PUBLIC HEARING COMMONS AVENUE WATER AND SEWER EXTENSION - 1996 A Public Hearing was held by the Town Board of the Town of Cortlandville on February 21, 1996 at 5:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, ® Cortland, New York, concerning the Commons Avenue Water and Sewer Extension - 1996. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato j Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Town Bookkeeper, Marcia Hicks; Town Resident, Vicky Boyle; and News reporter, Keith Doherty. Supervisor Thorpe called the Public Hearing to order at 5:00 p.m. The Town Clerk read aloud the Legal Notice, as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. No questions or comments were heard. Councilman Testa made a motion, seconded by Councilman O'Donnell, to close the Public Hearing. All voting aye, the motion was carried. PUBLIC HEARING ROUTE 13 WATER IMPROVEMENT PROJECT - 1996 A Public Hearing was held by the Town Board of the Town of Cortlandville on February 21, 1996 at 5:05 p.m. at the Town Hall, 3577 Terrace Road, Cortland, New York concerning the Route 13 Water Improvement Project. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Town Bookkeeper, Marcia Hicks; Town resident; Vicky Boyle; ,and News reporter, Keith Doherty. Supervisor Thorpe called the Public Hearing to order at 5:05 p.m. The Town Clerk read aloud the Legal Notice as posted and filed. No questions or comments were heard. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 5:10 p.m. J, 1 ♦ !, E • 1 FEBRUARY 21, 1996 TOWN BOARD MEETING The Regular Meeting of the Town Board of the TOwn of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Raymond Thorpe presiding, following two Public Hearings. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Town Bookkeeper, Marcia Hicks; Town resident, Vicky Boyle; and News Reporter, Keith Doherty. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file the Planning Board Minutes of January 30, 1996. All voting aye, the motion was carried. RESOLUTION #52 AUTHORIZE PAYMENT OF VOUCHERS FEBRUARY Motion by Councilman O'Donnell Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers # 72 - 100 $ 21,131.65 General Fund B 15 - 16 $ 9,067.50 Highway Fund DB 52 - 77 $ 17,888.07 Water Fund 30 - 46 $130,125.61 Sewer Fund 22 - 31 $ 99,503.07 Councilman O'Donnell reported that he, Highway Supt, Carl Bush, County Highway Supt, Walt Tennant, and County Engineer, Joe Eggleston, attended the last Board meeting of the Village of McGraw, to be involved in the discussion regarding the Bennett Street Bridge. County Highway Supt, Walt Tennant, provided a map of the area and presented their ideas of replacing the bridge down stream from the present location. He reviewed the history of the bridge, which was rebuilt 22 years ago. He suggested that .everyone needs to think about future planning. If. the suggested site is chosen, purchase of land, placement of roads and protection of the well -head area need to be considered. Only then, can an estimated cost be determined. .Review of the map and suggested location occurred. County Highway Supt, Walt Tennant, reported that he chose this tentative site to make it safer for area travelers. School and resident travel would be routed away from the Main St. entrances, which have been very congested and dangerous. The concerns of the recent flood were heard. Because the bridges in the Village were closed, the school could not get the students out. Thoughts were given to where a street would be placed on Bennett St, keeping it away from the Village wells. He would apply for Federal Funding to help with the cost of the project. i91 FEBRUARY 21, 1996 TOWN BOARD MEETING PAGE 2 Reports for the month of January 1996, from the Justice Department, are on the table for review, and filed in the Town Clerk's Office. Councilman O'Do:nnell reported that he has inspected the Justice records for the year of 1995. All reports are in order. Councilman Pilato reported that he has inspected the Town Clerk/Tax Collector records for the year of 1995, All are in order Councilman O'Donnell made a motion, seconded by It Councilman Pilato, to receive and file a letter from Mr. Warren Eddy, Library Director for the Cortland Free Library. All voting aye, the motion is carried. The letter expressed appreciation of understanding and support of their program. RESOLUTION #53 REFER AQUIFER PERMIT APPLICATION FOR LEE AMBROSE, COMMONS AVENUE LOT #5, TO TOWN AND COUNTY PLANNING 130ARDS FOR THEIR REVIEW Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES; ALL AYE ADOPTED BE IT RESOLVED, the Aquifer Special Permit Application submitted by Lee Ambrose for Commons Avenue, Lot #5, shall be referred to the Town and County Planning Boards for their review and recommendations. Councilman O'Donnell made a motion, seconded by COuncilman Pilato, to receive and file a notification from NYS DEC of their renewal of the mining permit for Polkville Crushed Stone, Division of Suit-Kote, located in Polkville. All voting aye, the motion