The Regular Meeting of the Town Board of the Town
of CortIandville, was held at the Town Hall, 15 Terrace
Road, Cortland, New York, with Supervisor Pierce
presiding.
Members present: Supervisor Melvin Pierce

The meeting was called to order by Supervisor
Pierce at 7:35 o'clock p.m., following a Public Hearing
for the Special Permit Application by Dean Mitchell.

WHEREAS, per State Environmental Quality Review Act,
Dean Mitchell is required to file a Short Environmental

project in the Town of CnrtIandvilIe will have any
significant on the environment, and
WHEREAS, the Town Board, as Lead Agency for this
project, has reviewed said Assessment Form, therefore
BE IT RESOLVED, that the Town Board does hereby declare
that the proposed project of Dean Mitchell will have no
significant impact on the environment, and also
RESOLVED, that Supervisor Pierce is hereby authorized to
sign a Negative Declaration regarding this application.

Whereas, there was filed
in the Office of the Town
Clerk of the Town of Cort-
landville, Cortland County,
New York, general plans,
map and engineering
report relating to the com-
pletion of a water well pro-
ject adjacent and to the
south of Lime Hollow Road
for the benefit of all pro-
perties on the town wide
water improvement
system, as required by Sec-
tion 209-q and 209-c of the -
Town Law, and are
available for public inspec-
tion, and
Whereas, by prior order
and resolution test wells,
surveying and land acquisi-
tion have been accomplish-
ed, and
Whereas, the proposed,
improvement consists of
sitework, pumphouse con-
struction, purchase and in-
stallation of approximately
5,200 feet .of pipe,
generator, pump, motor,
chlorination, hydrants,
electric and other items in
accordance with the said
plans now on file in the Of-
fice of the Town Clerk of
the Town of Cortlandville,
and,
Whereas, the maximum
amount proposed to be ex-
pended for said improve-
ment is $315,000.00 and
,Whereas, the proposed
method of financing the
said improvement is pay-
ment of the balance of the
Capital Reserve Fund for
the Lime Hollow Well Pro-
ject (current balance ap-
proximately $156,000.00),
which payment will be sub-
ject to permissive referen-
dum, and the balance of
the total cost from the is-
suance of bonds by the
Town of Cortlandville for a
maximum term of twenty-
five years at prevailing in-
terest; all costs, including
the principal and interest
on said bonds. or other obli-
gations authorized to be
issued shall be borne by
the lands benefited by -such
improvements and such
costs shall be assessed,
levied and collected from
the several lots or parcels
of land within said Town of
Cortlandville in just pro-
portion to the amount of
benefit which the improve-
ment shall confer upon
such lots or parcels; it is
further hereby proposed
that all lots or parcels in
the Town of Cortlandville
outside of Villages,
capable of being serviced
by the "Article 12-C" Water
Improvements heretofore
and hereafter provided,

WHEREAS, there was filed in the Office of the Town Clerk
of the Town of Cortlandville, Cortland County, New York,
general plans relating to the establishment of a water
improvement project for the Groton Avenue Plaza in the
Town of Cortlandville and designated "Rt. 281/Groton
Avenue Plaza Water Improvements-1989,"as required by
Section 209-q (2) and 209-c of the Town Law, and a short
Environmental Assessment Form pursuant to the State
Environmental Quality Review Act, and are available for
public inspection, and
WHEREAS, an Order was duly adopted by the Town Board on
January 04, l989 reciting the filing of said general
plans, the improvements proposed, and the estimated
expense thereof and specifying January 18, 1989 at 5:30
o'clock p.m. as the time and the said Town Hall in the
said Town of Cortlandville as the place where the said
board would meet to consider the documents filed as
aforesaid and to hear all persons interested in the
subject thereof, concerning the same, and
WHEREAS, such Order was duly posted and published as
required by law, and
WHEREAS, a hearing in the matter was duly held by the
board on the 18th day of January, 1989 commencing at
5:30 p.m. at the Town Hall in the said Town and
discussion upon the matter having been had and all

authorized pursuant to Section 209-q (6) (c) of the Town
Law; that the improvement therein mentioned be
constructed and the service therein mentioned be
provided for upon the required funds being made
available or provided for; and that such improvement
shall be designated and known as ''Rt. 231/Broton Avenue
Plaza Water lmprovements-1989"^. and it is further

including costs or rights of way, construction costs,
legal fees, engineering and consultant fees, and all
other expenses approximate to be a maximum of

Schedule NU-1, issued pursuant to Article 57-A of the
Arts & Cultural Affairs Law, and containing legal

