The Public Hearing was called to
order by Supervisor Pierce at 7:30 P.M.
The Town Clerk read aloud the legal
notice as shown:
Supervisor Pierce offered those in
attendance the privilege of the floor.
Diane Demeree wanted to know what
the tax increase was going to be,
Supervisor Pierce stated that he
expected about a 5 cent increase. This
has been lowered due to a change of
company with our liability insurance
and also an under estimation of sales
tax.
Tom Morton had some questions
about the street lights on Rt. 222 &
Groton Ave. He also wanted to know how
the recycling was going.
A motion was made by Councilman
O'Donnell, seconded by Councilman
Testa, to close the Public Hearing. All
voting aye, the motion was carried.

TOWN CORTLANDVILLE LOCAL_ LAW NO.3 FOR THE YEAR 1989
A Public Hearing was held at the Town Hall, 15 Terrace Road,
Cortland, New York, on November 08, 1989, following a Public
Hearing for the Preliminary Budget of the Year 1990, concerning
proposed Local Law No.3 for the year 1989, providing for an
amendment of Local Law No.2 for the Year 1983.

TOWN LAW SECTION 209-q (3) "N.Y.S.RT. 13/
N.Y.S. RT. 281 SEWER IMPROVEMENT
A Public Hearing was held at the Cortlandville Town Hall; 15
Terrace Road, Cortland, New York on November 08, 1989, following
a Public Hearing on Local Law No. 3, to hear all persons
interested in the proposed sewer improvement, and for such other
action of said Town Board with relation to the said sewer
improvement as many required by law or be deemed proper.

Sup'v. Pierce explained that only those
persons who could benefit from the sewer
would.be charged a benefit tax.

Supervisor Pierce offered those

Residents of the Bell Drive area
asked for an explanation of the Town
Benefit Tax.
Councilman Rocco explained that
this project would be paid from surplus
monies, and the benefit tar, will be paid
by those receiving a benefit from this
project.
Residents of the Bell. Drive area
asked questions relating to the
difference between bonding a project or
using surplus monies.
Attorney Rumsey explained to them
that the decision to bond or use surplus
monies is decided upon entirely by the
Town Board. It has been past practice
to use surplus monies for small projects
and bonding larger ones. By vote of
this Town Board, this project has been
proposed to use surplus monies.
Supervisor Pierce explained that
surplus monies are derived from an
accumulation, over a period of time, of
current sewer users.
Tarla Arnold, asked if it was
mandatory for residents to hook into the
system.
Attorney Rumsey explained that the
NYS Building and Fire Code states that
if sewer services are available, within
a reasonable distance, then it is

required for the property owner to hook into the line. State
Health requirements, which are handled by the County Health
Department are similar.
Councilman O'Donnell asked if the same requirements apply to
water hookups. it was explained that it does not.
Supervisor Pierce explained that the benefit tax, however,
must be paid by all property owners that have either water or
sewer lines available to them.
With no further comments, a motion was made by Councilman
Rocco, seconded by Councilman Thorpe, to close the Public
Hearing. 01.3. voting aye, the motion was carried.

REGULAR MEETING
The Regular Meeting of the Town Board of the Town of
Cortlandville, was held at the Town Hall, 15 Terrace Road,
Cortland, N.Y. with Supervisor- Pierce presiding.
Members present; Supervisor, Melvin Pierce
Councilman, Ted Testa

Others present were: Town Attorney, Phil Rumsey;

Carl Bush; Allen Schwartz from Health Services Medical Corp. of
CNY Inc.; Mr. Robert Tobias from Suit Kote Corp.; and many town
residents from the Bell Drive area and other areas.
The meeting was called to order- by Supervisor Pierce
following four Public Hearings regarding the 1990 Budget, Loral
Law No. 3 of 1989, Bell. Drive Sewer Project and Rt 4t-13 / Rt #281
Sewer Project.
A motion was made by Councilman Rocco, seconded by
Councilman Thorpe, to approve, as written, the Town Board
meetings of September 20, 1.999; October 4, 1989 and October 18,
1989. All voting aye, the motion was carried.
A motion was made by Councilman O'Donnell, seconded by
Councilman Rocco, to receive and file the Planning Board minutes
of September 26, 1989. All voting aye, the motion was carried.

