The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Highway Supt, Carl Bush; Town Typist, Edna Puzo; Members of S.H.A.P.E. Patrol for the Handicap Parking, Francis Pizzola and Helen Christian; and News Reporter, Sarah Fulmer. Supervisor Thorpe called the meeting to order at 5:00 p.m. Councilman Testa made a motion, seconded by Councilman Pilato, to approve, as written, the Town Board Minutes of June 26, 1996 and July 17, 1996. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file the Planning Board Minutes of June 25, 1996. All voting aye, the motion was carried. Councilman Pilato made a motion, seconded by Councilman O'Donnell, to receive and file the Zoning Board of Appeals Minutes of June 25, 1996. All voting aye, the motion was carried. RESOLUTION #168 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A General Fund B Highway Fund DA Highway Fund DE Water Fund Sewer Fund Capital Projects Vouchers# 456-467 115-121 10 345-355 192-197 128-134 12- 16 $ 8,715.96 $ 5,631.59 $ 3,500.00 $ 16,132.88 $ 4,668.62 $ 54,451.46 $205,337.69 Supervisor Thorpe offered privilege of the floor to Francis Pizzola, a member of the County SHAPE Patrol for Handicap Parking Enforcement. Ms. Pizzola submitted copies of the New York State Americans with Disabilities Act, information regarding the local SHAPE Patrol, and a Mission Statement of the Cortland County Accessibility Committee, of which she is chairperson. She informed the Town Board of the volunteer training conducted by Lt. Gosse.from the Cortland County Sheriffs Dept. Uniforms are being used by the patrol. AUGUST 21, 1996 TOWN BOARD MEETING PAGE 2 At the present time they can only issue tickets for cars parked in a handicapped space with no valid permit visible. She distributed and reviewed the ticket that has been proposed for use in the County. Ms. Pizzola requested the Town Board to draft a resolution regarding parking in Fire Lanes and curb cuts in the Town, to amend our current ordinance. A discussion was held concerning this whereby the Town Board wanted more time to review this request. They will forward this request to the Town Attorney to review and make recommendations. Councilman O'Donnell reported to the Town Board of the meeting he attended with the Village of McGraw Board regarding Well Head. Protection. They discussed concern of an area on Ridge Road which needs to be monitored. This area, as designated on the map presented, could pose a threat if a housing development were approved and septic tanks were allowed. The Well Head Protection Committee may request, in the future, the Town Board to include provisions in the Zoning Ordinance of the Town for protection of the Village water supply. There is no threat to their water supply at the present time. Supervisor Thorpe stated that this concern applies to all areas of the Town. We, Town and County Planning Boards, and the County Health Dept. have required a developer to install sewer lines in new proposed developed areas. The County Health Dept. must approve any septic tanks installed. A discussion was held concerning the requirements and procedures necessary for protecting Well Head Areas. The area in McGraw includes a hillside area with a farm at the top of the hill Supervisor Thorpe addressed the Town Board regarding the request of the City of Cortland for redistribution of sales tax monies. If this request is approved, the Town tax rate could triple. The Town of Cortlandville property owners will be subsidizing the residents of the City of Cortland. A discussion was held regarding the many factors involved. County Legislative action is required. RESOLUTION #169 APPROVE PLUMBERS APPLICATION OF GRANT STREET CONSTRUCTION FOR WATER AND SEWER CONNECTIONS WITHIN THE TOWN OF CORTLANDVILLE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an application was submitted by Grant Street Construction, formerly known as Compagni Construction Co., 48 Grant Street, Cortland, NY, for approval to install water and sewer services in the Town, and WHEREAS, such application included references and previous experience, as required, and reviewed and recommended by Water Supt, Carl Bush, therefore BE IT RESOLVED, the application submitted for Grant Street Construction is hereby approved, and shall be added to the approved Plumbers List of the Town of Cortlandville. 1 41 1 0 1 233 AUGUST 21, 1996 TOWN BOARD MEETING PAGE 3 Reports for the month of July, 1996 for the Town Justice and Supervisor are on the table for review, and filed in the Town Clerk's Office. RESOLUTION #170 ACKNOWLEDGE CERTIFICATE OF COMPLETION OF ADVANCED JUDICIAL EDUCATION COURSE FROM TOWN JUSTICE, MARDIS F. KELSEN Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge the Certificate of Completion of Advanced Judicial Education Course from Town Justice, Mardis F. Kelsen, as required, and shall be received and filed. Town Clerk, Pauline Parker, reported that the change of polling place from the Econo Lodge to the newly renovated and expanded Cortlandville Highway Barn has been accomplished. The election inspectors were given a tour of our facility and were acceptable to the change. A letter of appreciation was sent to Econo Lodge. The Board of Elections has advised of consolidation for both Primary Day and Registration Days. Only the Town Hall will be used for those days. RESOLUTION #171 AUTHORIZE HIGHWAY SUPT. TO INSTALL TWO 30 MPH SPEED LIMIT SIGNS ON LOUISE DRIVE AND ACCEPT PETITION Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, a petition was submitted by residents of Louise Drive requesting two 30 mph speed limit signs be placed on Louise Drive at the entrance from Levydale Park and the entrance from Delaware Street, therefore BE IT RESOLVED, the petition shall be received and filed, and further RESOLVED, the Town Board does hereby authorize the Highway Supt. to install two 30 mph speed limit signs on Louise Drive, as petitioned. RESOLUTION #172 AUTHORIZE TOWN ASSESSOR TO PROCEED • WITH THE REVALUATION OF PROPERTIES WITHIN THE TOWN AND COMPLETE AN REASSESSMENT PROJECT FOR THE 1997 ASSESSMENT ROLL Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Town of Cortlandville desires uniform and equitable assessment on all property located in said Town, and WHEREAS, the Town of Cortlandville believes the manner in which to achieve equitable assessment is by conducting a townwide reassessment project, and 2.8 AUGUST 21, 1996 TOWN BOARD MEETING PAGE 4 WHEREAS, it is understood that this revaluation will be completed in strict compliance with the Rules and Regulations of Article 15-B as promulgated by the New York State Office of Real Property Services, and WHEREAS, it is further understood that the reassessment project will be completed in conjunction with the New York State Office of Real Property Services, regional office in Syracuse, New York, and that office will furnish certain computer and personnel services necessary for successfully completing the reassessment in compliance with Article 15-B, and WHEREAS, the Town further understands that the New York State Office of Real Property Services will prepare a letter of commitment and a contract covering the scope of services it will provide, the responsibilities of the parties involved and the cost to the Town, therefore BE IT RESOLVED, -the Town of Cortlandville herein expresses its support for a revaluation of all property located in said Town and does hereby authorize and direct the Town Assessor, David Briggs, to conduct and complete the reassessment project for implementation on the 1997 Assessment Roll. RESOLUTION #173 REFER ZONING VIOLATION OF EMORY KNIGHT, RIDGE ROAD, TO TOWN ATTORNEY Motion by Councilman O'Donnell Seconded by Councilman Rocco VOTES: ALL AYE ADOPTED BE IT RESOLVED, a letter dated August 20, 1996 sent to Emory Knight of 2956 Ridge Road relating to zoning violations from Town Code Enforcement Officer, Bruce Weber, is hereby received and filed, and further RESOLVED, the matter shall be referred to the Town Attorney for review and action, if required. Councilman O'Donnell made a motion, seconded by Councilman Pilato, -to adjourn the regular meeting. All voting aye, the motion was carried.
