TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at 5:00 p.m. at the Town Hall,
3577 Terrace Road, Cortland, New York with Supervisor
Raymond Thorpe presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, Ronal Rocco
Councilman, John Pilato
Town Clerk, Pauline Parker
Others present were: Town Attorney, John Folmer;
Highway Superintendent, Carl Bush; Town Typist, Edna
Puzo; Mr. & Mrs. Chuck Paul of the Safety Council of
Central New York, and newsreporter, Maria Korolov.
Councilman Rocco made a motion, seconded by
Councilman Pilato, to approve, as written, the Town
Board Minutes of September 07, 1994. All voting ave,
the motion was carried.
RESOLUTION #183 AUTHORIZE PAYMENT OF VOUCHERS
NOVEMBER
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

Privilege of the floor was granted to Mr. Chuck
Paul of the Safety Council of Central New York. He is
the instructor for the Defensive Driving Course that has
been held at the Cortlandville Town Hall for the past
ten years. He apprised the Town Board that this has been
the most successful location in Central NY. Due to the
large attendance, they are now offering the program
twice a month at our Town Hall.
Mr. Paul presented the Town Board with a plaque
acknowledging their appreciation for outstanding service
and contribution to the defensive driving course.
Supervisor Thorpe accepted the plaque on behalf of
the Town of Cortlandville.
Superviso-r Thorpe read aloud a letter written by
Mr. Sam Forcucci who resides on Katie Lane in the Town.
The letter states Mr. Forcucci's appreciation for a job
well done on the new road surface that was recently done
on Katie Lane and Lyncort Drive.
The letter was given to the Highway Supt.

RESOLUTION #184 RECEIVE PETITION FROM RESIDENTS OF
QUAIL RIDGE REQUESTING INSTALLATION
OF STREET LIGHTS WITHIN THEIR
NEIGHBORHOOD
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, a petition was received from residents of Quail
Ridge requesting the installation of appropriate and
adequate street lighting for the safety and security of
their family neighborhood, therefore
BE IT RESOLVED, Highway Supt., Carl Bush, is hereby
authorized and directed to proceed with the process and
criteria set forth by the Town for new developments, and
RESOLVED, that the petition and request shall be
received and filed.
Repots of Zoning, Justice, Town Clerk and
Supervisor are on the table for review and are available
for inspection, upon request, in the Town Clerks Office.
The Town Clerk -received, and distributed, new
information regarding changes of rules and regulations
for the SEQRA process. This information has been given
to the Code .Enforcement Officer for distribution to the
Town Planning Board and Zoning Board of Appeals.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file the information
received for NYS D.E.C. regarding SEQRA. All voting
aye, the motion was carried.
RESOLUTION #185 ACCEPT RESIGNATION OF FRANK BARBIERI
AS ELECTED COUNTY LEGISLATOR
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the resignation of Frank J. Barbieri, as
Elected County Legislator for District No. 12, effective
November 13, 1994, is hereby accepted and shall be
received and filed.
Attorney Folmer reported on the following:
Polkville Gas Station Concerns: A copy of DEC
Regulations for operation of diesel engines was provided
to Councilman O'Donnell and Planning Board Chairperson,
Kathv Wickwire for further reference, and explained.
Blodgett Mills Concerns: Information to be left
with CEO Bruce Weber, charging two counts of violations
of Town Zoning Lahr, for property located in Blodgett
Mills. He will request the CEO to calculate and provide
information of times the violations have occurred, then
the information will be filed with Town Justice, Mardis
Kelsen.
Co-rtlandville Sand & Gravel Reclamation Bond: A
letter was received from Geologist, Jonathan Harrington,
concerning a change in state law pertaining to the

