PUBLIC HEARING 1997 PRELIMINARY BUDGET A Public Hearing was held by the Town Board of the Town of Cortlandville on November 06, 1996 at 7:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York:, regarding the 1997 Preliminary Budget. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were Town Attorney, John Folmer and Highway Supt, Carl Bush. The Public Hearing was called to order by Supervisor Thorpe at 7:00 p.m. The Town Clerk read aloud the Legal Notice as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. No comments or questions were heard. Councilman Rocco made a motion, seconded by Councilman Pilato, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:05 p.m. I. C� J i 31r NOVEMBER 06, 1996 TOWN BOARD MEETING 7:00 P.M. The Regular Meeting of the Town Board of the Town of Cortlandville was held at 7:00 p.m at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Raymond Thorpe presiding, following the 1997 Budget Public Hearing. Members present: Supervisor, Raymond Thorpe • Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were Town Attorney, John Folmer; Highway Supt, Carl Bush and Town Resident, Tim Darbishire of Lighthouse Hill. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to approve, as written, the Town Board Minutes of September 18, 1996. All voting aye, the motion was carried. Councilman Pilato made a motion, seconded by Councilman Rocco, to approve, as written, the Town Board Minutes of October 02, 1996. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Cortlandville Planning Board Minutes of September 24, 1996. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Cortlandville Zoning Board of Appeals Minutes of September 24, 1996. All voting aye, the motion was carried. RESOLUTION #189 AUTHORIZE PAYMENT OF VOUCHERS NOVEMBER Motion by Councilman Rocco Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED • BE IT RESOLVED, the vouchers and shall be as follows: submitted have been audited paid General Fund A Vouchers #553-570 $ 3,988.24 General Fund B 149-155 $ 5,005.50 Highway Fund DB 433-455 $159,606.56 Water Fund 254-264 $ 1,777.34 Sewer Fund 163-166 $ 639.11 Capital Projects 26- 28 $ 339.70 Privilege of the floor was offered to Mr. Tim Darbishire who resides at 1805 Lighthouse Hill Road. He explained he was in attendance to discuss the situation regarding code violations regarding his property. The Cortlandville Zoning Board of Appeals has allowed him to reside in a trailer on his property while 36-- NOVEMBER 06, 1996 TOWN BOARD MEETING PAGE 2 he builds a house there. It has taken longer than he anticipated. He also must remove unlicensed vehicles from his property. He explained that he has not been able to complete this house this summer due to an illness of a family member living in England. He hopes to have it completed by the end of the year and have the trailer removed by February. A discussion was held whereby Mr. Darbishire agreed to have the unlicensed cars moved by November 14, 1996. Councilman Rocco will check to see if this has occurred. A summons will be issued to Mr. Darbishire on November 15, 1996 if the cars are not removed. Town Board members noted that it has taken him three to four years to build his home. Councilman Rocco requested that he attend the next Town Board Meeting on November 20, 1996 and give an updated report. Any action will be postponed until that time. Reports for the Month of October 1996 from the Supervisor, Town Clerk, and Code Enforcement Officer are on the table for review, and filed in the Town Clerk's Office Town Clerk, Pauline Parker informed the Town Board of the Bond sale which occurred on October 29, 1996. Information regarding the current Bond Rating of the Town was distributed, which is Baal. Councilman O'Donnell made a motion, seconded by Councilman Testa, to receive and file the information received from NYS DOT regarding our request to lower the speed limit on Clinton Street Extension and South Hill Road upon entering the Village of McGraw. All voting aye, the motion was carried. NYS DOT reported that they will investigate the situation on Clinton Street Extension and notify us of the results. NYS DOT reported that upon their review it was determined that a reduced speed limit is not appropriate on South Hill Attorney Folmer reported on the following: Comptroller's application for Water Tank Project: He will meet with Assessor David Briggs this week to get needed information to complete the document requested by the State Comptroller's office. Public Improvement Bond - 1996: The bidding process occurred on October 29, 1996 and the Closing will take place on November 12, 1996 at the Bond Council Office in New York City. All necessary documents have been signed by the Supervisor and Town Clerk, and forwarded to Bond Council. Monies received will be forwarded and deposited at First National Bank of Cortland in a water and a sewer account. The schedule he has received reports that the BAN's will be paid off on February 2, 1997. The following resolution was presented for adoption, as required. 