PUBLIC HEARING PROPOSED AMENDMENT TO PARKING ORDINANCE TO INCLUDE HANDICAP PARKING REGULATIONS A Public Hearing was held by the Town Board of the Town of Cortlandville on April 03, 1996 at 7:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning a proposed amendment to the Parking Ordinance to include Handicap Parking Regulations. Members present:: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer, Highway Supt, Carl Bush; Town Typist, Edna Puzo; Miss Michele Pizzola, Mr. & Mrs. Frances Pizzola of Starr Rd, Douglas Fenton, Coordinator of SHAPE Patrol, and others unidentified, and News reporter, Keith Doherty. Supervisor Thorpe called the Public Hearing to order at 7:00 p.m. The Town Clerk read aloud the Legal Notice, as posted and filed. Supervisor Thorpe reported that he was contacted by the County requesting this awhile ago. He was of the opinion that the regulations of the SHAPE patrol was County regulated. Upon review of the program, it was determined that to accomplish this program in the Town of Cortlandville, our Parking Ordinance needs to be amended. A draft of this has been made available for public review. He offered those in attendance privilege of the floor. Mr. Douglas Fenton, Coordinator of SHAPE patrol, explained their program. They currently have 14 volunteers, whom can issue violation tickets for a vehicle parked in a handicap parking spot, which is not authorized to. Warning notices have been issued in the Town. Those SHAPE workers in attendance requested that the Town amend the ordinance so that they will be allowed to ticket those offenders. Councilman O'Donnell requested information regarding the penalty schedule of the City of Cortland. Mr. Fenton advised: $25.00, if the fine is not paid within seven days than the fine goes up to $50.00. Miss Pizzola stated that the fee charged for a fine, varies for different municipalities. Town Attorney, John Folmer, stated that State Law determines the manner and number of required handicap parking places in parking lots. The Local Ordinance will set the penalty schedule, of the cost of a fine. Ours, as proposed, state;: First offence will be not less then $25.00 and not more then $50.00. Town Clerk, Pauline Parker, discussed her concerns ® of those applicants who received a Permanent Handicapped Permit which does not hang from the mirror. Are they also looking on the dash of vehicles for these permits. A resident of the Town, who has this type, was issued a ticket in the City, during the holidays, and was very upset. Due to a change in the regulation procedure, this applicant was allowed to also receive the hangar type. Upon receipt of her permit, she was not fined, but it did upset her. J 0 1 Other concerns were heard such as parking in fire lanes and other questioned areas in parking lots. Attorney Folmer advised, the proposed amendment presented, is for handicapped parking spaces only, and providing a schedule for a fine. Other concerns can be considered in the future. Our current Ordinance, plus the State Vehicle and Traffic Law and others would need further review. No further comments were heard. Councilman O'Donnell made a motion, seconded by Councilman Rocco, to adjourn the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:20 p.m. APRIL 03, 1996 7:20 P.M. PUBLIC HEARING AQUIFER PERMIT NO. 3 OF 1996 DR. LEE AMBROSE - COMMONS AVENUE LOT #5 A Public Hearing was held by the Town Board of the Town of Cortlandville on April 03, 1996 at 7:20 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Permit of Dr. Lee Ambrose for Commons Avenue, Lot #5, to construct a 4300 square foot professional medical office building, with parking lot area to accommodating 15 parking spaces on an approximate 1 acre lot. (Parcel #86.09-04-12.000). Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present. were: Town Attorney, John Folmer, Highway Supt, Carl Bush; Town Typist, Edna Puzo; Miss Michele Pizzola, Mr. & Mrs. Frances Pizzola of Starr Rd, Douglas Fenton, Coordinator of SHAPE Patrol, and News reporter, Keith Doherty. The Regular Town Board Meeting of the Town of Cortlandville was held on April 03, 1996 at 7:30 p.m. at the Town Hall, 3577 Terrace Road, Cortland, New York with Supervisor Thorpe presiding. Supervisor Thorpe called the Regular Meeting to order at 7:30 p.m. following three Public Hearings. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to approve, as written, the Town Board Minutes of February 07, 1996 and February 21, 1996. All voting aye, the motion was carried. RESOLUTION #77 AUTHORIZE PAYMENT OF VOUCHERS APRIL Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers# 209 - 240 $23,903.33 General Fund B 24 - 31 $ 8,607.46 Highway Fund DB 127 - 144 $18,870.53 Water Fund 67 - 84 $33,613.42 Sewer Fund 49 - 60 $ 9,974.66 Privilege of the floor was given to Cortland County Legislators, Sandra Price and Carletta Edwards. They expressed pleasure for being in attendance and on the agenda for this meeting. As a team, they are attending Town Board Meetings to send the message that we can all work together. They want to hear and discuss our questions or concerns and open the doors for future communication, and continued teamwork. They distributed copies of their recent reports as majority and minority leaders of the County. They discussed budgets relating to Federal, State and Local Governments, and the effects of. It was announced today that Cortland County had a surplus of $3.7 million for 1995. Of this, the County has appropriated $1.5 million for a no tax increase to most municipalities in the County this year. That left, $2.2 million will go into the General Fund. There is 1 0 I. 217 APRIL 03, 1996 TOWN BOARD MEETING PAGE 2 surplus in other County Funds as well. Cortland County is in good shape, but we need to keep it that way. They requested comments or questions from the Town Board. Those heard were: Supervisor Thorpe strongly encouraged them not to renegotiate the sales tax issue. Attorney Folmer asked if surplus monies were being considered for a bridge (Bennett Street Bridge issue) to open the western end of the village for public and safety reasons. Facts of this issue were discussed. Councilman Pilato asked if there were any funds available, to assist us, for the Blodgett Mills Park. Our project plans were explained. Councilman Testa, and Board members, asked them to support our efforts allowing the Towns to have the jurisdiction of establishing speed limits on Town roads. Supervisor Thorpe has met with Senator Seward regarding this. Rural Roads are now becoming Residential Roads.It was further discussed. The County Legislators appreciated hearing of these concerns and will take them back to the county to be considered. Supervisor Thorpe expressed appreciation for them attending our meeting. Reports for the month of February 1996, from the Departments of Justice and Supervisor: reports for the month of March Tax Collector, 1996 from Zoning, the Departments of Town Clerk, and Supervisor are on the table for review, and filed in the Town Clerk's Office. RESOLUTION #78 RECEIVE ANNUAL REPORT OF TOWN HISTORIAN FOR THE YEAR OF 1995 Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Annual Report for the year of 1995 of the Town Historian is hereby received and filed. Town Clerk, Pauline Parker, reported that she has received a phone call from Lee Burkle regarding her proposed project at Riverview Home, on Lorings Crossings. She is attempting to put together a group to act as a Board of Directors. She reported that she provided her with information of the Town Historian and • Councilman O'Donnell, as contact people. Supervisor Thorpe had a query from a Development Company in Florida regarding property in the Town located near Starr Road, Parti Drive and Route 281. This developer was inquiring about constructing' 100 new homes on this hillside. He provided them information of the Town, as they requested. He also informed Planning Board Chairperson, Kathy Wickwire, of this. RESOLUTION #79 AMENDMENT TO PARKING ORDINANCE OF THE TOWN OF CORTLANDVILLE Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED �18 APRIL 03, 1996 TOWN BOARD MEETING PAGE WHEREAS, there is an increasing problem relating to parking for handicapped citizens within the Town of Cortlandville; and WHEREAS, the Cortland County Sheriff has established a SHAPE force to enforce handicapped parking regulations within the County of Cortland; and WHEREAS, it is the desire of the Town Board to facilitate the efficient and consistent enforcement of such parking regulations; WHEREAS, the Town Attorney has been advised by the Cortland County Sheriff's Office that the personnel utilized by the County Sheriff have been provided insurance coverage in connection with their duties by the County of Cortland, now therefore; The Town Board of the Town of Cortlandville does hereby ordain and enact as follows; The Parking Ordinance of the Town of Cortlandville, enacted October 19, 1988, as amended, is hereby amended as follows; SECTION 1. Sections 3,4,5,6,7, and 8, of said ordinance are renumbered 4,5,6,7,8, and 9, respectively. SECTION 2. There is added to said ordinance, a new Section 3 to be entitled "Regulation of Handicapped Parking" said section to provide as follows; SECTION 3 REGULATION OF HANDICAPPED PARKING 1.) Parking spaces for the handicapped as provided for in Sections one thousand two hundred three -a and one thousand two hundred three-c of the Vehicle and Traffic Law of the State of New York shall also be extended to a motor vehicle registered in accordance with section four hundred four -a of the Vehicle and Traffic Law of the State of New York. A handicapped