PUBLIC HEARING AQUIFER PERMIT NO. 9 OF 1996 GEORGE HASKELL - INTERSECTION NYS RTE.281 & 222 A Public Hearing was held by the Town Board of the Town of Cortlandville on October 2, 1996 at 7:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Permit of George Haskell to construct a 14,000 sq. ft. addition to the west of an existing 6,400 sq. ft. retail building and to construct two 5,000 sq. ft. out buildings together with associated parking on property located next to the intersection of NYS Rte. 281 and 222,(Tx Mp.#86.13-01- 23,35,36, and 37.2). Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; and Highway Superintendent, Carl Bush. Supervisor Thorpe called the Public Hearing to order at 7:00 p.m. The Town Clerk read aloud the Legal Notice, as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. It was reported that the Town Planning Board took no action on this permit as the applicant, nor a representative, were in attendance at their meeting. No comments or questions were heard. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:05 p.m. 294 OCTOBER O2, 1996 TOWN BOARD MEETING 7:00 P.M. The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, on October 2, 1996 at 7:00 p.m. with Supervisor Raymond Thorpe presiding, following a Public Hearing concerning an Aquifer Permit of George Haskell. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; and Highway Superintendent, Carl Bush. Supervisor Thorpe called the Regular Meeting to order at 7:05 p.m. Councilman Rocco made a motion, seconded by Councilman Pilato, to approve, as written, the Town Board Minutes of August 21, 1996. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the Town of Cortlandville Planning Board Minutes of August 17, 1996. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file the Cortlandville Zoning Board of Appeals Minutes of September 11, 1996. All voting aye, the motion was carried. RESOLUTION #182 AUTHORIZE PAYMENT OF VOUCHERS OCTOBER Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers# 504-521 $12,507.72 General Fund B 135-144 $11,608.24 Highway Fund DB 396-414 $13,070.71 Water Fund 224-237 $21,394.43 Sewer Fund 152-157 $34,950.02 Capital Projects 24- 25 $ 1,512.24 Reports of August, 1997 for the Justice Department, and of September, 1996 for Town Clerk and Zoning Officer, was available for review and filed in the Clerk's Office. 1 L� 1 • �J0 OCTOBER 02, 1996 TOWN BOARD MEETING PAGE 2 Privilege of the floor was granted to Councilman Testa. He requested a discussion relating to putting a freeze on any spending for the departments of the Town or Capital Projects. A request was made to set a reasonable limit for spending without prior approval. RESOLUTION #183 DECLARE A FREEZE ON SPENDING FOR THE TOWN AND CAPITAL PROJECTS ® Motion by Councilman Testa Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED WHEREAS, concern has been expressed of the financial situation of the Town due to the uncertainty of sales tax, surplus monies and the increased cost of the benefit tax for Capital Projects, therefore BE IT RESOLVED, no new employees shall be hired; no new Capital Projects shall be approved; no new equipment and no unnecessary expenditures of any department, with a maximum dollar limit of $500, shall be allowed without prior approval of the Supervisor. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter from Bruce Tinney of TWFanch-one Co. All voting aye, the motion was carried. The letter states a transfer of the Franchise Agreement with Fanch Communications of New York to TWFanch-one has occurred. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter from NYS Comptroller H. Carl McCall. All voting aye, the motion was carried. The letter informed the Supervisor of the Town's payment of State General Purpose Revenue Sharing (GPRS) for 1996, in the amount of $27,934, and future concerns. Councilman Pilato made a motion, seconded by Councilman Testa, to receive and file the correspondence received from Mr. John Shehadi of FA Fiscal Advisors & Marketing, Inc. All voting aye, the motion was carried. The correspondence relates to the pending sale of the Town's $2,225,000 Public Improvement Serial Bonds and the proposed Bond Principal Maturity Schedule, and • the forwarding of the required documents to Attorney Gerard Fernandez, Bond Council in New York. Town Clerk, Pauline Parker, informed the Town Board of the Prestigious Award recently presented to our Town Assessor, David Briggs, by his fellow associates of the NYS Assessors Association. This is the foremost award an assessor can receive, for his involvement and accomplishments, both at the state and local level. Town Clerk, Pauline Parker, distributed the 1997 Tentative Budget. Supervisor Thorpe explained the process, and compared rates of the previous year. He has been advised of a 3% increase of the Water Benefit Tax and a 36% increase of the Sewer Benefit tax. A 10 cent increase in the tax rate would raise $23,000. OCTOBER 02, 1996 TOWN BOARD MEETING PAGE 3 RESOLUTION #184 ACKNOWLEDGE RECEIVING 1997 TENTATIVE BUDGET Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Clerk presented the 1997 Tentative Budget to members of the Cortlandville Town Board, in accordance with Town Law. Supervisor Thorpe informed Board Members of the status of the Town relating to surplus monies, revenues, sales tax and the factors involved. Workshops will be scheduled. News Reporter,, Katie Hall, arrived and was introduced to Town Board Members. Attorney Folmer has nothing to report. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to adjourn the Regular Meeting. All voting aye, the motion was carried.
