Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Raymond Thorpe -Councilman Ronal.,Rocco Councilman Theodore Testa Councilman Edwin O'Donnell Town Clerk Pauline Parker Others present were Attorney, Phillip Rumsey; Highway Superintendent Carl Bush;,Engineer, Hayne Smith; Town Historian Alice Blatchley; Assessor, David Briggs; County. -Legislator... The meeting was called to order by Supervisor Pierce -at 7:30 o'clock p.m.. He requested that all those in,attendance rise and pledge allegiance,,to the.flag. .A motion was -made -by Councilman Rocco, seconded by Councilman -,.O'Donnell,.- to approve, as written the Cortlandville. All voting aye,.the motion was carried: RESOLUTION #171 AUTHORIZE PAYMENT.OF VOUCHERS - JULY Motion by Councilman Thorpe Seconded by Councilman Testa VOTES: ALL AYE . RESOLUTION #172 -ADOPT ORDER AND SET DATE FOR A PUBLIC HEARING PURSUANT TO TOWN LAW SECTION 209-q ..(3) _.."GROTON AVENUE PLAZA,�.ROUTE 281 / LUKER ROAD AREA SEWER PROJECT - 1990 Motion by Councilman Thorpe Seconded by Councilman Rocco VOTES : , ALL, AYE. ..ADOPTED WHEREAS, there was filed in.the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the.establishment of a sewer improvement.project for Groton Avenue.P,laza, Route 281 & Luker Road Area and designated "Groton.Avenue Plaza, Route 281 & Luker Road,Area Sewer:Project", as.required by Section 209-q and .209-c of the, Town Law, and are available for.public inspection, and Wednesday July 06, 1990 WHEREAS, the proposed extension of sewer lines Avenue Plaza, Route 281 approximately 6800 feet o station in accordance with the Office of the Town Cortlandville, and Page 2 improvement consists of the to the area of the Groton and Luker Road to include f sewer pipe and a pumping the said plans now on file in Clerk of the Town of WHEREAS, the maximum amount proposed to be expended for said improvement is $525,000.00, and WHEREAS, the proposed method of financing of said improvement is expenditure of $200,000.00 from the Sewer Fund Surplus Account of the Town of Cortlandville and the balance of a maximum of $325,000.00 by the issuance of bonds by the Town of Cortlandville for a maximum term of forty years at prevailing interest; all costs, shall be borne by the lands benefited by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby proposed that all lots or parcels in the Town of Cortlandville outside of Villages, capable of being serviced by the "Article 12-C" Sewer Improvements heretofore and hereafter provided, are lots or parcels benefitted by the proposed sewer improvement; and the cost of the proposed sewer project and all previous improvements shall be spread upon and over the enlarged benefitted area, all of such improvements constituting one sewer system, such system being described by and including the areas set forth in the "Maryland Avenue Sewer Project - 1990" Order adopted January 17, 1990 and the following parcels designated on the 1990 Cortland County Real Property Tax Maps as Cortlandville tax parcels: Tax Map 86.13-01: Parcels: 45.1, 45.2, 46, 47, 55.11, 55.12, 55.21, 55.22, 56, 57.2, 58.2, 60, 61, 62, 63, 64, 65.1 and 65.2. Tax Map 86.17-01: Parcels: 01, 02, 03.1, 04, 05, 06, 07.1, 07.2, 08.2, 09, 10.211, 10.212 and 10.22. Tax Map 86.17-02: Parcels: 03 and 04. WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from heretofore and hereafter serviced by the Town Law Article 12-C Sewer Improvements; and WHEREAS, a short Environmental Assessment Form has been prepared pursuant to the State Environmental Quality Review Act, and is available for review by the public at the Cortlandville Town Hall, IT IS -HEREBY ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, 15 Terrace Road, Cortland, New York on the 1st day of August, 1990 at 7:30 o'clock p.m. of that day to hear all persons interested in the proposed sewer improvement, and for such other action of said Town 1 1 n Wednesday July 06, 1990 Page 3 Supervisor Pierce offered the privilege of the floor to Georgianne Applegate and Pauline Pettit of Blodgett Mills. They submitted and read aloud the following requests; - Recycling Plant location in Blodgett Mills. - Governmental Funding to help