Regular Meeting The Regular Meeting of the Town Board of the Town of CortIandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. RESOLUTION #76 ADOPT 291/GROTON AVE PLAZA WATER i NFEOVEMEN• [ PROJECT Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED Adopt 281/Grol Ave. Water IT, Wednesday March 01, 1999 Page 3 WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the establishment of a water improvement project for the Groton Avenue Plaza in the Town of Cortlandville and designated "Rt. 281/Groton Avenue Plaza Water Improvements-1989,"as required by Section 209-q (2) and 209-c of the Town Law, and a short Environmental Assessment Form pursuant to the State Environmental Quality Review Act, and are available for public inspection, and WHEREAS, an Order was duly adopted by the Town Board on January 04, l989 reciting the filing of said general plans, the improvements proposed, and the estimated expense thereof and specifying January 18, 1989 at 5:30 o'clock p.m. as the time and the said Town Hall in the said Town of Cortlandville as the place where the said board would meet to consider the documents filed as aforesaid and to hear all persons interested in the subject thereof, concerning the same, and WHEREAS, such Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the board on the 18th day of January, 1989 commencing at 5:30 p.m. at the Town Hall in the said Town and discussion upon the matter having been had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Raymond G. RESOLUTION #79 AUTHORIZE TOWN CLERK TO PROCEED WITH NEW RECORDS RETENTION AND DISPOSITION SCHEDULE Authorize Town Clerk to Motion by Councilman Thorpe proceed with new Seconded by Councilman Testa Retention schedule VOTES: ALL AYE ADOPTED WHEREAS, per Resolution #21.8 of 1988, the Town Clerk was appointed Records Management Officer for the Town of Cortlandville, and WHEREAS, a new schedule has been received by the Town Clerk to allow proper procedure, therefore BE IT RESOLVED, that Records Retention and Disposition Schedule NU-1, issued pursuant to Article 57-A of the Arts & Cultural Affairs Law, and containing legal minimum retention periods for municipal government records, is hereby adopted for use by all municipal officers in disposing of municipal government records listed therein, and further Wednesday March 01, 1999 Page 6 RESOLVED, that in accordance with Article 57-A: a. only those records will be disposed of that are described in Records Retention and Disposition Schedule NU-1 after they have met the minimum retention period prescribed therein: b' only those records will be disposed of that do =�~ not have sufficient administrative, fiscal, legal, or historical value to merit retention beyond established time periods. Seconded by Councilman Testa n}zenlc to VOTES: ALL AYE ADOPTED Burnham WHEREAS, per Resolution 433 of 1989, the Town Board denied application for a Trailer Park Permit for Cortland Estates Mobile Home Park and authorized the Town Clerk to return the check that Mr. Kenneth Burnham has submitted for payment of such, and WHEREAS, Mr. Burnham has resubmitted payment for said Trailer Park Permit and apprised that required compliances had been met, and WHEREAS, the Town Code Enforcement Officer, Bruce Weber has apprised the Board that code violations have not all been corrected, therefore BE IT RESOLVED, that the Town Clerk is hereby authorized to return the check to Mr. Burnham with further instructions. RESOLUTION #81 APPOINT PARTICIPANTS' REPRESENTATIVE FOR Motion by Councilman O'Donnell Appoint rep Seconded by Councilman Testa Otte VOTES: ALL AYE ADOPTED 0r8elI Fund WHEREAS, the Town of Cortlandville, the City of Cortland Water Board and County of Cortland Health Department have reached a settlement agreement with the cooperation of the State DEC and Attorney General's office, and WHEREAS, the settlement provides for a remediation fund to be managed by the participants subject to approval of the DEC, therefore BE IT RESOLVED, that Town Engineer, Hayne Smith be and hereby is appointed to serve as the Town of CortlandviIle s representative on the participants' committee upon -Filing of the settlement in the US District Court in the case of the State of New York et. al., VS SCC. Renaissance Wednesday March 01, 1989 Page 7 WHEREAS, it has been determined that there has existed a water- pollution problem in the area of Cosmos Hill and Hillside Drive in the Town of Cortlandville, and WHEREAS, Town Engineer, Hayne Smith was authorized to investigate the feasibility of extending Town Water to said area, and WHEREAS, the Renaissance Subdivision, located in the area of Cosmos Hill and Rt. 281, does need Municipal water to continue their project, and WHEREAS, the Village of Homer, due to various problems, is unable to furnish water to said subdivision, and WHEREAS, the Town Board has held a Work Session at which the Town Engineer presented 4 proposals to extend Town water to.the area in question, and these plans have been reviewed by the Board, and WHEREAS, the Board determined that the most feasible plan submitted is Plan IV, therefore BE IT RESOLVED, that the Town Engineer is hereby authorized and directed to proceed with plan IV, which will provide Town Water- to the areas of Hillside Drive, Cosmos Hill, Alexandria Drive, and Bell Drive. RESOLUTION #89 9ET DATE FOR PUBLIC HEARING LIME HOLLOW WELL PROJECT COMPLE..rION Set Public Hearing Lime Hollow Well Motion by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, there was filed in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans, map and engineering report relating to the completion of a water well project adjacent and to the south of Lime Hollow Road for the benefit of all properties on the town wide water- improvement system, as required by Section 209-q and 209-c of the Town Law, and are available for public inspection, and WHEREAS, by prior order and resolution test wells, surveying and land acquisition have been accomplished, and WHEREAS, the proposed improvement consists of sitework, pumphouse construction, purchase and installation of approximately 5,200 lineal feet of pipe, generator, pump, motor, chlorination, hydrants, electric and other items in accordance with the said plans now on file in the Office of the Town Clerk of the Town of Cortlandville, and WHEREAS, the maximum amount proposed to be expended for said improvement is $470,000.00, and WHEREAS, the proposed method of financing the said improvement is payment of the balance of the Capital Reserve Fund for the Lime Hollow Well Project (current balance approximately $156,000.00), which payment will be subject to permissive referendum, and the balance of the total cost from the issuance of bonds by the Town of Cortlandville for a maximum term of twenty-five years at prevailing interest; all costs, including the principal and interest on said bonds or other obligations authorized to be issued shall be borne by the lands 1 1 L 5'7. Supervisor Pierce offered the privilege of the floor to ,Toe Gunzenhauser . Mr. Gunzenhauser voiced concern regarding illegal dumping off Lime Hollow Road in the Town of Cort 1andvi 1 .le. After discussion on the subject the Town Code Enforcement Officer, Bruce Weber advised Mr. Gunzenhauser that he should put something across the road entrance to discourage and could prevent dumping from occurring. A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell, to recess the regular meeting and convene to an Executive Session in the matter of a personnel problem. All voting aye, the motion was carried. The following information was received from the Supervisor's office.