permit issued in accordance with the provisions of section one thousand two hundred three -a of the Vehicle and Traffic Law of the State of New York shall entitle the driver to park in such parking spaces. Parking spaces for the handicapped shall be those parking spaces accorded to a holder of a handicapped parking permit provided in accordance with Section one thousand two hundred three -a or as provided in section four hundred four -a of the Vehicle and Traffic Law of the State of New York. 2.) it shall be a violation for any person to stop, stand or park a vehicle in any area designated as a place for handicapped parking unless the vehicle bears a permit or a registration issued pursuant to the provisions of the Vehicle and Traffic Law of the State of New York, and such vehicle is being used for the transportation of a severely disabled or handicapped person. 3.) Any person who parks in spaces clearly marked for use by the handicapped in accordance with this section, without a special municipal parking permit or whose motor vehicle is not registered in accordance with section four hundred four -a of the Vehicle and Traffic Law of the State of New York and being used for the transportation of a handicapped person, shall be subject to a fine of not less than twenty-five dollars nor more than fifty dollars for the first offense and I 119 APRIL 03, 1996 TOWN BOARD MEETING PAGE 4 not less than fifty dollars nor more that one hundred fifty dollars for the second offense occurring within a period of two years within the same municipality. The arresting or ticketing officer shall issue a summons to violators of this section. 4.) As used in this section, the term "handicapped" shall also include "severely disabled person" as defined in section four hundred four -a of the Vehicle and Traffic Law of the State of New York. SECTION 3. This ordinance shall take effect upon publishing and posting as required by law. RESOLUTION #80 AUTHORIZE TOWN ATTORNEY TO REVIEW TOWN PARKING ORDINANCE REGARDING FIRE LANES AND CURB CUTS AND REPORT BACK TO TOWN BOARD Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, there were questions from the County SHAPE Patrol regarding the Parking Ordinance of the Town relating to Fire Lanes and curb cuts, therefore BE IT RESOLVED, the Town Attorney is hereby authorized and directed to review the Town Parking Ordinance and if it is determined that changes need to be made, he will draft a proposed amendment and report his findings to the Town Board for their review. RESOLUTION #81 DECLARE NEGATIVE IMPACT FOR AQUIFER PERMIT #3 OF 1996 - COMMONS AVENUE - LOT #5 - DR. LEE AMBROSE Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, an Aquifer Special Permit application was submitted by Dr. Lee Ambrose, for Lot #5 on Commons Avenue, for the construction of a Medical Office building, with parking lot area, and WHEREAS, a Public Hearing was duly held by the Town Board on April 3, 1996, and • WHEREAS, the Town Board, as Lead Agent, duly reviewed and completed the Short Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board, as Lead Agent, does hereby declare the proposed project of Dr. Lee Ambrose for Lot #5 on Commons Avenue, shall have no significant environmental impact, and further RESOLVED, the Supervisor is hereby authorized and directed to sign the SEQRA application. RESOLUTION #82 APPROVE AQUIFER PERMIT # 3 OF 1996 LEE AMBROSE, LOT #5 - COMMONS AVENUE Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED 220 APRIL 03, 1996 TOWN BOARD MEETING PAGE 5 WHEREAS, the Cortland County Planning Board and the Cortlandville Planning Board have reviewed and recommended approval, with conditions, of the Aquifer Permit Application #3 of 1996, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer permit #3 of 1996, submitted by Dr. Lee Ambrose for Lot #5 on Commons Avenue, with the following conditions as set by the Cortland County Planning Board: 1.) That Commons Avenue and Adjacent drainage ditches be constructed to the Town's Road Design Specifications; 2.) That the Town encourage a project design that will infiltrate roof and parking lot runoff; FURTHER RESOLVED, the Supervisor is hereby authorized and directed to sign the permit. RESOLUTION #83 ADOPT RESOLUTION PURSUANT TO TOWN LAW SECTION 209-(q)(6)(c) "TOMPKINS & PLEASANT STREET WATER IMPROVEMENT PROJECT - 1996" Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, there were filed and made available for public inspection in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the "Tompkins & Pleasant Street Water Improvement Project - 1996", as required by Sections 209-q and 209-c of Town Law: and WHEREAS, an Order was duly adopted by the Town Board on March 20, 1996 reciting the filing of said general plan, the construction proposed, and the estimated expense thereof and specifying