TOWN BOARD MEETING
The Regular Meeting of the Town Board of the Town
of Cortlandville was held at 7:00 p.m. at the Town Hall,
3577 Terrace Road, Cortland, New York with Supervisor
Raymond Thorpe presiding.
Members present: Supervisor, Raymond Thorpe
Councilman, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, John Pilato
Councilman, Ronal Rocco
Town Clerk, Pauline Parker
Others present were: Town Attorney, John Folmer;
Highway Superintendent, Carl Bush; Town Typist, Edna
Puzo; and News reporter, Trish Hansen.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to approve, as written, the Town
Board Special Meeting Minutes of July 27, 1994. All
voting aye, the motion was carried.
Councilman Pilato made a motion, seconded by
Councilman O'Donnell, to receive and file the Zoning
Board of Appeals Minutes of June 22, and July 26, 1994.
All voting aye, the motion was carried.
RESOLUTION #144 AUTHORIZE PAYMENT OF VOUCHERS
SEPTEMBER
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, that the vouchers submitted have been
audited and shall be paid as follows:

RESOLUTION #145 DECLARE TOWN BOARD AS LEAD AGENT
AND DECLARE NEGATIVE IMPACT OF
AQUIFER SPECIAL PERMIT #5 OF 1994
FOR GUTCHESS INTERNATIONAL INC.
Motion by Councilman Rocco
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
WHEREAS, an Aquifer Special Permit, #5 of 1994 was
submitted by Gutchess International Inc. to construct
additional office space and an indoor tennis court on
their property located at 100 McLean Road in the Town,
and
WHEREAS, the Cortland County Planning Board and the Town
Planning Board have reviewed and recommended approval of
this project, subject to conditions, and

WHEREAS, a Public Hearing was duly held by the Town
Board on August 17, 1994, therefore

BE IT RESOLVED, the Town Board is hereby declared as
Lead Agent, and has completed the Short Environmental
Assessment Form, and hereby declared the proposed
project shall have no significant impact on the
environment.
RESOLUTION #146 APPROVE AQUIFER PERMIT #5 OF 1994
FOR GUTCHESS INTERNATIONAL
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Town Board does hereby approve
Aquifer Permit #5 of 1994, submitted by Gutchess
International Inc., with the following conditions as set
forth by the Town Planning Board:
1. Roof runoff from new buildings will be directly
infiltrated and will not mix with parking lot runoff.
2. Parking lot runoff will be directed to grass
filter strips rather than directly infiltrated.
AND FURTHER RESOLVED, the Supervisor is hereby
authorized to sign the application.
Councilman O'Donnell made a motion, seconded by
Councilman Testa, to receive and file a letter from the
Golden Lunch located at 3590 West Road, Cortlandville.
The letter advised they will be renewing their wine and
beer license. All voting aye, the motion was carried.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to receive and file a copy of the
Petition of the Special Franchise Assessment for the
1994 Tax Roll, filed with the New York State Board of
Equalization and Assessment, from NYNEX, with index
#501694. All voting aye, the motion was carried.
Councilman Rocco made a motion, seconded by
Councilman O'Donnell, to receive and file the list of
the Election Inspectors for 1994, appointed by the
County Board of Elections. All voting aye, the motion
was carried.
Town Clerk, Pauline Parker, informed the Town Board
that the Auditors are here to review Town Records.
Supervisor Thorpe reported that the ruling for the
deduction limit of Social Security has been changed from
$100 to $1,000, effective January 1, 1995. This has
affected our election inspectors. This is a welcome
change.
Town Attorney, John Folmer reported on the
following to the Town Board:
Loope Road Crossing: No further information has
been received relating to the Judge's decision.
NYS regulations concerning the idling of trucks at
truck stops: He has contacted NYS DEC and NYS DOT.
Information is forthcoming.

