TOWN BOARD MEETING
5:00 P.M.
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at the Town Hall, 3577 Terrace
Road, Cortland, New York with Supervisor Raymond Thorpe
presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Pauline Parker
Others present. were: Town Attorney, John Folmer;
and Intern, Kim Davis; Highway Supt., Carl Bush; Deputy
Town Clerk, Patricia O'Mara; Town Typist, Edna Puzo;
Town resident, Vicky Doyle; Richard Cowles of the Homer
Congregational Church with assistant; and News Reporter,
Lisa Hutchurson.
Councilman Testa made a motion, seconded by
Councilman Rocco, to approve, as written, the Town Board
Minutes of September 06, 1995. All voting aye, the
motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file the Cortlandville
Planning Board Minutes of August 29, 1995 and September
26, 1995. All voting aye, the motion was carried.
Councilman Rocco made a motion, seconded by
Councilman Pilato, to receive and file the Cortlandville
Zoning Board of Appeals Minutes of September 12 and 26,
1995. All voting aye, the motion was carried.
RESOLUTION #181 AUTHORIZE PAYMENT OF VOUCHERS
OCTOBER

Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the vouchers submitted have been audited
and shall be paid as follows:
General Fund A Vouchers# 439-465 $ 24,365.18
General Fund B 142-150 $ 363.44
Highway Fund DB 390-420 $125,883.38
Water Fund 262-279 $ 37,061.12
Sewer Fund 134-141 $ 7,332.70
Capital Projects 57- 60 $101,247.02
The Justice Report for the month of September 1995
is on the table for review, and filed in the Town Clerks
office.
Attorney Folmer reported on the following:
Bankruptcy Notice for Great American: received
notification to allow termination of services to their
store. Water Dept. has advised that the service has
been terminated.

be left tonight for CEO, Bruce Weber, to review.
Revision of filing requirements for Special
Districts: there has been a change in the statute
regarding the procedure. In the past many of our
projects, based on monetary limit, had to be submitted
to the State Comptroller for approval, which has proven
to be timely. The revisions made are based upon the
method by which the Town Board adopts and commences the
procedure to construct an improvement project. The
® process we have done; adopt by resolution and order,
doesn't exempt us from required approval of the
comptroller. If the project is adopted by motion,
subject to permissive referendum, and the proper
documentation is filed with the Town Clerk, then the
project would not require Comptroller approval.
Because we have commenced another water project,
using the old method, he has contacted Audit & Control
for advice. They could not answer him but will review
this and get back to him. He should have more
information to report at the next Town Board meeting.
Zoning Violations at Gerald Darling property: A
Court date of October 30, 1995 is scheduled. A report of
compliance of the Zoning Ordinance is expected. If so,
we will request a continued compliance process at that
time.
Purchase of Robert Goodale property: Checks in hand
for payment to purchase the property to construct a new
water tank. The Deed has been prepared and will be
filed soon. A resolution was adopted October 04, 1995,
subject to Permissive Referendum. This was posted and
published on October 14, 1995. The 30 day period will
expire mid November, then the funds will be transferred
back to the reserve accounts, should no petition be
received.
Privilege of the floor was given to those in
attendance. No comments were heard.
Supervisor Thorpe apprised the Town Board of
confusion of residents relating to the use of Town water
for pool fills or watering of their lawns. It has been
the Towns policy to allow residents to contact the Water
Dept. when they wish to fill their pool, using the Towns
water supply for such. Upon contact, a meter reading is
taken before and after. They are advised that they will
be billed for the water used and an adjustment will be
made to the sewer charge. Many residents request the
Fire Dept. to fill the pools. The fireman are metered
for this purpose and charged.
• Those who choose to use the Towns water for washing
of cars, watering lawns, or outside purposes, also have
an alternative. They can identify an outside spicket;
purchase an additional meter for this purpose only, and
this meter would be read, and charges billed. This
would prevent the sewer charge.
Using these procedures should be encouraged.
Forgiving of sewer charges, after the fact, has not been
this Boards policy.
A discussion was held by the Town Board concerning
this. Different methods of notifying residents were
discussed. No action was taken.
Letters requesting consideration of water and
sewer charges were presented from William Raney; large
consumption used for irrigation of new landscaping and
Eric Barden; large consumption due to pool fill and
watered lawn, were read and discussed.

