TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 15 Terrace
Road, Cortland, New York on November 20, 1990 at 5:00
p.m. with Deputy Supervisor, Raymond Thorpe presiding.
Members present: Deputy Supervisor, Raymond Thorpe
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, Theodore Testa
Town Clerk, Pauline Parker
Absent: Supervisor, Melvin Pierce
Others present were Town Attorney, Phillip Rumsey;
Assessor, David Briggs; Highway Supt., Carl Bush; Fire
Commissioners, David Payne, Jack Harvey and Tom Honour;
Newsreporter, Laura Jones; Executive Director, Mr.
Darrell Newvine of the Cortland County Chapter of the
NYS ASsoc. for Retarded Children Inc., and Town
residents, Dorthea Fowler and an unidentified person.
The meeting was called to order by Deputy
Supervisor, Raymond Thorpe, at 5:00 p.m. followed by the
pledge of allegiance.
RESOLUTION #299 AUTHORIZE PAYMENT OF VOUCHERS FOR
NOVEMBER
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

Deputy Supervisor Thorpe announced that there are
extra copies of the 1991 budget on the table for anyone
who wants one.
Councilman Rocco made a motion, seconded by
Councilman Testa, to receive and file a copy of the
letter sent to Fiscal Advisors and Marketing Inc. All
voting aye, the motion was carried.
The letter confirmed the retention of their firm as
the Town's financial advisor.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file a copy of the
letter received -from Attorneys Costello, Cooney and
Fearon. All voting aye, the motion was carried.
The letter advised that they had determined that
the City of Cortland and the Waterworks are one entity
for purposes of SEAR review and that they would be an
interested agency instead of an involved agency in
regards to the application of Cortland Housing Group for
a Condition Permit at the Groton Ave. Plaza.

Councilman Rocco made a motion, seconded by
Councilman Testa, to receive and file a letter received
from Homer's Mayor. All voting aye, the motion was
carried.
The letter explained information regarding a sewer
gravity line installed by the Village of Homer many
years ago. _
The Town is negotiating with the Village of Homer
to use the line, and/or purchase it as a result.of our
sewer expansion.
Deputy Supervisor Thorpe explained that the
preliminary budget was reviewed again. It has been
reduced to a 19 cents increase over last years rate.
which is a 5.9% increase. He expressed concern as to
what may happen next year with the budget changes.
Other.Councilman expressed their thoughts.
The Fire Commissioners explained their budget.
Concern was expressed by those in attendance at our
Public Hearing. Questions were asked about the Fire
Dept. having another station in Blodgett.11ill.s, and the
cost for doing this.
The Fire Commissioners explained that they have
received a petition from residents asking for this. It
is not something they have done. Because of receiving
the petition, they are hiring an independent firm to
conduct a survey of the whole fire district of the Town.
Upon completion of this, they will proceed with long
range plans.
The commissioners mentioned that their 1991 budget
is lowered by over $16,000.00
The Town Board requested them. to attend budget
hearings in the future,.as the Town Board cannot respond
to the questions of their budget,, as they are not
involved.
RESOLUTION #299 ADOPT THE TOWN OF CORTLANDVILLE
BUDGET FOR THE YEAR 1991,
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES. ALL AYE . ADOPTED
WHEREAS, on the 7th day of November, 1990, the Town
Board of the Town of Cortlandville, held a Public
Hearing on the preliminarybudgets and the proposed
amounts to be raised by benefit tax on benefited
properties in the Town Sewer Improvement District,
approved by the Town Board, and filed with .the Town
CLerk, for the fiscal year commencing January 01,
1991,and having heard all persons in favor of, or
against any items therein contained, therefore
BE IT RESOLVED, that- the preliminary budgets approved,
filed and amended, and the same is hereby adopted and
established as the annual budget of this Town for the
fiscal year beginning January 01, 1991,.and such annual
budget, as so adopted, is filed with.the.Town CLerk, and
RESOLVED, that the Town CLerk of this Town.shall,prepar.e
and certify, as provided by law, duplicate copies of the
annual budgets hereby amended and adopted, together with
the assessment rolls for the benefit of i.mprovement for
the Water Fund and the Sewer Fund, adopted pursuant to
Section 202-a of the Town Law and within five days
thereof, deliver two copies to the Supervisor of the
Town, and the Supervisor shall present the copies of the
annual budget to the Legislature of Cortland County
within ten days, after his receipt thereof from the
Clerk

Mr. Darrell Newvine, Executive Director of the
Local Chapter of NYS Assoc. of Retarded Children, was
introduced and asked to explain his program.
The site selection law does not apply in this case
because they are renting, instead of purchasing
property. The Town received notice that they were
renting apartments on North Homer Ave. as a courtesy.
There are a total of 19 sites being rented in the area
which accommodates around 55 people. There are still
about 50 names on a waiting list.
RESOLUTION #300 APPROVE CHANGE ORDER FOR THE MCLEAN
ROAD WATER AND SEWER EXTENSION
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, a change order has been submitted by the Town
Engineer, and has been reviewed, therefore
BE IT RESOLVED, that the change order for the McLean
Road Water and Sewer Extension in the amount of
$13,037.64 is hereby approved.
RESOLUTION #301 AUTHORIZE PARTICIPATION IN "HOLIDAY
ON ICE" PROGRAM FOR CORTLAND YOUTH
BUREAU
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a request was received from Francis Tokar,
Director of the Cortland Youth Bureau, asking the Town
to participate again this year for the Cortland Holiday
On Ice Program, therefore
BE IT RESOLVED, that the Town Board chooses to
participate in the "Holiday On Ice Program, and the
budget officer is hereby authorized to send $250.00 for
the Town's cost of the program.
A letter was received from General Codes Publishers
Corp. advising that they are prepared to hold the
editorial conference on the codification of the
legislation of the Town pursuant to their contract.
A date of Thursday, December 20, 1990 at 1:00 P.M.
was set, and the clerk will contact them for
confirmation.
RESOLUTION #302 AUTHORIZE BUDGET TRANSFER
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Budget Officer is hereby
authorized to transfer $20,095.27 from General Fund B
Budget Surplus Funds to B7146.4, to cover the cost of
the purchase of land for the Blodgett Mills Park
Attorney Rumsey reported that the closing occurred
on Friday, November 16, 1990 for buying the land in
Blodgett Mills.

RESOLUTION #303 AUTHORIZE TRANSFER OF FUNDS
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Budget Officer is hereby
authorized to transfer $16,781.60 from General Fund A
Surplus Funds to the following Capital Projects

Mrs. Dorthea Fowler, of Allen Drive, expressed
pleasure for the Town Board's actions on the 1991
budget. She had attended the Public Hearing, saw and
heard many people make comments to this Board. It was
pleasing to her that we have a responsive Board, and it
would have been nice if some of those people attended
the meeting tonight to express their pleasure.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to adjourn the meeting. All voting
aye, the motion was carried.
The meeting was adjourned at 5:25 p.m.