was carried. Town Clerk, Pauline Parker, reported that it has been a requirement of the NYS ABC (Alcoholic Beverage Control) for every business that is applying or renewing their license to sell alcoholic beverages, to send a certified letter to the local municipality advising them of their intent. She received a call from a local business advising that they also need a certificate of occupancy to send to NYS ABC. This information was received and referred to the Town Code Enforcement Officer, whom was not aware of this. He contacted NYS ABC: and explained that a Certificate of Occupancy can only be issued for new construction. He was advised that documentation from the local municipality to report that they are in compliance with zoning was sufficient. Every State Agency appears to require more. in Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file a notification from the Willow Brook Golf Club, 3267 NYS Route 215, in regards to renewing their seasonal liquor license. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file a notification from Joyce Burk regarding her recent purchase of Buff and Wills at 3303 Route 11, McGraw. She will apply for a license and plans to change the name to Bears Place. All voting aye, the motion was carried. 191 FEBRUARY 21, 1996 TOWN BOARD MEETING PAGE 3 Attorney Folmer reported on the following: Water and Sewer Improvement Projects: The Commons Ave. projects do not require Comptroller approval. The next step is to adopt a resolution for each one. This cannot be done tonight because he has received the total cost, but not the breakdown of each one. There must be two resolutions adopted. He will prepare these and perhaps a Special Meeting can be held, if necessary, to adopt these. There is a concern of the time limit, as • they are adopted subject to permissive referendum. We have taken steps which says the awarding of the bid cannot occur until after April 1st. The same rule applies for the Route 13 Water Project. He has had conversations with Tom Johnson, from Audit and Control, regarding new procedures, and the interpretation of them. He received a fax late today from him, but needs more time to review it. Comptroller approval procedure has delayed some projects for six months or more. This is a concern of the Town Engineer, and he will keep him advised. Attorney Folmer explained the necessary process when projects are to be paid from towns funds. When he is advised that a project is to be paid from surplus funds, he would think it to mean, an operational surplus. This can be mistaken when it is meant to be paid from Reserve Funds, which requires more procedures. Because there are so many projects, and because so many departments are involved, caution needs to be taken. A project protocol is needed, and hopefully this can be accomplished, to prevent further confusion for everyone. SHAPE PATROL: The County Sheriffs Dept. has reported that a Local Handicap Parking Ordinance is required to allow their SHAPE Patrol the provision to enforce tickets they may issue. He has drafted an ordinance which prohibits parking in handicap marked spots without a proper handicap parking permit. This will be consistent with the State's Vehicle and Traffic Law. A copy will be given to Judge Kelsen, for her review. Deed for Buck Road: Deed for Buck Road, Polkville, was given to the Town Clerk, for Town files and a copy was left with the Town Assessor. • Purchase property on Oakcrest: The County Attorney has advised that the property on Oakcrest is ready to be transferred to the Town. Upon receipt of a check in the amount of $157.27, payable to the County Treasurer, he will record the deed, as required. Purchase of Alexander property on Hoxie Gorge: Has received the survey from James MacNamara, for the .72 acres on Hoxie Gorge Road. Bill for the survey, in the amount of $290.00, was submitted. Town Clerk, Pauline Parker, provided a copy of the information received from Resource Assoc. relating to bidding of the Commons Avenue Water and Sewer Project. Is it permissible for them to handle the bid process, and collect the required fees? The Town Attorney will review the information. 192 FEBRUARY 21, 1996 TOWN BOARD MEETING PAGE 4 Supervisor Thorpe reported that a letter has been received from Aetna Insurance Company reporting that they have denied payment of a claim received from Robert Condi of Lamont Circle, in the amount of $3,095.00. It was denied because the claim was not reported to them in a timely manner. This claim was :not reported because we were taking steps to prevent litigation, such as working with the property owner and correcting the problem. Attorney Folmer reviewed the measures of the situation. Because the Town was working with the Condi's with the problem, there was no indication that a claim would be presented. Attorney Folmer will write a letter to Aetna Insurance Co., explaining the situation. Councilman O'Donnell made a motion, seconded by COuncilman Testa, to adjourn the Regular Meeting.
