M . PLEDGE OF ALLEGIANCE : Supervisbr :-Diettich :led' 'a'll ,: present in theg Pledge of Allegiance to the American flag . Emergency Towing of Vehicles The following resolution was presented to the Danby Town Board to be considered for adoption as a local law . Supervisor Dietrich stated that this resolution has been requested by the Town of Danby Highway Superintendent . The resolution read as follows : Adopted from New York State Vehicle and Traffic Law - Subsection 8 of Section 1660 , providing for the removal and storage of vehicles parked or abandoned on highways during snowstorms , floods , fires , or other public emergencies , or found unattended where they constitute an obstruction to traffic . WHEREAS , vehicles parked or abandoned on highways during snowstorms , floods , fires , or other public emergencies , or found unattended where they constitute an obstruction to traffic may be removed by order of the Town Superintendent of Highways ; and , WHEAEAS , the payment of a towing charge riot to exceed $ 75 . 00 and a storage charge not to exceed $ 15 . 00 per day shall be payable by the owner or operator of the vehicle , and WHEREAS , the Town Highway Superintendent shall notify without delay any vehicles so removed to the Town Clerk , and WHEREAS , it shall be the duty of the Town Clerk to ascertain to the extent possible the name of the owner of the vehicle and to notify them of the removal and disposition of such vehicle , and of the amount which will be required to redeem the same . THEREFORE , BE IT RESOLVED , that this rule and regulation shall apply hereinabove - described until a public announcement is made by the Town that the emergency has been terminated . Supervisor Dietrich explained that the Danby Town Board will act on this resolution at a later date . Call for Public Hearing Resolution 164 By Councilperson Roberts : Seconded by Councilperson Tagliavento RESOLVED ; That a Public Hearing for Emergency Towing of Vehicles in the Town of Danby will be held at 7 : 30 P . M . on January 8 , 1990 , at the Danby Town Hall , 1830 Danby Road , Ithaca , New York . Minutes December 28 , 1989 - 2 - Extension of Final Environmental Impact Statement (FEIS ) for Grisanzio Planned Development District Supervisor Dietrich reported that it is necessary to extend its time for preparation and completion of the FEIS for the Grisanzio Planned D evelopment District . The FEIS is due January 4 , 1990 and we have not ✓ eceived all of the information necessary to complete the FEIS . Resolution # 65 By Councilperson Tagliavento : Seconded by Councilperson Oltz RESOLUTION REGARDING ENVIRONMENTAL QUALITY REVIEW REQUIREMENTS FOR THE APPLICATION 1D'+ THE TOWN OF DARBY (THE. "TOWN" ) FOR APPROVAL OF A PLANNED DEVELOPMENT DISTRICT SUBMITTED BY MS . LIZ GRISANZIO ( "APPLICATNT" ) WHEREAS , Applicant has submitted to the Town an application for a Planned D evelopment District for a site proposed to consist of approximately 45 lots on approximately 72 acres located in the Town ( the " proposed action " ) and WHEREAS , the Town has designated itself as Lead Agency for purposes of the environmental review of the proposed action ; and WHEREAS , the Town has , after completion and review of the required Environmental Assessment Form ( " EAF" ) , filed a Positive Declaration - Notice of Intent to Prepare a Draft Environmental Impact Statement ( "DEIS ) / Determination o f Significance ; and WHEREAS , The Applicant has submitted a Draft EIS as required ; and WHEREAS , the Town Board , as the designated Lead Agency , has reviewed the Applicants DEIS and determined that it is satisfactory with respect to its scope , content and adequacy for the purpose of commencing public ✓ eivew ; and WHEREAS , a Public Hearing on the DEIS was held at the Town Hall on November 20 , 1989 , at which time all members of the public wishing to speak were given the opportunity to do so ; and WHEREAS , the designated public comment period following the filing of the Applicant ' s DEIS has expired and the Town Board , as the designated Lead Agency , has commenced preparation of the required Final Environmental Impact Statement ( " FEIS " ) ; and WHEREAS , The Town Board , as the designated Lead Agency has received e xtensive public comment necessitating full and proper response as part o f the preparation of the FEIS ; and WHEREAS , The Town Board , as the designated Lead Agency , has determined in accordance with 6NYCRR Park 617 , Section 617 . 