PUBLIC HEARING SLIDING SCALE FOR.INCOME REQUIREMENTS - AGED EXEMPTION A�Public Hearing.was held at the Town Hall, Town,of Cortlandville at 4:30.P.M. for the purpose of discussing a proposed sliding scale for income requirements to determine eligibility for an aged exemption for Town residents. • Members -present: Supervisor Stanley 'Nad'olski -Councilman Melvin' Pierce Councilman Ray Thorpe -.. Councilman Edwin O'Donnell Councilman Warren Manning Town Clerk Pauline Parker Others present were Attorney Phillip Rumsey; Assessor David Briggs; Highway.Sup't., Carl Bush;,Engineer, Peter Novelli and Town residents, Hazel Freer, Donna Reome and Martha Wisor. The Public Hearing was opened by Supervisor Nadolski. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE ry Otice is hereby given that a public hearing will be held ,by. the Town Board of the Town of Cortlandville, Cortland - -County, New York at the Town Hall, 15 Terrace Road in said Town on April 16, 1984 at 4:30 o'clock in The afternoon in the manner of the adoption of a.resolution modifying the `--maximum income eligibility level of $8,200.00 heretofore enacted by the Town for exemption from taxation of real property owned by persons sb ty-five (65) years of age or over. Pursuant to E eal Property Tax Law Section 467-d, the proposed income eligibility and percentages of exemption are as follows: Income Range Exemption $8,200.00 or less 50% 45% $8;200.01-8;699.99 4% $8,700.00.9,199.99 $9,200.00-9,699.99 35% . $9,700.00-10,199.99 30% 25% $10,200.00-10,699.99 20% $10,800.00-11,199.99 All parties interested and citizens will be heard at the said public hearing. Many towns in the county have also adopted the change. School districts in the county have yet to adopt the sliding scale. The impact of adopting this program should be minimal at the present time. It will be necessary for each eligible property owner to make application for approval before May lst. of each year. There were no comments offered by those in attendance. SPECIAL MEETING A Special Meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding following a public hearing for discussion of a sliding scale for income requirements to determine eligibility for an aged exemption. • Members present: Supervisor Stanley Nadolski Councilman Melvin Pierce Councilman Ray Thorpe Councilman Edwin O'Donnell Councilman Warren Manning Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; Assessor, :David Briggs; Highway Sup't., Carl Bush; Engineer, Peter Novelli; Newsreporter, Dick Camerano and Town residents, Hazel Freer, :Donna Reome and Martha Wisor. The meeting was called to order by Supervisor Nadolski at 4:35 P.M.. RESOLUTION # 84 AUTHORIZE PAYMENT OF VOUCHERS pay vouchers Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audited and shall be paid as follows: General Fund Vouchers # 132 - 143 $ 6,324.80 Highway 11# 55 - 56 1,413•45 Water Fund IT# 57 - 58 100.62 Supervisor Nadolski allowed those in attendance the privilege of the floor. Donna Reome of Blodgett Mills requested permission to plant • trees at the playground area in Blodgett Mills on Arbor Day. RESOLUTION # 85 AUTHORIZE PLANTING OF TREES AT BLODGETT MILLS tree PLAYGROUND AREA at B. Mills Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED Monday, April 16, 1984 Page 2 2011 BE IT RESOLVED that the engineer is hereby authorized and directed to meet with the committee and Donna Reome of Blodgett Mills for the purpose of planning the location for tree planting, and RESOLVED that Donna trees for Arbor Day, the Town Engineer. RESOLUTION # 86 Reome is hereby authorized to set out as requested, subject to approval of APPOINT COMMITTEE TO REPRESENT.' TOWN - UNIFORM FIRE PREVENTION AND BUILDING CODE Motion by Councilman Pierce Seconded by Councilman Manning VOTES: ALL AYE ADOPTED WHEREAS the town has adopted the New York State Uniform Fire Prevention and Building Code and has contracted with Atlantic Inland to make the necessary inspections, and WHEREAS it has been determined that a committee should be established to represent the Town. Robert Atkins, Jr. R.D.