PUBLIC HEARING NORTHWEST CORTLANDVILLE WATER IMPROVEMENT A Public Hearing was held at the Town Hall, 15 Terrace Road in the Town of Cortlandville on April 05, 1989 at 7:30 o'clock p,m., regarding the establishment of a water improvement area in the Town of Cortlandville -to be designated "Northwest Cortlandville Water- Improvement". Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline H. Parker Others present were Town Attorney, Phillip Rumsey; Town Highway Superintendent, Carl Bush; Town Engineer, Hayne Smith; newsreporters, Skip Chapman from the Cortland Standard, and Mickey Finlay from WKRT; and Town residents, Katherine Wickwire and her mother, Bob Moore, Jim Toukatly, Barbara Kuhlman, Brent Cross, Robert Goodale, Mary Fowler, Karen Bush and Cathy Smith. LEGAL NOTICE , NO_ TICS OF PUBLIC HEARING TOWN OF CORTLANDVILLE ORDER „ PURSUANT TO TOWN LAW SECTION 209- q(3) "NORTHWEST CORT- LANDVILLE WATER IMPROVEMENT" Whereas, there was filed in the Office of the Town Clerk of the Town of Cort- landville, Cortland County, New York, general plans, map and engineering report relating to the con- struction of a public water service extension to in- clude the areas of Kinney Gulf road between NYS Rt. 281 and Highland Road, Westmorelane, a portion of Blue Creek Road, Cosmos Hill Road, Alexan- dria Drive, Meadow Lane, Hillside' Drive, Bell Drive t and a portion of NYS Rte. 281 between Blue Creek Road and,Bell Drive, as re- quired by Section 209-q and 209-c of the Town Law, and are available for public in- spection,;and Whereas the proposed, improvement consists of easements and other land acquisition, sitework, the installation of approx- imately 26,000 feet of water main, pressure booster station, -hydrants, service connection, and other items in accordancee with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and Whereas, the maximum amount proposed to be ex- pended for said improve- ment is $1 ,000,000.00 and Whereas, the proposed method of financing the said improvement is by the. issuance of bonds by the Town of Cortlandville for a maximum term of forty years ,. at prevailing r iin- teaest all costs; including the principal' and interest on said bonds or other I. obligations authorized to be issued shall be borne by the lands benefited by such improvement. and such costs shall -be assessed, levied and collected from the s vQral lots. or po rsals of land within said Tow, of Corilonciv.ille in,just :,pro- I portion to the amount of benetit which the improve`. ment shall confer - u.pon such lots or parcels; it is. The Public Hearing was called to order by Supervisor Pierce at 7:30 o'clock p.m. He requested that all those in attendance rise and pledge allegiance to the flag. The Town Clerk read aloud -the notice as shown: Supervisor Pierce offered the privilege of the floor to those present. Town Resident, A.W.Roberts from 981 Rt.222 apprised the Board that his water has been polluted for some time. He asked if it was feasible for the Town to extend Town water to him, as he is located on a strip of Town land situated between; Fairview and Highland on the West and Rt. 201 on the East which does not have access to Town water. Supervisor Pierce apprised Mr. Roberts that because of his location, to extend water- to him would involve laying about one mile of pipeline, which could be very costly to the Town. Mr, Pierce also stated that eventually Town water would become available to Mr. Roberts and other residents located in this area; but not from this project. He stated that he would request the Town Engineer to prepare a cost figure for extension of Town Water to the residents in the area in question. 1 Wednesday April 05, 1999 Page 2 Mr' Roberts quest�cned the bonding process, as the proposed water project will require $1'DOOrO0O,00 bonding. Town, Attorney, PhiIlip Rumsey explained in detail how the bonding process murked and the bonding limit. Town resident, Rutherford Bell was concerned that the proposed project would put farmers in the area out of business. His main concern was the be:efit tax which would be levied on road frontage. This extra 4-ax would be a burden to the area farmer. After a lenghy discussion regarding this subject it the consensus of the Board that the process for determining benefit tax should be reviewed by the Town, to accommodate land that is zoneal "AgriculturaI" Town resident, Bob Moore commended the Board for the action taken. He stated Lhat the people that would receive the Town water from the proposed proJect would be grateful, and thankfuI. He complimented the Board for a job well done. Town resident, Jim Touhatly from