RESOLUTION #182 DENY SEWER ADJUSTMENT REQUEST AND
REQUEST SUPERVISOR TO DRAFT LETTER
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, Mr. William Raney of 1141 DaVinci Dr. and Mr.
Eric Barden of 3289 Coventry Lane, have sent letters to
the Supervisor requesting a credit of their sewer
charges due to high water consumption, used for watering
lawns and pool filling, and would not have entered the
sewer lines, therefore
BE IT RESOLVED, the requests of Mr. Raney and Mr.
Barden are hereby denied, and further
RESOLVED, the Supervisor is hereby authorized and
requested to draft letters to Mr. Raney and Mr. Barden
explaining the policies of the Town and the action
taken.
RESOLUTION #183 AUTHORIZE WAIVER OF ZONING FEES TO
HOMER CONGREGATIONAL CHURCH MISSION
"HOME STORE" TO BE LOCATED AT 4269
ROUTE 11 (NORTH HOMER AVE.)
Motion by Councilman Testa
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
WHEREAS, the Homer Congregational Church has requested
permission to operate a Community Mission known as "Home
Store" at 4269 Route 11, ( North Homer Avenue), to
minister to the needs of the poor of Cortland County,
and
WHEREAS, the process to accomplish requires zoning
applications and approvals, and such organization is
non-profit and have requested waiver of such fees,
therefore
BE IT RESOLVED, the 'Town Board does hereby authorize the
waiver of any and all zoning permit fees for the church
project.
RESOLUTION #184 AUTHORIZE WATER & SEWER DEPT. TO LET
OUT FOR BID, ONE NEW AND UNUSED 40
KW NATURAL GAS STAND-BY GENERATOR
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Water & Sewer Dept. is hereby
authorized and directed to let out for bid: one new and
unused 40 KW natural gas stand-by generator, and
RESOLVED, sealed bids will be opened November 13, 1995
at 3:00 p.m. and awarded on November 15, 1995 at 5:00.
Supervisor Thorpe reported that he has received
from Highway Supt, Carl Bush, a copy of the Cortland
County Drug and Alcohol Testing Policy. This was
distributed to the Councilman for review, as we need to
adopt this procedure for the Town by January 1, 1996.
Attention needs to be directed to the disciplinary

portion, as he has concerns about the one presented.
A discussion was held whereby this policy is a
Federal Mandated program and the intent is that it
should be used as preventive measures.
No action was taken.
Councilman Rocco questioned the status of changing
the Town Ordinance relating to adult entertainment
establishments that may want to locate in the Town.
Attorney Folmer stated that he is reviewing this, and
explained the process to the Board. He will attempt to
have.a report on this at the next Town Board meeting.
Supervisor Thorpe informed those in attendance that
the Town Board has been working on the budget for next
year. He stated there will be no tax increase for the
Town in 1996.
RESOLUTION #185 REFER AQUIFER PERMIT APPLICATION
OF NANCY AMBROSE, COMMONS AVENUE
TO TOWN AND COUNTY PLANNING BOARDS
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Aquifer Permit application submitted
by Nancy Ambrose, regarding five lots, near the Medical
Complex, located on'the West side of Route 281 is hereby
received and shall be referred to the Town and County
Planning Boards for their review and recommendations.
Councilman Rocco made a motion, seconded by
Councilman Testa, to adjourn to an executive session
regarding a personnel matter. All voting aye, the
motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to adjourn the executive session and
reconvene to the regular meeting. All voting aye, the
motion was carried.
RESOLUTION #186 AUTHORIZE DEPUTY TOWN CLERK # 3

the Town, at an annual salary of $16,000, and cost shall
be shared equally by A1410.1 and B8010.1, effective
immediately.

Councilman O'Donnell made a motion, seconded by
Councilman Testa, to, adjourn the regular meeting. All
voting aye, the motion was carried.
The regular meeting was adjourned at 6:05 p.m.
