TOWN BOARD MEETING
7:00 P.M.
The Regular Town Board Meeting of the Town of
Cortlandville was held at the Town Hall, 3577 Terrace
Road, Cortland, New York, with Supervisor Raymond Thorpe
presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Pauline Parker
Others present were: Town Attorney, John Folmer;
Highway Superintendent, Carl Bush; Town Typist, Edna
Puzo; and Town resident, Vicky Doyle.
The Meeting was called to order by Supervisor
Raymond Thorpe at 7:00 p.m.
Councilman Rocco made a motion, seconded by
Councilman Pilato, 'to approve, as written, the Town
Board Minutes of June 21, 1995 and July 05, 1995. All
voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file the Cortlandville
Zoning Board of Appeals Minutes of June 27, 1995. All
voting aye, the motion was carried.
RESOLUTION #142 AUTHORIZE PAYMENT OF VOUCHERS
AUGUST
Motion by Councilman Rocco
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

Reports submitted by the Town Clerk and Code
Enforcement Officer for July 1995, and the Supervisors
June 1995 report, are on the table for review, and are
available, upon request in the Town Clerks office.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file the annual
report from the Cortland Free Library. All voting aye,
the motion was carried.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file the 2nd
Quarter of 1995, Sales Tax Distribution Report for

Cortland County, received from Cortland County
Treasurer, Carl Edlund. All voting aye, the motion was
carried.
Supervisor Thorpe stated that the Towns portion is
a little lower than last year, as anticipated.
A discussion was held whereby car dealers have
reported that more people are leasing cars. This would
have an impact on sales tax receipts.
Councilman Pilato complimented Highway Supt., Carl
Bush, and the Park Director, Andrew Pierce, for their
accomplishments this year at the Cortlandville Citizens
Park. He has received many compliments from citizens
and business's that have used our facility.
Supervisor Thorpe stated that Councilman Testa has
prepared a letter to send to area residents and
business's requesting donations for improvements at
Blodgett Mills Park. Suit-Kote is donating paving at
the park. Top's Market, Wal-Mart, Monarch, and others
have committed donations for the park project.
Checks can be made payable to the Blodgett Mills
Park Committee.
Supervisor Thorpe reported that the Town Clerk has
distributed copies, for their review, of the most recent
Debt Statement, explaining the status of bonding for the
Town. This does not include the new improvement
projects, which we received BAN's, (Bond Anticipation
Notes) today.
A discussion was held concerning this. The Town is
indebted for four million and the limit for the Town is
seventeen million.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file the letter
received from Cortland County Business Development
Corp., acknowledging receipt of our payment, per
contract agreement. All voting aye, the motion was
carried.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file the 2nd
quarter report received from Cortland County Business
Development Corp, in agreement with their contract. All
voting aye, the motion was carried.
® RESOLUTION #143 RESCHEDULE DATE FOR A PUBLIC HEARING
FOR AQUIFER PERMIT REQUEST OF CARL L
SAVINO AND RICHARD H. OSBORNE FOR
WALDEN OAKS GOLF COURSE
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, an application for an. Aquifer Special Permit
was submitted by Carl L. Savino and Richard H. Osborne
for an expansion of the Walden Oaks Golf Course,
therefore
BE IT RESOLVED, the Public Hearing will be rescheduled
for September 06, 1995 at 7:00 p.m., to allow time for
review and recommendation of the Town Planning Board.

Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file a "Notice of
Petition" for the review of their assessment, by Aldi
Inc. All voting aye, the motion was carried.
There was a discussion regarding the status of the
project of First United Methodist Church, whom purchased
land and approval, to construct a new church on NYS
Route 222. Construction has not commenced yet.
It was reported the Church has had difficulty
selling their property located on Church Street in the
City of Cortland.
Attorney Folmer reported on the following:
Bonding of Improvement Projects: This has been
completed. Two BAN's have been renewed, and new BAN's
have been obtained for five projects, in the amount of
$1,334,700.00. It is the intent to combine these into
one bond issue, as it is anticipated that all pending
projects will be completed about the same time.
Revision of Cortlandville Code Book: He has the
proposed draft to accomplish the project to create " The
Town of Cortlandville Code Book." Within a week he will
have this ready for department heads of the Town to
review, and submit any changes. After reviewing the
revisions, if any, it will be submitted to General
Codes, to publish the final draft, or proof. When this
is returned to us, there is a grace period of 120 days
to review the contents before the final publication
occurs.
Group Homes in the Town: A resident of Westmore
Lane has requested him to send a letter to our State
Legislators regarding the current procedure used for the
placement of group homes within local communities in the
state. Local government should be allowed more input.
The Town Board encouraged this also.
Tax Exemption request from Jim May: A request has
been heard that the Town Board allow him to be made an
exception of for applying for a new construction tax
exemption. A discussion was held whereby the Attorney
was requested to notify Mr. May that March 1st is the
deadline, set by State Law, for filing of tax
exemptions, and should prepare his submission for March
1, 1996, for future use.
Cellular Telephone application: Advised the Town
Board that the request to construct a cellular tower on
Locust Avenue has been denied by the Cortlandville
Planning Board. The reason being, this location may
cause an obstruction for an airplane landing locally.
A discussion was held concerning this project and
changes of laws relating to these requests. Neighbors do
not want this tower. With the materials presented, an
attempt will be made to resolve the issue.
Attorney Folmer commended the review the Planning
Board members applied to this project.
Insurance Eligibility: The Town Bookkeeper has
requested assistance for interpreting the Towns
Personnel Policy relating to the health insurance
eligibility. He will meet with her next month after the
holiday.