rehabilitate. - Recreational facilities for children. - Unregistered motor vehicle storage on private property. All of the above concerns were discussed. A committee was established to review the concerns. Supervisor Pierce asked for volunteers. They are as follows: Town Board Members: Councilman Ronal Rocco Councilman Edwin O'Donnell Community Members; Georgianne Applegate Patricia Breed Barbara Spence David Quail Jeff Wheaton Edward Pettit Warren Friedah Mr. Kris Larsen, owner of the Recycling Plant known as Plastics and Metal Recycling Co., was in attendance and explained the factors involved with his company. He stated that he would 'like to work with his neighbors, not fight them. He explained that his business has grown very fast and it has been difficult to keep up with demand. He is in the process of -constructing a large building. When completed, all of the materials now stored outside will be inside. He has met all requirements with both the State- D.E.C-.- and" the County Health Department. County Legislator, Frank Barbieri, advised that he was very pleased with the number of concerned citizens that attended the'meeting. He has listened to these people and has heard many comments from his constituents and they have felt that they have been the forgotten area of the Town of Cortlandville. He expressed pleasure that a committee has been formed, and that something will be accomplished. The Town Board "Thanked" the residents for coming. A motion was made by Councilman O'Donnell, seconded by Councilman Testa to receive and file a copy of the letter from James V. Feuss of the Cortland County Health Department. All voting aye, the motion was carried. The letter was concerning the public sewers and Potential contaminant areas -of Otter Creek/Dry Creek. A motion was made by Councilman O'Donnell, seconded by Councilman Thorpe to receive and file a copy of the letter from Harold J. Herzog, Director of Community Assistance,-NYS DOT. All voting aye,the 'motion was carried. The letter was concerning Consolidated Local Street and Highway Improvement Program (CHIPS) payments for 1990. 3311 Wednesday July 06, 1990 Page 4 A motion was made by Councilman Thorpe, seconded by Councilman Testa to receive and file a copy of the letter and mining permit from Barry L. Borrow, Deputy permit Administrator for.the NYS DEC. All voting aye, the motion was carried. The letter was a copy of a mining permit issued to Economy Paving Co., Inc. for their location on Rt. 13. A motion was made by Councilman O'Donnell, seconded by Councilman Testa to receive and file a copy of the letter from William W. Porter. All voting aye, the motion was carried. The letter was concerning sewer easement at Groton Avenue Plaza. A motion was made by Councilman O'Donnell, seconded by Councilman Testa to receive and file a copy of the letter from Quick Stop of 126 West Road, Cortland, N.Y. All voting aye, the motion was carried. The letter was concerning intent to renew the Liquor License. RESOLUTION #173 RECEIVE STATE DENIAL OF REDUCING SPEED LIMIT ON MCLEAN ROAD Motion made by Councilman O'Donnell Seconded by Councilman Testa VOTE: ALL AYE ADOPTED WHEREAS, many concerns were heard from residents concerning the current speed limit on the McLean Road, and WHEREAS, per Resolution #228, adopted on September 6, 1989, this Town Board did petition the County Highway Department to reduce the speed limit on the McLean Road, a County Road located in the Town, therefore BE IT RESOLVED, that notice has been received from the New York State Department of Transportation, that -the request has been reviewed and denied, and RESOLVED, that such letter shall be received and filed. RESOLUTION #174 APPROVE STATE ACCEPTANCE OF REDUCING SPEED LIMIT ON ROUTE 215 Motion made by Councilman Thorpe Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED WHEREAS, this Town Board received a petition from residents concerning the current speed limit at the intersection of Starr Road and Route 215, WHEREAS, per Resolution #256, adopted on October 4, 1989, this Town Board did forward to the state through necessary channels, to reduce the speed limit at the intersection of Starr Road and Route 215, a State Road located in the Town of Cortlandville, therefore BE IT RESOLVED, that notice has been received from the New York State Department of Transportation, that the request has been reviewed and accepted, and that the 40 mph speed zone will be extended southerly for an additional 0.3 +- mile, also BE IT 1 1 RESOLVED, that such letter shall be received and filed. 