Tarla Arnold, of Locust Ave., apprised the Town Board that
she recently built, and has moved in a new house on Locust Ave.
She had chosen that location because it was in a rural area.
Since then, three street Lights have been installed at the
intersection of Lighthouse Hill Rd. and Locust Ave. and she does
not like the lights shining in her windows all night. She
advised that she had received about 20 signatures on a petition
to request that they be removed, however she did not submit it to
the board as she felt her efforts would be futile.
Ms. Arnold also expressed her opinion in regards to
installing a flashing signal light at the same location. She is
opposed to this. The recent accident history of this intersection
does not warrant it. She mentioned the real concern of this
intersection is the parking of tractor trailers near the
intersection. She also provided a copy of the State Vehicular and
Traffic Law; which she thought would apply.
Supervisor- Pierce stated that he had received the
information, and that it would be passed on to the proper
agencies to investigate this section of the law.
Diane Demeree, of McDonald Rd., a resident of that area
expressed the same concern about the tractor trailers.
RESOLUTION #273 ACKNOWLEDGE AND RECEIVE STATEMENT OF
COMPLETION - BENNIE ROAD SEWER PROJECT
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Statement of Completion in the amount of
$116, 336.03, for Bennie Road Sewer System Improvements is hereby
submitted and shall be received and filed. 11
Councilman Thorpe made a motion, seconded by Councilman
Rocco, to receive and file a letter received from the County of
Cortland Agricultural Corp. All voting aye, the motion was
carried.
The letter advised that they would hold their 35th Annual
Business meeting on November 14, 1999, and would appreciate that
our representative attend.
Councilman O'Donnell made a motion, seconded by Councilman
Thorpe, to receive and file a copy of a letter- sent to Town
resident, Cecelia Rea, from County Legislator, Delmar Palm. All
voting aye, the motion was carried.
The Letter related to the area of Allen Drive. That road
was closed to traffic a few years ago, as was requested by
residents of the area. There is a turn -around there now, and a
barrier which can be opened by the Fireman for emergency
Purposes.
Councilman Thorpe made a motion, seconded by Councilman
Testa, to receive and file a letter from Assemblyman, Clarence
Rappleyea sent to Code Enforcement Officer, Bruce Weber. All
voting aye, the motion was carried.
The letter was his response in regards to the Low Level
Radioactive Waste dump and the State Siting Commission.

RESOLUTION #279 ADOPT LOCAL LAW NO. 3 OF 1989 - PROVIDING
FOR THE AMENDMENT OF LOCAL LAW NO. 2 FOR
THE YEAR 1983 THEREBY ADDING REGULATIONS
FOR FLOOD HAZARD AREAS

BE IT ENACTED, by the Town Board of the Town of CortlandvilIe as
follows:
SECTION 1. Local Law Number Two for the Year 1983 for the
Town of CortIandviIle is hereby amended by adding a new
subdivision (4) to Section 5.1-3 and a new subdivision (5) to
Section 5.1-4 each to read as follows:
Electrical, heating, ventilation, plumbing and air-
conditioning equipment and other service facilities shall be
designed and/or located so as to prevent water from entering or
accumulating within the components during condition of flooding.
When designed for location below the base flood elevation, a
professional engineer's or architect's certification is required.
SECTION 2. This Local Law shall take effect in accordance
with the Municipal Home Rule Law.
RESOLUTION #280 ADOPT RESOLUTION PURSUANT TO TOWN LAW SECTION
209-q (6) (c) "N.Y.S. RT. 13/RT. 281 SEWER
IMPROVEMENT PROJECT

VOTES: ALL AYE ADOPTED
WHEREAS, there was filed in the Office of the Town Clerk of the
Town of CortIandville, Cortland County, New York, general plans,
map and engineering report relating to the construction of a
public sewer service extension to include the areas near the
intersection of N.Y.S. Rt. 13 and N.Y.S. Route 281v as required
by Section 209-q and 209-c of the Town Law, and are available for
public inspection, and
WHEREAS, an Order was duly adopted by the Town Board on October
18, 1989 reciting the filing of said general plans, the
construction proposed, and the estimated expense thereof and
specifying November B, 1989 at 7:30 o'clock p.m. as the time and
the said Town Hall in the said Town of CortlandviIle as the place
where the said Board would meet to consider the documents filed
as aforesaid and to hear all persons interested in the subject
thereof, concerning the same, and
WHEREAS, such Order was duly pp,ted and published as raquired by
law, and
WHEREAS, a hearing in the matter was duly held by the Board on
the Bth day of November, 1989 commencing at 7;30 p.m. at the Town
Hall in the said Town and discussion upon the matter having been
had and all persons desiring to be heard having been duly heard
including members of the Board and various other persons, and
NOW, upon the evidence given upon such hearing and upon the
the motion of Edwin O'Donnell, Councilman, seconded by Ronal L.
Rocco, Councilman, and unanimously passed, it is