# 1,-Cortland, N.Y. James McGuire R.D.# 1, Truxton, N.Y. Fred Walker, Jr. 3585 Rt. 215, Virgil Rd., Cortland, NY AND FURTHER RESOLVED that Fred Walker, Jr., 3585 Rt1215, Cortland, N.Y. is hereby approved to install water connections in the Town of Cortlandville, and RESOLVED that above names shall be added to the list to be fade available to the public. RESOLUTION # 90 ADOPT AND ENFORCE NYS FIRE CODE AND BUILDING CODE Motion by Councilman O'Donnell Seconded by Councilman Manning VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Town Board of the Town of Cortland- ville does hereby adopt and enforce the NYS Uniform Fire Prevention and Building Code. RESOLUTION # 91 ADOPT SLIDING SCALE FOR INCOME REQUIRE- • MENTS TO DETERMINE ELIGIBILITY FOR AN AGED EXEMPTION Motion by Councilman Thorpe Seconded by Councilman Manning VOTES: ALL AYE ADOPTED Monday, April 16, 1984 Page 4 WHEREAS, the Town of Cortlandville be Resolution No. 206 made on October 6, 1982, established the maximum income eligibility level of $ 8,200.00 for exemption from taxation of real property owned by persons sixty-five (65) years of age or over, and WHEREAS, Real Property Tax Law Section 467-d now authorizes a graduated schedule of maximum income, and ® WHEREAS, a public hearing regarding a change to a graduated schedule was duly noticed and held on April 16, 1984, NOW, THEREFORE, BE IT RESOLVED, that the maximum income eligibility level of $ 8,200.00 as set forth in Resolution No. 206 of October 6m 1982, is hereby modified pursuant to and in accordance with Section 467-d of the Real Property Tax Law. The percent- age of exemption shall be based on the maximum annual income range specified herein, as follows: INCOME RANGE PERCENTAGE OF EXEMPTION $ 8,200.00 or less 50% - 8,699.99 45% $8,200.01 8,700.00 - 9,199.99 40% 9,200.00 - 9,699.99 35%. 9,700.00 - 10,199.99 30% 10,200.00 - 10,699.99 25% $;10,700.00.- 11,199.99 20% Attorney Rumsey reviewed with the Town Board the inform- ation to be contained in the contract that he is drafting for the 1984 DCO with the SPCA. A discussion followed whereby it was the consensus spca of the Town Board, that instead of paying an agreed contract amount, the SPCA would receive all revenues taken in relating to the dog licensing program, seizure fee, etc. It was agreed that an enumeration should be done now, which would be the responsibility of the Town Board. The responsibility thereafter would be handled by the D.C.O. and would recommend that it be done every two years. Supervisor Nadolski apprised the Town Board of a variance which was issued on March 22, 1971. The variance allowed a house trailer, due to a hardship, to be placed Bliss on their property as an additional dwelling until the trailer termination of the grandparents use. The grandfather is now deceased and the grandmother is in a nursing home. The property owner has now moved his brother into the trailer. A neighbor has questioned the legality of this. The matter has been referred to the (buty Planning Dept. and to the Cortlandville Zoning Board of Appeals. Attorney Rumsey was requested to prepare a bill of sale and complete the necessary, to specify that the trailer trailer at park 04 Monday, April 16, 1984 Page 5 now being used at the Cortlandville Municipal Park would be returned to the Jaycees., the owners of the,trailer,' when we have no further use of such. Attorney Rumsey advised that the contract with Atlantic Inland is near completion. The Highway Sup't., Carl Bush, wants to designate someone within his department as a working foreman. A highway sup't discussion followed whereby it was the consensus of the Town designate Board that the 'Highway Sup't . should proceed as necessary working in accordance with the existing personnel policy.adopted foreman by the Town Board. Councilman Pierce made a motion, seconded by Council- man Thorpe, to adjourn the meeting. All voting aye, the motion was carried. adjourn The meeting was adjourned at 5:05 P.M..
