A Public Hearing was held by the Town Board of the Town of Cortlandville on November 01, 1995 at 1:00 p.m. at the Cortlandville Town Hall, 3577 Terrace Road, Cortland, New York, regarding the 1996 Preliminary Budget. ® Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; Highway Superintendent, Carl Bush; Town resident, Vicky Doyle; NYS Troopers, Sullivan and Albrizzo and, News reporter, Lisa Hutchurson. The Public Hearing was called to order by Supervisor, Raymond Thorpe at 7:00 p.m. The Town Clerk read aloud the Legal Notice as posted and filed. Supervisor Thorpe offered those in attendance privilege of the floor. Supervisor Thorpe stated that the Town tax rate will remain the same as last year. The Town tax rate is $1.55. Village tax rate is $1.55. Cortlandville Fire tax rate is $2.30. In 1994, the Town tax rate was $3.18. The Town Board elected to take all the sales tax money, rather than using a portion of it to reduce the County rate. Our rate was reduced at that time and has remained the same. No other comments or questions were heard. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to close the Public Hearing. All voting aye, the motion was carried. The Public Hearing was closed at 7:05 p.m. 138 NOVEMBER 01, 1995 TOWN BOARD MEETING 7:00 P.M. The Regular Meeting of the Town Board of the Town of Cortlandville was held at 7:00 p.m. at the Town Hall, 3577 Terrace Road, Cortland, New York with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; Highway Supt, Carl Bush; Town residents, Vicky Doyle of Rt. 215; Betty Wood of Blodgett Mills and Henry Chapin of Lamont Circle; NYS Troopers, Sullivan and Albrizzo and News Reporter, Lisa Hutchurson. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to approve, as written, the Town Board Minutes of September 20, and October 04, 1995. All voting aye, the motion was carried. RESOLUTION #187 AUTHORIZE PAYMENT OF VOUCHERS NOVEMBER Motion by Councilman Testa Seconded by Councilman O'Donnell VOTEti> : ALL AYE ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: General Fund A Vouchers #466 - 483 $13,833.84 General Fund B 151 - 157 $ 6,174.73 Highway Fund DB 421 - 431 $ 6,487.85 Water Fund 280 - 292 $ 4,981.89 Sewer Fund 142 - 149 $ 1,054.15 Capital Projects 61 $ 5,740.00 Privilege of the floor was granted to NYS Police, Sergeants Sullivan and Albrizzo of the local sub- station. Trooper Albrizzo stated that they are in attendance tonight to introduce themselves and to discuss any concerns the Town Board may have. The following concerns were heard: Supervisor Thorpe has received many complaints from people concerning the misuse of parking in handicap parking spots in various parking lots. Intersection at Route 281, Lime Hollow Rd. and Wal- Mart. Could the yield sign at the exit from Wal-Mart be changed to a stop sign. Intersection at Route 281, Lamont Circle and Route 13: Could an arrow light be installed for those needing to make a left hand turn. Traffic problems and new signs within the Groton Ave. Plaza. Parking lots are private property. Controls within are restricted. Kinney Gulf Road and Route 281: Letter was read from NYS DOT denying a request for a street light. A discussion was held whereby it was agreed that they will investigate these concerns and report their findings, and recommended changes, to NYS DOT. They make the final decision. I • • 1 133 NOVEMBER 01, 1995 TOWN BOARD MEETING PAGE 2 The traffic has shown a large increase due to the opening of new malls and business in this area. Only the NYS DOT has control of traffic patterns when new commercial construction occurs. Supervisor Thorpe and Town Board members have been very frustrated that they are not allowed more control regarding the speed limits on Town roads. Many petitions are received from residents requesting this, and they are always denied. is Trooper Sullivan thanked the Town Board for the budgeted $500.00 the State Police receives from the Town. They have purchased many needed supplies and enjoy this support from the Town. They also appreciate the relationship and expertise of our Town Court. They now have two Truck Inspectors at their location which will monitor the concerns of the McLean Road. Councilman O'Donnell reported that the Village of McGraw sent a letter to officials of Cortland County advising of their decision and requested the Bennett Street Bridge to remain at the