The regular meeting of the Town of Cortlandville Town
Board was held at the Town Hall, 15 Terrace Road, Cortland,
New York with Deputy Supervisor Melvin Pierce presiding.
Members present:

Assessor, David Briggs; Zoning Officer, Don Fowler; Attorney,
Phillip Rumsey; Justice, Donald Eaton; Highway Sup't.,
Carl A. Bush, Jr.; Confidential Sec'y., Edna Puzo; Legislator,
Del Palm and newsreporter Michael Mittelstadt.
Also present was town resident Richard Tupper.

Melvin Pierce at 7:30 P.M..
Councilman Thorpe made a motion, seconded by Councilman
Manning to accept the minutes of March 7, 1984 and'March 19,
1984, as written. All voting aye, the motion was carried.

Zoning Officer, Don Fowler discussed with.the Town Board
the New Uniform Mandated Fire Code implemented January 1, 1984.
He stated he wrote a letter to the states attorney and fire uniform
control but has had no reply. The new code book contains fire
5 different codes, which includes the New York State Build- code
ing Code adopted in 1975 by the Cortlandville Town Board.
The New York State Fire Code was adopted by the
Cortlandville Town Board on December 16, 1981. .
. Mr. Fowler reported that he has contacted several
factories and industries in the area regarding the new code.
OSHA has made periodic on site inspections but they do not
issue a certificate of compliance, therefore he is request-
ing a certificate from their individual insurance carriers.
A discussion followed whereby Mr. Fowler requested the
Town Board to adopt a resolution for the matter of adopting
and enforcing the mandated uniform fire code.

It was the consensus of the Town Board that the Town
uniform Attorney and the Zoning Officer review this request further
fire and present it to the Town Board on April 16, 1984. Also
code lacking are documents forthcoming from Carl Hinkle of
Atlantic Inland.
No action was taken.
Reports of various departments are on the table or •
are available, upon request, in the Clerk's office.
EDA Councilman O'Donnell made a motion, seconded by
Councilman Thorpe to receive and file the Economic Develop -
application ment Administration application which has been submitted
to EDA regarding assistance for water and sewer,improve-
ment projects. All voting aye, the motion was carried.

man Thorpe to receive and file the signed 1984 agreement

Councilman O'Donnell made a motion, seconded by
Bonding Councilman Thorpe to receive and file the Certificate of
Polkville Determination from First National Bank for issuance of a
Sewer $ 110,000 Sewer Improvement Serial Bond-1984, for the Polkville
Sewer Project. All voting aye, the motion was carried.

RESOLUTION # 73 AUTHORIZE TOWN CLERK TO CLOSE CLERK'S
ACCOUNT AT KEY BANK AND OPEN CLERK'S

WHEREAS the Town Clerks account has been designated for transfer
depositories at Homer National Bank for many years, and Clerks

WHEREAS Homer National Bank has merged with Key Bank and
coding changes must occur on the account and the bank
could not forgo charges to the account as that is the only
account at their bank, therefore
BE IT RESOLVED that the Town:Clerk is hereby authorized
and directed to close the Town Clerks account at Key Bank
and shall open a rew account for Town Clerk fees at First
National Bank.

RESOLUTION # 79 SETTING DATE FOR PUBLIC HEARING-
,GED EXEMPTION USING SLIDING -SCALE

VOTES: ALL AYE ADOPTED
WHEREAS the state has authorized towns to adopt a sliding public
scale for income requirements to determine eligibility hearing
for an aged exemption, therefore aged

BE IT RESOLVED that a public hearing shall be held on
April 16, 1984 at 4:30 P.M. at the Town Hall to allow
citizen input regarding using a sliding scale to determine
aged exemptions.
Assessor, David Briggs, apprised the Town Board that
the McGraw Village Board adopted a resolution, following Village of
a public hearing, to terminate their status as an assessing McGraw
unit and turned over their assessing responsibility to the change of
Town. This occum-ed as a result of a change of Chapter 735 assessing
of the Real Property Tax Law. status
A discussion followed -whereby Assessor Briggs advised
that this change would cause no additional work load nor
responsibility for himself as they have been using our
assessment ro71s for th&ir purpose. It was just a matter
of formally changing the status as a result of a change in
the law.
RESOLUTION# 80 AUTHORIZE PAYMENT OF VOUCHERS

BE IT RESOLVED that the vouchers submitted have been
audited and shall be paid as follows:

Deputy Supervisor Pierce apprised the Town Board
workshop that the Cortland County Chamber of Commerce in cooperation
with Senate Rappleyea are holding an Economic Development
Conference."Networking for Cortland Countys Future" on.,
April 14, 1984 at 8:15 a.m. - 12:00 noon at BOLES and
encouraged the councilmen to attend if possible.
Deputy Supervisor Pierce apprised the Town Board that
a discussion regarding the proposed sewer extension projects
be held over until the April 16, 1984, special meeting.
RESOLUTION# 82 AUTHORIZE ENGINEER, PETER NOVELLI TO
ATTEND THE AMERIC'AN PUBLIC WORKS ASSOC-
ICATION MEETING

VOTES: ALL AYE ADOPTED

meeting authorized to attend the Annual meeting of American Public
Works Association, May 6 - 8, 1984, at Cooperstown, New York,

RESOLUTION # 83 AUTHORIZE ENGINEER TO PURCHASE SOIL AND
ASPHALT TESTING EQUIPMENT

WHEREAS the Town Board does propose to cooperate with one
or more nearby municipalities to purchase equipment, and
share the use of such equipment, and
WHEREAS the equipment will be used to check the quality of
gravel and asphalt to insure that construction procedures
are adequate, therefore
BE IT RESOLVED that: Engineer Novelli be, and he hereby is
authorized and directed to purchase soil and asphalt testing
equipment, the cost not to exceed $ 1,000.00.

Councilman Thorpe questioned if anyone has filed a law
suit against William Porter for the condition of his
private road at the rear ent?ance to the Groton Ave. Shopping
Mall. It is in extremely poor condition. Councilman
Manning wondered if there was some way the Town Board
could voice their opinions on the poor conditions of the
road. Being a privately owned road the Town Board has no
judication over the up --keep of the road.

40 Town Clerk, Pauline Parker asked if the status of the Transient
Transient Business Ordinance affected Bill Beck from Groton Ordinance
Agway. Deputy Supervisor Pierce stated that Mr. Beck will
have to comply with the Transient Business Ordinance the
same as last year.
The new Zoning Ordinance hopefully will be completed soon.
Councilman O'Donnell made a,motion, seconded by
Councilman Thorpe to recess the regular meeting and convene
to executive session to discuss a matter of litigation.
All voting aye, the motion was carried.
The following information was received from the Super-
visors office.
Councilman Manning made a motion, seconded by Council-
man O'Donnell, to adjourn the executive session and reconvene
the regular meeting. All voting aye, the motion was carried.
No action was taken.
Councilman Thorpe made motion, seconded by Councilman
Manning, to adjourn the regujjar meeting. All voting aye,
the motion was carried.
The meeting was adjourned at 8:40 P.M.