Attorney Folmer will be on vacation from August 14,
to August 28, 1995. His partner will be available if an
emergency should occur.
RESOLUTION #144 ESTABLISH STANDARD WORKDAY FOR
ELECTED AND APPOINTED OFFICIALS
Motion by Councilman Rocco
• Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the Town Board be and hereby
established the following as a standard workday for
elected and appointed officials for the purpose of
determining days worked reportable to the New York State
and Local Employee's Retirement System:
Elected officials:
Supervisor - Eight hour day
Deputy Supervisor - Eight hour day
Councilman - Six hour day
Town Clerk - Seven hour day
Town Justice - Seven hour day
Superintendent of Highways - Eight hour day
Appointed Officials:
Town Attorney - Seven hour day
Town Assessor - Seven hour day
The standard work week for all officials is five days.
RESOLUTION #145 AUTHORIZE BENEFIT TAX REFUND OF
$104.09 FOR JOHN LARKIN OF 832
LAMONT CIRCLE
Motion by Councilman O'Donnell
Seconded by Councilman Rocco
VOTES: ALL AYE ADOPTED
WHEREAS, Mr. John Larkin, 832 Lamont Circle, requested a
review of the 1.7 unit charge levied on his 1995 Tax
bill, as it was too high, and
WHEREAS, upon review of his account, it was determined
that a computer error occurred when estimated readings
were required, and a refund has been submitted and
recommended by Water Supt., Carl Bush, to correct the
unit charge to 1.0 for both water and sewer., therefore
• BE IT RESOLVED, the Town Board does hereby authorize a
refund to John H. and Marie A. Larkin in the amount of
$104.09.
RESOLUTION #146 AMEND RESOLUTION #141 AND RESCHEDULE
DATES FOR HIGHWAY BIDS
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, Resolution #141, adopted on July 19,
1995 is hereby amended by rescheduling the dates as
follows: sealed bids will be opened on September 04,
1995 at 3:00 p.m., and awarded on September 6, 1995 at
7:00 p.m.

Councilman Rocco expressed concern about a barn
being dismantled on Fairview Drive. It is unsightly
and will cause health concerns if it is allowed to
remain as left. Carl Bush reported the Methodist Church
now owns the land and an agreement was made with an
individual who wanted to salvage the boards.
Supervisor Thorpe reported that he receives a lot
of requests from developers, both out of state and
locally, wanting to develop new ares within the Town,
and they want the Town to extend water and sewer lines
to accommodate them. Local businesses also make the
same request.
In the past, this Town Board has taken the
position that it cannot be done for housing projects. If
the request comes from a business, and the extension of
water or sewer lines result in the creation of more jobs
for the community, then the Town has been willing to
participate at some negotiated level.
A request has been received from Mr. Roy Susskind,
of The Murray Center, whom recently purchased from Smith
Corona on Route 13. They want the Town to extend the
Town's water line to their facility, as their water
supply is a part of the Smith Corona system. The water
line serving them is not large enough to accommodate
their needs, and would like the size of the line
increased. Supervisor Thorpe requested a discussion and
assistance from board members regarding this request.
A discussion was held whereby Town Board members
expressed concern about the uncertainty of what could
happen in that area. The bankruptcy, filed by Smith
Corona, could add to the confusion.
In the past, through negotiations, the Town has
paid about one/third of the cost of projects for a
business.
Questioned was, who is going to do the design work?
The business making the request should be responsible
for the design work, subject to approval of our
Engineer. The Town Engineer, Attorney, or other
employees cannot honor private requests.
A discussion was held concerning other applicants
whom have requested assistance. The Town is not allowed
to give away town monies. The Town has made allowances
for developers regarding the benefit tax, allowing them
a discount until their improved lots are sold.
It was the consensus that those making the request
should submit a written proposal to the town for review,
in advance. It is -the applicants responsibility to have
an engineer provide prints for the design of water and
sewer lines to their project.
No action was taken.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to adjourn the regular Meeting.
All voting aye, the motion was carried.
The meeting was adjourned at 7:50 p.m.
