The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa • Councilman, Edwin O'Donnell Councilman, Ronal Rocco Councilman, John Pilato Town Clerk, Pauline Parker Others present were: Town Attorney, John Folmer; Highway Superintendent, Carl Bush; Town Typist, Edna Puzo; Town resident, Vicky Doyle of Page Green Road and Town resident, Lewis Homer of Saunders Road. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file the Cortlandville Planning Board Minutes of July 25, 1995. All voting aye, the motion was carried. RESOLUTION #157 AUTHORIZE PAYMENT OF VOUCHERS SEPTEMBER Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED General Fund A Vouchers# 349-394 $ 8,388.06 General Fund B 114-122 $ 8,435.45 Highway Fund DB 319-351 $122,216.60 Water Fund 217-237 $ 21,991.53 Sewer Fund 105-112 $ 10,641.78 Capital Projects 45- 47 $ 6,223.24 Privilege of the floor was granted to Ms. Vicky Doyle of Page Green Road. She requested an update of the status regarding the code violation on Mr. Darling's property. The Town Attorney stated that he is scheduled to appear in front of Judge Kelsen on September 18, 1995. Mr. Darling has hired an Attorney to represent him. He will not permit CEO, Bruce Weber, or himself as Town Attorney, to inspect the property. He may have to get a search warrant to inspect the area. A discussion was held concerning this matter. It was reported that collection and accumulation on this property has occurred after Mr. Darling moved there, which is approximately 10 years ago. The date of the Town Zoning Ordinance is being questioned. Mr. Lewis Homer of Saunders Road, asked the Town Board of the time schedule to bring water to his property. He made this request about two or three years ago, and was advised then, about one year. Mr. Homer stated that the current water line on Starr Road is approximately 1,000 feet from his property, but there are no signs of extending it to him. He reported that his well water is not usable. All drinking water is brought in, and he has to take his laundry out. Supervisor Thorpe stated that he would need to review the situation with the Town Engineer. The problem may be solved when the new water tank is built on Saunders Road. 1L SEPTEMBER 06, 1995 TOWN BOARD MEETING PAGE 2 Supervisor Thorpe read aloud a letter sent to Councilman Rocco from Beth Van Deusen of Gwen Lane, regarding the problems a bicyclist has while riding on country roads while passing over sections used as a cow crossings. Also read was the response to her. It is amazing the many requests or responsibilities endured while being a member of a Town Board. Reports of the Supervisor, Town Clerk, and Zoning Officer for the month of August, 1995, and the Justice for the month of July, 1995, are on the table for review, and are available for inspection, upon request, in the Town Clerks office. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a letter of thanks and donation from Mr. Peter Rogati II, of the Cortland County Chapter of NYSARC, Inc. for using the Cortlandville Citizens Park for their Family Fun Days. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file a letter of thanks and donation from Doreen Quinn, on behalf of the Knights of Columbus for using Cortlandville Citizens Park. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file a letter from NYSDOT regarding the denial to lower the speed limit on Highland Road. All voting aye, the motion was carried. RESOLUTION #158 AMEND RESOLUTION #141 AND RESCHEDULE DATES FOR HIGHWAY BID Motion by Councilman Rocco Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, Resolution #141, adopted on July 19, 1995 is hereby amended by rescheduling the dates as follows: sealed bids will be opened on October 02, 1995 at 3:00 p.m., and awarded on October 04, 1995 at 7:00 p.m. RESOLUTION #159 SET DATE FOR A PUBLIC HEARING FOR AQUIFER PERMIT REQUEST OF CORTLAND HEALTH CENTER - FISHER AVE. Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, an application for an Aquifer Special Permit has been submitted by the Cortland Health Center, Fisher Avenue, for construction of a 2-story addition to the existing building, therefore BE IT RESOLVED, a Public Hearing shall be scheduled for October 04, 1995 at 7:00 p.m., as required is 1 11.7 SEPTEMBER 06, 1995 TOWN BOARD MEETING PAGE 3 Councilman Rocco made a motion, seconded by Councilman Testa, to receive and file the 1995 list of Election Inspectors, appointed by the Cortland County Board of Elections. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a Notice of Petition from the New York RSA No. 4 Cellular ® Partnership. All voting aye, the motion was carried. Attorney Folmer stated that the court date for the above will be changed because Judge Rumsey has disqualified himself and another will be appointed. