PUBLIC HEARING
AQUIFER PERMIT - BENDERSON DEVELOPMENT CORP -
TOPS SUPERMARKET - ROUTE 281
CONSTRUCTION OF NEW AND ENLARGED SUPERMARKET
A Public Hearing was held by the Town Board of the
Town of Cortlandville on July 27, 1994 at 5:00 p.m. at
the Town Hall, 15 Terrace Road, Cortland, New York with
Deputy Supervisor, Theodore Testa presiding..
Members present: Deputy Supv, Theodore Testa
Councilman, Edwin O'Donnell
Councilman, John Pilato
Town Clerk, Pauline Parker
Absent: Supervisor, Raymond Thorpe
Councilman, Ronal Rocco
Others present: Town Attorney, John Folmer;
Highway Supt, Carl Bush; Dennis Mulcahy of Resource
Associates, Robert Tucker, Brian Kinney, Alice Blatchley
and Newsreporter, Trish Hansen.
The Public Hearing was called to order by Deputy
Supervisor, Theodore Testa at 5:00 p.m.
The Town Clerk read aloud the Legal Notice as
posted and filed.
Deputy Supervisor Testa offered privilege of the
floor to those in attendance.
Attorney Folmer requested an explanation of the
conditions set forth by the County Planning Board and
the Town Planning Board.
Dennis Mulcahy, of Resource Associates, explained
that the conditions set by the County Planning Board
were discussed and worked through with the Town Planning
Board. As a result of this, the Town Planning Board
recommended approval of this Aquifer Permit with the two
conditions reported. It was also agreed upon with the
Town Planning Board that they would comply with the 25-
year attenuation, for storms.
No further comments or questions were made.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to adjourn the Public Hearing. All
voting aye, the motion was carried.
The Public Hearing was closed at 5:05 p.m.

AQUIFER PERMIT - FIRST UNITED METHODIST CHURCH
OF CORTLAND - NYS ROUTE 222 & FAIRVIEW DRIVE
CONSTRUCTION OF NEW CHURCH BUILDING
A Public Hearing was held by the Town Board of the
Town of Cortlandville on July 27, 1994 at 5:00 p.m. at
the Town Hall, 15 Terrace Road, Cortland, New York with
Deputy Supervisor, Theodore Testa presiding.

Attorney Folmer requested an explanation of the

Dennis Mulcahy of Resource Associates, reported
that "no conditions" were set by the Town Planning
Board. It was agreed that the church would be made
aware of the concern of using sodium chloride and
pesticides, and use sound judgement with this issue and
others presented by the County Planning Board.
No further comments or questions were made.
Councilman O'Donnell made a motion, seconded by
Councilman Pilato, to adjourn the Public Hearing. All
voting aye, the motion was carried.

A Special Meeting was held by the Town Board of the
Town of Cortlandville on July 27, 1994 at 5:00 p.m. at
the Town Hall, 15 Terrace Road, Cortland, New York with
Deputy Supervisor, Theodore Testa presiding.,
Members present: Deputy Supv, Theodore Testa

The Special Meeting was called to order by Deputy
Supervisor, Theodore Testa at 5:15 p.m. following two
Aquifer Permit Public Hearings.
RESOLUTION #126 DECLARE NEGATIVE IMPACT FOR AQUIFER
PERMIT #3 OF 1994 - BENDERSON
CORTLAND ASSOC. FOR TOPS SUPERMARKET
PROJECT - ROUTE 281
Motion by Councilman O'Donnell
Seconded by Councilman Pilato
VOTES: ALL AYE ADOPTED
WHEREAS, an Aquifer Special Permit application was
submitted by Benderson Cortland Assoc., for allowing and
permitting the construction of a new Top's Supermarket,
to be located on Route 281, and
WHEREAS, per Resolution #3, adopted on January 4, 1994,
the Town Board of the Town of Cortlandville was declared
Lead Agency, in accordance with S-EQR Law, for the
project, and
WHEREAS, NYS DOT, as an involved agency, completed its
review of the project, and responded per their letter of
March 7, 1994, and
WHEREAS, the Town Board of the Town of Cortlandville, as
Lead Agent, has reviewed the Full Environmental
Assessment Form, as required, therefore
BE IT RESOLVED, the Town Board does hereby declare the
proposed project of Benderson Cortland Assoc. for Tops
Supermarket, shall have no significant impact on the
environment, and further
RESOLVED, the Supervisor is hereby authorized and
directed to sign the SEQR form.
