Members present: Supervisor Melvin Pierce Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker absent: Councilman Raymond Thorpe Others present were Highway Superintendent Carl Bush, Laura Jones from the Cortland Standard, and Town Residents Karen Bush and Seymour Parker. TOWN CLERK TOWN OF CORTLANDVILLE 15 Terrace Road Cortland, New York 13045 128-1t 1 1 1 1519 Wednesday June 6, 1990 7:30 p.m. REGULAR MEETING The Town Board of the Town of Cortlandville, was held at the Town Hall, 15 Terrace Road, Cortland, New York, with Supervisor Pierce presiding. Members present: Supervisor Melvin Pierce Councilman Edwin O'Donnell Councilman Ronal Rocco Councilman Theodore Testa Town Clerk Pauline Parker absent: Councilman Raymond Thorpe Others present were Highway Superintendent Carl Bush, Laura Jones from the Cortland Standard, Town Residents Karen Bush and Seymour Parker. The meeting was called to order by Supervisor Pierce at 7:30 o'clock p.m. Following the flag salute, a Public Hearing was held regarding proposed Local Law No. 1 for 1990. RESOLUTION #154 AUTHORIZE PAYMENT OF VOUCHERS - JUNE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers 194 - 211 7,467.61 General Fund B 36 - 40 3,924.21 Highway Fund 147 - 166 25,853.73 Water Fund 60 - 66 6,696.20 Sewer Fund 41 - 43 88.93 Capital Projects 92 - 97 169,038.10 The reports of the various departments are on the table for review, and are available for inspection, on request, in the Town Clerks office. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file easements from Michael R. Stokoe, David J. Yaman, and William Cox; Elizabeth Spencer; Charles M. and Shirley M. Proctor; Donald L. and Janice B. Hart; Howard. J. and Lois P. Stafford. All voting aye, the motion was carried. The above mentioned easements were necessary to achieve. the Northwest Water Project. A motion was made by Councilman Rocco, seconded by Councilman Testa, to receive and file easements from Eleanor M. Tarbell; Leland A. and Gertrude Cunningham. All voting aye, the motion was carried. The above mentioned easements were necessary to achieve the Bell Drive Sewer Project. Wednesday June b, 1990 Page 2 A motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to receive and file easements from Lionel Gilels and Alice Griswold. All voting aye, the motion was carried. The above mentioned easements were necessary to achieve the NYS Route 13/NYS Route 281 Sewer Improvement Project. A motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to receive and file a copy of the letter from Attorney Sidney Manes to Paul E. Roberts. All voting aye, the motion was carried. The letter was concerning a permit for Nanam Corp. issued by New York State Department of Environmental Conservation. A motion was made by Councilman Testa, seconded by Councilman O'Donnell, to receive and file a copy of the two letters from Attorney Linda E. Romano. All voting aye, the motion was carried. The letters were copies of eviction notices that had been sent to tenants of Cortland Estates Mobile Home Park that have not complied with local and/or state zoning codes. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the letter from General Code Publishers Corp. All voting aye, the motion was carried. The letter was concerning the Town codes update. They will commence on June 22, 1990. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the letter from Senator James L. Seward. All voting aye, the motion was carried. The letters were concerning the low-level radioactive waste dump. A motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to receive and file a copy of the notice from New York State Department of Taxation and Finance. All voting aye, the motion was carried. The letters were concerning New York State Sales Tax on parking, garaging and storing of motor vehicles. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to receive and file a copy of the letter from Carl A. Edlund, County Treasurer. All voting aye, the motion was carried. The letters were concerning Reimbursement. Otter/Dry Creek A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the letter from Joan M. Lambert, New York State DOT. All voting aye, the motion was carried. The letters were concerning the intersections of McLean Road and Route 281, and Route 281 and Luker Road. All voting aye, the motion was carried. The letters were concerning intersection of McLean Road and Route 281, and road condition between Route 281 and Route 222. A motion was made by Councilman Rocco, seconded by Councilman Testa,..to receive- and file a copy of the letter from Richard L. Bassler New York State DOT. All voting aye, the.motion was. -carried. The. letters..were concerning streambank erosion along Tioughnioga River off of Loring Crossing Road. .A motion was made by -.Councilman O'Donnell, seconded by Councilman Testa,.to .receive and file a copy of the letter from Attorney-.Scott--F. Chatfield. All voting aye, the motion was carried. The letters were concerning Local Law No. 1 for 1989. All voting aye, the motion was carried. . I The letters were concerning the installation of new light poles. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the letter from Lisa A. Jensen of Niagara Mohawk. All voting aye, the motion was -carried. The letters were concerning installation of five sodium lights. A motion was made by -Councilman Rocco, seconded by Councilman O'Donnell, to receive and file a copy of the letter from Douglas C. Staley. All voting aye, the motion was carried. The letters were concerning fire inspections. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to receive and file a copy of the letter from Richard C. Fox, Chairman, Cortland County Economic Development Committee (CCEDC). All voting aye, the motion was carried. The letters were concerning job responsibilities of the CCEDC management.team. A motion was made by Councilman Testa, seconded by Councilman O'.Donnell, to receive and file a copy of the letter from Phillip R. Rumsey. All voting aye, the motion was carried. The letters were concerning the opinion letter of Willkie Farr & Gallagher - BAN for Northwest Water Improvement.