Members present: Absent: Supervisor Stanley Nadolski Councilman Melvin Pierce Councilman Edwin O'Donnell Town Clerk Pauline Pa rler Councilman Warren Manning Councilman Raymond Thorpe Others present were Attorney, Phillip Rumsey; Deputy Town Clerk, June Bradshaw; Zoning Officer, Don Fowler; Newsreporter, Dick Camerano and resident Ken Andrews. The meeting was called to order by Supervisor Nadolski. RESOLUTION # 95 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED General Fund Vouchers # 121 - 123 $ 4,973.08 Highway it# 85 - 86 285.68 RESOLUTION # 96 AUTHORIZE AMENDMENT TO CORTLANDVILLE DOG CONTROL ORDINANCE Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, after due notice a Public Hearing was held by the Town Board of the Town of Cortlandville, at the Town Hall, on April 6, 1983 at 8:00 o'clock p.m. to consider increasing certain fees set forth on the Town of Cortlandville Dog Control Ordinance, now, therefore BE IT RESOLVED, that this Board does hereby enact and ordain as follows: The Town of Cortlandville Dog Control Ordinance Section 3 is hereby amended to change the last sentence to read as follows: The fee for such license shall be the sum of $ .50 for each spayed or neutered dog and the sum of $ 12.50 for each unspayed or unneutered dog. The Town of Cortlandville Dog Control Ordinance Section 8 is hereby amended to change sub -paragraphs (a), (b) and (c) to read as follows: (a) First seizure - $ 20.00 plus $ 5.00 per day as cost of boarding. pay voucher amend dog ordinance 5 `% Monday, April 18, 1983 Page 2 (b) Second seizure - $ 30.00 plus $ 5.00 per day as cost of boarding. RESOLUTION # 97 WILLIAM BECK - GROTON - MUST APPLY Agway FOR TRANSIENT RETAIL BUSINESS PERMIT apply for permit Motion by Councilman Pierce Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS a question was presented by Bill Beck regarding merchants that rented a location at the Cortlandville Mall, if they were determined a transient business, and WHEREAS upon reviewing the Cortlandville Transient Retail Business Ordinance a location must be rented for more than 6 months to be exempt, therefore BE IT RESOLVED that Mr. William Beck, Groton, will be required to apply for a Transient Retail Business Permit and also craft fairs and shows will be required. RESOLUTION # 98 SET DATE FOR PUBLIC HEARING - LOCAL LAW - set public heari m # 1 OF 1983 Motion by Councilman O'Donnell Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS, proposed Local Law No-1 for the year 1983 pro -riding for the amendment of Local Law No. 1 for the year 1981, to add prohibitions of certain conduct in park and recreation- al areas in the Town of Cortlandville has been requested by the R-ecreation Committee, and WHEREAS, the proposed Local Law # 1 of 1983 was distributed, for review, to the Town Board member, therefore BE IT RESOLVED, that a public hearing upon said Local Law • No. 1 for the year 1983 be held before this Town Board on May 4, 1983 at 7:30 O'clock p.m. in the Town Hall, Terrace Road, Cortland, New York, and that the Clerk of this Board be and hereby is directed to publish notice of said hearing as required by the Municipal Home Rule Law of the State of New -York. Monday, April 18, 1983 Page 3 RESOLUTION # 99 LUKER ROAD - REZONING AMENDMENT amend rezoning Motion by Councilman O'Donnell Luker Rd. Seconded by Councilman Pierce VOTES: ALL AYE ADOPTED WHEREAS, this Board on April 6, 1983, amended the Cort- landville Zoning Ordinance to change the classification of certain parcels on Luker Road from "Business";to ® "Industrial", and WHEREAS, the Cortland County Planning Board had recommend- ed approval of said zone change with a qualification, and WHEREAS, this.Board agrees with said qualification, now therefore BE IT RESOLVED, that the rezoning amendment of the 1968 Zoning Ordinance of the Town of Cortlandville, New York, which amendment was adopted on April 6, 1983, be considered as the first phase of the general rezoning and industrial park development plan that is intended to be considered in the near future. RESOLUTION # 100 AUTHORIZE HIRING OF RAYMOND COOPER - SUMMER RECREATION DIRECTOR Motion by Councilman Pierce Hire Ray Seconded by Councilman O'Donnell Cooper VOTES: ALL AYE ADOPTED WHEREAS the position of summer recreation director was advertised and all applications were reviewed by the recreation committee, therefore BE IT RESOLVED that the Recreation Committee is hereby authorized and directed to hire Raymond G. Cooper, as the summer recreation director for a ten week period, June 13, 1983 - August 19, 1983, at a salary of $ 1200.00, plus mileage as recommended by the recreation committee. Councilman Pierce made a motion, seconded by Council- mand O'Donnell, to adjourn the meeting.