8 ( e ) ( 2 ) ( i ) that additional time is necessary to prepare the FEIS adequately : NOW THEREFORE , IT IS HEREBY RESOLVED , That the Town Board of the Town of Danby , as Lead Agency , hereby approved and accepts the minutes attached hereto for the Public Hearing on the DEIS held at the Town Hall on November 20 , 1989 ; and it is further RESOLVED , That the Town Board of the Town of Danby , as Lead Agency , pursuant to 6 NYCRR Part 617 , Section 617 . 8 ( e ) ( 2 ) ( i ) hereby determines that additional time is necessary to prepare the FEIS for the. proposed Grisanzio Planned Development District ; and it is further RESOLVED , That the Town Board of the Town of Danby , as Lead Agency , hereby extends its time for preparation and completion of the FEIS until February 15 , 1990 , such extension to be subject to further extension in the event that the Town Board hereafter determines that further and additional time is necessary for adequate preparation of the FEIS . f•fa- v ' �,ry Town Bd . Minutes December 28 , 1989 - 3 - A roll call vote on the resolution resulted as follows : E ckstrom Aye O ltz Aye Roberts Aye Tagliavento Aye D ietrich Aye Carried Unanimously Town of Danby Town Justice Vacancy Supervisor Dietrich reported to the Town Board that due to the untimely death of Town Justice A . Francis Wright it is necessary to complete important paperwork to release funds for the Town Court . The Town Justice position will not be filled immediately . He explained that it is a requirement for the new Justice to attend school in the Spring of 1990 . Supervisor Dietrich also reported that he has received four ( 4 ) applications for the Justice position . Town Justice Henson reported to the Board that it is necessary to release funds as soon as possible . Town Computer System Supervisor Dietrich passed out to the Board information on computer systems . Councilperson Eckstrom explained the difference in the computers , printers , systems and cost listed for each item . Discussion followed in regard to IBM compatible , Mackintosh , and other computers . Justice Berson stated that he strongly recommends an IBM system for his court needs . Town Clerk elect , Carol Sczepanski and Bookkeeper , Mildred Miller both reported that they preferred an IBM compatible system . Councilperson Eckstrom stated that although he favors the Mackintosh computer it is not compatible with the court systems and other New York State systems . He recommended that the Town consider an IBM compatible computer . ReEolution 166 By Cbuncilperson Eckstrom : Seconded by Councilperson Oltz WHEREAS , The Town of Danby is endeavoring to improve its infrastructure through computer automation of various internal function , BE IT RESOLVED , That the Town Board wishes to reserve $ 5 , 000 of Fiscal Year 1989 monies to purchase a computer system for use in the Town . Councilperson Eckstrom stated that he will be seeking the purchase of a computer system through a local vendor in Ithaca with a good reputation . Roberts , Town Director of Danby Senior Citizen ' s addressed the Town Board with the following request : " TO WHOM IT MAY CONCERN : As Tour Director of Danby Senior Citizen ' s , I am asking that the amount of $ 130 . 00 , balance from 1989 Budget of Town of Danby for the Danby Senior Citizen ' s be encumbered into the 1990 Budget Account for same . This will make a balance of $ 2 , 130 . 00 for 1990 ." z f 5 Town Bd . Minutes • A :r;; .s. December 28 , 1989 - 4 - Resolution #67 By Councilperson Roberts : Seconded by Councilperson Oltz RESOLVED , That the Town Board encumber $ 130 . 00 balance from the Senior Citizen ' s 1989 Budget into the Senior Citizen ' s 1990 Budget for a 1990 total of $ 2 , 130 . 00 . A roll call vote on the resolution resulted as follows : E ckstrom Aye O ltz Aye Roberts Aye Tagliavento Aye D ietrich Aye Carried Unanimously Charge for Returned Checks Insufficient Funds Resolution By Councilperson Tagliavento : Seconded by Councilperson Roberts RESOLVED , That Town Officials collecting money from persons doing business in the Town of Danby shall hereby charge $ 10 . 00 for any check returned for insufficient funds or accounts closed , in accordance with Chapter 203 of the Laws of New York , 1989 . FURTHER RESOLVED , that any person having a bad check which was returned for insufficient funds shall be required to remit any future payments only in the form of cash or by certified or cashier ' s check . FURTHER RESOLVED , that such fee may only be waived for those persons who can prove that it was through no fault of their own that a check was returned for insufficient funds .