Councilman O'Donnell reported that he has received
a complaint from a resident near the Mobile Station in
Polkville. She had called NYS Police and they responded,
but the truck had left.
Attempting to find out more, it was stated that NYS
DEC has a five-minute idling law. Most businesses
selling diesel fuel have a sign posted in their window
concerning this. A discussion was held concerning this.
Attorney Folmer reported:
Adopt order for Rt 222 Water Project. It has been
prepared and sent to Engineer Smith for review. It will
be submitted for approval at the next meeting.
1995 Proposed Contract with Atlantic Inland: Is
reviewing and has questions for them. Should be
accomplished by next meeting.
Aged Exemption Program: A discussion was held at
the last meeting concerning this. He advised that a
Public Hearing would be necessary to accomplish.
Deed and Abstract: Delivered to Town Clerk for the
property deeded to the Town from the Cortland Enlarged
City School District on Isabell Drive.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to receive and file the Abstract and
Deed for the property that the Cortland City School
District has given to the Town of Cortlandville. All
voting aye, the motion was carried.
RESOLUTION #147 REFER AQUIFER PERMIT OF MOHAWK
VALLEY OIL TO THE TOWN AND COUNTY
PLANNING BOARDS AND SET DATE FOR
A PUBLIC HEARING
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
WHEREAS, an application for an Aquifer Permit was
submitted by Mohawk Valley Oil, therefore
BE IT RESOLVED, the Town Board does hereby refer this
Aquifer Permit application to the Town and County
Planning Boards for their review and recommendations,
and
BE IT FURTHER RESOLVED,
that
a Public Hearing shall be
scheduled for October 05,
1994
at 7:00 p.m..

WHEREAS, a letter from Mr. William Wood of 3752 Westvale
Drive was submitted to the Town Board requesting the
penalty charged to his July water bill be forgiven due
to the fact that he did not receive his water bill, and

WHEREAS, such customer request have not been honored in
the past, and was advised against setting such precedent
for the Town, therefore
BE IT RESOLVED, that the penalty charged shall not be
refunded to Mr. William Wood, and
RESOLVED, the Supervisor shall send a letter to advise
him.
RESOLUTION #149 AUTHORIZE BUDGET OFFICER TO
ESTABLISH NEW REVENUE ACCOUNT
IN WATER FUND
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Budget Officer is hereby authorized
and directed, to set up a new account #F2680 in the
water fund to record the compensation received from the
insurance company, for the damage to the water tank that
was hit by lightning.
RESOLUTION #150 AUTHORIZE BUDGET TRANSFER FOR WATER
IMPROVEMENT CAPITAL PROJECT
Motion by Councilman O'Donnell
Seconded by Councilman Testa
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the Budget Officer is hereby authorized
and directed to transfer $2,450.00 from Water Surplus
Funds, and transfer into the Route 222 Water Improvement
Capital Project.
Councilman Testa informed the Board members of a
concern of residents of Bell Drive relating to the sign
at the entrance of Bell Dr. It has been damaged and
they are requesting the Town to repair it.
Supervisor Thorpe reported that he was advised that
our snow plow pushed snow into the planter during our
heavy snow season and damaged one corner. This was
discussed with the Highway Supt. The sign is close to
the Town's right-of-way, and ultimately, the planter has
been damaged by the freezing and thawing over the years.
It has been estimated that reconstruction would cost
about $500.00.
A discussion was held concerning responsibility.
RESOLUTION #151 TABLE REQUEST FOR REPAIR OF PLANTER
ON BELL DRIVE AND REFER TO TOWN
ATTORNEY FOR REVIEW
Motion by Councilman Rocco
Seconded by Councilman O'Donnell
VOTES: ALL AYE ADOPTED
BE IT RESOLVED, the request to repair the planter
located at the entrance of Bell Drive is hereby tabled
and referred to the Town Attorney for review.

Attorney Folmer will meet soon with Attorney
Pomeroy and Lee Ambrose concerning Renaissance
Development concerns.
Councilman O'Donnell made a motion, seconded by
Councilman Rocco, to adjourn the Regular Meeting. All
voting aye, the motion was carried.
The Regular Meeting was adjourned at 7:35 p.m.
