Town CEO, Bruce Weber apprised that the Public Hearing can still be held, and final action will be taken at the July 19, 1989 meeting. Supervisor Pierce called for a vote from the Board members. RESOLUTION #175 RECEIVE APPROVAL FROM STATE - LIME HOLLOW WELL COMPLETION AND NORTHWEST WATER IMPROVEMENT PROJECTS Rec approval from State - Lime Motion by Councilman O'Donnell Hollow well & Seconded by Councilman Thorpe Northwest Water VOTES: ALL AYE ADOPTED WHEREAS, per Resolution No. 94 of 1989 and Resolution No. 111, the Town Board of the Town of Cortlandville was authorized to apply to the State Comptroller of the State of New York for permission to provide water improvements in said Town known as the "Lime Hollow Well Completion Project" and the "Northwest Cortlandville Water Improvement Project" respectively, and WHEREAS, the Town Clerk has received notification from the State Comptroller of acceptance of said applications, therefore BE IT RESOLVED, that the Town Board does hereby receive notification from the State Comptroller that the projects known as "Lime Hollow Well Completion Project" and "Northwest Cortlandville Water Improvement Project" are hereby granted by the State in accordance with the resolution adopted on May 03, 1989, and also RESOLVED, that said documents from the State Comptroller shall be received and filed. RESOLUTION #181 APPOINT PETER ALTERI, JR. RESOLUTION #182 AUTHORIZATION TO EXTEND WATER 600 FT. RT. 13 - AND SET HYDRANT Motion by Councilman O'Donnell Extend water Seconded by Councilman Testa 600 ft. Rt13 VOTES: ALL AYE ADOPTED 134 Wednesday July 5, 1989 Page 6 WHEREAS, the Water Department has attempted and found it to be impossible to bore under the road near Cortlanes, to extend Town water to the businesses on the South side of Route 13, and WHEREAS, other alternatives have been explored and found to be too costly, therefore BE IT RESOLVED, that the Water Department is hereby authorized to extend the Town Water line approximately 600 feet on the south side of Route 13 in order to pick up any businesses on that side of the road, and also RESOLVED, that they are also authorized to install a hydrant on that side of the road. Supervisor Pierce offered the privilege of the floor to Gary VanGorder. Mr. VanGorder distributed copies of layouts for a Gary Vangorder proposed newsletter for the Town of Cortlandville. Newsletter A discussion followed regarding the procedure involved with distributing such a newsletter. Supervisor Pierce apprised that the Town would make a decision regarding said newsletter and submit the information to him at the next meeting. Supervisor Pierce offered the privilege of the floor to Roy Susskind, Manager of J.M.Murray Center, Inc. In reviewing the special permit application of J.M. Murray Center, Inc, the Board members asked Mr. Susskind about the chemicals that are stored at the Center. They Roy Susskind asked how they are used, are they volatile, how are they Special Permit disposed of, if there is a containment center in case of spills. Mr. Susskind explained the procedures used, how the chemicals are stored, how the chemicals are disposed of, and why the proposed new building is designed more efficiently for these operations. RESOLUTION #183 DECLARE NEGATIVE IMPACT - SPECIAL PERMIT - J.M.MURRAY CENTER, INC. Motion by Councilman O'Donnell Declare Negative Seconded by Councilman Thorpe Impact J -M -Murray VOTES: ALL AYE ADOPTED WHEREAS, per State Environmental Quality Review Act, J.M.Murray Center, Inc. is required to file a Short Environmental Assessment Form to determine whether the proposed project will have any impact on the environment, and WHEREAS, the Town Board as Lead Agency for this project, has reviewed said Assessment Form, therefore BE IT RESOLVED, that the Town Board does hereby declare that the proposed project of J.M.Murray Center, Inc. will have no significant impact on the environment, and also RESOLVED, that the Supervisor is hereby authorized to sign a Negative Declaration regarding the application. 11 1 1 135 1 1 Wednesday July 5, 1989 Page 7 RESOLUTION #184 APPROVE SPECIAL PERMIT - J.M. MURRAY CENTER, INC. Motion by Councilman Thorpe Seconded by Councilman o'Donnell VOTES: ALL AYE ADOPTED WHEREAS, application was made by J.M.Murray for an Aquifer Protection Area Special Permit and recommendations have been received from the County Planning Baord and the Town of Cortlandville Planning Board, and a hearing had been duly held before the Town Board, now therefore BE IT RESOLVED, that the Town Board does hereby authorize approval of an Aquifer Protection Area Permit No. 9 for 1999 for J.M.Murray Center, Inc.