RESOLVED AND DETERMINED, all costs, including the principal and
interest on said bonds or other obligations authorized to be
issued shall be borne by the lands benefited by such improvement
and such costs shall be assessed, levied and collected from the
several lots or parcels of land within said Town of Cortlandville
in just proportion to the amount of benefit which the improvement
shall confer upon such lots or parcels; it is further hereby
determined that all lots or parcels in the Town of Cortlandville
outside of Villages, capable of being serviced by the "Article
12-C" Sewer Improvement heretofore and hereafter provided, are
lots or parcels benefited by the proposed sewer project and all
previous improvements shall be spread upon and over the enlarged
benefited area, all of such improvements constituting one sewer
system, such system being described by and including the areas

RESOLVED AND DETERMINED, that the establishment of a sewer
improvement as proposed in said plans be authorized pursuant to
Section 209-q (6) (c) of the Town Law; that the improvement
therein mentioned be constructed and the service therein
mentioned be provided for upon the required funds being made
available or provided for; and that such improvement shall be
designated and known as "N.Y.S. Rt. 13/N.Y.S. Rt. 281 Sewer
Improvement," and it is further
RESOLVED AND DETERMINED, that the proposed improvement, including
costs or rights of way, construction costs, legal fees,
engineering and consultant fees, and all other expenses
approximated to be a maximum of $50,000.00 shall be financed with
bonds issued by the Town of Cortlandville for a term of a maximum
of 20 years and at the interest rate prevailing at the time of
sale, and it is further

RESOLVED AND DETERMINED, that the costs of management,
maintenance, operation and repair of said improvement or services
shall be a charge upon the area of the Town of Cortlandville
outside of Villages and shall be levied and collected in the same
manner- and at the same time as other Town charges, provided that
it is the intention of the Town Board that such costs will be
raised in the first instance from sewer rates, charges and fees
upon all lots or parcels heretofore and hereafter serviced by
Town Law Article 12-C Sewer Improvements, and it is further
RESOLVED, that the Town Clerk of this Town shall within ten (1.0)
days after- the adoption of this Resolution file a certified copy
thereof in the Office of the Cortland County Clerk as provided
for by the Town Law, Section 209-q (6) (c).
RESOLVED, that this Resolution is adopted subject to permissive
referendum.
A motion was made by Councilman O'Donnell, seconded by
Councilman Rocco to approve the Bell Drive Sewer Project and that
the cash reserve program be used to pay for it.
A lengthy discussion followed.
Councilman Thorpe opposed this project using surplus funds.
Other areas of the Town should be sewered first and expressed
concern about financial fiasco.
Councilman O'Donnell referred to the sewer project in McGraw
a. few years ago. He thought both water & sewer should be
installed at Bell Drive at the same time to prevent it being torn
up twice, using the same contractor for both.
Supervisor- Pierce presented, and read, a petition received
from area residents of Halstead Rd. They strongly opposed
installing sewer lines on Bell Dr. They have been promised a
sewer line for over 1.4 years, and the petition requested their
priority be given. They have the same concerns as Bell Dr.
residents.
Members of the Town Board asked Town Engineer, Hayne Smith
for his input. He stated all areas should be considered, however
his main concern is that we take steps to protect our new well
just installed on Lime Hollow. Our old wells are on the
borderline, now, for contamination. Our water supply needs to be
protected. His priority is near the new well and includes Lamont
Circle.