3�� Wednesday July Ob, 1990 Page 5 A motion was made by Councilman Thorpe, seconded by Councilman O'Donnell to receive and file a copy of the letter from*. RESOLUTION #175 RESCHEDULE A PUBLIC HEARING - SPECIAL PERMIT - PALL TRINITY MICRO CORP..- WEST ROAD AND MCLEAN ROAD Motion made by Councilman Rocco Seconded by Councilman Thorpe VOTE: ..ALL AYE ADOPTED WHEREAS, Pail Trinity, has submitted a request for a Special Permit to, and ,• WHEREAS, this application has been referred to the Cortlandville,Planning Board, and WHEREAS, the continuing process requires a Public Hearing before this Board.; therefore BE, IT RESOLVED, that a Public Hearing shall be held before this Town Board.on July„18, 1990 at 5:30 p.m. RESOLUTION #176 AUTHORIZE JOHN MURDOCK TO PROCEED IN THE AREA OF SLEEPY•HOLLOW TO BOWLING Motion made.by�Councklman Rocco Seconded --,by Councilman Testa VOTE: ALL -AYE ADOPTED WHEREAS, John Murdock has a proposed subdivision in the area of Sleepy Hollow and -.,Bowling -Green and.it will' be necessary for him to extend both the road and water, and, sewer lines, therefore BE IT RESOLVED, that the Town Board does hereby authorize John Murdock.to commence with.installing airoad and water and sewer lines from-,,.,Sleepy:.Hollow­to Bowling Green, starting this year and, finish:ing next year..,, RESOLUTION #177 AUTHORIZATION TO STANDARDIZE TO ROCKWELL METERS. Motion made by.Councilman Thorpe Seconded by Councilman Rocco VOTE: ALL AYE ._ 1ADOP.TED WHEREAS, all meters used in the Town,of , Cortlandville are measured by gallons, -therefore - BE IT RESOLVED, that. the _Water and Sewer Department is hereby authorized to standardize. -the purchasing of water meters. RESOLUTION #178 AUTHORIZE BUDGET TRANSFER Motion made by Councilman Thorpe Seconded by Councilman Testa VOTE: .ALL.AYE ADOPTED BE IT RESOLVED, that the Budget Officer is hereby authorized to transfer $250.00 from General Fund A A1410.4 into A1410.2 to purchase a new calculator and typewriter. 3,36 Wednesday July 05, 1990 Page 6 RESOLUTION #179 AUTHORIZING THE ISSUANCE OF $600,000 SERIAL BONDS OF THE TOWN OF C'VILLE, CORTLAND COUNTY, NEW YORK, TO PAY THE COST OF THE CONSTRUCTION OF A WATER IMPROVEMENT KNOWN AS THE HIGHLAND ROAD WATER STORAGE TANK CONSTRUCTION OF SAID TOWN Motion made by Councilman Thorpe Seconded by Councilman O'Donnell VOTES: ROLL CALL Melvin H. Rocco Aye WHEREAS, pursuant to proceedings heretofore had and taken in accordance with the provisions of Article 12-C of the Town Law, and more particularly an order dated October 4, 1989 and the approval of the Comptroller of the State of New York on May 24, 1990 the Town Board of the Town of Cortlandville, Cortland County, New York, has established a water improvement known as the Town of Cortlandville Highland Road Water Storage Tank Construction; and WHEREAS, it is now desired to authorize the issuance of $600,000 serial bonds of said Town to pay the cost of said water improvement; and WHEREAS, all conditions precedent to the financing of such capital project, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Cortlandville, Cortland County, New York as follows: Section 1. For the specific object or purpose of paying the cost of the construction of a second Town of Cortlandville public water storage tank on approximately one acre of land near Highland Road, consisting of easements and other land acquisition, sitework, land surveys, soil borings, the installation of and the construction of a water storage tank with capacity of approximately 1,000,000 gallons, service connection, together with other equipment, machinery, apparatus and appurtenances necessary in connection therewith, there are hereby authorized to be issued $600,000 serial bonds of the Town of Cortlandville, Cortland County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such specific object or purpose is $600,000, and that the plan for the financing thereof shall consist of the issuance of the $600,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Town Board. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will exceed five years. Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and 1 1 Wednesday July 06, 1990 Page 7 to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be 'prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section S. The faith and credit of said Town of Cortlandville,' Cortland County; New York, are hereby irrevocably pledged to the- payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient'to pay the principal of the interest on such obligations becoming due and payable in such year. Section 6. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions -of law- which should be complied with at the date of publication of this resolution are not substantially complied with', and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication; or 8) Such obligations are authorized in violation of the -provisions of the Constitution'. Section 7. This resolution, which takes effect immediately; shall be published -in full in the Cortland Standard, the official newspaper, together with a notice of the Town Clerk in substantially the —form provided in Section 81.00 of the Local Finance Law. - RESOLUTION #180 AUTHORIZING THE ISSUANCE OF $470,000 SERIAL BONDS OF THE TOWN OF C'VILLE, CORTLAND COUNTY, NEW YORK, TO PAY THE COST OF THE CONSTRUCTION OF A SEWER IMPROVEMENT KNOWN AS MCLEAN ROAD PROJECT-1990 OF SAID TOWN (`lotion made by Counci'lman-O'Donnell Seconded by Councilman Rocco VOTES: ROLL CALL Melvin H. For the specific object or purpose of paying the cost of the construction of sewer lines from Luker Road westerly along McLean Road for approximately 6700 feet to Deerfield Heights, together with other equipment, machinery and apparatus and other appurtenances necessary in connection therewith, there are hereby authorized to be issued $470,000 serial bonds of the Town of Cortlandville, Cortland County, New York, pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the maximum estimated cost of such specific object or purpose is $470,000, and that the plan for the financing thereof shall consist of the issuance of the $470,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Town Board. Section 3. Rocco Aye WHEREAS, pursuant to proceedings heretofore had and taken in accordance with the provisions of Article 12-C of the Town Law, and more particularly an order dated February 7, 1990 and the approval of the Comptroller of the State of New York on May 24, 1990 the Town Board of the Town of Cortlandville, Cortland County, New York, has established the Town of Cortlandville Fairview Drive/McLean Road Water Project-1990; and WHEREAS, it is now desired to authorize the issuance of $280,000 serial bonds of said Town to pay the cost of a water system improvement for said Fairview/McLean Road Water Project-1990; and WHEREAS, all conditions precedent to the financing of such capital project, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Cortlandville, Cortland County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of easements and other land acquisition, sitework, land surveys, soil borings, the installation and the construction of a 7400 feet of new water main, hydrants and connections, together with other machinery, equipment, apparatus and appurtenances necessary in connection therewith, there are hereby authorized to be issued $280,000 serial bonds of the Town of Cortlandville, Cortland County, New York, pursuant to the provisions of the Local Finance Law. Further details concerning said bonds will be prescribed in a further resolution or resolutions of this Town Board. Section 2. It is hereby determined that the maximum estimated cost of such specific object or purpose is $280,000, and that the plan for the financing thereof shall consist of the issuance of the $280,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. , Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law.
