September 9, 2008 Meeting Summary

Announcements
Tuesday 9116 Dan is meeting with Tim DePriest of NYS DEC Habitat division to discuss
permitting needs relative to construction of the Highway Departments Salt Storage Barn. Bard
Prentiss will join us and anyone else is welcome to come. We will also walk the wetland and
assess connectivity with state wetland DR -1 especially the high quality area behind
Willowbrook.
FPIG update - Dan reported that this year the Carpenter's Wideawake Dairy, and the Marquis'
Freebrook Farm would be the town's applicants to the state's farmland protection program, with
the county applying for the Prince property. Announcements come out in December, hopefully.
Wetland Issue - Dan relayed an issue with a wetland that was filled on Etna Lane. The owner
was filling over one acre along Etna Lane and included a Class A stream and direct tributary to
Fall Creek. The town was able to place a stop work order on the site, and has been consulting
with the owner, the DEC and the Army Corp. of Engineers to resolve the issue. The original
roadcut permit was issued by the County, and the fill came from a project in Ithaca by Cornell.
Dan reported that he is trying with some success to try and prevent this type of oversight in the
future by better coordinating with County Highway, and with less success, making Cornell
accountable for where excess material ends up.
366 and Freese Road - The fill and materials site on the corner of 366 and Freese Road was
discussed. It seems that the owner has gone beyond reasonable acceptable amounts of fill on
the site without a stormwater permit. Dan reported that Henry is aware of the issue, but was
unsure of the status of the site.
Open Space Planning and the Recreation Commission - A recent law developed by the
Recreation Commission was discussed. In an early version of the law there was language
about the Commission approving open space purchases. The TB struck the language with the
reasoning that the Conservation Board is the town advisory body charged with open space
issues. Discussion led to the resolve that the CB could and should work with the Commission
when possible and necessary, and Charlie Smith offered to help expand programming in the
town by being available for interpretive projects.

• Dryden Lake Oversight - There was a question concerning oversight of the management of
Dryden Lake. Dan reported that the Town Department of Public Works manages the parkland
which is leased from NYS, and the trail which is owned by the town. The DEC is responsible for
the southern area and the lake itself.
Riparian Buffer Discussion
There was a discussion regarding the riparian buffer ordinance and how to proceed, as well as
reflection on Marci Meixler's presentation on riparian buffer modeling. The discussion resulted
in a series of questions such as; how many acres of private land affected, what is the risk to
buffers in the town, how to establish a set width buffer along streams and the ability to establish
a more dynamic buffer when necessary, and how could a local SEQRA law, or establishment of
riparian corridors as Critical Environmental Areas under SEQRA further the town's goal of
protection?
