PUBLIC HEARING AMENDING TOWN OF CORTLANDVILLE TRANSIENT RETAIL BUSINESS ORDINANCE A Public Hearing was held at the Town Hall, Town of Cortlandville at 4:30 P.M. to consider amending the Town of Cortlandville Transient Retail Business Ordinance. In attendance were Supervisor Stanley Nadolski, Councilman Ray Thorpe, Councilman Edwin O'Donnell, Council- man Warren Manning, Councilman Melvin Pierce, Attorney Phillip Rumsey and Town Clerk, Pauline Parker. Also present were Deputy Town Clerk, June Bradshaw; Zoning Officer, Don Fowler; Newsreporter, Paul LaDolce and William Clemens, Zoning Commission Chairman. The Public Hearing was opened by Supervisor Nadolski. The Town Clerk read the legal notice as follows: LEGAL NOTICE TOWN OF CORTLANDVILLE Notice is hereby given That a public hearing will be held by 'the Town Board of the Town of Cortlandville, Cort- land County, New York at the Town Hall, 15 Terrace Road in the Town of Cortlandville on May 16, 1983, at 4:30 o'clock p.m. to consider the adoption of an Ordinance amending the Town of Cort- landville Transient Retail Business Ordinance enacted November 3, 1982 to exempt from its provisions those businesses authorized to con- duct business on properties of shopping malls. Dated: May 5, 1983 PAULINE PARKER Town Clerk Town of Cortlandville 15 Terrace Road Cortland, New York, 13045 107-1t Supervisor Nadolski asked the Attorney to apprise the Town Board of his findings regarding the Transient permit. Attorney Rumsey reported that he had contacted the clerks", -in the Towns of DeWitt and Salina and has received copies of their ordinances. Malls, themselves, are not • exempt. They do exempt certain types of sales, but not property. The Cortlandville Mall had requested that malls be exempt in our ordinance. Different options were discussed. Attorney Rumsey advised that guidelines should be established, as we should not consider each request as a possible exception. A request was received today in the clerk's office from Arnolds Florist in Homer. Their application stated that because they have been an established business in the area for many years, they did not consider themselves "transient". With the existing ordinance, they must apply for a permit and comply with the ordinance. Monday, May 16, 1983 Page 2 William Clemens reported that the Zoning Commission is reviewing the existing ordinance now. Possible changes would be included in the new zoning ordinance. The Town Board reminded those in attendance that the existing ordinance was a stop gap measure, at the request of area merchants. No one in attendance offered further comments. • Councilman Manning made a motion, seconded by Council- man,Thorpe, that the public hearing be closed. Page 1 A Special Meeting of the Town of Cortlandville Town Board was held at the Town Hall, 15 Terrace Road, Cortland, New York, on May 16, 1983 at 4:35 P.M. with Supervisor Nadolski presiding. Members present: Supervisor Stanley Nadolski Councilman Melvin Pierce isCouncilman Edwin O'Donnell Councilman Warren Manning Councilman Raymond Thorpe Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; Deputy Town Clerk, June Bradshaw; Zoning Officer, Don Fowler; Newsreporter, Paul LaDolce and William Clemens, Zoning Commission Chairman. The meeting was called to order by Supervisor Nadolski following a public hearing regarding the Transient Retail Business Ordinance, at 4:45 P.M.. RESOLUTION # 116 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED that the vouchers submitted have been audit of audited and shall be paid as follows: vouchers General Fund Vouchers # 160 - 163 $ 5,480.03 Highway # 117 - 118 839.65 Water Fund # 60 - 61 1,989.94 Sewer Fund # 35 - 37 17,662.15 RESOLUTION # 117 POSTPONE ACTION ON AMENDING TRANSIENT RETAIL BUSINESS ORDINANCE Motion by Councilman Manning Seconded by Councilman Thorpe VOTES: ALL AYE ADOPTED BE IT RESOLVED that any action on amending the Transient Transient Retail Business Ordinance shall be postponed until the Retail June 20, 1983, Town Board meeting. Ordinance Councilman Thorpe made a motion, seconded by Council- man 0"Donnell, to recess the special meeting and convene to executive session to discuss a real estate matter.