WHEREAS, it has been determined that there has existed a
water- pollution problem in the area of Cosmos Hill and
Hillside Drive in the Town of Cortlandville, and
WHEREAS, Town Engineer, Hayne Smith was authorized to
investigate the feasibility of extending Town Water to
said area, and
WHEREAS, the Renaissance Subdivision, located in the
area of Cosmos Hill and Rt. 281, does need Municipal
water to continue their project, and
WHEREAS, the Village of Homer, due to various problems,
is unable to furnish water to said subdivision, and
WHEREAS, the Town Board has held a Work Session at which
the Town Engineer presented 4 proposals to extend Town
water to.the area in question, and these plans have been
reviewed by the Board, and
WHEREAS, the Board determined that the most feasible
plan submitted is Plan IV, therefore
BE IT RESOLVED, that the Town Engineer is hereby
authorized and directed to proceed with plan IV, which
will provide Town Water- to the areas of Hillside Drive,
Cosmos Hill, Alexandria Drive, and Bell Drive.

of the Town of Cortlandville, Cortland County, New York,
general plans, map and engineering report relating to
the completion of a water well project adjacent and to
the south of Lime Hollow Road for the benefit of all
properties on the town wide water- improvement system, as
required by Section 209-q and 209-c of the Town Law, and
are available for public inspection, and
WHEREAS, by prior order and resolution test wells,
surveying and land acquisition have been accomplished,
and
WHEREAS, the proposed improvement consists of sitework,
pumphouse construction, purchase and installation of
approximately 5,200 lineal feet of pipe, generator,
pump, motor, chlorination, hydrants, electric and other
items in accordance with the said plans now on file in
the Office of the Town Clerk of the Town of
Cortlandville, and
WHEREAS, the maximum amount proposed to be expended for
said improvement is $470,000.00, and
WHEREAS, the proposed method of financing the said
improvement is payment of the balance of the Capital
Reserve Fund for the Lime Hollow Well Project (current
balance approximately $156,000.00), which payment will
be subject to permissive referendum, and the balance of
the total cost from the issuance of bonds by the Town of
Cortlandville for a maximum term of twenty-five years at
prevailing interest; all costs, including the principal
and interest on said bonds or other obligations
authorized to be issued shall be borne by the lands

benefited by such improvement and such costs shall be
assessed, levied and collected from the several lots or
parcels of land within said Town of Cortlandville in
just proportion to the amount of benefit which the
improvement shall confer upon such lots or parcels; it

the Town of Cortlandville outside of Villages capable of
being serviced by the "Article 12-C" Water Improvements
heretofore and hereafter provided, are lots or parcels
benefited by the proposed water improvements and the
cost of the proposed well project and all previous
improvements shall be spread upon and over the enlarged
benefited area, all of such improvements constituting
one water system, such system being described by and
including the areas set forth in dissolved former

WHEREAS, it is further proposed that the costs of
management, maintenance, operation and repair of said
improvement or services shall be a charge upon the area
of the Town of Cortlandville outside of Villages and
shall be levied and collected in the same manner and at
the same time as other Town charges, provide that it i!
the intention of the Town Board that such costs will be
raised in the first instance from water rates, charges
and fees upon all lots or parcels heretofore and
hereafter serviced by Town L_.aw Article 12-C Water
Improvements,
IT IS HEREBY'
ORDERED, that a meeting of the Town Board of the said
Tot -in of Cortlandville shall be held at the Town Hail,
Terrace road, Cortland, New York on the 15th day of
('larch, 1989 at 5:30 o'clock p.m. of that day to hear all
persons interested in the proposed water well
improvement, and for such other action of said Town
Board with relation to 'the said water improvement as may
be required by law or be deemed proper.
A discussion followed with Town Attorney, Phillip
Rumsey, regarding the status of the new contract between
the Town of Cortlandville and the Village of f-lomer contract With
pertaininn to the set,er billing and relevy of delinquent Homer Water
accounts.
Supervisor Pierce offered the privilege of the
floor to ,Toe Gunzenhauser .
Mr. Gunzenhauser voiced concern regarding illegal
dumping off Lime Hollow Road in the Town of
Cort 1andvi 1 .le.
After discussion on the subject the Town Code
Enforcement Officer, Bruce Weber advised Mr.
Gunzenhauser that he should put something across the
road entrance to discourage and could prevent dumping
from occurring.
A motion was made by Councilman Thorpe, seconded by
Councilman O'Donnell, to recess the regular meeting and
convene to an Executive Session in the matter of a
personnel problem. All voting aye, the motion was
carried.
The following information was received from the
Supervisor's office.
