SPECIAL MEETING The Special Meeting of the Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe Councilman Edwin O'Donnell Councilman Ronal. Rocco Councilman Theodore Testa Town Clerk Pauline H. Parker Others present were Town Attorney, Phillip Rumsey; Town Engineer, Hayne Smith. The meeting was called to order by Supervisor Pierce at 5:30 o'clock p.m., following the pledge of allegiance to the flag. RESOLUTION #244 AUTHORIZE SUPERVISOR TO SIGN CONTRACT - BERNIE THOMA - . PREPARE GRANT - BLODGETT MILLS Motion by Councilman Testa Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized and directed to sign the contract with -Bernie Thoma of Thoma Development, to prepare a Federal.Block Grant to finance a housing rehabilitation -project for -the Blodgett Mills area. RESOLUTION #245 AUTHORIZE PURCHASE OF LAND FOR PUBLIC PARK - KELLOGG ROAD - SUBJECT TO PERMISSI-VE REFERENDUM Motion by Councilman Testa Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED RESOLVED, that the Town of Cortlandville acquire 6.9+ acres of land to establish a public park.area on Kellogg Road in the hamlet of Blodgett Mills, and 7.1+ acres of land adjacent thereto to acquire topsoil. for Town purposes, all at a maximum purchase,of. $20,000.00 and a maximum cost of related expenses of-$1,000.00,-further be i.t . . _ . . . RESOLVED, that pursuant to Town Law Sections 81 (1) (d) and 220 (4), this resolution is adopted subject to a permissive referendum. 3E9 Wednesday, September 13, 1990 Page 2 RESOLUTION #246 AUTHORIZE REMOVAL OF OBSOLETE EQUIPMENT FROM FIXED ASSETS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTE: ALL AYE ADOPTED WHEREAS, a portable cassette tape recorder that was being used by the Cortlandville Planning Board no longer performs, therefore BE IT RESOLVED, that the Supervisor Pierce is hereby authorized and directed to remove said equipment from the Fixed Assets. Councilman Rocco had concern that the local newspaper, the Cortland Standard, does not always attend the Town Boards meetings. Councilman Rocco stated it is the responsibility of this Town Board to contact the local newspaper. It is important to report to the general public what occurs at the meetings. Town Attorney, Phillip Rumsey spoke with the Town Board members on the behalf of the projects that are occurring in the Town now and in the near future. Mr. Rumsey stated how important it was to have a file for a project totally completed with the necessary forms and a very thorough comprehensive report from an Engineer before Public Hearings were scheduled. Mr. Rumsey feels the projects need to be done in a fashion of a plan motive other than a major emergency motive. The Comptroller very carefully looks over every project that is submitted. If any project in the Town is incomplete or the information to this project is unavailable to the public the Comptroller will and has delayed the project. Mr. Rumsey stated we should not be ordering these hearings until we have Engineering materials developed and plans done. We are to offer to the public a full hearing on the projects. This causes embarrassment to you as Town Board members, the employees within this Town Hall and my office who participate in the completion of these necessary reports. Mr. Rumsey stated that we should slow down and take a little bit more time on these projects and complete them properly, in order not to be embarrassed or have to recomplete the project again. Mr. Rumsey also discussed that we will have to adopt another order for the Groton Ave./Luker Road Sewer Improvement Project. A letter was sent from the Comptroller on this project stating that completed project reports were filed three days to soon. It should be filed at least ten days and not more than twenty days before the public hearing. This project was filed twenty-three days before the public hearing which allowed to much time. Town Engineer, Hayne Smith had questions on Lamont Circle, when the project of placing sewer lines within the area will happen. Mr. Rumsey stated to Mr. Smith that he received the grant of $100,000.00 from the State Comptroller. Mr. Rumsey reviewed the contract and stated it would be a contract with the DEC. The funds will be funded to us through them. We should be able to put this project out to bid by March of 1991. The grant of $100,000.00 needs to be used. If not for Lamont Circle, some project within the Town or the Town will lose this grant. 39� Wednesday, September 13, 1990 Page 3 A discussion was held between Town Attorney, Phillip Rumsey and Board members in regards to the Resolution adopted at the last Board Meeting of September 5, 1990, concerning the Town Highway Barn Expansion. The Expansion will be going to mandatory referendum and placed on the November b, 1990 ballot. A motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to recess the Special Meeting and convene to an Executive Session 'in the matter of a personnel problem. All voting -aye,- the motion was carried. The following information was received from the Supervisor's office: A motion was made by Councilman Rocco, seconded by Councilman Testa, to adjourn the Executive Session and reconvene the Special Meeting.