® 3-�z Wednesday June 6, 1990 Page 4 A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the letter from Dr. J. Lee Ambrose. All voting aye, the motion was carried. The letters were concerning Dr. Ambrose's acceptance of the Town's offer to purchase Route 2B1 transmission line. A motion was made by Councilman O'Donnell, seconded by Councilman Testa, to receive and file a copy of the easement from Frederick H. and Brenda Ludwig. All voting aye, the motion was carried. The letters were concerning 50 foot right-of-way along Munson Ave. RESOLUTION #155 ACKNOWLEDGE APPROVAL FROM STATE COMPTROLLER FOR WATER AND SEWER PROJECTS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, large water and sewer projects have been initiated within the Town and such projects needed State approval, therefore BE IT RESOLVED, that this Town Board does hereby acknowledge the receipts of approval from the NYS State Comptroller for the Highland Road Water Storage Tank Construction Water Improvement Project; Fairview Drive/McLean Road Water Project - 1990 Water Improvement and the McLean Road Sewer Project - 1990 Sewer Improvement, and further RESOLVED, that the approvals shall hereby be received and filed. RESOLUTION #156 AUTHORIZE EXPANDED USE OF MEETING ROOM TO SAFETY COUNCIL OF CENTRAL NY Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Safety Council of Central New York Inc. has been using our meeting room monthly to conduct their Defensive Driving Course, and the arrangement has worked well, and WHEREAS, due to the high demand for their course they wish to expand their program and hold an additional night course, and have requested use of our meeting room to accomplish, therefore BE IT RESOLVED, that the Town Board does hereby authorize the use of our meeting room on the following dates to the Safety Council of Central NY from 6:00 P.M. to 10:00 P.M.: September 6th and 13th, 1990 October 18th and 25th, 1990 November 29th and December 6th, 1990 13-z)s Wednesday June b, 1990 Page 5 RESOLUTION #157 ADOPT LOCAL LAW NO. 1 OF 1989 - PROVIDING FOR THE BILLING AND COLLECTION OF ALL RENTS, RATES FEES AND ASSESSMENTS FOR WATER AND SEWER Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE., ADOPTED BE IT ENACTED, by the Town Board of the Town of Cortlandville as follows: SECTION 1. The Secretary for the Town of Cortlandville Highway, Water and Sewer Departments shall have.the duty and responsibility to bill and collect all rents, rates, fees .and assessments for water -and sewer in the Town of Cortlandville. SECTION 2. It is the intent of this Local Law to amend or supersede..the provisions.of Town Law Section 30 (10-a) and Article. 12-C _and any., and all other conflicting Town, of.Cortlandville laws, ordinances and resolutions. This Local Law is -intended to further the reorganization of the Water:.and Sewer Departments per resolutions. of. the..Cortlandville. Town -Board adopted March 21,.1990. SECTION 3. This Local Law shall take effect immediately upon filing with the. Secretary -:of State pursuant to the Municipal Home Rule Law. RESOLUTION #158 AUTHORIZE RENEWAL OF CORTLAND ESTATES MOBILE HOME TRAILER PARK PERMIT - 1989 AND 1990 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTE: ALL AYE ADOPTED WHEREAS, Cortland Estates Mobil Home Park Renewal permit for 1989 was denied per Town Board Resolution #33 adopted January 18, 1989, and WHEREAS, Trailer Park Permit- renewals have been submitted for both the years 1989 and 1990,, and have been inspected by the Town Code Enforcement,Officer, and has advised that not everything ,is ,in .compliance, however, they have put forth effort to comply and recommends that the permit be issued, therefore BE IT RESOLVED, that the Town -Clerk i,s hereby authorized and directed to issue a Trailer Park Renewal Permit good for two years, 1989 and 1990, to Cortland Estates Mobile -Home Park. 1 Wednesday June 6, 1990 Page 6 RESOLUTION''#159 AUTHORIZE A CONSULTATION WITH PETER NOVELLI - EXPANSION OF THE TOWN HALL Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, overcrowding of offices due to growth of the Town has occurred, and WHEREAS, the occupancy for the meeting room has been maximized at 53, therefore BE IT RESOLVED, that Supervisor Pierce is hereby authorized to meet with Consultant Peter Novelli to discuss options and cost for designing the meeting room into offices. Supervisor Pierce apprised the Town Board that the Cortlandville Planning Board is holding a public hearing for David Yaman, PUD, Bennie Road on June 26, 1990. He encouraged Town Board members to attend as this matter will be coming before the Town Board. A discussion followed regarding changes and improvements to the area of the proposed project. RESOLUTION #160 AUTHORIZE TRANSFER OF FUNDS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the bookkeeper is hereby authorized to transfer $2,315.73 from the Water Fund and $3,405.73 from the Sewer Fund to be transferred to the Capital Project Funds to help cover McLean Road Water, McLean Road Sewer, and Groton Avenue/ Route 281 Sewer projects which have not been bonded. A motion was made by Councilman O'Donnell, seconded by Councilman Rocco, to recess the Regular Meeting and convene to an Executive Session in the matter of a personnel problem. All voting aye, the motion was carried. The following information was received from the Supervisor's Office: A motion was made by Councilman Rocco, seconded by Councilman O'Donnell, to adjourn the Executive Session and reconvene to the Regular Meeting. All voting aye, the motion was carried. RESOLUTION #161 AUTHORIZE SUPERVISOR TO WRITE LETTER OF EXPLANATION TO TOWN CLERK BE IT RESOLVED, that the Supervisor is authorized to write a letter of explanation to the Town Clerk regarding cooperation with the Zoning Office on filing Zoning Law and Town Board Minutes. Wednesday June 6, 1990 Page 7 A motion was made by Councilman Testa, seconded by Councilman O'Donnell, to adjourn the Regular Meeting. All Voting aye, the motion was carried.
