The regular meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, New York with Supervisor Nadolski presiding. Members present: Supervisor Stanley Nadolski Councilman Melvin Pierce Councilman Ray Thorpe • Councilman Warren Manning Councilman Edwin O'Donnell Town Clerk Pauline Parker Others present were Deputy Town Clerk, June Bradshaw; Assessor, David Briggs; Zoning Officer, Don Fowler; Attorney, Phillip Rumsey; Highway Employees Dudley Henry, Wilbur Hayes and Jody Button; Legislator, Richard Tupper, Newsreporters Randy Ford and Dick Camerano and town residents Ken Andrews and Mark Hulbert. The meeting was called to order by Supervisor Nadolski at -7:30 P-.M. . Councilman Manning made a motion, seconded by Council- man Thorpe to accept the minutes of November 2, 1983; app:r-ove November 8, 1983; November 18, 1983 and November 21, 1983, minutes as written. All voting aye, the motion was carried. RESOLUTION # 232 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that thevouchers submitted have been, audit of audited and shall be paid as follows with the exception vouchers of voucher # 474'General-Fund, Cortlandville Fire Police Claude Munson, TreasurEr, of which the Fireman are respon- sible for: General Fund Vouchers # 462 - 506 $ 12,230.52 Highway '° # 286 - 308 10,775.08 Water Fund # 132 - 151 3,681.76 Sewer Fund # 77 - 81 3,589.86 Supervisor Nadolski allowed those in attendance the privilege of the floor. Councilman Manning made a motion, seconded by Council- S.P.C.A man O'Donnell to receive and file the S.P.C.A. October and reports November, 1983 reports. All voting aye, the motion was carried. Buttino Councilman O'Donnell made a motion, seconded by Gouncil- .man Manning to receive and file the reports. All voting aye., the motion was carried. Reports of various departments are on the table or are available, upon request, in the Town Clerk's office. • A letter from Assessor, David Briggs, was read, advising aged of the change in state law for aged exemption. Each exemption governing body shall be allowed to set up their aged exemp- tion using a sliding scale for both income aaa.exempti,on status. After much discussion Councilman Manning made a motion, seconded by Councilman O'Donnell to table the matter until February or March for further study. All voting aye, the motion was carried. Councilman Manning made a motion, seconded by Council- man Thorpe to receive and file the letter from Assessor, David Briggs. All voting aye, the motion was carried. Council - Society man Pierce made a motion, seconded by Councilman Thorpe) to receive and file the newsletter. All voting aye, the motion was carried. A copy of the Zoning Board of Appeals public hearing ZBA - was received regardng,a special permit for Bestway Enter- Bestway Prises to build a new treatment plant. They will begin to build as soon as the weather clears. Councilman Manning made a motion, seconded by Councilman Pierce to receive and file the copy of the public hearing.- All voting aye, the motion was carried. Resolution # 437 of the Cortland County Legislature was received stating that the releving of sewer charges for sewer the Town will be put on the taxes in January. Councilman charges O'Donnell made a motion, seconded by Councilman Manning tax relevy to receive and file the resolution. Councilman Pierce made a motion, seconded by Councilman Thorpe to receive and file the notice.- All voting aye, the motion was carried. �E�DUeR'1%% RESOLUTION # 233 AUTHORIZE SUPERVISOR TO SIG /AGREEMENT WITY POLKVILLE MOTEL DEVELOPERS-POLKVILLE Polkville SEWER Sewer agreement Motion by Gouncilman Manning Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED 1. J. p Wednesday, December 7, 1983 Page 3 BE IT RESOLVED that the Supervisor be, and he hereby is, authorized and directed to sign the agreement with Henry Baranello and Janice Currie, doing business as a partner- ship of Polkville Developments, in regards to their cost to the Town for installing a sewage system to accomodate their property in Polkville, and RESOLVED