local reclamation bond required under the State Mined
Land Reclamation Law.
Attorney Folmer reported that he has researched
this and advised the request could be honored.
RESOLUTION #186 AUTHORIZE RETURN OF FUNDS REQUIRED
AS RECLAMATION BOND TO CORTLANDVILLE
SAND & GRAVEL INC., AS REQUESTED
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
WHEREAS, Cortlandville Sand & Gravel Inc. provided a
Reclamation Bond, dated November 20, 1987 in the amount
of $13,500., to the Town of Cortlandville, as required,
and
WHEREAS, State Law, at that time, required filing of a
Reclamation Bond both at the Town and State level, and
WHEREAS, in 1991 the law was amended, and such bond is
no longer required by the Town, and
WHEREAS, Cortlandville Sand & Gravel Inc. has been sold,
therefore
BE IT RESOLVED, the Town Board does hereby authorize the
release of funds held at First National Bank of Cortland
in the amount of $13,500., and
FURTHER RESOLVED, that the Town Board does hereby
relinquish the requirement for a Reclamation Bond for
the new owners of Cortlandville Sand & Gravel, as the
result of the change in New York State Law.
RESOLUTION #1.87 SET DATE FOR A PUBLIC HEARING FOR
LOCAL LAW NO. 2 OF 1994 FOR AGED
EXEMPTIONS LIMITS
Motion by Councilman Testa
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, a Public Hearing for Local Law No. 2 of
1994 regarding the aged exemptions limits, shall be held
on December 07, 1994 at 7:00 p.m.
Councilman O'Donnell asked the status of the
following:
Report sent to NYS DOT in regards to the Loope Road
rail -road track concerns:
The Highway Supt. reported that he has contacted
DOT but has not met with them yet. He will call them
again.
Rebuilding of Exit 10 Truckstop: Residents of the
area were notified by letter of the intent of the
owners: fire; temporary trailer to conduct business now;
rebuilding intent; permits will be required; who to
contact etc. etc. to express their concern.
Now telephone calls are reporting that trucks are
going to the other gas stations, in the same area, and
continue to idle for long periods of time etc.. He
requested assistance to correct this.
A discussion was held concerning this.
Attorney Folmer will send a letter to gas station
owners to apprise them of neighborhood concerns.

A discussion was held concerning the time frame to
appoint a replacement to fill the vacancy of the County
Legislator. The Town Board has 30 days to accomplish
this. Committee Chairman, Dorthea Fowler, will call a
meeting sometime next week.
RESOLUTION #188 ADOPT THE TOWN BUDGET FOR FISCAL
YEAR 1995
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, on the 2nd day of November, 1994, the Town
Board of the Town of Cortlandville, held a Public
Hearing on the Preliminary Budget and proposed amounts
to be raised by the benefit tax on the benefited
properties in the Town Sewer Improvements District,
approved by the Town Board, and filed with the Town
Clerk, for the fiscal year commencing January 01, 1995,
and having heard all persons in favor of, or against any
items therein contained, therefore
BE IT RESOLVED, that the preliminary budgets approved,
filed and amended, and the same is hereby adopted and
established as the annual budget of this Town for the
fiscal year beginning January 01, 1995, and such annual
budget, as so adopted, is filed with the Town Clerk, and
RESOLVED, that the Town Clerk of this Town shall prepare
and certify, as provided by law, duplicate copies of the
annual budgets hereby amended and adopted, together with
the assessment rolls for the benefit of improvement for
the Water Fund and the Sewer Fund, adopted pursuant to
Section 202-a of the Town Law within five days thereof,
delivered two copies to the Supervisor of the Town and
the Supervisor shall present the copies of the annual
budget to the Legislature of Cortland County within ten
days after his receipt thereof from the Clerk.
RESOLUTION #189 AUTHORIZE HIGHWAY SUPERINTENDENT TO
DISPOSE OF OLD EQUIPMENT
Motion by Councilman Rocco

VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Highway Superintendent is hereby
authorized, and directed to dispose of, and remove from
the Town's fixed assets program, the following
equipment:

Councilman Rocco made a motion, seconded by
Councilman Pilato, to recess the regular meeting an
convene to an executive session, to discuss possible
land acquisition. All voting aye, the motion was
carried.

The following information was received from the
Supervisors office.
Councilman Testa made a motion, seconded by
Councilman O'Donnell, to adjourn the executive session
and reconvene to the regular meeting. All voting aye,
the motion was carried.
No action was taken.
Councilman Testa made a motion, seconded by
Councilman Pilato, to adjourn the regular meeting. All
voting aye, the motion was carried.
The meeting was adjourned at 5:57 p.m.