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a notice from Cort-Lanes Inc., advising of their intent to renew their liquor license. All voting aye, the motion was carried. Councilman O'Donnell made a motion, seconded by Councilman Pilato, to receive and file a notice from Coach Lite Family Restaurant, advising of their intent to renew their liquor license. All voting aye, the motion was carried. Councilman Rocco made a motion, seconded by Councilman O'Donnell, to receive and file a notice from 281 Bowl, Inc., advising of their intent to renew their liquor license. All voting aye, the motion was carried. RESOLUTION #160 AUTHORIZE DISPOSING OF TOWN CLERK EQUIPMENT AND TAKE TO AUCTION IN _ LANSING AS REQUIRED Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, the Town Clerk's office has updated the computer equipment in the office, therefore BE IT RESOLVED, the following shall be removed from the Towns Fixed Asset Program and taken to the auction in Lansing, for disposal, as required: 1211-1-WSD1.0 K104 IBM Computer Base - S/N4300758 ® 2001-1-WSD - IBM Key Board - SIN 2089246 2207-1-WSD - IBM Monitor - SIN 6172414 Councilman Rocco reported that he received a phone call from the Good Year Tire Dealership in the City of Cortland with interest to purchase the old Firestone Tire Dealership on NYS Route 281 near the new Top's building. He also reported that he spent several hours with the residents of Isabel area, listening to their concerns caused by the construction of sewer lines. Supervisor Thorpe reminded those in attendance that Water & Sewer Supt., Carl Bush, is the contact person for these projects and advised that all board members have been contacted. These should be referred to Carl, to eliminate confusion for everyone. He requested Carl to give a report. 113 SEPTEMBER 06, 1995 TOWN BOARD MEETING PAGE 4 Carl Bush reported that he met with the residents of Isabel Dr. and the area regarding the installation of the sewer lines. The residents appeared to be satisfied after learning the facts. The contractor is not scheduled to be finished until the end of October. He is keeping within the schedule. The Contractor will be digging out, and widening, one side of the road, the side with the pump station, and pave it. This should be finished by the end of October. Next year the Town will do the other side. This will not take long, as all lines will be in and in operation. Upon completion, Isabel Dr. will be widened to twenty eight feet.. Abdallah Avenue cannot be finished until all connections are made and the pump station is operable. A chain link fence will be installed around the pump station. A discussion was held whereby it was mentioned that similar concerns are heard whenever these projects occur. Because of septic tank failures, residents request these services, and installation of them takes time and patience. Except for the dust, the weather has been a cooperative factor this year to comply with the schedule. This year other streets have been torn up for repaving for other projects, which has compounded the concerns of the residents. Town Attorney Folmer reported on the following: He has received the notice of Claim of Bankruptcy from Smith Corona which have to be filed by October 31, 1995. Attorney Folmer will bring paperwork to Supervisor for his review. An action has been commenced, based upon the denial of the permit. for the location on Locust Avenue for the Cellular Tower. This case will go to court. The Town Planning Board has done an excellent job of review for this application. Reihlman, Shafer & Shafer are still awaiting the Abstract and Title for the property owned by Mr. Goodale which the new water tank will be constructed on. As soon as Mr. Folmer receives that information, the closing will occur. Supervisor Thorpe should be receiving a letter soon from the attorneys representing John Buck, regarding his property on Route 11 in Polkville. 1 n �J A letter was received from a property owner • regarding sewer line hook up procedure. The Water and Sewer Dept. will respond to the letter. The Town Clerk informed the Town Board that a request was received regarding Bingo. She informed them of the process required, and advised them of the time element as it would be required to be on the ballot for voter approval. It was stated, no other contact has been made. Attorney Folmer requested a request of this nature be referred to him. The Cortlandville Planning Board has scheduled a Public Hearing for September 26, 1995, at 7:30 p.m. regrading the Site Plan application from Roger Simpson and A dy Mantella for the Quinlin Bros. building off Route 3. 113 SEPTEMBER 06, 1995 TOWN BOARD MEETING PAGE 5 Councilman Pilato suggested that an Information Hearing be held for the concerned residents dealing with the installation of water and sewer lines. A discussion was held whereby if further concerns are heard, this will be considered. Councilman O'Donnell asked of the status of the Bennett Street Bridge. A discussion was held whereby the wording of some communication was misunderstood by some, but does not seem to be a problem. Highway Supt., Carl Bush, has talked with those involved, and they are reviewing the alternatives. RESOLUTION #161 AUTHORIZE CHANGE ORDER FOR NYS ROUTE 222 WATER IMPROVEMENT PROJECT Motion by Councilman Rocco Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Change Order No. One has been submitted by the Town Engineer for the NYS Route 222 Water Improvement Project, therefore BE IT RESOLVED, the Town Board does hereby approve Change Order No. One in the amount of $6,163.24 and the contract with Lafayette Pipeline Inc. is hereby amended. Water & Sewer Supt., Carl Bush, apprised the Town Board of a leak with a section of the water lines which runs through Fairfield and Halstead Road. The Health Dept. has recommended replacement of the pipe. No money has been budgeted for the replacement of this pipe, nor does the Town Engineer have the time to draw the specs for the project. Alternatives were discussed and the Town Board requested Mr. Bush to return with further information. Councilman O'Donnell made a motion, seconded by Councilman Testa to adjourn the Regular Meeting.
