received from Governor Cuomo's office acknowledging receipt of our resolution regarding hydropower allocations. All voting aye, the motion was carried. The Town Clerk'reported that she has received the minutes Bd. ofof the 1984 Board of Assessment Review. Assessment Councilman O'Donnell made a motion, seconded by Councilman Asment Manning, that the minutes ,,be 'received and filed. All voting aye, review the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman NY Telephonning , to receive and file a "protest for review" of the protest Special Franchise assessment for the New York Telephone Company. All voting aye, the motion was carried. 1 • • 1 233 Thursday, July 5, 1984 Page 3 The Town Board requested a report concerning the zoning violations of Robert and Wilma'Bliss of the Gallagher zoning Road and Robert Bean of Penguin Trailer Park. violations Attorney Rumsey advised that all information, on both places, have been received by him. He will continue the proceedings. Zoning Officer, Don Fowler, reported that he heard nothing from either party and has referred it to the Town Attorney. ® Councilman Pierce reported that he received a complaint call in regards to a trailer moving in next to a house trailer on Fisher Ave.; and are now living in the trailer. The caller did not identify themselves. RESOLUTION # 134 AUTHORIZE ATTORNEY TO PREPARE THE 1984 DCO CONTRACT Motion by Councilman 1yanning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS the Town Board has submitted to the S.P.C.A. a proposal for the 1984 Dog Control Services where they shall receive'all revenue received by the Town for the dog program instead of a set fee, and WHEREAS correspondence has been received from the S.P.C.A. agreeing to the proposal, therefore, BE IT RESOLVED that the attorney is hereby authorized and directed to prepare a contract for signing for the year 1984 and also submit the same for 1985. RESOLUTION # 135 AUTHORIZE DOG ENUMERATION FOR THE TOWN OF CORTLANDVILLE Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS_ an dog enumeration has not been done recently in the Town and much revenue is lost because all dogs are not being licensed, and WHEREAS the S.P.C.A. has agreed to our 1984 proposal providing that an dog enumeration be taken, therefore, BE IT RESOLVED that the Supervisor is hereby authorized to make the necessary arrangements to take a dog census or enumeration in the Town of Cortlandville and submit ® it to the Town Board. Mr. Kenneth Becker of Footies Freeze, located at the intersection of Route #13 and McLean Road, has advised us of a bad traffice situation at his location. Because vehicles can turn right at the red light, they are encroaching on his property, plus causing conditions for a serious auto accident. There have been several accidents at this location in the past. Supervisor Nadolski has advised NYS Dept. of Trans- portation of this problem. They have responded, by letter, and advised that they.would install new lane markings, which has been done. RESOLUTION # 136( '.AU.THORIZE ASSESSOR TO ATTEND SEMINAR AT CORNELL Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED • BE IT RESOLVED that the Assessor, David Briggs, is assessor hereby authorized to attend a Seminar at Cornell University seminar on July 23rd - 27th, 1984, and RESOLVED that the expenses incurred by same shall be reimbursed partially by the Town and partially by the State of New York, subject to audit by the Town Board. RESOLUTION # 137 AUTHORIZE TOWN CLERK TO ATTEND SCHOOL AT SYRACUSE UNIVERSITY Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Town Clerk BE IT RESOLVED that the Town Clerk, Pauline Parker, is school hereby authorized to attend a school at Syracuse University from August 12th - 17th, 1984,'and RESOLVED that the expenses incurred by same,shall be paid subject to audit by the Town Board RESOLUTION # 138 AUTHORIZE REFUND OF DOG IMPOUNDMENT FEE - WILLIAM MOORE Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED refund WHEREAS the S.P.C.A. were contacted by police agencies dog seizure to pick up a dog tied behind Friendly's on July 12, 1984, and fee WHEREAS the dog was stolen from William Moore's residence on Gallagher Road in the Town, and WHEREAS a seizure