1 • 1 303 NOVEMBER 06, 1996 TOWN BOARD MEETING PAGE RESOLUTION #190 ADOPT RESOLUTION DELEGATING TO THE SUPERVISOR CERTAIN POWERS AND DUTIES WITH RESPECT TO THE ISSUANCE OF SERIAL BONDS WITH SUBSTANTIALLY LEVEL OR DECLINING ANNUAL DEBT SERVICE Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, pursuant to the provisions of Chapter 201 of the 1994 Laws of New York (the "Level Debt Legislation") the Town of Cortlandville, in the County of Cortland (the "Town"), is authorized to issue bonds with annual debt service which is substantially level or declining, and the Town Board of the Town is further authorized to make the determination as to whether bonds shall be issued in a manner which causes annual debt service to be substantially level or declining; and WHEREAS, the Town Board of the Town is further authorized to delegate to the Supervisor, as chief fiscal officer, the power to make such determination with respect to bonds which may from time to time be sold by the Town; now therefore, BE IT RESOLVED, by the Town Board of the Town of Cortlandville, in the County of Cortland, New York (by favorable vote of not less than two-thirds of all the members of said Town Board) as follows: Section 1. Pursuant to Section 56.00 of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (the "Law"), as amended by the Level Debt Legislation, the Town Board hereby delegates to the Supervisor all of its powers and duties prescribed in Section 21.00 of the Law, as amended by the Level Debt Legislation, pertaining to the making of determinations respecting the issuance of bonds with substantially level or declining annual debt service. The foregoing delegation shall apply to all bonds authorized pursuant to bond resolutions heretofore and hereafter adopted by the Town Board. Section 2. This resolution shall take effect immediately. Supervisor Thorpe presented a request from First United Methodist Church, 734 Route 222 to have their water benefit tax reduced, and a memo from Assessor, David Briggs, regarding this. They requested there current 6.60 unit charge be lowered to 1 unit. The Assessor stated this charge was based on road frontage, and the facility has only one hookup, similar to the request of the Cortland County Airport. A discussion was held relating to our current formula used and the impact of this request. RESOLUTION #191 AUTHORIZE REQUEST OF FIRST UNITED METHODIST CHURCH TO CHANGE WATER BENEFIT CHARGE TO ONE UNIT Motion by Councilman Testa Seconded by Councilman O'Donnell AYE: Councilman Testa, O'Donnell, Pilato NAY: Councilman Rocco _�Oy NOVEMBER 06, 1996 TOWN BOARD MEETING PAGE 4 WHEREAS, First United Methodist Church located on NYS Route 222, has submitted a request for review and consideration, to reduce their current Water Benefit Tax unit charge of 6.6 units to one unit, and WHEREAS, the church, a non-profit organization, has been charged in accordance with their road frontage and they only one hook-up at their location, therefore BE IT RESOLVED, the Town Board does hereby authorize a change of the Water Benefit Tax formula for tax map parcel 95.00-05-05.000, to one unit charge, effective with the 1997 Tax Roll of the Town of Cortlandville. RESOLUTION #192 ACCEPT NOTIFICATION OF COMPLETED WATER AND SEWER IMPROVEMENT PROJECTS Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby accept the notice, submitted by Town Engineer, Hayne Smith, which states the Capital Improvement Projects of Mid -Town Sewer; Route 13 SCM Water; Luker Road Sewer and Route 215 Water Tank Connection are 100% complete. RESOLUTION #193 APPOINT PETER ALTERI JR. AS WATER AND SEWER SUPERINTENDENT, EFFECTIVE OCTOBER 26, 1996 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the appointment of Peter Alteri Jr. as Water and Sewer Dept. Superintendent, effective October 26, 1996, at an annual salary of $34,078.20. RESOLUTION #194 APPOINT WILLIAM TIERNEY AS WATER AND SEWER OPERATOR, EFFECTIVE OCTOBER 26. 1996 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the appointment of William Tierney as Water and Sewer Dept. • Operator, effective October 26, 1996, at an annual salary of $28,078.27, subject to the terms of his present leave of absence. RESOLUTION #195 RECEIVE LISTING OF WATER AND SEWER AGED ACCOUNTS FOR 1996 Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the listing of water and sewer aged accounts for 1996 is hereby received and filed, as required, and shall be received and filed. 1 E NOVEMBER 06, 1996 TOWN BOARD MEETING PAGE 5 Supervisor Thorpe referred to the documents given to Town Board members tonight from Mrs. Fortuna Abate, 1227 Bell Drive. She has contacted him many times, regarding the ongoing water drainage problem for the residents of Bell Drive. When it rains the water drains from the Renaissance Development, through the drainage ditch under NYS Route 281 to the North side of Bell Drive. Because of the complexity of this situation, Jeff Ten Eyck of Cortland County Soil and Water Conservation District was contacted for assistance. He investigated the area and gave recommendations, which we could not fulfill. After several contacts with those at the State level, he requested a State hydrologist from NYS State Soil and Water Conservation Service to study this and submit a report. Before this was accomplished, a letter was received from Attorneys representing the residents, which has been referred to our Town Attorney. Since he has received a call informing him that a report is in the process of being written. Our Attorney has informed the Attorney representing Bell Drive residents of this. Until the report is received nothing can be done. A discussion was held concerning this situation and the history of this problem. It was agreed that we will wait until we receive the report from the Hydrologist. No action was taken. Councilman Pilato made a motion, seconded by Councilman Testa, to adjourn the Regular Meeting.