Meadow L�ne ��ked the Board how much increase in benefit tax the proposed project would create, Town Engineer, Hayne Smith replied thit would be approximately $192.00 a year for the average taxpayer who benefits from Town water throughout the Town of [ortIandviIIe. Sevc-_�ral other asked regarding the advantages and disadvantages of the proposed project. Among these were: the cost of operating a pump, what side of the road the project would be on, when the pro�ect wiIl t)egin, and where the water would be supplied from, and whether or not the Town mould supply water for future subdivision developments. Supervisor Fierce apprised that the project would commence sometime this year, the yater would be supplied by the old well and the new one, developers wilI continue to install their own water Gnd sewer lines, and the advantages definitely outweigh the disadvantages, among which include better fire protection, upgrading the property vues and, most importA-nt, unpolIuted mate— for everyone mhu has the option to hook into the Town's water system. PUBLIC HEARING SUBDIVISION REGULATIONS A Public Hearing was held at the Town Hall, 15 Terrace Road in the Town of Cortlandville on April 05, 1989 at 7:30 O'clock p.m., regarding proposed revisions to the Subdivision Regulations for the Town of Cortlandville. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline H. LEGAL NOTICE NOTICE OF PUBLIC HEARING TOWN OF CORTLAND V ILLE SUBDIVISION REGULATIONS Notice is hereby given that a public hearing will be held on April 5, 1989 at 7:30 o'clock p.m. at the Cortlandville Town Hall, 15. Terrace Road, Cortland, Now York concerning pro- posed amendments to the Town of Cortlandville Rules and Regulations for . the Subdivision of Land adopted by the Town Board and Planning Board May 3, 1967. Proposed amend- ments include changes to the required dimensions of local street cul-de-sacs, elimination of the require- ment for public hearings for, certain subdivisions, and changes in roadway and drainage re- quirements. r At the time and place of said hearing all parties in interest and citizens shall have an opportunity, to be heard. Parker, Town Clerk Town of Cortlandville 15 Terrace Road Cortland, New York 70-11 The Public Hearing was called to order- by Supervisor - Pierce at 3:15 o'clock p.m. The Town Clerk read aloud the notice as shown: Supervisor Pierce apprised those present what was involved With the proposed amendments. The length of the cul-de-sacs would be changed as well as changes in roadway specifications. There would also be no requirement for a Public Hearing for certain subdivisions. He also apprised that final approval would be made by the Cortlandville Planning Board, Town H'way Superintendent, Carl Bush explained why they needed new specifications for these cul-de-sacs. For servicing these areas with plows and fire equipment, there is more of a need -For longer and wider roadways. Supervisor Pierce offered the privilege of the floor to Brent Cross. 1 1 Wednesday April 05` 1989 Page E Mr, Cross questioned how a cul-de-sac is measured, for future reference. Counci1man Thorpe explained th,et the maximum is only a basis to go by. All situations are not the same. Final decision would be made by the Planning Board. Mr. Bush stated that the measurement would be total roadway length, including the turn around - After a Iengthy discussion, Supervisor Pierce apprised that final action wiIl be made by the CortlandvilIe Planning Board, including a Public: Hearing before said Board as soon as the text is defined and prepared' With no furthL-r questions or discussion, a mo-Gion was made by Councn Rocco, seconded by Councllman Thorpe, to close the Public Hearing- All voting aye, the motion was carried. Regular Meeting The Regular Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York., with Supervisor Pierce presiding. The meeting was called to order by Supervisor Pierce at 8:40 o'clock p.m., following two Public Hearings. A motion was made by Councilman Rocco, seconded by Councilman Testa, to approve as written the approve TB Cortlandville Town Board minutes of March 15, 1989. RESOLUTION #106 REFERRAL TO TOWN PLANNING BOARD - ZONE referral to CHANGE - AL ZOGG - POLKVILLE Planning Board Motion by Councilman O'Donnell Zone change Seconded by Councilman Thorpe Al Zogg VOTES: ALL AYE ADOPTED WHEREAS, a request was resubmitted to the Town Board from Alfred Zogg for a zone change from Agriculture to Business at tax map parcel no. 88.00-01-41.000, and WHEREAS, this request was submitted in 1988 and denied because of the soil and location in the flood plane, and WHEREAS, the next step in the process of acquiring a zone change is to present this request to the Cortlandville Planning Board, therefore BE IT RESOLVED, that said request from Al Zogg for a zoning change is hereby referred to the Cortlandville Planning Board for review. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe, to receive and file the letter and rec & file copy of Local Law #5 of the Village of Homer from JoAnne Local Law #5 Williams to the Town of Cortlandville. All voting aye, for Homer the motion was carried. This law terminates the Village of Homer's status as a real property tax assessing unit. RESOLUTION #110 AUTHORIZE TOWN ATTORNEY TO PROCEED WITH CREATING SEWER IMPROVEMENT AREA RT 11 PROPERTIES IN TOWN OF C'VILLE AND PREPARE CONTRACT WITH VILLAGE OF HOMER Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, the Village of Homer bills the Town of Cortlandville for sewer accounts located in the Town and maintained by the Village, and certificate of attendance ChsorIoa Pzoot, Authorize TC attend ZMTC conference authorize town attorney to create sewer improvement adopt Northwest C'ville water improvement Wednesday April 05, 1989 Page 5 WHEREAS, the Town of Cortlandville is only allowed, by law, to bill these customers the minimum, since they have no water meters, and WHEREAS, this process results in a considerable monetary loss for the Town of Cortlandville, and WHEREAS, per advise from the Town Attorney, the first step in the process of alleviating this problem is to create a Sewer Improvement Area for these Town properties on Rt.11, therefore BE IT RESOLVED, that the Town Attorney, Phillip Rumsey is hereby authorized and directed to proceed with the process needed to establish a Sewer Improvement Area for those properties located on Rt. 1.1 in the Town of Cortlandville and serviced by the Village of Homer for sewer, and also RESOLVED, that Mr. Rumsey is hereby authorized to prepare a proposed contract with the Village of Homer, regarding these accounts. RESOLUTION #11.`1 ADOPT NORTHWEST CORTLANDVILLE WATER IMPROVEMENT PROJECT Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES; ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk o-F the Town of Cortlandville, Cortland County, New York, general plans, map and engineering report, relating to the construction of a public water service extension to include the areas of Kinney Gulf Road between NYS Rt. 281 and Highland Road, Westmorelane, a portion of Blue Creek. Road, Cosmos Hill Road, Alexandria Drive, Meadow Lane, Hillside Drive, Bell Drive and a portion of NYS Rt. 281. between Blue Creek Road and Bell Drive in the Town of Cortlandville and designated "Northwest Cortlandville dater Improvement,"as required by Section 209-q (2) and 209-c of the Town Law, and WHEREAS, said project is a Type II action which does not require an environmental impact statement or any other determination or procedure, pursuant to the State Environmental Quality Review Act and Regulations, and WHEREAS, an Order was duly adopted by the Town Board on (''larch 1.5, 1989 reciting the filing of said general plans, the improvements proposed, and the estimated expense thereof and specifying April 5, 1989 at 7:30 o'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the said Board would meet to consider the documents -Filed as aforesaid and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, such Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the Board on the 5th day of April, 1989 commencing at 7:30 P.M. at the Town Hall in the said Town and discussion upon the matter having been had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and Wednesday April 05, 1989 Page 6 NOW, upon the evidence given upon such hearing and upon the motion of Raymond Thorpe, Councilman, seconded by Ronal Rocco, Councilman, and unanimously passed,it is RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of CortlandvilIe are in compliance with Section 209-c of the Town Law of the State of New York and are otherwise sufficient, and that to establish the aforesaid water improvement is in the public interest, and it is further RESOLVED AND DETERMINED, all costs, including the principal and interest on said bonds or other obligations authorized to be issued shall be borne by the lands benefited by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of CortlandviIIe in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby determined that all lots or parcels in the Town of CortlandviIIe outside of Villages, capable of being serviced by the "Article 12-C" Water Improvement heretofore and hereafter provided, are lots or parcels benefited