TOWN BOARD MEETING
The Regular Town Board Meeting of the Town Board of the Town
of Cortlandvill.e was held at the Town Hall, 15 Terrace Road,
Cortland, New York with Supervisor, Melvin Pierce presiding.
Members Present: Supervisor, Melvin Pierce
Councilman, Thordore Testa
Councilman, Edwin O'Donnell
Councilman, Raymond Thorpe
Councilman, Ronal Rocco
Town Clerk, Pauline Parker
Others present were: Town Attorney, Philip Rumsey; Highway
Sup't., Carl Bush; Town Engineer, Hayne Smith; ' Fire
Commissioners, Benny Gunzenhauser, Jack Harvey, Robert Payne;
Fire Chief, Mike Maxwell; Newsreporter, Ship Chapman; Local
Contractors, John Murdock, Tim Murdock, Robert Goodale, Scott
Flatt and Brent Cross; Town residents, Victor Loomis and Bell
Drive residents, John Bishop, Wm. Pauldine, Henrietta Williams,
Barbara Kuhlman, Mary Fowler and Jack Fitzgerald.
The meeting was called to order by Supervisor Pierce
following the salute to the flag at 5:30 p, m.
RESOLUTION #289 AUTHORII.E PAYMENT OF VOUCHERS - NOVEMBER
Motion by Councilman Thorpe
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been audited and
shall be paid as follows:
General. Fund A Vouchers #364 - 402 2,999.69
Highway Fund 344 - 347 22,524.51
Sewer Fund 84 - 87 6,267.1
RESOLUTION #290 RECEIVE STATEMENT OF COMPLETION - McLEAN
ROAD / LUKER ROAD SEWER PROJECT
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Statement of Completion for the McLean
Road / Luker Road Sewer Project in -the amount of $152,935.67 is
hereby accepted, as submitted, and shall be received and filed.
Councilman Rocco made a motion, seconded by Councilman
O'Donnell, to receive and file the letter written to Cortland
County Highway Sup't., Walter- Tennant, by Supervisor- Pierce. All
voting aye, the motion was carried.
The letter was in regards to tractor trailers parked near
the intersection of Lighthouse Hill Road and Locust Ave.

Councilman O'Donnell made a motion, seconded by Councilman
Rocco, to receive and file the letter sent to Jay Cobb, Fire
Chief of the McGraw Fire Department, by Supervisor Pierce. All
voting aye, the motion was carried.
The letter- was relating to the pumper connections to be
installed in the Polkville area.
Councilman Rocco made a motion, seconded by Councilman
O'Donnell, to receive and file a letter sent to the Cortland
County Sheriff, Duane Whitman, from Supervisor Pierce. All
voting aye, the motion was carried.
The letter was in regards to the tractor trailers parked
near- the intersection of Lighthouse Hill Rd. and Locust Ave., and
also a copy of the request submitted by County Legislator, Frank
Barbieri, of concerns of Town residents on Loope Rd.
Supervisor Pierce offered those in attendance the privilege
of the floor.
Councilman Testa requested Town Engineer, Hayne Smith to
give a report on the water project an. Cosmos Hill.
He advised that the project should be started next spring.
A discussion followed regarding the need to reroute the
lines for the project due to a property owner not signing an
easement.
Mr. Victor Loomis, requested an explanation of the comments
in the newspaper relating to the Fire District's 1990 budget, and
also the large increase.
Fire Commissioner Chairman, Benny Gunzenhauser, explained
that the increase is mainly due to having to purchase two trucks,
which had been voter approved. He also explained what had
happened when they attempted to repair old trucks. Also, extra
monies were put in the budget to accommodate for training
programs.
Fire Chief„ Mike Maxwell, apprised that their department
have averaged over 300 calls per year.
The new 911 program was discussed. It is not available here
at the present time.
Appreciation was expressed by Supervisor Pierce for those
coming to the meeting to explain their program. He explained
that the Town Board has no involvement with the Fire District's
budget, so we cannot answer the questions.
RESOLUTION 1291 AMEND 1990 PRELIMINARY BUDGET
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the 1990 Preliminary Budget is hereby
amended by decreasing the following for a total of $60,000.00:
DB5110.1 - $13,972.00
DB5130.1 - $26,02e.00
DB5142.1 - $251000.00
AND FURTHER RESOLVED, that the Revenue Account D91120 in hereby
increased by $75,000.00, due to underestimating sales tax.

