The regular meeting of the Town Board of the Town of Danby was held December 11 , 1989 , at the Danby Town Hall , 1830 Danby Road , County of Tompkins , New York . Pledge of Allegiance was led by Councilman Dietrich , at 8 : 10 p . m . Present : Dean Eckstrom Councilman Mary Oltz Councilwoman Dorothy Roberts Councilwoman Julia Tagliavento Councilwoman Ric Dietrich Supervisor . Others Present : Frank Darrow , Carol Sczepanski , Elizabeth Roe , Roy Casterline , Steve Rider , Natalie Rider , Frank Proto/County Representative , Nancy Weitzel , George Schledlt , Verna Little , Charles Robinson , Rick Dobson , Pat Woodworth , Joel Gagnon , Ray Axtell , Edward Roberts/ Bald Hill Road , Lorraine Bard , Robert Maycumber , David Maycumber , Debbie Maycumber , Ronald Maycumber , Rich Marisa Recording Secretary : Bonita Franklin , Deputy Approval of Minutes : A motion was made by Clmn . Eckstrom , seconded by Clwn . Oltz to accept the minutes of November 13 , 1989 , as submitted . Adopted : Eckstrom , Oltz , Roberts , Tagliavento , Dietrich . Communications : Supervisor Dietrich read two letters received during the month of November and _, early December . The first was from Dorothy & Willard Daetsch acknowledg- ing Supervisor Dietrich ' s letter of November 22 , 1989 ; and reaffirming that they would make land available as an access road into Olde Towne Village . The second was from Ronda Engman requesting that the town include a clause in its noise ordinance requir- ing people to target practice at designated target ranges . Some discussion followed and it was concurrci that this would be a difficult clause to enforce and , therefore , would not specifically be included in the ordinance . Privilege of the Floor : It was noted that since Dorothy Robert's resignation , this will be her last board meeting . Town Board : Met with Dick Rust , formerly with Sterns & Wheeler , about redesign of the Town Barns . He will submit new plans to the Town Board by December 28 , 1989 . These will be preliminary plans that will then be approved and drawn up . We hope to start this project in 1990 . Town Clerk : No report submitted . County Rep . , Frank Proto : The county board will approve the testing of wells in the area of the Landstrom Landfill . The testing of the water will be extensive and is to be done by an independent lab versus the County Health Department . Clean-Up - Pat Gallagher of the Probation Dept . will be heading up a program to send out clean-up crews to Danby to remove the trash from the roadsides . We have been approved for an additional $ 16 , 000 for that program . Burning/State Land : A letter was received from the Cortland office of the DEC stating that they would attend an open meeting in Danby to address the concerns of the residents with regard to burning of the state lands . Their office is available Jan . 10- 16 , 1990 . After some discussion , it was decided that a meeting around Feb . 15 , 1990 , would be a better date for the meeting to allow for pro- per advertisement in the Danby Area News . Danby and Caroline would have separate meet - ings so that residents of both towns would have a choice of meeting dates to attend . Fire Department : The County approved $ 90 , 000 to purchase a compressor for use in fill - ing air tanks . Busses : The three Caravan busses for Danby , Lansing and a " Floater " have been approved for purchase . They are to be received in early 1990 . It looks like bus service is finally coming to Danby . Transit Task Force : We are waiting until the first of the year to form this committee . Affordable Housing : Danby has not submitted any resumes for this appointment . Won ' t like to see Danby without a voice in the de- cisions to be made in this area . Danby has the opportunity to make an impact on this for your residents . Recycling : Everything is on track and ready to open . Central Processing Facility : I remain steadfast in that the facility should remain in Ithaca , however , other sights should be looked at as well . F . E . I . S . - There will be two " last shot " hearings at NYSE&G and at the Women ' s Community Bldg . to consider public opinion on this . The application for permit is complete . We are still waiting for the Army Corp . of Engineers to get back to us . We don ' t know how long this could take . Central Processing Facility : We have until 8 : 30 a . m . tomorrow to submit our comments on the Environmental Impact Statement . Dietrich : We will either attend meetings on this or submit something in writing to state Danby ' s stand . The town passed a resolution on this which we toni lan to add to tonight . This will be covered under New Business . p g ( Much discussion followed regarding the timing of opening C . P . F . and closing Landstrom . ) Public : Proto : Is the No Smoking sign in anticipation of the new state law? Dietrich : Yes ; as well as requests that have come in from residents . Proto : Be aware that you can ' t simply post a public building for no smoking . Schlecht : We talked earlier about the writing of the F . E . I . S . and I would like to know when we can proceed with this? All Town Board Minutes Town of Danby December 11 , 1989 Page 2 After reading the minutes of the Hearing , I would like to offer my help in answering the questions raised by the December 28th meeting with the hope that we could proceed . I would be willing to make a draft of the F . E . I . S . even though it is the town ' s responsibility . I am looking for direction . Dietrich : We will give approval for you to answer the questions raised in the Hearing and to draft a F . E . I . S . to be re- viewed at the December 28th meeting . At which time it will be decided whether Schlecht or a Board member will do the final draft . Let it be on record also that the Planning ul Board will have some input on this as well . Anything to be elaborated on , from the minutes , is to be submitted by Friday . Gagnon : Going back to Ronda Engman ' s letter , should the noise ordinance include target shooting? After some discussion , it was w ' decided that this would be hard to enforce . Little : I would like to request a copy of the new zoning ordinance . Gagnon : It doesn ' t exist yet . Little : How was permission given for the new heavy equipment barn to be built on Danby Road ? Is this categorized as Commercial ? Can anything be done