PUBLIC HEARING REAL PROPERTY AGED EXEMPTION A Public Hearing was held by the Town Board of the Town of Cortlandville at the Town Hall, --577 Terrace Road, Cortland, New York, on December 07, 1994 at 7:00 p.m. to amend the income eligibility level for Real Property Aged Exemption. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal Rocco Others present: Attorney, John Folmer; Assessor, David Briggs; Highway Supt., Carl Bush; Residents, Leon Doran, Richard Doran, Donald Morton, Danny Ross and Newsreporter, Lisa Hutcherson. Supervisor Thorpe called the Public Hearing to order at 7:00 p.m. The Town Clerk read aloud the Legal Notice as posted and filed. Town Assessor, David Briggs, explained the process. To meet the criteria for aged exemption, the applicant must be age 65 or over, a resident of the Town for two years, and their gross income within the limits established. The established limits are set by the Town, County, and School, individually. in the early 1980's the Town and County had the same limits. Through the years, they have differed. The County has -requested all the Towns to review this again and consider an increase of the limits, so all can be equal again. This will be a benefit to the elderly, and will be less confusing. Most Towns in the County are in the process of adjusting the limits and standardized with the County. Increasing the maximum limit from $12,000.00 to $16,200.00, will allow more senior citizens to become eligible. The effect to the current tax rate will be minimal. The Town Attorney requested a clarification of the new limit, and confirmed it to be changed to 16,200. A discussion was held by those in attendance, whereby the benefit to town residents was explained. Mr. Don Morton wanted an explanation as to why the tax base was growing in Cortlandville, yet the County tax rate continued to rise. He was pleased to read the answer to this question in the " Cortland Standard." The article in the paper related to Equalization Rates set by the state. No further comments were heard. Councilman O'Donnell made a motion, seconded by Councilman Testa, to adjourn the Public Hearing. All voting aye, the motion was carried. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Town Hall, 3577 Terrace Road, Cortland, New York, on December 07, 1994 with Supervisor Raymond Thorpe presiding. Members present: Supervisor, Raymond Thorpe Councilman, Theodore Testa Councilman, Edwin O'Donnell Councilman, John Pilato Town Clerk, Pauline Parker Absent: Councilman, Ronal_ Rocco Others present: Attorney, John Folmer; Assessor, David Briggs; Highway Supt., Carl Bush; Residents, Leon Doran, Richard Doran, Donald Morton, Danny Ross and Newsreporter, Lisa Hutcherson. The Meeting was called to order by Supervisor Raymond Thorpe at 7:15, following a Public Hearing relating to Aged Exemptions. RESOLUTION #190 AUTHORIZE PAYMENT OF VOUCHERS DECEMBER Motion by Councilman O'Donnell Seconded by Councilman Pilato General Fund A Voucher # 451 - 482 $ 9,421.16 General Fund B 95 - 96 $ 3,666.52 Highway Fund DB 432 - 449 $16,325.31 Water Fund 284 - 289 $ 1,183.10 Sewer Fund 142 - 146 $ 3,056.51 Councilman O'Donnell was given privilege of the floor. He reported that Highway Supt., Carl_ Bush has advised that a meeting is scheduled for next week with representatives of NYS DOT and the Railroad to discuss the concerns and problems at the railroad crossing,on Loope Road in the Town. He expressed pleasure and stated that he would contact the involved residents of that area to let them know what was happening. Reports of Supervisor, Town Clerk and Zoning are on the table for review, and are available for inspection, upon _request, in the Town Clerk's office. Supervisor Thorpe read a letter received from property owners of Quail Ridge dated November 29, 1994. The letter requested that street lights not be installed in that area. He also referred to the petition received at the last meeting to have them installed. A discussion was held concerning this. 2-199, DECEMBER 07, 1994 TOWN BOARD MEETING PAGE 2 RESOLUTION #191 ACCEPT PETITION OPPOSING STREET LIGHTS ON QUAIL RIDGE AND AUTHORIZE SUPERVISOR TO SEND A LETTER TO THE RESIDENTS OF QUAIL RIDGE REQUESTING A MEETING AND COMPROMISE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, Per Resolution #184, adopted November 22), 1994, .I a petition was received from residents of the Qua'] Ridge neighborhood requesting the installation of street lights, and WHEREAS, a letter dated November 29, 1994, has been received from other residents of the Quail Ridge neighborhood opposing the installation of street lights, and requested that no action be taken by this Town Board until all residents of Quail Ridge meet as a group to discuss the issue, and WHEREAS, Highway 1'3upt, Carl Bush, has reported that the area meets the criteria for the number of houses built on the street and three lights could be installed in that area, therefore BE IT RESOLVED the Supervisor is hereby authorized and directed to send a letter to all residents of the Quail Ridge Development that signed a petition, advising them of the situation, and request that they meet to discuss this issue and attempt a compromise, and further RESOLVED, the Supervisor will offer the Town Hall Meeting Room for their meeting regarding this issue, and report their decision beck to the Town Board at the February 1, 1995 Town