that such agreement shall be filed with the Town Clerk. ® Correspondence was received from the Cortlandville Planning Board in reference to the Cortland Emergency Housing project on 2866 E. Main St., McGraw, N.Y.. Supervisor Nadolski apprised the. Town Board that the requ6st�from the,Cortland Emergency Housing Project has been withdrawn. Councilman O'Donnell made a motion, seconded by Councilman Thorpe to receive and file the letter. All voting aye, the motion was carried. Cortland Emergency Housing RESOLUTION # 234 AUTHORIZE SUPERVISOR TO SIGN AND PAY AGREEMENT WITH POLKVILLE MOTEL DEVELOP- ERS --PUMP STATION -- POLKVILLE SEWER Motion by Councilman Manning - Seconded by Councilman Thorpe VOTES: ALL AYE . ADOPTED BE IT RESOLVED that the Supervisor be, and he hereby is, authorized and,d.irected to sign the agreement with Henry Baranello and Janice Currie, doing business as a partner- ship of Polkville Motel Developments, for a portion of land on their property, 40 ft. X 30 ft., to be used to construct a pumping station for the Polkville Sewage System, and BE IT FURTHER RESOLVED.that the Town shall pay the sum of $ 100.00 to the Polkville Motel Developersfor the parcel, and RESOLVED that such agreement shall be filed with the Town Clerk. RESOLUTION # 235 AUTHORIZE SUPERVISOR TO SIGN AND PAY AN EASEMENT WITH PETRELLA'S -- POLK- VILLE SEWER Motion by Councilman Manning ® Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that the Supervisor be,,and he hereby is, authorized and directed to.sign an easement with Louis and Mildred Petrella on Rt. 11.South,-McGraw, N.Y. for laying of sewer mains, laterals and manholes, on their property, and BE.IT FURTHER RESOLVED that the Town shall pay the sum of $_2,500.00 to the Petrella Is for -the easement, and RESOLVED that such easement shall be filed with the Town Clerk. RESOLUUION # 239 AUTHORIZE SUPERVISOR TO SIGN THE HAYES • AMBULANCE CONTRACT FOR THE YEAR 1984 Hayes Motion by.Councilman Pierce Ambulance Seconded by Councilman- O'Donnell 1984 VOTES:. ALL AYE ADOPTED BE IT RESOLVED that the Supervisorishereby authorized and directed to sign the contract for ambulance service for the Town of Cortlandville with Hayes Ambulance commencing January 1, 1984 and shall terminate on December 31, 1984, and 14i`7 Wednesday, December 7, 1983 Page 5 RESOLVED that the. fee for such contract shall be $ 4,887.00 and shall be paid in full in January. Councilman O'Donnell made a motion, seconded by Councilman Thorpe to receive and file the certificate of Insurance from Hayes Ambulance contract. All voting aye, the motion was carried. ® RESOLUTION # 240 AUTHORIZE TOWN OFFICERS AND EMPLOYEES TO ATTEND MEETING OF ASSOCIATION OF TOWNS Assoc. of Motion by Councilman Thorpe Towns meetings Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE.1T:RESOLVED that Town officers and employees, who have been authorized by their department head, are hereby authorized to attend the 1984 Annual Meeting of the Association of Towns, to be held in New York City, February 19, 20, 21, 22nd, 1984, and RESOLVED that any expenses incurred by same, be reimbursed, subject to audit by the Town Board. RESOLUTION # 241 AUTHORIZE SUPERVISOR TO SIGN AND PAY AN EASEMENT WITH JOHN A. Mc CULLY AND FRANCIS E. BORER - POLKVILLE SEWER Polkville Motion by Councilman Manning Sewer Seconded by Councilman Thorpe easement VOTES: ALL AYE ADOPTED Stop N Sho, BE IT RESOLVED that the Supervisor be, and he hereby is, authorized and directed to sign an easement with John A. Mc Cully and Francis E. Borer (Stop N' Shop) R.D.# 1, McGraw, N.Y. for laying of sewer mains, laterals and man- holes, on their property, and BE IT FURTHER RESOLVED that the Town shall pay the sum of $ 1,000.00 to Mr. McCully and Mr. Borer for the easement, and RESOLVED that such easement shall be filed with the Town Clerk. ® Councilman Pierce made a motion, seconded by Council- man O'Donnell, to recess the regular meeting and convene to executive session to discuss a personnel problem. All voting aye, the motion was carried.