fee of $25.00 was paid by Mrs. Moore, and a refund was requested by them, therefore, BE IT RESOLVED that a refund of $25.00 shall,be paid to William Moore for Dog Seizure Claim #22 • A discussion followed whether it is.necessary to charge an impoundment fee if it is known that a refund would be issued or a situation similar to the above should occur. It was the consensus of the Town Board that the same procedue should apply, as in the past, as it does not happen that often. fence The Town Board was advised that Supervisor Nadolski Lamont gave permission to Morton Parsons, 784 North Lamont, to Circle install a rail fence on his property to prevent traffice from driving on his lawn. There is no ordinance for fencing. n r. r 1 C: 1 11 n Thursday, July 5, 1984 Page 5 Information was received from the Association of Towns asking for support from us to increase from $5.00 to $10.00, the fee which the State returns to Town's and Villages for their Justice Court. A letter supporting such was signed by the Town Board members present and shall be forwarded to Govenor Cuomo. Councilman Manning made a motion, seconded by Council- man O'Donnell -o receive'and file the letters. All voting aye, the motion was carried. RESOLUTION # 139 DETERMINE PENALTY DUE - LOCKO GLAZIER - INDUSTRIAL SEWER BILLING Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS an industrial sewer billing was sent to Locko Glazer on January 26, 1984 and a penalty is due after 30 days if payment is not received, and WHEREAS they mailed there payment on February 27, 1984 and was received by us on March 1, 1984, and WHEREAS they have requested forgiveness of the penalty, therefore, BE IT RESOLVED that it is hereby determined that the penalty in the amount of $381.41 is due.the Town and must be paid due to their untimely payment. Attorney Rumsey will review our water and sewer billing procedue and report back to the Town Board.. RESOLUTION # 140 AUTHORIZE MINIMUM CHARGE WATER AND SEWER FINALS Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Assoc of Towns increase court fee Locko Glazer sewer penalty WHEREAS there have been many homes sold in the area and when a final reading is requested, many town personnel minimum fee are involved and the procedure is costly to the Town, water & therefore, sewer final BE IT RESOLVED that when a final reading is requested, a minimum fee of $3.50 shall be charged to the owner for a water charge and $9.25, the minimum fee for a sewer charge, providing the usage equals less than the minimum fee. RESOLUTION # 141 AUTHORIZE TRANSFER OF 1,10NIES - HIGHWAY EQUIPMENT CAPITAL RESERVE Motion by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Budget Officer is hereby authorized to transfer $42,991.00 from the Highway Equipment Capital Reserve Fund to DM5130.2 for one new double drum vibratory roller, to be paid to Tracy Road Equipment, upon acceptance of the equipment by the Highway Sup't. tramsfer monies highway equipment r� 3b Thursday, July 5, 1984 page 6 RESOLUTION # 142 INTRODUCING LOCAL LAW # 1 OF 1984 AND SET DATE FOR PUBLIC HEARING Motion'by Councilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED Local Law WHEREAS proposed` Local Law No. 1- for the year 1984 #1 of 1984 providing for the appointment instead of election of the Superintendent of Highways of the Town of Cortland - appoint ville, now therefore, highway sup't. BE IT RESOLVED that a public hearing upon said Local Law No. 1 for the year 1984 be held before this Town Board on August 1, 1984 at 7:30 o'-clock p.m. in the Town Hall, Terrace Road, Cortland, New York, and that the Clerk of this Board be and hereby is directed to publish notice of said hearing as required by the Municipal Home Rule Law of the State of New York. All board members reported that they have received a copy of the proposed local law. RESOLUTION # 143 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED pay vouchers BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers #235 - 282 $9,308.27 Highway # 96 - 108 3,120.09 Water Fund # 96 - 105 2,798.14 Sewer Fund # 39 - 45 7,36o.27 There being no further business to bring before the board, Councilman O'Donnell made a motion, seconded by Councilman Manning, to adjourn the meeting.