April 3, 1996, at 7:00 p.m. as the time and the Town Hall in the Town of Cortlandville as the place where the said Board would meet to consider the documents filed as aforesaid and to hear all persons interested in the subject thereof concerning the same, and WHEREAS, said Order was duly posted and published as required by law, and WHEREAS, a hearing in the matter was duly held by the Board on the 3rd day of April, 1996 commencing at 7:00 p.m. at the Town Hall in the said Town and discussion upon the matter having been had and all persons desiring to be heard having been duly heard including members of the Board and various other persons, and NOW, upon the evidence given upon such hearing and upon the motion of Edwin. O'Donnell, Councilman, seconded by Theodore Testa, Councilman, and unanimously passed, it is RESOLVED AND DETERMINED, that the plans heretofore filed with the Town Clerk of the Town of Cortlandville are in compliance with Section 209-c of the Town Law of the State of New York and are otherwise sufficient, and that to construct the aforesaid water improvement is in the public interest, and it is further, 1 110 1 RESOLVED AND DETERMINED, all costs, including the APRIL 03, 1996 TOWN BOARD MEETING PAGE 6 principal and interest on said bonds or other obligations authorized to be issued shall be borne by the lands benefitted by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is further hereby determined that all lots or parcels in the Town of Cortlandville outside of Villages capable of being serviced by "Article 12-c" Water Improvements heretofore and hereafter provided, are lots or parcels benefitted by the proposed project and all previous improvements, all of such improvements constituting one water system, and WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement as proposed in said plans be authorized pursuant to Section 209-q-(6)(c) of the Town Law; that the improvement therein mentioned be constructed and the service therein mentioned be provided for upon the required funds being made available or provided for; and that such improvement shall be designated and known as "Tompkins & Pleasant Street Water Improvement Project- 1996", and it is further RESOLVED AND DETERMINED, that the proposed improvement, including costs and rights of way, construction costs, legal fees engineering and consultant fees, and all other expenses approximated to be a maximum of $190,500 shall be financed by the issuance of bonds by the Town of Cortlandville for maximum term of forty years at prevailing interest rates, and it is further RESOLVED AND DETERMINED, that the costs of management, maintenance, operation and repair of said improvement or services shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from water rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Water Improvements, and it is further RESOLVED, that the Town Clerk of this Town shall within ten (10) days after the adoption of this Resolution or within 10 days after receipt of the approval of the Comptroller of the State of New York, if such approval is required by law, file a certified copy of this Resolution in the Cortland County Clerk's Office as • provided for by Town Law Section 209-q (6)(d). RESOLUTION #84 APPROVE 1996 AGREEMENT WITH THE CORTLAND COUNTY BUSINESS DEVELOPMENT CORPORATION Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Town Board does hereby approve the 1996 agreement with the Cortland County Business Development Corp. Town Clerk, Pauline Parker asked what was the status of the update to General Codes. Highway Supt, Carl Bush, stated that it is still being reviewed. 222 APRIL 03, 1996 TOWN BOARD MEETING PAGE 7 RESOLUTION #85 ADOPT ORDER PURSUANT TO TOWN LAW SECTION 209-q(3) "ROUTE 215 WATER TANK CONNECTION PROJECT - 1996" Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, there were filed and made available for public inspection in the Office of the Town Clerk of the Town of Cortlandville, Cortland County, New York, general plans relating to the "Route 215 Water Tank Connection Project - 1996", as required by Section 209-q and 209-c of the Town Law; and WHEREAS, the proposed improvement consists of construction of a new connecting transmission main from the northwest corner of the intersection of Starr Road and Route 215 to a point 1300 feet eastward along Starr Road Extension and then southerly across private property to the parcel of land upon which a new water storage tank will be located, in accordance with the plan and report now on file in the Office of the Town Clerk of the Town of Cortlandville; and WHEREAS, the maximum amount proposed to be expended for said improvement is $262,000.00; and WHEREAS, the proposed method of financing of said improvement is by the issuance of bonds of the Town of Cortlandville in the principal sum of $262,000.00; all future costs including the repayment of the principal and interest of such bonds shall be borne by the lands benefitted by such improvement and such costs shall be assessed, levied and collected from the several lots or parcels of land within said Town of Cortlandville in just proportion to the amount of benefit which the improvement shall confer upon such lots or parcels; it is hereby proposed that all lots or parcels of the Town of Cortlandville outside of Villages, capable of being serviced by the 1°Water Article 12-C" Water Improvements heretofore and hereafter provided, are lots or parcels benefitted by the proposed water improvement; and the cost of the proposed water project and all previous improvements shall be spread upon and over the enlarged benefitted area, all of such improvements constituting one water system; WHEREAS, it is further proposed that the costs of management, maintenance, operation and repair of said improvement shall be a charge upon the area of the Town of Cortlandville outside of Villages and shall be levied and collected in the same manner and at the same time as other Town charges, provided that it is the intention of the Town Board that such costs will be raised in the first instance from water rates, charges and fees upon all lots or parcels heretofore and hereafter serviced by Town Law Article 12-C Water Improvements; and WHEREAS, a short form Environmental Assessment Form has been prepared pursuant to State Environmental Quality Review Act, and is available for review by the public at the Cortlandville Town Hall; it is hereby ORDERED, that a meeting of the Town Board of the said Town of Cortlandville shall be held at the Town Hall, 3577 Terrace Road, Cortland, New York on the 17th day of April, 1996 at 5:00 p.m. o'clock in the afternoon that day to hear all persons interested in the proposed water improvement, and for such other action of said Town Board with relation to the said water improvement as may be required by law or deemed proper. 1 E 1 (a 1 223 APRIL 03, 1996 TOWN BOARD MEETING Attorney Folmer reported on the following: PAGE 8 Commons Ave. Water and Sewer Improvement Projects: On March 06, 1996, Resolutions were adopted authorizing the Supervisor to expend $16,999.00 from the Sewer Improvement Capitol Reserve Fund and $15,541.00 from the Water Reserve Fund for the Commons Avenue Water & Sewer extension, and that the resolutions shall be subject to permission referendum. The notices for these resolutions were posted in the Cortland Standard within 10 days. The Permissive Referendum date runs out 30 40 days from date of adoption. Attorney Folmer has two certificates one for water and one for sewer. The Town was given�a letter of credit from Dr. Lee Ambrose, and accepted by this Board on March 25, 1996. This letter of credit would insulate you from the responsibility for cost, in the event that this permissive referendum were called for and held. Now that the Permissive Referendum date shall soon expire, the letter of credit may be returned to Dr. Ambrose. Locust Ave. Transmission Tower: The tower has been erected. The gate is in the process of being constructed but is not in place as of yet. RESOLUTION #86 AUTHORIZE MCGRAW CENTRAL SCHOOL TO USE TOWNS VOTING MACHINE Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, the McGraw Central School District is hereby authorized to use the Town's voting machines for their scheduled annual budget vote, and elections, on May 15, 1996. RESOLUTION #87 AUTHORIZE CORTLAND CITY SCHOOL DISTRICT TO USE TOWN HALL MEETING ROOM FOR SCHOOL BOARD ELECTIONS Motion by Councilman Pilato Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Cortland City School District is hereby authorized to use the Cortlandville Town Hall Meeting room on Tuesday, May 07, 1996 from 11:30 a.m. to 9:45 p.m. for their School Board Elections. RESOLUTION #88 AUTHORIZE SUPERVISOR TO INVITE AMTEK REPRESENTATIVE TO ATTEND NEXT TOWN BOARD MEETING TO DISCUSS NEED TO REWRITE TOWNS PERSONNEL POLICY Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the need to update or rewrite the Towns Personnel Policy has been requested, and not yet accomplished, and WHEREAS, a representative from AMTEK, Management Services Corp., has requested time to submit a proposal, therefore 224 APRIL 03, 1996 TOWN BOARD MEETING PAGE 9 BE IT RESOLVED, the Supervisor is hereby authorized to contact AMTEK, Management Services Corp. and request a consultant to attend the next Town Board Meeting and discuss their services. Councilman Testa requested the Supervisor to send a letter to local stores and shopping centers to inform of the new Handicap parking ordinance. Supervisor Thorpe agreed to do this. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the Regular Town Board Meeting. All voting, aye, the motion was carried.