RESOLVED AND DETERMINED, that the establishment of a sewer
improvement as proposed in said plans be authorized pursuant to
Section 209-q (6) (c) of the Town Law; that the improvement
therein mentioned be constructed and the service therein
mentioned be provided for upon the required funds being made
available or provided for; and that such improvement shall be
designated and known as "Bela. Drive Sewer- Improvement," and it is

RESOLVED AND DETERMINED, that the proposed improvement,
including costs or rights of way, construction costs, legal fees,
engineering and consultant fees, and all other expenses
approximated to be a maximum of $175,000.00 shall be financed by
payment from the Sewer Fund Surplus Account of the Town of
Cortlandville, and it is further
RESOLVED AND DETERMINED, that the costs of management,
maintenance, operation and repair of said improvement or services
shall be a charge upon the area of the Town of Cortlandville
outside of Villages and shall be levied and collected in the
same manner and at the same time as other Town charges, provided
that it is the intention of the Town Board that such costs will
be raised in the first instance from sewer rates, charges and
-fees upon all lots or parcels heretofore and hereafter- serviced
by Town Law Article 12-C Sewer Improvements, and it is further
RESOLVED, that the Town Clerk of this Town shall within ten (10)
days after the adoption of this Resolution file a certified copy
'thereof in the Office of the Cortland County Clerk as provided
-for by the Town Law, Section 209-q (6) (c).
RESOLVED, that this Resolution is adopted subject to permisssive
referendum.
RESOLUTION #292 RECEIVE PETITION TO INSTALL SEWERS ON
HALSTEAD ROAD

VOTES: ALL. AYE ADOPTED
WHEREAS, area residents of Halstead Road expressed strong
disapproval of installing a sewer line on Bell Drive by means of
a petition, therefore
BE IT RF_SOIVED, that the petition received from the residents of
Halstead Road requesting their area to receive priority for
installing of sewers is hereby received and filed.
Supervisor Pierce apprised those in attendance that the
area residents of Abdallah Ave., Levydale, and Starr Road were
gold 28 years ago that they would receive sewer- services for
their area the next year. It still is not there. It ends at the
City of Cortland line. Those residents are still concerned and
petitions may be forthcoming -from that area.
Barbara Kuhlman, Bell Drive, requested confirmation that
Bell Drive could expect to have water & sewer- lines installed
next spring. She was advised that it was our intent. Water
lines will be installed on the opposite side of the road of the
gaslines, and sewer lines will be installed in the middle of the
road.

BE IT RESOLVED that the list showing all delinquent accounts for
water & sewer- is hereby received and filed in accordance with
the law.
A motion was made by Councilman O'Donnell, seconded by
Councilman Testa, to receive and file the notice received from
the Public Service Commission . All voting aye, the motion was
carried.
The notice advised that a Public Hearing will be held on
November 21, 1989 in Albany, N.Y. at 1:00 p.m. to hear comments
on New York Telephone Company Rate Proposals.
RESOLUTION #204 REFERRAL TO TOWN PLANNING BOARD SPECIAL
PERMIT #17 SUIT-KOTE CORP.

WHEREAS, application has been made by Suit�Kote Corp. by means
of a Special Permit, to develop over the Aquifer, and
WHEREAS, Mr. Robert Tobias of SuitrKote was in attendance and
advised that they wish to install a new fuel tank contained
within concrete .galls and floor, therefore
BE IT RESOLVED, that the application for a Special Permit
submitted by Suit�Kote Corp. is hereby referred to the
Cortlandville Planning Board for their review and
recommendation.

WHEREAS, Mr. Allen Schwartz was in attendance and advised that
their intent was to erect a medical care facilities on Fisher
Ave., commonly known as PHP, therefore

Health Services Medical Corp. of CNY Inc., is hereby referred to
the Cortlandville Planning Board for their review and

RESOLUTION #288 RESCHEDULE NEXT TOWN BOARD MEETING
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, the next Town Board meeting had been rescheduled for -
Wednesday, November 22, 1989, however the 1990 Budget must be
adopted no later than November 20th, therefore
BE IT RESOLVED, that the next Town Board meeting is rescheduled
to be held on the usual date, November 1.5, 1999 at 5:50 p.m.
Councilman Thorpe made a motion, seconded by Councilman
O'DonnelL, to receive and file the request -from Richard Finn to
have a road sign for Fairgrounds Dr. put at the end of their
street. All voting aye, the motion was carried.
Councilman Rocco apprised Mrs. Gibson of Halstead Rd. that
they would address the issue of sewers for that location soon.
Supervisor Pierce apprised those in attendance that the
Masterplan for sewers in the Town is as follows:
1. Starr Road
2. Lamont Circle
3. Bowling Green
4.. Highland Road
He also reported that he has discussed this problem with
Assemblyman Rappleyea, and has requested assistance with funding
if possible.
Supervisor Pierce apprised the Town Board that they have
received copies of a proposal for reviewing the Towns codes. He
requested that everyone review the information as a gentleman
will attend our next meeting on December 6, 1989 to discuss this.