to stop what ' s already been built ? Dietrich : Concerns like this should be taken up with Doug Staley and the laws should be reviewed . If you disagree with the outcome , it can be taken to the Board of Zoning Appeals . Little : I will volunteer my time to help with the writing of the new zoning ordinance . Roe : We need to be tolerant of other people ' s rights . We all have our reasons for chosing country living . Sczepanski : A noise ordinance would be unreasonable . A lot of residents enjoy target practicing on their property . Debbie Maycu<nber : What is happening on the double wide issue ? Will there be a permissable referendum in February? Dietrich : It will be on a referendum along with other zoning issues . It is due to come out the end of February . The present law that we have is the law that we are operating under for mobile homes . The referendum would not allow or disallow in and of itself . The town is in court for several trailers in the area . Dobson : Doublewides should be allowed . Would hate to see Danby build a wall around itself with all the new laws under consideration . Dietrich : Let me remind you that there is an agency where residents can go to have their disputes resolved effortlessly . It is called Community Dispute Resolu- tion . Committee Reports : EMC - No report. Community Council - Will be sponsoring a Holiday Party this Saturday from 1 : 00 p . m . - 2 : 00 p . m . with an appearance from Santa . Highway - Will the recycling program open this Saturday? Has anyone been hired ? Dietrich : No , we are not ready to open until later this month . No one has been hired to handle the n� i . recycling yet . Dog Control - 3 Complaints , 1 Trip , 3 Lost Dogs , 5 Found , 1 Dog Impound - ' 1 1 Euthanized . Expenses were $ 18 . 05 . Will I be appointed to continue as Dog Warden for I 1990 ? I am classified as a part -time employee , correct ? Dietrich - You will be our Dog Warden next year with a 4% increase . We hadn ' t considered anything otherwise . Zoning - 1 New House , 1 Garage , 2 Illegal Automobiles , 1 Storage Trailer , 1 Business in R1 District . $432 . 00 in Building Permits with $ 263 , 900 . 00 Total Construction Value . One Certificate of Occupancy . Senior Citizens - None . Planningjfoard - We are going to need a couple of members . Dietrich : We have a couple of people who said they may do it , however , no commitments . Fire District - West Danby has a new pumper . There have been numerous calls with two fire tragedies . County Youth - Money available for next year . We will meet again by March to decide what is to be done for next year . Water District - The Fire Dept . is using water from the hydrants in West Danby . We had an agreement that they would not do that since it interferes with the water usage of the residents . We have received some complaints about this . Dietrich - I will write them a letter and ask them not to do this in the future . They can do their practicing off stand pipes . Roberts : We have had an inspection of the Town Hall and all the improvements have been made . We may have a potential problem with the well . Some of the wells in the area have had to be lowered due to the water level dropping 25- 30 feet . Roger Howell will have to be contacted to locate the present well and do an investigation of our situation . The water has been turning dark on occassion . ( Resolution passed under New Business . ) Old Business : None . New :Business : Dietrich - Read Resolution #60 ( See Attached . ) Resolution #62 was presented and read . It pertains to solid waste as outlined below . RESOLUTION #62 - Whereas , the Town of Danby has more than any other municipality bore the burden of Tompkins County solid waste , and whereas , the County in its endeavor to site a landfill proceed with all possible haste on it ' s current designated site in order to meet the closure date of August , 1990 , and whereas any delay that prolongs the County ' s dump in the Town of Danby is unacceptable , and whereas , whereas , the current old technology dump is endangering wetlands , aquifers , public drinking water and the head waters of one of the best trout streams in the State of New York , and whereas , the Town is adamant that the site be closed and not used for any interim solution concerning solid waste , including the possibility of a transfer station . Therefore , be it resolved , that the Town of .t 1 r • zi/ Town Board Minutes Town of Danby December 11 , 1989 Page 3 RESOLUTION #62 ( Cont ' d . ) Danby supports and encourages the County to move with all possible speed to site the County ' s new landfill and bailing station . A motion to support the above resolution was made by Supervisor F . W . Dietrich , and seconded by Councilperson Mary Oltz . Ayes : Roberts , Tagliavento , Oltz , Eckstrom , Dietrich . Adopted : December 11 , 1989 RESOLUTION #63 Appoint Ed Roberts to contact Roger Howell to give us a preliminary estimate on our water problem . We would ask him for a diagnosis . The expenses of this not to exceed $ 500 . 00 . Motion was made by F . W . Dietrich , seconded by Councilperson Roberts . Ayes : Roberts , Tagliavento , Oltz , Eckstrom , Dietrich . Adopted : December 11 , 1989 Supervisor Dietrich announced the year-end meeting to take place December 28 , 1989 , at the Town Hall at 7 : 00 p . m . APPROVAL OF WARRANTS : A motion was made by Clwn . Roberts , seconded by Clwn . Tagliavento to approve payment of General Fund Warrant #12 , totaling $ 5 , 920 . 86 . Adopted : Eckstrom , 4Oltz , Roberts , Tagliavento , Dietrich . A motion was made by Clwn . Tagliavento , seconded by Clwn . Roberts to approve payment of the Highway Fund Warrant #12 , totaling $ 6 , 832 . 08 . Adopted : Eckstrom , Oltz , Roberts , Tagliavento , Dietrich . A motion was made by Clwn . Oltz , seconded by Clmn . Eckstrom to approve payment of the West Danby Water District Warrant # 12 , totaling $ 86 . 90 . Adopted : Eckstrom , Oltz , Roberts , Tagliavento , Dietrich . A motion was made by Clmn . Eckstrom , seconded by Clwn . Roberts to approve the Supervisors Monthly Report for December . Adopted : Eckstrom , Oltz , Roberts , Tagliavento , Dietrich . A motion was made by Clwn . Oltz , seconded by Clwn . Tagliavento to approve the Town Clerk ' s Monthly Report for December . Adopted : Eckstrom , Oltz , Roberts , Tagliavento , Dietrich .