RESOLUTION #292 ADOPT THE TOWN OF CORTLANDVILLE
BUDGET FOR THE YEAR 1990
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, on the 8th day of November, 1989, the Town Board of the
Town of CortIandville, held a Public Hearing on the preliminary
budgets and the proposed amounts to be raised by benefit tax on
benefited properties in the Town Water Improvement District and
the benefit tax on benefited properties in the Town Sewer
Improvement District, approved by the Town Board, and filed with
the Town Clerk. for the fiscal year commencing January 01, 1990,
and having heard all persons in favor of or against any items
therein contained, therefore
BE IT RESOLVED, that the preliminary budgets approved and fiIed,
and amended, and the same is hereby adopted and established as
the annual budget of this Town for the fiscal year beginning
January 01, 1990, and such annual budget, as so adopted, is filed
with the Town Clerk, and
RESOLVED, that the Town Clerk of this Town shall prepare and
certify, as provided by law, duplicate copies of the annual
budgets hereby amended and adopted, together with the assessment
rolls for the benefit of improvement for the Water Fund and the
Sewer Fund, adopted pursuan± to Section 202-a of the Town Law,
and within five days thereof, deliver two copies to the
Supervisor of the Town, and the Supervisor shall present the
copies of the annual budgets to the Legislature of Cortland
County within ten days, after his receipt thereof from the Clerk
Supervisor Pierce apprised the Town Board that next years
budget will have a 6 cent increase over last year. He stated
that the Town of Cortlandville has the lowest tax rate in the
county.
Councilman O'Donnell expressed pleasure of the increase in
assessments for this last year for the Town. This is very
helpfuI.
Attorney Rumsey discussed with the Town Board the different
mays that an Order can be adopted to extend Water and Sewer lines
in the Town. In the past, they have been adopted, subject to
Pei -missive referendum. He advised that this is permissibIer
however it also can be just adopted, or it can be adopted subject
to referendum by petition, or it can be adopted by mandatory
referendum. Because the vote was not unanimous for the Bell
Drive Sewer, he wanted everyone to be informed.

REFERENDUM AND AMEND RESOLUTION #281

WHEREAS, in the past, this Town Board has made a practice of
adopting all Water and Sewer Orders for extension of lines,
adopted subject to permissive referendum, and
WHEREAS, after discussion with the Town Attorney and Town Board
members, therefore
BE IT RESOLVED, that Resolution's No. 281, adopted by this Town
Board on November 8, 1989 is hereby amended by removing the last
paragraph.
Local Developers, John Murdock, Robert Goodale, Brent Cross
and Scott F1att asked many questions in regards as to what they
could expect for future developments. Different opinions were
heard from Town Board members and also residents in attendance.
RESOLUTION #295 AUTHORIZE TRANSFER OF MONIES
Motion by Councilman Thorpe
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Budget Officer is hereby authorized and
directed to transfer the following monies in the 1989 Budget to
balance the retirement billing per Audit & Control for a total
transfer of $47,641.00:
a. transfer $16,452.00 from A1990.4 to A9010.8
h. transfer $2,694.00 from B1990.4 to 99010.9
C. transfer $3,300.00 from G1990.4 to G9010.8
d. transfer 120,426.00 as follows: Debit Highway 599
Credit 960 = Transfer to DB9010.9

e. transfer $4,769.00 as follows: Debit Water 599
Credit 960 = Transfer to F9010.8
Bell. Drive resident, William Pauldine, requested more
information regarding the delays for the Northwest water project.
It was explained again, the problems with getting one of the
necessary property owners to sign an easement.
Developer, Brent Cross, asked if -the Town Masterplan made
mention of what area would receive funding, if funding should
become available. Will there be a new Masterplan or will the
Board continue to follow the present one?
He was advised that it would be the Boards decision at the
time that a project is proposed.
Developer, Robert Goodale, asked what he needed to do to
request sewer- for his subdivision. He has just installed water,
as the Town required. He requested the Board to provide
direction for himself, and others.
Concern was expressed, but was told that he must convince
the Town Board and obtain a majority vote.
A lengthy discussion followed mentioning concerns for the
aquifer, Health Department regulations, how much additional cost
can taxpayers absorb, and how fast and where do we expand.
Sewers have now become an important issue, and has been ignored
in the past. Monies were available in the past and residents
turned it down.
A motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to adjourn the meeting. All voting aye,
the motion was carried.
The meeting was adjourned at 7:00 p.m..
