A Public Hearing was held by the Town Board of the Town of Cortlandville on June 26, 1996 at 7:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an amendment to the Town Zoning Law regarding Adult Entertainment. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Charlene Seamens of East West Martial Arts and News Reporter, Sarah Fulmer. Supervisor Thorpe called the Public Hearing to order at 7:00 p.m. The Town Clerk read aloud the Legal Notice, as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. Attorney Folmer explained this amendment was distributed to Town Board members and also the Town Planning Board and ZBA for review and input. Questions were answered and no changes were recommended. There was some discussion regarding this amendment, and an explanation of the zones of the Town, relating to the distance stated within the amendment. This amendment does not include any regulations for printed material. No further questions or comments were heard. Councilman Testa made a motion, seconded by Councilman Rocco, to close the Public Hearing. All voting aye, the motion was carried. PUBLIC HEARING AQUIFER PERMIT NO. 8 OF 1996 TAX MAP #85.20-01-35.110 & 86.17-10-02.200 BESTWAY ENTERPRISES - 3877 LUKER ROAD A Public Hearing was held by the Town Board of the Town of Cortlandville on June 26, 1996 at 7:15 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Permit application of Bestway Enterprises, to construct two new storage buildings, to be located at 3877 Luker Road. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Charlene Seamens of East West Martial Arts and News Reporter, Sarah Fulmer. PUBLIC HEARING AQUIFER PERMIT NO. 6 OF 1996 TAX MAP #95.12-01-16.000 CORTLAND WOOD PRODUCTS - 150 MCLEAN ROAD A Public Hearing was held by the Town Board of the Town of Cortlandville on June 26, 1996 at 7:20 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Permit application of Cortland Wood Products, to construct a second floor office area, to be located at 150 McLean Road. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Charlene Seamens of East West Martial Arts and News Reporter, Sarah Fulmer. A Public Hearing was held by the Town Board of the Town of Cortlandville on June 26, 1996 at 7:25 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Permit application of Christine T. Place on behalf of S.J.M. Entertainment, for the Plaza Theatre to construct an addition to the existing theatre to be located at Tompkins Street and Glenwood Avenue. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Absent: Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Charlene Seamens of East West Martial Arts and News Reporter, Sarah Fulmer. The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Raymond Thorpe presiding, following four Public Hearings. Members present: Absent: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Town Clerk, Pauline Parker Councilman, John Pilato Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Charlene Seamens of East West Martial Arts and News Reporter, Sarah Fulmer. Supervisor Thorpe called the meeting to order at 7:25 p.m. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to approve, as written, the Town Board Minutes of May 15, 1996. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file the Cortlandville Planning Board Minutes of May 28, 1996. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to receive and file the Zoning Board of Appeals Minutes of May 28, 1996. All voting aye, the motion was carried. RESOLUTION #136 AUTHORIZE PAYMENT OF VOUCHERS Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A • General Fund B Highway Fund DB Water Fund Sewer Fund Vouchers #378-388 $36,147.03 80- 87 $49,894.24 258-267 $ 8,364.09 157-160 $13,608.09 108 $14,189.25 Privilege of the floor was given to Councilman Rocco. He stated that Gutchess Lumber -Cortland Wood Products keep there property looking good and the Town is fortunate to have them as a business of the Town. Supervisor Thorpe stated that at a previous meeting Mayor of Homer, Mary Alice Bellardini, requested funding from the Town for the purchase a tub grinder, contingent upon approval of a grant. Trish Hanson of the City of Cortland, will draft another application to submit to NYS DEC, for grant approval. Attorney Folmer will have the Adult Entertainment Law ready to be adopted at the July 17, 1996 Town Board meeting. RESOLUTION #137 DECLARE NEGATIVE IMPACT FOR BESTWAY ENTERPRISES, AQUIFER PERMIT # 8 OF 1996 Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Special Permit application was submitted by Bestway Enterprises for the construction of two storage buildings, to be located at 3877 Luker Road, and WHEREAS, a Public Hearing was duly held by the Town Board, and WHEREAS, the Town Board, as Lead Agent, duly reviewed and completed the Short Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed project of Bestway Enterprises shall have no significant environmental impact and further RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA application. RESOLUTION #138 APPROVE AQUIFER PERMIT #8 OF 1996 FOR BESTWAY ENTERPRISES Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Planning Board and the Cortlandville Planning Board have reviewed and recommended approval of this application, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Permit # 8 of 1996, submitted by Bestway Enterprises, located at 3877 Luker Road, and further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. PLACE - PLAZA THEATRE Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Cortland County Planning Board and the Cortlandville Planning Board have reviewed and recommended approval of this application, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Permit # 7 of 1996, submitted by Christine T. Place on behalf of S.J.M. Entertainment, The Plaza Theatre, located at Tompkins Street and Glenwood Avenue, and further RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. Attorney Folmer reported on the following: Renewal of 3 BAN's: Paperwork has been completed and will be submitted to the Bank, to be renewed until February 28, 1997. The plan is, when those notes come due, or prior to, we will combine them into one Bond Issue, which we will sell publicly. This bond will include several improvement projects. Comptroller Approval Rt 215 Water Tank Project: Audit & Control have advised of new regulations relating to Comptroller approval of improvement projects. They have received, and are returning, our application for the 215 Water Tank. Only the format needs to be changed. He may need a Special Meeting to adopt a resolution. They also advised the approval should be accomplished timely, whereby we should be able to go out to bid this Fall, for construction next Spring, of the water tank. Obtain BAN's for Tompkins St. and Pleasantview; Route 13 and Route 215 Water Tank Connection projects: When the 20 day referendum period is up, he will prepare the certificate for Town Clerk to sign. Then we will get BAN's for these projects. Freedom of Information Requests: Fax requests are acceptable under "Freedom of Information Law." A discussion followed whereby it was agreed that when a request is honored; only names, no addresses or phone numbers should be released. Any request must be in writing, but it does not have to have a signature. Attorney Folmer reported he will be on vacation from July 15-29, 1996. If a need should occur, contact his office. Supervisor Thorpe stated that he has discussed the Town's Bond rating with John Schadie. The Town's rating is E-AA. The Town's Insured Bond rating is AAA. Councilman Rocco made a motion, seconded by Councilman O'Donnell to adjourn the Regular meeting. All voting aye, the motion was carried.