same location and be repaired. The factor of their decision was because of the concerns of the location of their new well. Because of budget restraints, nothing can be done now. More meetings are anticipated concerning this. Councilman Rocco reported that Ithaca has denied the request of Wal-Mart to open a store there. This is a boost to our area as many come here to shop. Councilman Testa reported that letters will be mailed soon requesting donations for improvements at the Blodgett Mills Park. The Town's Bookkeeper has provided a list, including addresses, to accomplish this. Betty Wood of Blodgett Mills, stated that she has recently purchased the Church in Blodgett Mills and is now living in it. The park is located next to her property and requested information regarding the fence. The fence around the park only encompasses three sides. The area not fenced is next to her property, and the basket ball court. She advised that balls are hitting her siding and the children are using her steps as part of the park. A fence would deter this. The children have not been a problem, and they are enjoying the park. She asked if the fence could be continued and a trash can placed at the area. A discussion was held whereby it was determined that a continuance of the fence will occur next year. Betty Wood of Blodgett Mills, also apprised the Town Board that she has visited the South Hill Dump site. She asked' if this site should be posted and fenced in. The gate and fence there is fine, but should be extended. Should be there be signs posted which "Toxic reads Waste?" Concerns were heard of ATV vehicles, snowmobiles, hunters and deer going into the area, which could cause a liability factor. A discussion was held concerning this. Posted signs have been placed there but weather and other factors do occur. It was reported that everything on the surface at this site has been removed. The Town paid the State $25,000. to accomplish this a couple of years ago. No further communication has been received from the State advising of further problems. NYS DEC monitors this. Attorney Folmer invited her to come and review his files concerning the dump site. i4o NOVEMBER 01, 1995 TOWN BOARD MEETING PAGE 3 The Supervisor's Report for the month of September 1995, is on the table for review, and available, upon request, in the Town Clerk's office. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter received from Barry A. Stevens, Regional Traffic Engineer of NYS DOT. All voting aye, the motion was carried. The letter advised that they determined that a traffic signal at NYS Route 281 and Kinney Gulf Road, is • not appropriate at this time. Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file a letter from Mr. Walt Tennant, Jr., Cortland County Supt. of Highways. regarding NYS DOT denying a traffic light at the intersection of NYS Route 281 and Kinney Gulf Road. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Pilato, to receive and file correspondence regarding scheduled Public Hearings by Assembly Standing Committee on Local Governments relating to benefits and importance of Industrial Development Agencies,(IDAs). All voting aye, the motion was carried. Attorney Folmer reported on the following: Code violation at 3594 Terrace Road: paperwork has been filed. Parties involved appeared in Court last week, and was adjourned until November 20, 1995 to allow property owner time to meet compliance. Code violation of Gerald Darling, Page Green Road: Mr. Darling's attorney has advised him that the property is in compliance. The Town CEO has made an inspection and advised that it is not in compliance. This matter was adjourned until November 13 or 20, 1995. He will notify the Attorney of the Town's CEO report of non- compliance. Robert Goodale, Conveyance of property for new water tank: payment has been made. County Clerk could not charge the Town for the fee to file the deed, but charged Mr. Goodale, whom needs to be reimbursed. RESOLUTION #188 AUTHORIZE PAYMENT OF $300.00 TO ROBERT GOODALE FOR THE FILING FEE FOR CONVEYANCE OF PROPERTY ON PAGE is GREEN ROAD TO THE TOWN Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, The Town of Cortlandville has purchased property from Mr. Robert Goodale, Page Green Road, per Resolution #166 of September 20, 1995, for the construction of a new water tank, and WHEREAS, upon filing of the new deed, the fee was charged to Mr. Goodale, as a municipality could not be charged, therefore BE IT RESOLVED, the Town Attorney is hereby authorized to reimburse Robert Goodale $300.00, the fee charged. 