by the proposed water improvement; and the costs of the proposed water project and all previous improvements shall be spread upon and over the enlarged benefited area, all of such improvements constituting one water system, such system being described by and including the areas set forth in the "Lime Hollow Well Completion" Resolution adopted by this Board on March 15, I989 and the following parcels designated on the 1989 Cortland County Real Property Tax Maps as Cortlandville Tax Parcels: Tax Mao 76,13-01: Parcels: 01, 02, 03, 04, 05, 06, 07, 0B, 09, 10, 11, 12, 13, 14; 15, 16.2, 16.1, 18 and 19. RESOLVED AND DETERMINED, that the establishment of a water improvement as proposed in said plans be authorized pursuant to Section 209-q (6) (c) of the Town Law; that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made available or provided for; and that such improvement shall be designated and known as "Northwest Cortlandville Water improvement," and it is further RESOLVED AND DETERMINED, that the proposed improvement, including costs or rights of way, construction costs, I egal fees, engineering and consultant fees, and all other expenses approximate to be a maximum of $1,000,000.00 shall be financed by the issuance of bonds by the Town of Cortlandville for a maximum term of twenty-five years at prevailing interest, and it further RESOLVED AND DETERMINED, that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from water rates, charges and fees upon all lots or parcels heretofore and hereafter- serviced by Town Law Article 1.2-C Water Improvements, and it is fur than RESOLVED, that the Town Clerk of this Town shall within ten (10) days after •the adoption of this Resolution file certified copies thereof in duplicate in the Office of the State Department of Audit and Control at Albany, New York, together- with an application by this Board in duplicate for permission to create such improvement project as provided for by the Town Law section 209- q(13) and that such application shall be executed by and in behalf of the Town Board by the Supervisor of the Town; and further file a certified copy of this Resolution in the Cortland County Clerk's Office as provided for by the Town Law, Section 209-q (6) (c), and it is further RESOLVED, that this Resolution is adopted subject to permissive referendum. 1 11 1 87 1 1 1 Wednesday April 05, 198? Construction in the amount of $85,000.00, and WHEREAS, Town Engineer, Hayne Smith has proposed an additional extension of this sewer- line to Rt. 281 to accommodate further development, therefore BE IT RESOLVED, that the Town Board does hereby authorize a work order in the amount of $17,772.60 to extend the Bennie Road Sewer Project. RESOLUTION #1.11 APPOINT A COMMITTEE TO REVIEW TOWN OF CORTLANDVILLF_ PLUMBER REQUIREMENTS appoint committee to review Plumber Motion by Councilman Rocco requirements Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, due to the increase of construction in the Town of Cortlandville the applications for approved plumbers have increased, which has initiated a review of the process to accept a plumber to the Town's Approved Plumber List, and WHEREAS, to insure that all plumbers are qualified to do hookups to the water and sewer systems in the Town, it has become necessary to update the requirements, therefore BE IT RESOLVED, that the Supervisor is hereby authorized and directed to appoint a committee to review the requirements for becoming an approved plumber in the Town, Supervisor Pierce offered the privilege of the floor to Robert Goodale, who desires Town water for his privilege of proposed subdivision on Rt.215 in the Town of :loor - R.Goodale Cortlandville, His proposed subdivision will eventually lesires Town waterinclude 49 units. Presently, 3 lots have been approved. Mr. Goodale would like the Town to extend the line at the Town's cost. Wednesday April 05, 1989 Page 10 After much discussion, Supervisor Pierce apprised Mr. Goodale and those present that the policy of the Town is for the developer to install water lines in his project and connect to the closest municipal lines available, at the expense of the developer. After completion and approval, the lines are dedicated to the Town. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to recess the regular meeting and convene to an Executive Session, in the matter of pending litigation. All voting aye, the motion was carried, The following information was received from the Supervisor's office- A motion was made by Councilman Rocco, seconded by Councilman Thorpe, to adjourn the Executive Session and reconvene the Regular Meeting.