Board meeting at 7:00 p.m., and RESOLVED, that the petition shall be received and filed. Councilman Testa made a motion, seconded by Councilman O'Donnell, to receive and file the Annual Water Supply Inspection Report received from the Cortland County Health Dept. All voting aye, the motion was carried. Councilman O'Donnell asked about the status of the zoning violations in Blodgett Mills. Attorney Folmer stated that he has prepared criminal information that will be left for CEO Bruce Weber. He will need to sign and file with Town Justice, Mardis Kelsen. The Judge can then issue an appearance ticket. This would recruire the land owner to appear, and respond to the alligation that he has failed to comply with the Cortlandville Zoning ordinance in connection with the buil-ding permit and also another Zoning ordinance violation that pertains to automobiles. Attorney Folme.- also reported that he received a telephone call today from a resident of Blodgett Mills stating that some effort has been made by one party to have automobiles removed, and appears to have vacated the property. 300 DECEMBER 07, 1994 RESOLUTION#192 TOWN BOARD MEETING PAGE 3 AUTHORIZE USE OF THE MEETING ROOM FOR DEFENSIVE DRIVING COURSES FOR THE YEAR OF 1995 Motion by Councilman Pilato Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED BE IT RESOLVED, the Safety Council of Central New York is hereby authorized use of the Town Hall Meeting room to conduct their Defensive Driving Course for the year of 1995, twice a month, and RESOLVED, the schedule submitted shall be received and filed. Attorney Folmer reviewed the following 1995 contracts with the Town Board: The Lamont Library - needs further review. The Cortland County SPCA - in order The Cortland Free Library - in order TLC Ambulance Service - needs further review RESOLUTION 9193 AUTHORIZE SUPERVISOR TO SIGN 1995 CONTRACTS WITH CORTLAND COUNTY SPCA AND CORTLAND FREE LIBRARY Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED BE IT RESOLVED, that the Supervisor is hereby authorized and directed to sign the 1995 contracts for the Cortland County SPCA and the Cortland Free Library, and RESOLVED, such contracts shall be received and filed. Attorney Folmer reported on the following: Polk-ville Area Concerns: He has drafted a letter, as requested by the Town Board, to send to business's in the Polkville area regarding the concerns of noise and iidling of trucks. He requested Councilman O'Donnell to review the letter before they are mailed out. Luker Road Sewer Project: He has received four easements for the Luker Road Project from Town Engineer, Hayne Smith, and requested Supervisor Thorpe to sign. RESOLUTION #t194 APPROVE MODIFICATION OF INCOME ELIGIBILITY LEVEL FOR AGED TAX EXEMPTION REQUIREMENTS FOR TOWN OF CORTLANDVILLE Motion by Councilman Testa Seconded by Councilman O'Donnell VOTES: ALL AYE ADOPTED WHEREAS, the Town of Cortlandville by Resolution No.55 made on February 1, 1989, established the maximum income eligibility level of $12,000.00 for exemption from taxation for real property owned by persons sixty-five (65) years of age or over, and 0 M DECEMBER 07, 1994 TOWN BOARD MEETING PAGE 4 WHEREAS, Real Property Tax Section 467-d now authorizes a granted schedule of maximum income, and WHEREAS, the Town Board desires to modify the levels of income and corresponding exemption for persons over age sixty-five (65), and WHEREAS, a Public Hearing was held by the Town Board on December 07, 1994, in relation to such modification, now THEREFORE BE IT RESOLVED, that the maximum income eligibility level of $12,000.00 as set forth in Resolution No.55 of February 1, 1989 is hereby modified pursuant to and in accordance with Section 467-d of the Real Property Tax Law. The percentage of exemption shall be based on the maximum annual income range specified herein, as follows: INCOME RANGE PERCENTAGE OF EXEMPTION $10,500 or Less 500 $10,501 - $11,500 450 $11,501 - $12,500 400 $12,501 - $13,500 350 $13,501 - $14,400 300 $14,401 - $15,300 250 $15,301 - $16,200 200 RESOLUTION #195 AUTHORIZATION TO RELEVY DELINQUENT WATER AND SEWER ACCOUNTS TO THE 1995 TAX ROLL FOR THE TOWN OF CORTLANDVILLE Motion by Councilman O'Donnell Seconded by Councilman Testa VOTES: ALL AYE ADOPTED WHEREAS, information was submitted by the Water and Sewer Department of the Town of Cortlandville providing the list of delinquent accounts, as required, therefore BE IT RESOLVED, the Town Board does hereby authorize and direct the list of delinquent water and sewer accounts of the Town of Cortlandville be forwarded to the Cortland County Real Property Tax Office to be relevyed onto the 1995 tax roll for the Town. Resident, Donald Morton, asked if the Town or County, can enforce the problem of people parking in designated handicap parking areas with no permit. Supervisor Thorpe informed the -resident that the Town does not have law enforcement. The County Sheriff's and the State Police Departments patrol the Town area. Both have the authority to ticket any person parked in a designated handicap area that do not have a handicap parking permit. These are state regulations that businesses must comply with. The same regulations apply to privately owned parking lots. Councilman Testa made a motion, seconded by Councilman Pilato, to recess the regular meeting and convene to an executive session in the matter of personnel matters.