141 NOVEMBER 01, 1995 TOWN BOARD MEETING PAGE 4 Revisions of filing requirements for Special District: Effective September 1, 1995, the state revised the process of establishing Special Districts. We have used Town Law Article 12-C in the past which required Comptroller approval if the estimated dollar amount exceeded a percentage of the Town's assessed valuation. We are now permitted to use Town Law Article 12-B, which is subject to permissive referendum. The new allowed procedure shortens the time period to proceed. The water tank project was commenced using the old method which would have required Comptroller approval. is He has been advised, and recommends, that we rescind the resolutions adopted for this project, and adopt new ones. He is working with Town Engineer, Hayne Smith, to accomplish this. He will have this prepared for the next meeting, if possible, as they need to be done at the same time. Amend Town Zoning Law regarding Adult Entertainment Has discussed with CEO Bruce Weber. They will provide information for your review. Other sections of the ordinance may need to be amended to accomplish that purpose. Handicapped Parking Ordinance review: You have requested information relating to the Town keeping the monies received for such violations in the Town. In review, NYS Vehicle and Traffic Law allows for this. He has heard that the County has enacted a Local Law pertaining to this, and may have preempted the Towns from doing this. He will continue and report his findings. his review of this SCM Bankruptcy Notice: Procedure informational paperwork has been sent to his office. It has advised of a meeting to be held in Bloomingdale, Delaware on November 21, 1995 concerning this. He does not need to attend this meeting. Other information has been received from Central Claims Services, Inc. RESOLUTION #189 ACKNOWLEDGE LETTER FROM CENTRAL CLAIMS SERVICES, INC. RELATING TO SMITH CORONA CORP. BANKRUPTCY Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, a letter was received from Central Claims ®, Service, Inc. relating to Smith Corona Corporation Bankruptcy, by the Town Water and Sewer Dept, and referred to Town Attorney, and WHEREAS, the letter proposed an offer to pay 20% of the total claim, therefore BE IT RESOLVED, the Town Board does hereby acknowledge receipt of such letter, and shall be received and filed, with no further action at this time. William McDermott- Highland Heights Subdivision - Water supply system: Received a letter from Resource Associates asking the status of the above. Forwarded letter to Town Supervisor. Supervisor Thorpe has conversed with them. Federal Mandated Alcohol and Drug Testing Program NOVEMBER 01, 1995 TOWN BOARD MEETING PAGE 5 review: Attorney Folmer requested more time to review this. That presented to him, for review, is very stringent. Is this a new law or regulation requirement. He has requested, and just received a manual concerning this. This needs to be adopted by January 1, 1996. Councilman O'Donnell informed the Town Board that he visited his neighbors in Blodgett Mills relating to zoning problems there. He discussed the problems with them. They told him that CEO, Bruce Weber, had been there and explained the Junk Car Ordinance to them. No summons were issued and he allowed for time to clean up. Progress is evident regarding the clean up. Councilman Rocco expressed appreciation to Highway Supt, Carl Bush, for the improvements of the roads within Weathervane. Paving of Abdallah will start on Friday November 3, 1995. They are 80% finished. Very few complaints. RESOLUTION #190 SET DATE FOR A PUBLIC HEARING AQUIFER PERMIT FOR CORTLAND HEALTH CENTER ON NOVEMBER 15, 1995 Motion by Councilman Testa Seconded by Councilman Pilato VOTES: ALL AYE ADOPTED WHEREAS, an application for an Aquifer Special Permit has been submitted by Cortland health Center, Fisher Avenue, for construction of a 2-story addition to the existing building, therefore BE IT RESOLVED, a Public Hearing shall be scheduled for November 15, 1995 at. 5:00 p.m., as required. Councilman Rocco made a motion, seconded by Councilman Testa, to adjourn the Regular meeting. All voting aye, the motion was carried.
